background of this labor turmoil and chaos on the set. listen to this definition of involuntary manslaughter. it involves a killing that occurs when the defendant is engaging in a lawful but dangerous act without exercising due caution and circumspection. the example they gave is the driver who is texting and accidentally kill somebody. involuntary manslaughter is a fourth degree felony in new mexico punishable by up to 18 months in prison. this is very serious. this is at the minimum they spent on the in the fourth degree,ny this is what alec baldwin or the props guy or girl may be facing, sean. >> sean: listen very carefully. lawful but dangerous act without using due caution. i'm listening to those words carefully. i will pick you a legal mindur here. would it be the actors role to take a prop gun and say, excuse

me, can you assure me that this is a blank and not a bullet? >> it's not his role. if there is no evidence that he knew there was a real bullet gun, he would not be criminally charged. unless it can be shown, sean, he was mishandling the gun in a grossly negligent or reckless way. the information we have doesn't indicate that but law enforcement continues to investigate. there will be a civil lawsuit for moneyy damages alleging negligence, almost a given. this sort of thing shouldn't happen. there are standards, safety protocols in place on film sets involving licensed armorers who are there to provide, handle, maintain, check, and double check, and secure the weapons and nobody else has access to ia

before it is ever used. though baldwin might not be criminally charged, it's altogether possible based on gross negligence and recklessness as geraldo has defined itck in this new mexico statute, that somebody else in the nonproduction could have it. they should have never happened atd all. happened back in 1993 with the actor brandon lee. there was a fragment of a projectile lodged in the barrel. when the blank was fired it evicted it, killing him. that barrel should have been checked. the d.a. said there is negligence here, but it doesn't rise to the level of criminal negligence. no charges were filed. >> sean: let me just say -- >> in 1983 there were criminal charges filed. >> sean: i'd be hard-pressed even though alec baldwin hates men' and i don't really like hi. i'd be hard-pressed to believe that he knew that this would
