message. jillian: makes you wonder how much we still don't know. >> turning to president biden's border crisis texas state troopers across del rio in an effort to regain control after 15,000 illegal immigrants set up a massive tent city. jillian: requesting president biden to declare a federal emergency. >> reporter: it's okay massing of texas troopers to stop that surge after 15,000 migrants mostly haitian crossing the del rio, we will hear from texas governor greg abbott who is traveling there, furious it hasn't heard from the president on the crisis is a lot under mayorkas travel barriers today still refusing to call it a crisis. >> we reiterated our borders are not open. if you come to the united states

illegally you will be returned. >> as thousands rushed across the river, cdc sources confirmed at one .224 miles of the border were uncontrolled as alexandria ocasio cortez blasts the administration, you see them driving migrants back, she tweeted it doesn't matter if democrat or republican is president, our immigration system is designed for cruelty towards and the humanization of immigrants and she wasn't the only member of the squad lashing out. >> we are dealing with mainly black immigrants and asylum-seekers at the border in this kind of way. we need to speak to the systematic racism embedded in that department. >> vice president harris addressing root causes of the crisis seen at a football game as the white house defended her actions on the issue.
1:06 am
>> with the vice president on this? isn't she supposed to address the root causes of migration? >> absolutely and she has been addressing root causes migration by working with countries in the region to ensure they have the assistance they need to reduce the number of people who are coming and make those journeys across the border. >> reporter: officials say as many 6000 migrants from under the bridge but mexican officials told me there are some 10,000 haitians on the way. todd: based on griffiths reporting everything we've seen with our allies we have reached a new level in this crisis, the images you see on the screen getting worse and worse by the day. border patrol overwhelmed and exhausted. migrants not being tested for covid or not being required even to be vaccinated and as governor greg abbott explains, he is getting nothing from this white house. >> not yet heard from this president during his entire presidency concerning the
1:07 am
border. the biden administration refuses to even pretend as though there is a crisis. >> you mentioned those migrants not being tested are required to be vaccinated. there was an announcement that international travelers have to show proof of vaccination as a negative, test within 3 days and the cdc determining which vaccines will be accepted. that is backed up compared to what we see at the southern border and the fact that there is no vaccine requirement leaves a lot of people to wonder why. is peter doocy asking us. >> is somebody asking the foreign nationals in del rio, texas for proof of vaccination? >> as individuals come across the border they are both assessed, they have symptoms the intention is for them to be
1:08 am
court teens. they are not intending to stay here for a lengthy time. >> some might argue people who come here internationally for trips or various things also are intending to stay for a long time. some might argue migrants intend to stay longer than those traveling internationally. >> it was a compelling answer in light of the point he just made. seems obvious to everyone, don't know why it wasn't obvious to jen psaki. it is extremely confusing. we've seen this administration, specifically a lot of mayorkas acts somewhat tougher, at least talking tougher with regard to the haitian migrant saying maybe the administration was finally implementing some solutions but not so fast. forward from advisor stephen miller.
1:09 am
>> it is alive from secretary mayorkas is a pathological liar. i spent days on the phone with all of my sources in the us government who work in homeland security and the message is the same across the board. they are making a small cell deporting and full of people, thousands of haitians have been let into the country, thousands more across the border are being let into the country, illegal haitian families being sent to ways to be released, it has been described to me as a shell game. >> it is clear this administration is scrambling. yesterday to see even on some mainstream media even they are doing reports from the border, not just bill. and fox news going to the border but other media outlets and you wonder, the white house finally eight month into their presidency after they unleashed the sport a crisis on all of us are starting to say there may be something here we need to deal with. >> not just reporters at the scene of the border but media in general, some people submitting this agenda from this administration is in danger after multiple failures from these crises. we will talk to joe concha in the next hour. >> with the ministration scrambling what is the white house doing, why we seeing a

