"fox news primetime" hosted by lawrence jones starts right now. hey, lawrence. >> lawrence: hey, bret. thanks, brother. good evening and welcome to "fox news primetime." ♪ ♪ >> lawrence: i'm lawrence jones in new york. and tonight the fallout continues over a new book detailing general mark milley's efforts to undermine donald trump. reports indicate millie had two phone calls with the chinese government while trump served as commander-in-chief. and the deep state has already started at the white house has a full-court press out to defend millie's actions. watch. >> the president knows general milley. he has been chairman of the joint chiefs for almost 8 months of his presidency. they have worked side by side through a range of international events.

>> lawrence: we are all crazy. where there is smoke there is usually fire. millie's first call happened under mark esper when he served as secretary of defense. according to esper the millie communications but then there is a second call that was placed while christopher millie was the acting secretary of defense his office didn't approve of the call. this is what they told fox news. it represents a disgraceful and unprecedented act of insubordination by the nation's top military officer. he must resign immediately or be fired. as the secretary of defense i did not and would not ever authorize such a conduct. so, if the acting dod chief didn't approve the call, who did? it looks like mille went around the chain of command, leaving president trump to call the act treason and then you got florida senator marco rubio is calling on joe biden to hold him accountable. you must immediately dismiss general milley the ability to lead in the world is at stake. the entire military industrial

complex is bending over backwards to tell the american people there is nothing to see here. but we're all smarter than that. when the white house tells you there is no crisis, there must most definitely be a crisis. joining me now host of unfiltered dan bongino. so, dan, obviously, we're all crazy. it's no longer a question if the call took place. it did take place. so, where do we go from here? >> yeah, first, let's clear up a few things. you are right, lawrence. the call isn't the controversy this is the white house doing the little shiny head object, okay? it's like saying, listen, you know, i have conversations with my wife paula every day and then one day we have a conversation about robbing a bank. it's not about talking to your wife. of course millie talks to generals. it's about the contents of the conversation. you think the white house is dumb and they don't know this? we talk to generals all the time. of course you do. the question is and the only question which the white house is successfully i think thousand

manipulating the media again on is what was the content of the call? now, this is easily rectified. there is a transcript of the call. i think releasing transcripts are a bad idea. i think for a lot of reasons. however releasing them to a select group of congress in the senate to look and see what the content of the call was is an excellent idea and they need to look for one thing. forget about all the other stuff that's all great. did millie say that he would issue them a warning that chinese communist party if we were to attack? if he did that, it could be an act of treason. and this guy should be court-martialed for it. that's -- if he didn't, he is going to be able to wiggle his way out of it. if he said that he is in a world of trouble. >> lawrence: let's dig deeper dan, first of all as it relates to donald trump released his call. if liberals want to have -- they pressured him to release his phone call they should be able to do the same thing. i want to go to the second phone call.

the secretary of defense said that he didn't approve this so, at least we know that the second call is under question. no matter what the conversation was, he didn't authorize it. >> yeah, and the question is also, how deeply -- by the way, i disagree with no president should be releasing transcripts of their foreign -- i just greevment donald trump or anyone else. i know why he did it. i get it. but i don't think -- it really causes a serious problem. what foreign leader is ever going to want to talk to the president again? i get it new rules, man. if the democrat say it's good for trump it should be good for them. they can see what's in the call, members of congress. by the way in a leak washington is like a sieve, that's just the way it is. again, it's not the call. it's the content. i want to bring this up, too. a couple of important points here. remember when mike flynn was the incoming national security adviser and he made the call to the russian ambassador to dial down the temperature on the expulsion of the russian nationals and that was considered an international cosmic controversy worthy of years long fbi investigation and

the arrest of a prominent lieutenant general? i kind of -- i find it kind of odd now that it's the same scenario yet involves possible nuclear war and same lefties who condemned mike flynn for a phone call 1/1,000th of the magnitude of this are all of a sudden trying to get mark mill lay pass. give me a break. i know you are frauds on the left side of the media. at least try to hide it sometimes. mark milley has no function in making these -- there is a decision-making chain. lawrence, it's not bottom up. it's top down. the president makes the decision as the commander-in-chief. we have a civilian led military and the decision is implemented downward links of the chain. mark milley seems to think the decision is from the bottom up. that he makes the decision to do things and then it finally gets back to the president what he feels like telling him. this man has got to to resign. he has lost all credibility. and as i said, if he said to the chinese government and he denies it, to give both sides, but if

will say this. as being a military lawyer for 33 years. if the book is accurate and the conversation did occur as described in the book, general milley undercut civilian control. >> lawrence: senator, i just want to stay with you for a second because i hear what you are saying and everyone is innocent until proven otherwise. but we already know from the interim dod acting secretary of defense he did not approve the second phone call. i know generals like doing what they want to do. we have a system in america. it wasn't approved. should he resign simply based on that? >> well, dan, we don't know what the phone call was, about dan nailed it. >> lawrence: doesn't matter it wasn't approved. >> no, i mean, generals talk to generals all the time about the state of military exercises. i don't buy that at all. the content does matter, dan was right. if the content was that we have got a shaky president. i promise you we are not going

