in america. and how joe biden has politicized the just its department to protect his political allies and perhaps even his son. first my open. how would you feel if your daughter, sister or mother were raped on a train over the course of 27 stops for 40 minutes while other train passengers and there were many, picked up their phones, not to call the police, not to call 911, but to videotape the act being perpetrated in front of them. no one interfered. no one yelled stop, no one tried to end the horror inflicted on his innocent helpless woman. instead they chose to take out their phones and videotape the maddening violence in front of them. so far no one has volunteered

investigation go from here? fox news analyst gregg jarrett joins me to break it down. you and i both know hopefully there was a camera where they were filming what happened here. but let's start with the fact there are two tracks here. a civil liability issue, and criminal liability responsibility. and let's talk about the fact that alex baldwin, the person who shot the gun, he's the executive producer of the company. it goes back to him from ruch rush"rust" production goes backo the company he apparently owns. >> there will certainly be a civil lawsuit alleging wrongful death arising out of negligence. that's an incredibly strong

case. but you just don't have this kind of a tragedy happening absent some measure of negligence. the real issue is what about criminal culpability. if it's true that alex baldwin had no idea there was a live round bullet in the gun, then he would not be charged with murder. but there are other potential lesser charges. for example, in new mexico where this occurred. involuntary manslaughter which is grossly negligent or reckless conduct resulting in death. the failure to exercise due care and recklessly fail to protect the health and safety of your co-workers. as executive producer, he's potentially culpable in that regard. in the final analysis it's up to

him to make sure everybody on that set including the licenses armorer is competent, sufficiently trained and doing the job properly. judge jeanine: the armorer is 24 years old. the daughter of a very famous hollywood armorer which brings questions up as to how she got the job, she just finished one job. she complained on a podcast that she wasn't sure she was up to it. and she -- think think think like the prosecutor. she actually took the cartridge out of the gun before she gave it to the sheriff. that has been reported. >> all of that is very suspicious. it's what law enforcement is investigating. they are obtaining affidavits and eyewitness testimony.

they are look for videotape or film of the incidents. someone who is a neophyte on the set in charge of a gun, if it's true that this was a live bullet round and she mistakenly thought it was a blank, an experienced highly trained individual would know the difference immediately. a blank is simply a casing that's been hollowed out. it still has wax and paper and gun powder to simulate the action, the firing, the image of a real bullet coming out of a gun. if she didn't know the difference and alex baldwin hired a person who didn't know the difference, they could be criminally culpable. judge jeanine: the entire crew walked out according to several

publications because they hadn't been paid in two weeks and there was poor gun safety. and they brought in non-union guys to replace us and called cops. if you have a 24-year-old armorer responsible for that gun safety. how does a bullet actually -- real bullet get into a prop gun, or were they using a real gun without a blank cartridge? then the issue becomes how did he point the gun at someone. on set you are taught not to point a gun at someone. >> using a blank with a real gun you must be at least 20 feet away. they will be look at that. but you bring up a good point about safety of workers. some of them walking off the set

jenna: remember the other week when the national school boards association wrote a letter to biden likening american parents to domestic parents. they did a 180 saying there was no justification for some of the language in the letter. how about attorney general merrick garland will he apologize? is the attorney general so politically biased and so malleable that he will get a letter for which there is no basis in fact. then decide to deploy the fbi to go after parents of children in school? is this what we have for an attorney general? i don't care if he never apologizes. but has he? >> that's exactly what happened.

he said so in the hearing this week. letter goes to president biden september 29 asking for the president to get involved in local school board members. five days later the attorney general of the united states does just that. his only basis for doing that was this letter from the left wing national school boards association. and what did they do? they pregreat and apologize for the letter. the logical thing to do would be for him to rescind this letter. it looks like the school board association was coordinating the white house before they certain the letter on the 29th. and god bless these moms and dads who mad the courage to go to school and say we don't want this racist anti-american curriculum taught to your

judge jeanine: the fentanyl is in mexico. then they put an imprint on the pills so the kids thing they are getting oxycontin. so it looks like it's legitimate and it's being brought into the united states. >> the mexican cartels want to make billions of dollars. that's what they are doing. now because of the migrant crisis they have an unlimited cash flow. the chinese criminals want to kill us and destabilize our country. they are providing the chemicals coming in from these chinese wuhan-style labs. the cartels are making so much money because the fentanyl is very addictive. the kids are getting addicted. every kid wants a xanax.

these are not overdose deaths anymore. these are fentanyl murder and drug induced homicide and poisoning. judge jeanine: fentanyl has increased. what percentage of the pills people are buying its counterfeit from china through mexico? >> chien always providing -- china is providing the precursor chemicals. and they are buying the pill presses and the dyes on these different social media sites and the internet and making the pills in our backyard. the dea seized 9.5 million pills. 40% of those pills had a lethal dose of fentanyl. one pound of fentanyl can kill

you have covid or not and let's make sure teachers get vaccinated. people spreading it right now in schools are really young children not getting vaccinated. bringing kids together doesn't help, fast or no mask so they've got to be practical. it's not like you go to the back of the room and you win, we know it's worth that's not the way to teach, is it? teaching, learning, exchanging. instead, the idea of the rule, that's with the biden administration is using, the ruler on kids. that's getting nowhere. >> the mandates don't work so why are we masking kids? they want to vaccinate them and mask them. it's a negative influence on their psychological health, their emotional health and social well-being, what is this about? >> it sends the wrong message, it's always going to be us scrolling scalding and bowling you and telling you what to do.

i think once you are vaccinated, your chances of spreading this are low especially -- again, there could be exceptions where kids are really close together in schools but masks are know and what we are seeing is victim after victim which doesn't work, it backfires and there's rebellions and threats and then counter threats judge comes in and says there's lawsuit. we need public health, vaccine and testing and mask if you're unvaccinated course quarters. >> everybody knows kids go to school in the fall, it's flu season. kids always come home with the flu and all of a sudden we've got to force them to take the vaccine. can i tell you how many people i know who say if they require me to vaccinate my child, i don't want to do it. my child is not going to get it. >> i want to talk about that because they are going to end up approving in the next couple week for five to 11 euros i
