"fox & friends first" starts right now. todd: you're watching "fox & friends first" on this monday morning. i'm todd piro. jillian: i'm jillian mele. gabby petito's father posted an em mention nail tribute after -- emotional tribute after a body is covered in the wyoming national park. todd: carley shimkus has more. >> reporter: todd, jillian, the petito family attorney is asking the media a not to contact gabby's family as they grieve the loss of their daughter but you're right, we are hearing from gabby's father who posted that touching tribute on social media that shows gabby as an angel, he wrote hashtag gabby petito, she touched the world. this is after the denver fbi agent, charles jones, confirmed a body was found in grand teton national park that fits the description of the missing 22-year-old. >> i would like to extend sincere and heart-felt

condolences to gabby's family. we ask that you all respect the privacy as they mourn the loss of their daughter. earlier today, human remains were discovered consistent with the description of gabrielle gabby petito. >> reporter: investigators made the grim discovery while searching the spread creek disburse camping area in the teton national forest. two youtubeers shared footage with the fbi of what is believed to be petito's converted white van in the area on august 27th. the teton county coroner's office will conduct an autopsy tomorrow to determine cause of death and officially identify the body. the petito schmidt family attorney thanking law enforcement including the grand teton search and rescue team, writing your tireless work and determination helped bring gabby home to her parents, the family and i will be forever grateful. we're hearing from the laundrie

family, their attorney releasing a statement saying the news about about gabby petito is heart breaking, the laundrie family prays for gabby and her family. many wonder why they refused to cooperate with authorities during the search. brian laundrie is a person of interest and police are looking for him but search crews appear in north port are up against a number of challenges including the fact that brian was given a three day start. police say it is possible he has hurt himself or even committed suicide but they have no evidence of that right now. people across the country responding to the news of gabby's death by posting tributes on twitter and demanding answers from the laundrie family including one woman who drove two hours to be in north port. >> i wish they would stop protecting their son. i'm a parent. and if it were my child, i couldn't wait three days. as soon as i knew something i would have immediately called.

the other family needs closure. they need to know what happened. >> reporter: and a photo is also going viral that shows a rainbow near the area where gabby's body was found yesterday and, guys, there is no official confirmation that the search will resume for brian laundrie here near the carlton reserve. but we are here to monitor the situation. we're going to bring you the latest as we get it. jillian: the photo with the rainbow is truly chilling. it really is. there's so many questions that remain unanswered. carley, thank you. todd: to another big story we are following for you. the senate parliamentarian blocking the democrats' immigration plan as crises pile up at home and oversees while president biden vacations at his delaware beach house. jillian: lauren blanchard joins us to break it down. >> reporter: first up, a big setback in the democrats' plan to include 8 million green cards in the spending bill working through congress. the senate parliamentarian said it's not within the rules of the budget process that will allow

democrats to pass this without any republicans. quote, the policy changes of this proposal far outweigh the budgetary impacts scored to it and it is not appropriate for inclusion in reconciliation. the president who spent the weekend at his home in delaware called the ruling deeply disappointing. thousands of migrants have continued to camp under a bridge in del-rio, texas. the u.s. is conducting a mass expulsion flying haitians back to the homeland and the border patrol chief said the plan is to have the encampment cleared within a week. >> we're working around the clock to move migrants from out of the heat, elements and underneath the bridge to processing facilities in order to quickly process and remove individuals. >> reporter: as the situation at the border remains chaotic, abroad the administration is facing criticism for an air strike in kabul that killed 10 of civilians including children and no isis-k fighters. some members of the family say

they want a better apology and a flight out. >> i thought what general mckenzie did was right, admit the mistake and apologize and he also spoke later of possible reparations. secretary austin has committed to a review that hopefully will look at accountability for this. >> reporter: and he said he would follow the science but president biden is facing criticism for getting ahead of an fda panel that ultimately recommended vaccine booster shots only be used for those over 65 and with he severe health risks. the administration planned to roll out boosters for all this week. a new fox news poll found 65% of voters believe the vaccine is safe and effective and we'll go back to the first issue i talked about, the massive spending bill, the poll showed the top concern with voters with 82% is inflation and prices. republicans have warned a $3.5 trillion bill could send them even higher. todd, jillian. todd: lauren, thank you very

much. jillian: former secretary of state mike pompeo is taking the white house to task for the drone strike that killed afghan civilians. >> you could see the political pressure and if there was one thing that drove this failed evacuation was the arbitrary political deadline that president biden set that arbitrary cap on the number of troops that could be there so we could secure american departure and the departure for our equipment. these were political decisions driven down to the military and i'm confident the military was under enormous pressure. president biden said we're going to strike back at the folks that killed the 13 americans and we have a strike that clearly failed, failed to deliver to protect america and killed civilians. this is another piece of an evacuation that was driven by politics and not putting america first and america's national security. todd: in response to that crisis, senator ted cruz said the white house is trying to control the narrative, pivoting to the pandemic in an effort to deflect from failures in afghanistan.