little more although not enough from them? laura ingraham says it is all about the midterms. >> now the fact is they know 2022 is right around the corner and i facing multiple crises weighing them down so they need to take a political weapon away from republicans in the border is a huge one. the regime media as i am now calling the which had been dutifully dumping the crisis from it is now stepping up to help burnish biden's reputation as tough on immigration. >> i can't get over the point you made and i don't think i will, name me one person who comes here for a vacation and stays for life. that ultimately is what all the migrants coming to our border are trying to do, not the person who is coming to new york to see some shows from your a couple weeks. jillian: if there was a blanket rule people would be a little more accepting that everyone has to do the same but when there
1:11 am
are different rules for different groups that is what people take issue with and that is what we are seeing happening right now. >> president biden will announce the united nations general assembly, about several international crises. jillian: the president attempts to sell the idea that america is back. >> reporter: president biden will deliver remarks he hopes will smooth over strained relationships with allies. during a sitdown with the secretary general the president declaring america is back, the assurance he's working with congress overseas but some relationships are on the rocks. french officials are outraged after blindsided by us and uk agreement to provide submarines to australia. >> between us. >> boris johnson attempting to calm concerns claiming the uk has a solid relationship with france.

>> this is just a way of the uk, the us and australia sharing certain technologies because that is the sensible thing to do in the world in which we find ourselves. >> reporter: president biden will speak with french president emmanuel macroin incoming days and will face questions over the afghanistan withdrawal and botched drone strike, the pentagon saying the strike was successful in preventing another attack on kabul airport but when pressed on the decision to launch the strike pentagon press secretary john kirby pushes back. >> why was the decision taken as we have now learned there was another surveillance drone showing there were kids or individuals on the ground? >> you can understand we are going to review this investigation. i'm not in a position to relitigate what happened and in what order. >> it is unclear whether any officials will be held accountable for the drone

strike. >> pfizer submit a request to give covid 19 vaccines to children as young as 5 when the american academy of pediatrics report kids make up 30% of new cases nationwide. vaccines are only approved for people 12 and older. it is possible kids could receive those shots by halloween. >> action by the fda will make a big difference keeping school safe or implementing what we are seeing now. todd: pfizer's vaccine for kids is not as strong as the doses teens and adults receive yet drugmaker says it produces the same amount of antibodies. admiral brett gerard reacting to pfizer's findings on fox news prime time. >> we do know at whatever level we are seeing more cases in children, probably 250,000 a week and probably 0.50% of those
1:14 am
become hospitalized so it is an issue but we know the fast majority of children recover without any problems. we know most of the severe cases occur in people with preexisting conditions so these are risk factors we have to look at. todd: if you have consented is best to check with your child's pediatrician or go to vaccines.gov. jillian: let's talk football, the green bay packers rebound from an embarrassing loss, 35-17. peyton manning throwing jabs at the new england patriots. >> i feel like the packers were listening to our conversation friday but the conversation was bugged like the patriots.

>> i don't practice the red zone data because i am red zone. >> there within striking distance of breaking peyton manning's record. todd: eli will be inducted into the giants ring of honor on sunday. the only positive, something that happened a decade ago. san francisco's mayor violating the indoor mask mandate but had a really good excuse. >> i got up and started dancing because i was feeling the spirit and wasn't thinking about a mask. >> i'm going to use that time every time i mess up from now on. it doesn't stop there in the

