investigation go from here? fox news analyst gregg jarrett joins me to break it down. you and i both know hopefully there was a camera where they were filming what happened here. but let's start with the fact there are two tracks here. a civil liability issue, and criminal liability responsibility. and let's talk about the fact that alex baldwin, the person who shot the gun, he's the executive producer of the company. it goes back to him from ruch rush"rust" production goes backo the company he apparently owns. >> there will certainly be a civil lawsuit alleging wrongful death arising out of negligence. that's an incredibly strong

case. but you just don't have this kind of a tragedy happening absent some measure of negligence. the real issue is what about criminal culpability. if it's true that alex baldwin had no idea there was a live round bullet in the gun, then he would not be charged with murder. but there are other potential lesser charges. for example, in new mexico where this occurred. involuntary manslaughter which is grossly negligent or reckless conduct resulting in death. the failure to exercise due care and recklessly fail to protect the health and safety of your co-workers. as executive producer, he's potentially culpable in that regard. in the final analysis it's up to

him to make sure everybody on that set including the licenses armorer is competent, sufficiently trained and doing the job properly. judge jeanine: the armorer is 24 years old. the daughter of a very famous hollywood armorer which brings questions up as to how she got the job, she just finished one job. she complained on a podcast that she wasn't sure she was up to it. and she -- think think think like the prosecutor. she actually took the cartridge out of the gun before she gave it to the sheriff. that has been reported. >> all of that is very suspicious. it's what law enforcement is investigating. they are obtaining affidavits and eyewitness testimony.

they are look for videotape or film of the incidents. someone who is a neophyte on the set in charge of a gun, if it's true that this was a live bullet round and she mistakenly thought it was a blank, an experienced highly trained individual would know the difference immediately. a blank is simply a casing that's been hollowed out. it still has wax and paper and gun powder to simulate the action, the firing, the image of a real bullet coming out of a gun. if she didn't know the difference and alex baldwin hired a person who didn't know the difference, they could be criminally culpable. judge jeanine: the entire crew walked out according to several

publications because they hadn't been paid in two weeks and there was poor gun safety. and they brought in non-union guys to replace us and called cops. if you have a 24-year-old armorer responsible for that gun safety. how does a bullet actually -- real bullet get into a prop gun, or were they using a real gun without a blank cartridge? then the issue becomes how did he point the gun at someone. on set you are taught not to point a gun at someone. >> using a blank with a real gun you must be at least 20 feet away. they will be look at that. but you bring up a good point about safety of workers. some of them walking off the set

jenna: remember the other week when the national school boards association wrote a letter to biden likening american parents to domestic parents. they did a 180 saying there was no justification for some of the language in the letter. how about attorney general merrick garland will he apologize? is the attorney general so politically biased and so malleable that he will get a letter for which there is no basis in fact. then decide to deploy the fbi to go after parents of children in school? is this what we have for an attorney general? i don't care if he never apologizes. but has he? >> that's exactly what happened.
