enough of a travel headache, you may need that mask for a very long time if dr. fauci gets his way. todd: and the founder of the 1619 project just took a swipe at parents who don't want her work in their kids' classrooms. >> i don't really understand this idea that parents should decide what's being taught. todd: there you have it. you're watching "fox & friends first" here on a monday morning, i am todd piro. carley: i'm carley shimkus. let's dive in. kamala harris says she is not being set up to fail while deflecting on the border crisis and defending biden's stalled spending bill. todd: lauren blanchard joinses us live from washington as a growing number of americans reject the administration's agenda. lauren, good morning. >> reporter: good morning, carley, todd. some democrats say vice president kamala harris has been given a nearly impossible of job by the oval office. the vice president shot back, saying that's what she signed up for. >> no, i don't believe i'm being

set up to fail. i'm vice president of the united states. anything that i handle is because it's a tough issue. and it couldn't be handled at some other level. knew the cbsinterview aired yes. she was asked if sinking poll numbers and unfavorable headline are because she is a female minority. she said she will leave others to deal with that and she is focused on her job which includes the border which remains chaotic and another part of the jobs is passing the president's stalled bill which she says still could happen. >> you're talking about build back better, asking like it has life to it. senator joe manchin said he's a no. .you don't have the votes. >> i'm not giving up. the president's not giving up and frankly the stakes are too high. >> reporter: a stalled agenda heading into the new year and much of the first year of the

biden/harris administration has frustrated many within the party and a most republicans and a growing number of americans. >> we went from literally 11 months safe streets to record crime. we went from a secure border to complete chaos. we went from stable prices to now record inflation. we went from strength and projecting strength around the world to the debacle that was the exit in afghanistan. so you name the policy, they've screwed it up. >> reporter: a real clear politics average of polls shows harris with 52% unfavorable rating, president biden has 53% disapproval on his job so far. carley, todd. todd: lauren blanchard live for us in washington. lauren, thank you very much. a lot of news coming out of that interview that we just saw part of. and one of the major pieces that we're analyzing this morning is kamala harris' take on what the major national security threats are to our country. you think it would involve the border, you think it would involve the wrist situation that

is -- tar wrist situation that is more or less cultivated by the pullout of afghanistan. but no, that's not what tops her list of national security threats. >> frankly, one of them is our democracy. there is i think no question in the minds of people who are foreign policy experts that the year 2021 is not the year 2000. i think there's so much about foreign and domestic policy that, for example, was guided and prioritized based on september 11th, 2001 and we are embarking on a new era where the threats to our nation take many forms including the threat of autocracies taking over and having outsize influence. i go back to our fight for our

democracy. in addition, it's about what we need to do with the climate crisis. todd: you should expect to hear this democracy is in crisis narrative from not just the white house but all democrats between now and the midterms. it's how they think they make the case for voting changes. that is code for wanting to change the rules to benefit democrats in perpetuity. there's another line that is extremely concerning, talking about how our foreign and domestic policy was guided and prioritized based on september 11th. what i read into that, carley, is a notion that we are going to take our foot off the pedal when it comes to keeping terrorists out of our country, to keep terrorists on other soils, not on american soil and i worry what this could mean for this administration's commitment to keeping the homeland safe at the expense of things like, uh oh, we have to worry about domestic

terrorism and insurrections and the like when in fact that is not the number one concern facing america in 2021. carley: yeah. i think that when people hear the vice president say that climate change is one of the biggest national security threats that that we face, people roll their eyes. it's such a completely unserious answer. but what is she supposed to say, the reality of the situation is that if you talk to republicans, one of the biggest national security threats we face is the fact that we have a porous southern border and terrorists because of the withdrawal from afghanistan have been emboldened, a suspected terrorist was caught trying to cross into the country which begs the question how many others have successfully crossed into did country and are in the united states by evading cbp. there's also russia amassing troops on the ukrainian border and what that could mean for the future of democracy in their country and how we're going to respond to that threat. china as well. and none of those were even

mentioned at all a when she talked about national security. she talks about climate change and democracy which is completely separate issue. congressman ralph norman was on with us earlier in the show and take a listen to what he had to say. >> kamala harris is our threat to our democracy because of this administration's aca shuns. they're the -- actions. they're the reason that democracy is a threat. it's not related to climate change. kamala harris is the problem and, you know, she's in denial. when asked if she was set up for failure, she is a failure. she doesn't need to be et set up. carley: and margaret brennan who did a cbs news interview with kamala harris pointed out that some democrats feel like the vice president has been given an impossible job by the oval office and if you look at the responsibilities that she was given, she wanted to do election reform. the other, the root causes of illegal immigration could be difficult for a democrat to handle but not impossible. when you think about what vice president mike pence was handed