>> back with fox news, houston police officer william jeffrey dies during a shootout well serving a felony warrant. another officer taking a bullet recovering in the hospital right now. the suspect is killed after ambushing those officers with iraqi dating back to 2008 with multiple convictions, a judge granting bond despite objections from prosecutors. every was approaching 31 years of service with apartment it leaves behind a wife and child. >> the autopsy for the body believed to be missing gabby petito is set for today is police storm the laundrie family home. todd: thanks for being here. walk us through the key features of today's autopsy. >> today will be absolutely critical. the first thing to consider, if we think about late august, quite a bit of time for her to
1:21 am
be deceased and the body to decompose. that will make things challenging. we don't know exactly how she died. that will be critical for the pathologists to dive in and use all sorts of extra analyses not only toxicology, forensic anthropologists, if bone trauma is there depending on the condition of the body and need to work on formally identifying her. i don't know how much of that has been done. the fbi said it is her but we have to think about how she was cocoa was she shot, stabbed, strangled, blunt force to the head, there are so many variables that need to be accounted for. >> the timeline of the whole saga starting from when they left new york july 2nd, we up to
1:22 am
this point in time and there's a lot of time since she was last heard from by her family so we don't know how long the body has been there so more on the decomposition factor because there's a lot at play depending on the reason, the cause of death, how she died, conditions like the weather being warm during the day in that area and getting colder at night, 40 degrees or colder, there are animals out there. how important is decomposition at this time and how important is time and how long the body was out there and what came in contact with that body, what can they gather, what can they not on the basis of decomposition? >> that is another level of complexity to the autopsy. it is not something we don't encounter and we are trained for that but there are changes that happen to the body right after
1:23 am
death and the elements here whether it be the weather or predators like whatever animals are there they are going to look at the human body as a potential food sources there could be lots of changes just from the environment, the heat plays a more important role in expediting decomposition so the changes in temperature really important. given the length of time, everything is not going to look like it is supposed to be, hence the decomposition and that can change not only the color of tissue but could potentially even hide surface defects. once we get inside hopefully they can see remnants of blood, discoloration, whatever else, boneing trauma should be readily identified nonetheless. >> what will they be looking for on the body linking a suspect to the death. >> that is a really great point
1:24 am
especially in the setting of decomposition, you try to collect as much tracer evidence as you can. i'm not a dna expert but our technology has come far so just like any other suspicious death, fingernails, hair, anything, you never know what can be found with further testing and even with decomposition sometimes bugs found on the body or other tissue changes, that can tell you, bugs, soil elements, that, they can work backwards to deduce a better timeline for when she was killed. >> he had a few distinct tattoos but depending on what the body
1:25 am
looks like that may or may not be helpful so we will be continuing to follow this and see. thank you for your expertise, appreciate it. >> it is so tough when we transition from talking about her as a vibrant young lady to talk about the body and the science of it all, very sad. 24 minutes after the hour. a hostess is attacked in the little time square for enforcing build applause you's vaccine passport program but black lives matter wants her canceled. >> portland, maine could be the first city in the state to impose an indoor mask mandate. our next guest is a restaurant owners as customers won't just go to the next town and that's not the only reason he opposes it.
1:30 am
back, the us will these travel restrictions on international visitors for the first time in every year, they will have to show proof of vaccination. the cdc will determine which vaccines will be accepted. foreign travelers must also have a negative covid tests taken within 3 days of departure, the changes take effect in early november. sean hannity calls it a big double standard. >> we have the vaccine mandate for millions of american citizens but not for one single illegal immigrant, look at your screen, look at the numbers of people, look at the hall high rate of covid positivity, look at the cages for kids president biden has been putting people in, numerous international travel restrictions for americans but not at the border, not if you are an illegal immigrant, special president biden treatment. >> hannity says donald trump gave president biden a secure