>> they want to change the topic from afghanistan. it's why biden issued this completely illegal and unconstitutional vaccine mandate because he wanted to change the topic from the disas tear in afghanistan -- disaster in afghanistan. the vaccine mandate will be struck down in court. the president is defying the laws law because he wanted the press to start defending him and stop talking about the disaster in afghanistan and he's counting on big businesses in particular forcing employees to comply before the matter is adjudicated and the order is struck down. jillian: we spoke with former border patrol chief ron vitiello who says the border crisis is on brink of becoming a major catastrophe. >> the images that we're seeing from del-rio should disturb all of america, whether you're on the right, the middle or the left. we deserve better from our leadership at homeland and certainly in this administration. we're one incident away to

gabby's family thanked law enforcement. jillian: the search for gabby's boyfriend, brian laundrie intensifies. he hasn't been seen since tuesday. the reserve is 25,000 acres. let's bring in former homicide detective and retired connecticut police officer, brian foley. thanks for being here. good to see you. a lot of new information since we spoke to you last week. the fbi making the announcement last evening that they discovered a body that seems to match gabby petito's. what do you make of all this right now. >> there will be an autopsy performed by the medical examiner and a dna test, not to just match the dna to the body to see if there's anyone else's dna present at the scene. this is big for the family and the criminal investigation. it does not bring he closure to anybody but it can help the victim's family start to begin

the healing, the long healing process. jillian: i want to pull up this video on the screen, this is video of the van that belonged to gabby, this is from august 27th. a blogger posted this online from the spread creek disburse camping area in grand where police and fbi officials made the discovery of a body yesterday. in your estimation, how crucial was this, the of most crucial piece of evidence that came forward that led investigators to a specific area at least in this massive grand teton park. >> exactly. so it would not -- they found the body fairly quickly in that huge reserve there. they must have had something to get them that close to be able to find it that quickly t they .they do have technology, they have k-9s that are good at finding those. for them to find it that quickly, they had had technology

to help as well. jillian: we go back to last week and it was tuesday that we learned from brian's parents that brian went missing from their house on tuesday. reported went to go object a hike at the carlton reserve in florida, 25,000-acre reserve. wednesday reportedly the family goes to the reserve and finds the mustang he was driving, just abandoned and brought it home and two days later on friday is when they decided to report him missing to police in the area. what do you think of that timeline which just seems rather peculiar to a lot of people and do you think his family could potentially be in any sort of legal trouble depending on what the next few days brings? >> there are a lot of he potentials. what we're most likely to find out, unfortunately in these types of scenarios, suicide is not -- can not be ruled out at this point where a suspect commits suicide. two, the family could be

harboring him somewhere, not in florida, it could be out of the state, but protecting him. it's difficult to convince a parent not to protect their child. flight is important here. before there was a body, we didn't have a crime. if the autopsy investigation he shows that this is a homicide, and the injuries are consistent with domestic violence, if there's no one else's dna on her, this has a possibility to have a murder charge with it given the proximity of the suspect to the victim, given the lack of cooperation and given the previous he domestic violence issues and the last thing, homicide detectives love flight when the suspect flees the scene. that is a key indication of guilt. i think with all those factors together i think they have enough for an arrest warrant for brian laundrie as we speak right now. jillian: okay. i know the next few days are going to certainly tell us a lot. hopefully they tell us a lot in this case and we'll look forward to see what that autopsy shows

staffer in the defense department and so i was allowed to make this phone call. it's outrageous that the mainstream is carrying water for these deflexions when the only thing they should focus on is the failure to do the mission, which is to protect this country. todd: he accused milley of a, quote, pattern of behavior from a chairman who says whatever he needs to say to save his job. jillian: an fda panel backs booster shots for older and high risk americans but the head of national institutes of health believes it will broaden the recommendation soon. >> the place that might still be somewhat questionable would be the very youngest individuals, the benefit, risk is it needed there but i think there will be a decision in the coming weeks to extend boosters beyond the list they approved on friday. jillian: the cdc will convene the advisory committee on immunization practices this week to make their recommendation on booster shots. todd: dr. anthony fauci facing questions over his changing tune

on booster shots. recently he claimed it would be a mistake not to get a booster shot. now fauci said the fda made the right decision to advise against extra jabs for most americans, clarifying his stance on cnn. >> what i would say, my own personal looking at this, again, just because i look at the data and say i would do it this way, that's the reason we have qualified groups of people who together as a committee examine all the data and make a decision. so i have no problem at all with their decision. the thing that i'm saying is that data will continue to come in. todd: and with that, fauci adding it's entirely conceivable that the general public will need a third booster shot. jillian: former texas congressman beto o'rourke is considering a run for the texas governor's mansion, this according to axios. he lost the senate race the to ted cruz in 2018 and launched a bid for the white house in 2020.

