country. carley: we should video the migrant who said there are a lot of people coming to the southern border because they know the remain in mexico policy is being re-implemented. how is border patrol going to deal with that surge? >> that is something i actually welcome. if migrant protection protocols are implemented properly the work load will go up initially but it is like a light switch. when you look at how donald trump implement the remain in mexico program the moment we started sitting people back to mexico people stopped coming because they are not going to give criminal smugglers thousands of dollars to be sent back to new mexico, they give these cartels their money because these cartels were promising them if they are going to get relief they will be rewarded once they cross the border illegally. ones that stopped, once we get rid of the catch and release magnet and key people in custody, they will stop coming.

bit of snow and parts of new england but along the i-95 corridor door. it will be too warm it. that we look at one of the other computer models which was giving us a blockbuster storm yesterday, most of it towards upstate new york, the great lakes and new england. let's look at the northwest, this other area of low pressure, stockton with storm after storm and this one will bring significant snow across the rockies and the northwest, california over the next 7 days. we will get that snowpack in our several systems move into the west. there is your forecast, low-pressure across the southeast of the gulf coast will combine with the low-pressure coming out of the rockies and give us our coastal low but it won't be the blockbuster we thought it would be yesterday. some snow across areas north and west of new york city.

epstein because maxwell told her he could help her with her music career, trial is set to resume in a few hours. the meantime jussie smollett is back on the stand today after 5 hours of testimony yesterday. todd: more on what the actor revealed. >> the former empire start taking the stand in his defense reiterating he's a victim of the hate crime. khorasan 9 claims the attack was a hoax. he admitted he paid the brothers for nutrition and training advice but not to stage any kind of attack. jussie smollett admitted he had a relationship with one of the brothers who previously testified jussie smollett paid them $3,500 to stage the attack and another $100 for supplies, he says the court was upset was police were called because he never would have done so. the greater director called police that night. the actor saying i am a black

man in america. i do not trust the police. he says he was a well-known figure at the time and is an openly gay man. police arrived an hour after the alleged attack to find jussie smollett wearing a ropelike news around his neck. he informed the courts initially took off the rope but they instructed him to put it back on so as not to temper with any evidence. prosecutor say jussie smollett dated the attack because he was unhappy with empire studios response to hate mail he receives. the studio offered him extra security but he turned it down because it was intruding on his personal life. the act revealing cnn's donovan tested him relaying information police do not believe jussie smollett's account of what happened, telling viewers after the 2019 incident that he was in close contact with the actor. he cover the case on his show last night but made no mention of the fact that the alleged contacting had with jussie

smollett. jussie smollett will take the stand when court resumes and will be cross-examined by the special prosecutor, the trial is expected to wrap up this week. todd: thank you very much. the criminal defense attorney, does any of jussie smollett's testimony make any sense to you? >> it all comes down to credibility. jussie smollett is the name of the game and it doesn't make common sense by my estimation. a number of things contradict the story these brothers didn't like him. text messages produced by the prosecution indicated jussie smollett said the text saying let's do something, the brothers were indicating when they met afterwords about staging this attack, the fact they were out to get him belies the at the he gave them a $3,500 check and $100 which sounds like a business transaction. is the money for the deal and

but have to separate that from the fact that the law. he's a first offender. this is a low-level offense that could carry three years in prison. in my experience it is very likely he would receive a probationary sentence if convicted. todd: will the defense regret putting smollett on the stand? >> hard things to say but sometimes you are driven by the actor with the defendant but especially if they feel they need to tell their story. that's not going to do him any favors because the jury will look at fine detail about everything he says. i love that lien in the cage and their scoring points. >> i wouldn't want to be on the other side of your cross-examination. hopefully never i will get there. todd: it is not like lying about lying. thank you. one of bill deblasio's final acts in office, vaccine mandate

ahead and invade ukraine and gobble them up, it's the second largest country by land size in europe. and it's only harbin jeopardy of things to come. this is very important that we don't allow this. i believe the president needs to use every tool at his disposal, including economic sanctions. but one other tool that he has that he probably won't use is energy. energy is key to russia's economy. we're destroying our us energy producing sector here in the united states. we ought to start ramping that up and pose a serious threat to russia and its ability to generated cash. todd: congressman, you talked about what you want joe biden to do. what you hope joe biden does. what he should do. at the end of the day, will vladimir putin be more or less emboldened following today's conversation? >> will look, vladimir putin and the rest of the world saw what we did in afghanistan. hopefully the president learned his lesson from that.

but, 40 years of history tells us that this president is very weak. and when you show weakness on the world stage, bad actors will take advantage of it. so while i hope that the president does the right thing, i, you know, history tells me otherwise. carley: he says is he a foreign policy expert. let's hope is he right on that front. yesterday the biden administration announced a diplomatic boycott no u.s. officials will go but athletes will still be allowed to attend china released this statement in response. they say if the u.s. insists in willfully clinging to its course, china will take resolute counter measures. will taking counter measures. what do you make of that situation? >> well, i don't know what the counter measures means. but if i were president biden i would say bring it on. but, also president biden has gone far enough. we should just boycott the olympics. the things that the chinese are

doing to their own people, uyghur minorities is, you know, barbaric. what they're doing to hong kong, again, you know, really clamping down on freedom, freedom of expression, freedom of speech those are not american values and we should not reward the chinese by having our athletes go there this whole thing of a diplomat being boycott is nonsense. they are still going to have the olympics and meet and generate money. that's not what we should be doing. we should be boycotting the entire thing. our athletes should not go. >> but now, congressman, the biden administration may need rely on russia and china as the iran nuclear talks are really on the verge of collapsing right now. how aemasculating is it that we may need to crawl with our tail between our legs to russia and china after biden purposefully destroyed any leverage we had with iran by saying we are going to get out of this nuclear deal. it seems like it is a sad

circular situation. >> again, shows you the weakness of the biden administration and so-called expert is getting us into more and more trouble every single day and putting the united states in a very dangerous situation. look, the only way to deal with thugs is-to-through strength. the only way to peace is through strength. the more you appease the more they will take and the more it puts new danger. all you need to do is ask neville chamberlain how appeasement helped him back in the 1930s with germany. it's amazing to me we don't leisure the lessons of history. it's right there in front of you. the only way to peace is through strength not through appeasement. carley: yeah, you know, congressman, we are seeing increase amount of maligned activity. russia may invade ukraine. china may invade taiwan and you said it. you have got to be strong. these things don't happen.
