>> ♪ ♪ >> the parents of the 15-year-old boy accused of killing 4 students in a michigan high school could be held responsible for their son's crime. ethan crumbley pleaded not guilty to murder and terrorism. prosecutors charged him as an adult. the victims age range from 14 to 17 years old. three other students were still in the hospital last night including a 17-year-old girl in critical condition. in a rare move the lead prosecutor suggested that the suspect's parents could face charges. the sheriff said the gun used in the shooting belonged to the

suspect's father. the prosecutor would not provide details which asked if the gun was locked in the family's home. but she said gun owners have a responsibility to keep their weapons out of the hands of minors. it's not clear what statute or charge she might bring for the parents. in michigan there is not a law that requires parents to keep guns locked up and away from children. your thoughts? >> as a gun owner, we always stress safety, safety, safety and secure your weapon. that's universal. when we talk about not getting trigger happen and making sure you properly place your finger not on the trigger, it's about safety because accidents happen. the parents had a responsibility to do that. harris spent a lot of time as a local anchor.

whenever these tragedies have happen, i go to the local affiliate. they have the facts. abc 7 interviewed this kid who said i have seen him around school. the kid had been picked on and stuff like that. people were bullying him. you are going to get this type of reaction. i disagree that is when you get when people are bullied they kill people. he decided not to go to school and he told his mom he knew this might happen and felt it in his gut. what did the people know when he was at the school. he was posting on instagram flexing his weapon. he was called to the school with his parents back-to-back days. why didn't they stop this from happening?

>> that's a great question. i have to say that police have responded to the allegations of bullying and said there were zero reports of bullying. the prosecutor addressed the meeting with the parents and said it's under investigation. the sheriff reported that there was a journal found in crumbley's backpack with the details of the attack and two social media videos and photos of him with the gun. the sheriff said there is no way this was not premeditateed. >> it was certainly. he made videos detailing his plans to commit this atrocity. this is a trend we see in this country. there was a study that came out on november 4th. they looked at 170 mass shooting events and 44.3% the shooter articulates his plan in advance. this was no exception. up to 60% of the individuals

have, cute paranoi and depression beforehand. just because you have a mental illness doesn't mean someone will commit this atrocity but there is certainly a connection. there are many red flag. how do we act upon them in advance? >> the reason why terrorism is a charge in michigan. there doesn't need to be a political intention for that charge to hold true. the prosecutor preferenced the trauma the victims endured and their families. >> and ethan crumbley did terrorize his community. we can argue about whether he did so legally or not. maybe in the state of michigan he can be held to account there. that's great.

emily, you mentioned that in his state there is not a legal requirement for the parents to keep their firearms from children which sounds insane. if that's the case, they have a moral and ethical obligation to the rest of human society to keep their children away from their firearms especially if they have known behavior problems as ethan crumbley did. the day before he was called into school for a special meeting to talk about his behavior that other students flagged. 3 hours before he committed from atrocity the parents were meeting with his teachers. it wasn't just other students that knew something was going on. his parents new and the entire school probably new. there is a lot of culpability. law enforcement may host the parent's feed to the fires because of the insurgents point where he said the gun was here.

>> the negligence standard is knew or should have known. there could be a landmark case by prosecuting them. >> something that lawrence talked about, the back stories you get from the local news. they can talk to the kids and families and get on the ground. some reporters have children in that school i am certain of it. i want to know the role of the parents in all of this. do we really want to go so far not to old the 15-year-old not accountable for his own actions. do you want to separate these cases out? if he is old enough to be charged as an adult at 15, then i think there has to be accountability that starts and ends there.