it is unconscionable that the president ignores this crisis and the danger that it presents. clearly, the word is out that if -- that there are open borders in the u.s. and this is how you access it. what we read and hear about, there seems to be different path pathways the haitians are taking to get to the border. they're willing to risk it.

these are dangerous journeys, especially for young women and young men and i don't understand how this president can ignore it an hour longer. jillian: members of congress alarmed at the chaos unfolding at the border and today hundreds of agents are set to arrive in del-rio, texas. the reinforcements come as the biden administration ramps up what some are calling the quickest mass expulsion of refugees in decades. todd: lawrence jones has more. good morning to you. >> reporter: good morning, guys. it is definitely a crisis of the biden administration's own making. what we're seeing is a lot of these folks are coming from south america. they're not coming directly from haiti and because of the economic depression and they weren't able to get citizenship through the legal pathway that a lot of these countries, they decided to make their way to -- through mexico, to texas. now, they were warned, there was

a memo that was sent out by border patrol to the secretary of homeland security back in june. why the administration did not look at that memo and have some type of action, i don't know. but it's a stressful situation. a lot of hotels are closing early because they just don't have the capacity and the people that were cleaning those hotels cannot get across the border. as a result of everything that's happening right now, the legal pathway, the port of entry is closed. you cannot come in or out. todd: lawrence, go back to the shot again where you're live. seems like a lot of activity around you. what are you seeing behind you right now? >> reporter: yes. so right behind me is dps. our troopers in the state of texas. they're the ones that are pretty much locking it down right now. now, there is a legal issue. todd, maybe you can speak to

this, of national immigration. and so when you look at the troopers, they cannot legally secure the border. that is a federal issue. but right now, just from what i'm seeing on the ground, the only thing that's stopping folks from coming across right now is texas state troopers. when you look at the border agents and they're doing the of best they can, they're really handling the processing of the haitian population right now. but the barrier between the border from texas and mexico, those are texas dps troopers. todd: it's that delicate balance that dps faces. their job is to protect the texas citizens but obviously immigration is a federal issue. so it's that delicate balance. they can't step on toes but obviously something needs to be done to protect the fine citizens of texas. that's part of the reason we have this mess. we're going to get into a little of the texas folks taking matters into their own hands in the next segment.

jillian: lawrence, thank you. >> reporter: thanks, guys. todd: more than 100 texas land owners near the border have aagreed to let their state put up temporary fencing on their property as the border crisis opens. a co-owner of a ranch company joins us now. page, we have been covering rangers like you for months now. how much worse has the crisis gotten for you? >> this crisis s has gotten way worse than i've ever seen it. you know, you see the iran. s on the border -- you see the ranches on the border, we come across maybe one, two, maybe three groups a week right now. now you see a surge, we're up to five or six groups a week, maybe seven to eight and groups of 15 to 20 at a time. todd: what stands out to me the most from the situation that these hundred plus ranchers are encountering, texans are so

fiercely protective of their land rights and their land ownership. what message does it send that you texas ranchers were willing to say, look, state, come on my land and do this? >> yes. i mean, i think for the state, you know, they need to send resources to help us. i think what really people don't realize is that the people that are coming through our properties are criminals that are getting around through the ranches and what a lot of people don't realize, the general public, are how many are coming through the ranches that aren't getting caught. todd: this is part of governor greg abbott's $1.8 billion funding bill for border security. have you seen any evidence of the biden administration doing anything to help you guys out? >> no, no, definitely they're not helping out. i mean, we really do need the federal government to step in and handle this horrible situation on the border.

todd: how frustrating is it that eight months into this administration, eight months this week, your livelihood has been so compromised? >> i really don't even know where to explain, basically it's a financial burden on us, having to go around check things every day to make sure live stock is in the right pasture, holes ain't cut. it's overwhelming on us right now. todd: let's listen to your governor talking about the crisis. take a listen. >> texas is stepping up and doing what the federal government is supposed to do. the biden administration's open border policies have opened the floodgates to illegal immigration, to crime, to human trafficking, to drug smuggling. todd: i don't know if you heard lawrence jones right before you came on, page, but he was discussing the balance, the dichotomy between the federal and state governments when it comes to border enforcement.

obviously, immigration is a federal issue but the state of texas has an obligation to protect its own citizens. are you worried that the federal government will stand in the way of you and fellow texans from building this wall, from protect thing your property which is ultimately your property, which is state property. >> correct. yeah, we're hoping that the federal government will allow -- i mean, i say allow, sorry, but let texas -- basically texas ranchers and the governor, we're going to do what we can to get through this and i definitely think we can get is done and hopefully they ain't going to step in. as you know, they've been stepping in on everything governor abbott's trying to do. todd: page, keep us posted. appreciate your time this morning. >> thank you all. jillian: clear skies over downtown san diego this monday morning.