to attack. but if hes to something crazy, i will give you a heads up. that's completely unacceptable. but i don't want to hear from me and you about what he said. i want general milley to come forward tomorrow and clear this up for the sake of the country. >> lawrence: congressman, where do you stand on this? should he resign? >> well, i think the senator -- i think the senator is right. it's the content that matters. that's why we have congressional oversight. that's why you are sworn under oath and in your testimony, and i -- we need to hear that the senator and i though, we want to hear some answers before two weeks from now because we think it's that critical. but we have understand, you know, in that transition period, in that election period and in that transition, we are absolutely vulnerable to our adversaries. that's when the russians, the chinese and others are seeking to take advantage of us and if general milley had such concerns about the commander-in-chief, did he share those with

secretary pompeo? the national security adviser, robert o'brien? was this something the interagency a was aware about? had they seen this intelligence that's cited that the chinese were so concerned they were perhaps considering a preemptive strike? there's a lot more to learn here and that's why we have these hearings and that's what we're looking forward to. >> lawrence: i'm going to be looking forward to seeing you guys question because like i said the american people want answers and there is a philosophy that we see the generals just doing what they want to do. it seems like this is a general that got caught. senator, i want to get your thoughts on the taliban, you guys just released a statement saying you wanted to be designated as terrorist organization. tell me about that. they're already a terrorist organization. so what are we going to do to hold them accountable? >> if we designate them as a foreign terrorist organization under u.s. law, which they should be, the haqqani network is a foreign terrorist organization. the pakistan taliban under our law are foreign terrorist

organization. why would not the taliban in afghanistan be a foreign terrorist organization because they're a bunch of damn terrorists? so if mike and i have our way, they will be designated a foreign terrorist organization. we cannot legally give them a dime. we will isolate them. we will come after any country who empowers the taliban and i want to tell everywhere country out there if you give these guys money, you are giving people money who have american blood on their hands and led to the first 9/11 and we're going to allow the second 9/11 so you are going to have a real problem with u.s. congress if you legitimize the taliban. >> lawrence: senator with all due respect joe biden wants them to be inclusive government. >> yeah. well, let me tell you about my old buddy joe biden. my old buddy joe biden has been about as dumb as rock on foreign policy for 0 years. he has been a disastrous president of the united states. he is trying to blame the military, general milley advised him to keep bagram open and have

and this is where it gets really really scary if you ask me. comes a point you are able to criminalize all americans, then suddenly the state is in the position of being able to arrest anybody they want for any reason they want. and my big point that i would like to make to our friends on the left is this. if you are concerned about racial profiling. if you are concerned about the treatment of people who have been charged -- who are charged with crimes, then you should be terrified by this because it is a -- it is a recipe for disaster and it is the way people constitutional's rights are stripped from them. you know, irregardless of whether or not they have committed a serious crimes or not. or are in danger to society or anything. >> you know, some would argue maybe this is by design. charlie, i want to go to you, mollie. you wrote this fantastic piece in the federalist. and it was about people that

have the guts to fight. and i just got to ask you that question who is fighting for the american people on this issue? where are the republicans? where are the civil libertarians? do we got to do it ourself at this point? >> well, that's what's really been interesting about the last year and a half. we have gone from two weeks to slow the spread to now arresting people if they're not wearing masks. it makes sense democratic party likes to weaponize covid and use it to advance their political interest. it's worked well for them electorally. being able to pass large budgets. but a lot of people are wondering where in the world are the republican leaders who are fighting against mandates who are fighting against restrictions of liberty, who are fighting against shut downs of economy, destroying people's jobs. limiting church attendance and all these types of things in the american people are ready to 2350eu9. they are wondering where their leaders are it is important that republican leaders stop kowtowing to the left and start fighting for their country. >> lawrence: charlie, they buckle. that's exactly what they do.

but police say he is not being cooperative. petito and laundrie were traveling the country for months in a camper van visiting several national parks when they are in moab city utah police responded to an incident involving petito and laundrie. apparently they got into an argument over a cell phone and witnesses say it turned into a physical altercation with gabby slapping her fiance while he held her face to calm her down. but apparently laundrie did not physically strike gabby. and police later said there was no evidence to justify criminal charges. they even categorized the dispute as more of a, quote, mental emotional health break than a domestic assault. the couple continued the trip. but, august 25th is the last time gabby's parents heard from her. and on september 1st brian laundrie returned to his florida home with gabby's camper van but without gabby. 10 days later she was reported missing. the van has now been seized and processed. but brian laundrie's attorney