by president trump to handle the coronavirus and you didn't hear him complaining whatsoever, todd. todd: yeah. i think it is so vital that republicans make the case going forward between now and the midterms that some overweight 65-year-old guy in a red hat is not the threat to democracy that kamala harris and the democrats would like you to think is reality. i worry way more on a day in, day out basis about what's cultivated right now in the taliban controlled fields of afghanistan, more than i worry about that guy that i mentioned. the borders' a huge issue in all this. we'll be talking to brandon judd, president of the national border patrol council, in just a few minutes on this and talk to him about what he thinks of the president and the vice president's statement. carley. carley: that's right. in the meantime, the latest surge of covid cases, dr. fauci admits the biden administration failed to get americans a suitable amount of tests. >> we've obviously got to do

better. i mean, i think things will improve greatly as we get into january but that doesn't help us today and a tomorrow. carley: americans you across the country forced to stand in lines for hours just to get tested as omicron cases spike by 41% overnight. later today, president biden will speak about omicron in the white house. he has delivered a promise, he has promised, rather, to deliver 500 million free covid tests to americans who reportedly without actually signing a contract to buy them. and omicron jamming up holiday travel as airlines report hundreds of cancellations and delays already today. there are more than 600 cancellations. the airlines are blaming weather and staffing shortages. over the weekend delta leading the way with 774 total flights delayed or canceled on sunday. jetblue delaying or canceling 508 trips and united reporting

point? >> to not get out of d.c. more. i actually mean that sincerely, for a number of reasons. carley: vice president kamala harris lists her biggest regret in her first year in office but surprisingly the ongoing border crisis is not on the top of her list. here to react, brandon judd, national border patrol council president. what do you think vice president kamala harris' biggest failure is in her first year. >> i'm obviously going to point to the border. that's what i live. i see it every day. the american public, they recognize it as well, not just myself, not just my fellow officers. when you look at when she gets questioned, when she is asked what is her biggest failure, the only thing the american public is getting is rhetoric, deflection and lies. she's going to continue to point to climate change as one of the root causes for illegal immigration, rather than admit that they were wrong, rather than facing up and saying this is what we need to do.

there is a simple solution. we can actually get this under control. but in order to do that there's going to have to be humility, they'll have to say president trump did have it right and they're going to have to change their policies. instead, they're going to continue to deflect and lie to the american public. let's look at facts. when we talk about the biggest border crisis in the history of the united states, tens of thousands of people are dying because of fentanyl overdoses. we have more than a million illegal borders crossers have been added to our public last year. now on top of that, we also have a border where we're seeing more people from around the world coming in, suspected terrorists. we've taken into custody. so this is seriously the biggest border crisis we've ever faced but what we get from the vice president is laughter. can't happen. carley: yeah. you know, you mentioned that suspected terrorist that was caught along the southern border, the vice president was asked about national security threats. she obviously didn't mention the fact that we do have a pretty

open border right now. can you explain how big of a threat that is to our national security? >> well, it's a huge threat especially when you consider the cartels. when they're able to dictate to us what our operations are going to be, when you go to you'd yumn you go to mcallen and see the vast majority of our resources are in processing, and when you recognize that 65% of the northern border isn't even being patrolled 24/7, those are serious threats, those are threats to the american public. it's threats to national security. and the cartels, they recognize this and they know this. but not just the cartels. but the terrorist organizations, they also recognize and they know this and they know that that this is the time that's ripe in order to cross very, very bad actors into the united states and, again, we're just doing nothing about it. we're laughing and saying that our biggest threat is democracy.

that is a serious problem and until we get this under control, some very bad things are going to happen down the road. carley: brandon, dhs secretary alejandro mayorkas, he recently authorized cbp to restart building small sections of the border wall. how big of a deal is this? >> that's a huge deal. and again, i don't care if you give me 10 feet of wall, if you give me 100 miles of wall. we need walls in strategic locations so we can dictate where illegal border crossings take place. i'm going to point to yuma. when you go to yuma, there are several gaps in our walls and that's where people are crossing the border, that's where people are giving up and they're opening up the more urban areas, i'm sorry, the more rural areas, they're opening up to higher value products, criminal aliens, fentanyl, opioids and potentially even terrorists. that's a serious i don't know and i'm going to point right back to it again. this white house is doing

nothing about the issue. carley: well, border patrol agents worked on christmas. they also delivered christmas gifts to communities. i'm sure that this was a wonderful moment for everybody involved. >> it is. when you look at law enforcement nationwide, we have a very unique opportunity to get into the public, to interact with the public, border patrol agents delivering christmas presents to needy families, law enforcement nationwide putting on the uniform going out and protecting the american public, at the same time also doing service for the public. had this is something that we love to do, something that we want to do. we want to alleviate the hurt, the stress, the pain that there is on the american public and we go out and we try to do it every day and christmas is one of those days that's very special that we can deliver presents to people. carley: we're looking at great pictures of the celebrations that you guys had. brandon, thank you for joining us. >> any time. thank you. carley: you bet.