border but, quote, joe messed up. >> rules for thee, not for me. london bree brushing off backlash after defining the city's indoor mask mandate. >> we don't need the police to come in and tell us what we should or shouldn't be doing. we know what we need to do. >> as they brush off produces them over her maskless experience at a concert candace owens has this response. >> he is saying mask mandate don't make any sense, the problem is they don't practice that when legislating, there's the social hierarchy. they know they stand above the law and they never seem to face any consequences for. >> tomi lahren will join us live on how she says the real pandemic is the hypocrisy of democrats in high places. he will join us live. >> i cannot wait to hear what tommy has to say about the london soundbite. lawmakers in portland deadlocked on whether to require masks indoors regardless of vaccination status. once the council member who supports the mandate saying,
1:32 am
quote, cities like portland have to take the lead and by doing so there will be people who are going to win and lose but at the end of the day if we can save people from going to hospitals and have fewer kids being quarantined and have more pressure on childcare that is a good thing. what about the bottom line of businesses, portland restaurant owner joins me now to react, thanks for being here. in that quote the city council says some people will win and some will lose under mask mandates. why - basically saying his own citizens will lose because tourists and customers alike will go to the town next door to get their food, beverage, whatever. >> good morning, thanks for having me. kind of funny the segway was san francisco because basically portland is like a little san francisco but that is the big problem a lot of businesses whether the studio, restaurant or anything, we've been through this when they had the no
1:33 am
smoking ordinance and people went to the next town and were allowed to smoke and it was going to support business centers because they didn't get the revitalization act. todd: is a mask mandate necessary in light of your city's vaccination rate? >> the state did a great job getting people vaccinated, the rate is 65% but down here, cumberland county where we are is 85% and covid vaccine, you can look up by zip code and every zip code, 99.9% of people had at least their first vaccine. todd: are you worried some businesses will close because of the mask mandate?
1:34 am
>> there's been quite a few that they probably would. one of the oldest fitness center said membership is down 50% and have to pay the rent on a 10,000 square-foot space and fitness centers in other cities, where people will go. i have friends that own restaurants, they closed the restaurant until this thing is over with but the bottom line is people need to be vaccinated. people in portland and cumberland county are doing a great job doing that. is one of those things that and you were talking about, those who got beaten up, it would be a hard thing to enforce, basically turning bartenders, mask fleets
1:35 am
which isn't really fair. i have a great staff as we went through this entire thing until may when we had to tell people to wear masks, we have little paint sticks that said mask up, just to remind people because you get so tired of saying put your mask on so it is a relief not to have to do that and people take care of themselves and especially as far as restaurants it is a choice, you don't have to go out to dinner, you do have to go to a place like kroger or cvs to get necessities. you need those things to get by day today but nobody has to go to a restaurant. it is a personal choice, getting your car and decide you are going to the restaurant. >> it is a shame we are forcing these men and women to become cops, that's not what they sign up for what they should be doing and we are putting them in an
1:36 am
untenable position. the deadlock is 44, keep us posted what happens in two weeks, if it is deadlock the one side - we have you back, thank you. jillian: 35 after the hour, the humanitarian crisis at the southern border is getting worse by this and overwhelming the city of del rio, texas. what about all the americans who live, work and raise their families there. todd: we are talking to two of those americans next. life insurance policies they no longer need. i'm an anesthesiologist and a pain physician by specialty. i was trying to figure out what i could do with this term life insurance policy. i'm sorta stuck because i can't just go out and buy more insurance, because of my diagnosis. i called coventry direct and everything clicked. there actually were a lot more options that i thought there ever would be. coventry helped michael like we've helped thousands of people
1:37 am
sell all or part of their life insurance policies for cash. even a term policy. there probably are a lot of people that are in a similar situation who don't know they have an option. i would definitely recommend talking to coventry about it. coventry made it very easy. i just couldn't have asked for a better experience. don't cancel or let your policy lapse without finding out what it's worth. visit coventrydirect.com to find out if your policy qualifies. or call the number on your screen.

todd: former border patrol chief says the southern border crisis is a national security threat writing a letter to senate leadership, quote, the us border control is rapidly losing the situation and is required to know who or what is entering our homeland and also call the messaging from the white house saying contrary to the current rhetoric this not simply another immigration search, this is a national security threat. scott is asking the congress and the white house to take immediate action. jillian: texas, greg abbott calling out president biden as the migrant crisis in diarrhea reaches the tipping point. >> texas, a federal court order against the biden administration requiring the biden administration to keep in place donald trump's remain in mexico policy. president biden is in violation of that federal court order.
1:41 am
if president biden followed the court order we would not see the chaos we are seeing and el rio today. >> reporter: residents are here to discuss. how is this affecting your lives on a daily basis? >> my husband works for border patrol. he has mandated extra so that in itself is a huge change for us. a lot of time he has been away from the kids and i and it is hard knowing he's a lot more danger now than he has previously been. laura: you must be exhausted. i want to go to you. you are a resident and small business owner. how a specific your life and your business? >> it affects my business personally because our mayor had to close the port of entry. in our business we do business
1:42 am
with manufacturing plant in our sister city and we are not able to do that in order to service our customers we just to take one service call for example would be a round-trip of 228 miles having to drive to eagle pass, 57 miles away, drive back and to tell rio is 228 miles and personally i see my friends, i see how it is affecting our community and it is heartbreaking to see these people in the greatest country in the world, everybody would agree to that which is one of the reasons they want to be here. but we are a country of laws, as flawed as those laws may be they are the laws we have in place
1:43 am
and that makes them want to come here but there's a right way to do it, and right now the program we have in place is what it is. sometimes it takes years. i have families and friends, it is taken 12, 15 years, thousands of dollars to become us citizens. i am a second-generation american, we understand that but those laws are there for a reason and that is why they want to come here because we are a country of laws. jillian: i want to have you guys listen to what alejandro mayorkas has to say about this surge and react on the back end. >> if you come to the united states illegally, this administration is committed to
1:44 am
developing safe, orderly, and humane pathways for migration but this is not the way to do it. >> the conversations you had if you discussed this, is that happening? >> they do a lot of shuffling around, and i don't think they do, people don't realize, the situation and how bad it has been for the last eight month and i feel the administration is so good at demonizing our men and women who have been defending our borders and holding our laws, it is to visit the border.
1:45 am
jillian: 30 seconds left, they have to show a negative covid tests, we are not seeing that at the border. how do you see that. >> it is hypocrisy and optics. and signs and symptoms of covid, it is a boldfaced lie. people are not being turned away and covid among other things. in this group of illegal migrants. jillian: thank you for joining us.