concerned with what their kids are learning at school. listen to this. >> i don't understand this idea that parents should decide what's being taught. i'm not a professional educator. i don't have a degree in social you studies or science. we extend our children to school because we want them taught by people who have expertise in the subject area. todd: hanna jones taking heat for the remark and for claiming not to be a professional educator, despite being a tenured faculty member at howard university. she also denies that democrat terry mcauliffe lost the governor's race in virginia because of his claims that parents should not have a say in their kids education. she said it was decided based on the success of a right wing propaganda campaign. carley: a transgender swimmer is making a big splash in the college ranks, but backlash is forming as records fall. our next guest, madison kenyan, idaho state track and field at lead and kristin wagner, her

attorney. good morning to you both. >> good morning. carley: madison, good morning to you. what is your message this morning? >> my message is to let all the people out there know that right now what we need is for people to speak up and take a public stance on this. the fact that biological males are beating females in their own sport is insane and the only way it's going to stop is if we speak up and we go public and we have more parents writing letters and athletes speaking out and officials taking a stand because the only way to get fair competition is to fight for it and to not be silenced. carley: and kristin, madison decided to take legal action after she lost to a transgender athlete. where do the lawsuits stand on that front? >> well, the lawsuit is in the trial court. it's already been up to the ninth circuit once. it will continue to go up. i imagine the u.s. supreme court will eventually decide this. the university of pennsylvania

for example right now has a male swimmer who is about to shatter u.s. olympic records. women's records. and it's wrong for women to be sidelined in their own sports and it's wrong for colleges and universities to actually side with activists over their own athletes. carley: yeah. madison, what is your goal with that lawsuit? what would you like to see happen? >> you know, i'd like to see that fairness for women's sports gets -- it's fair and we get a level playing field and buy laws should be -- by laws should be females compete against females. carley: several teammates have spoken out, saying that it is unfair that she is competing as a woman after competing on the men's team for the first three years that she was in college. but her teammates have done so anonymously because they're afraid of repercussions. you're speaking out so publicly. why did you decide to do that?

and what has the reception been like? >> i decided to do this because i had the experience to compete against a biologic male and i was beat five times. it's extremely deflating. and i know it's not fair. and so in any point where a biological male competes against a female or competes as a female, competition is unfair. i want to say to the athletes, don't let anyone silence you. it's not scary and we have so much support by taking a stance and what we need now is for people to take a public stance and say we want a fair competition and not be silenced. carley: the thing is, leah thomas is not breaking ncaa rules, because under the rules transgender athletes are allowed to compete with their chosen gender after taking a year of hormone therapy. what should the rules be, in your opinion? >> i think that for this

biological females should be competing against biological females because that creates a fair playing field for women. carley: do you agree? >> absolutely. no amount of suppress ants will overcome the advantages that are natural. we need think about where this destructive ideology leads. women are referred to as birthing people or chest feeders. parents are shunned for teaching their kids that there are two sections and they matter and they're equal and complementary and we're seeing women who are being denied private spaces in locker rooms and dorm rooms and women's shelters, prisons and other places. i'm proud of matt hey for standing up -- mattie for standing up, for what's going on in the swimming pool and track competition but we all need to stand up on behalf of our women and our girls throughout the nation. carley: madison, final thought to you. >> yeah, just to all of the people out there, not just the

athletes, to the parents and officials, take a public stance. don't allow yourself to be silenced. the only way for us to have fair competition for females is to fight for it and to speak up. carley: it is certainly an interesting conversation that isn't going anywhere and madison right now you're leading the charge and madison and kristin, thank you for joining us. >> thank you. >> thank you. carley: you bet. now to a fox weather alert. parts of the west coast experiencing a christmas winter whiteout. check out conditions in nevada where the 50-mile-an-hour winds and poor visibility caused a 20-car pileup, six people were hurt in that situation there. todd: california, an entire 70-mile stretch of an interstate shut down because of hazardous conditions there. meteorologist adam klotz is here with the fox weather forecast. >> good morning. that minister weather held off to -- the winter weather held