jillian: welcome back. america's climate crisis hits a good milestone reporting at 100 homicide of the year with a total of 10 people killed in the last 7 days. there pleading with the community to stop the bloodshed. >> so much violence, so many guns and senseless lies. if this is not something for everybody that there is a crisis i don't know what is. >> reporter: the oakland police
1:51 am
department has 695 officers employed in 10 years. black lives matter is protesting a famous new york city restaurant after 3 people attacked a hostess when she asked proof of vaccination. the employee was hit repeatedly by three women. the hostess used a racial slur as they are facing several charges was the vaccination mandate imposed by democrat mayor bill deblasio requires businesses to enforce the policy without support from health officials. todd: the deadliest year in two decades after another violent weekend. mayor lori lightfoot is refunding the police after slashing $60 million from the department budget. >> expansion of the officer wellness program, incredibly hard-working police officers have the resources they need for the stress and trauma they have every day.
1:52 am
todd: we've been talking about this for months. the fact that the funding the police would lead to carnage not just on chicago city streets but across the nation in cities across our great country. wise mayor lori lightfoot just waking up to the reality of defunding her department? >> those folks and the criminals who support having their way in any particular city. this mayor should have done this a long time ago through emergency authorization, and in july 6, '00 people shot, 300 children shot, and in chicago, police department has a morale issue.
1:53 am
in addition to that we have a cook county prosecutor who is their religion their duties in every way, criminal after criminal, people charged with violent felonies over 25,000 people including folks who were charged with murder. how can we help the city which violence in chicago should be the number one issue, when the teams and cohesively working together to solve the issue that plagued the city. todd: how far will this go with the chicago pd or is it broken beyond repair. >> the way it works officers i talked to it is broken beyond
1:54 am
repair. the truth of the matters you have to hold police officers accountable for doing their job but also be supportive of these individuals, they put their lives and harm's way in a lot of cases the only individuals who support their families financially. there's a lot at risk when you go out as a police officer especially in the city of chicago. any day you go out could be your last. especially when you don't have a team that is working to ensure there is not just safety for citizens but officers, when they make a tough call they will be as long as they did everything by the book a proper procedure that they will be detected they don't have that. in the state of illinois there was a law that allows people to call in and make complaints about officers anonymously and they can be fired from that. who does that? we need to support these claims but in the state of illinois
1:55 am
they don't necessarily have that so it is more problematic path for those who want to serve and protect in the city of chicago. todd: it is sad that some of the debts, some of the shootings especially the killings of kids could have been prevented if mayor lori lightfoot did not jump on the defund the police bandwagon last year when she did. these numbers are said. it is horrible. unless someone changes, unless this money takes effect immediately we will have you back talking about the same thing. thanks for joining us >> so true. todd: thank you. >> dan patrick speaks out as biden's border crisis explodes. >> they don't care. you have to look at president chaos, everything he touches a total chaos. todd: lawrence jones joins us
