the u.s. senate because the senate, as the senate democrats as expected, lost the bid to change the filibuster. the final vote was 452 to 48. kyrsten sinema and joe manchin voted with every republican. it was expected chuck schumer tried for the nuclear option to change it. didn't happen. the president said last night he is disappointed but will continue to push for changes in the senate. mitch mcconnell accused chuck schumer and the democrats of trying to silence the senate and silence millions of americans and seize control of the democracy. and it was a bad night, ainsley, for joe biden in the senate but then again he had a really long press conference. >> ainsley: yeah, he did. he was up there speaking for more than two hours. your son asked him a great question why are you going so

far left? and he says he claims he's not. he says he likes bernie sanders but he doesn't always agree with bernie sanders. but he said i outperformed in the first year. he said i didn't overpromise. look at that the "new york post" said he said what? now we know why they keep him hidden. but, if you go through some of the things that he talked about. you know, he did promise us that he was going to wipe out code and then yesterday he said the pandemic is far from over. he admitted he didn't have enough tests even though hes told us he was going to wipe it out. he also promised us our economy would be better. we played that. we are at 7% inflation and he blamed the pandemic and he blamed the federal reserve. cbs did a poll and 65% of americans say he hasn't done enough to alleviate inflation. his approval ratings are horrible, 33%. he also said that he is going to be on the ticket in 2024 with camla. asked why americans question his mental capacity he said i have no idea.

when it came to russia he said they will move in on ukraine and if they invade they will pay. then, brian, he defended afghanistan's withdrawal. he said i make no apologies. >> brian: which is sin of with 13 dead and biggest embarrassment in military history. what he did with russia says expects incursion. you can't walk that back. one president at a time. his words matter. can you imagine being ukrainian and seeing that while we pledge to give money and arms, can we get them there already? here's the president with his response to an opening question. >> look, i didn't overpromise. but i have, probably, outperformed what anybody thought would happen. the fact of the matter is that we're in a situation where we have made enormous progress. you mentioned the number of deaths from covid. well, it was three times that not long ago.

it's coming down, everything is changing. it's getting better. one of the things that i think is something that -- one thing i haven't been able to do so far is get my republican friends to get in the game of making things better in country. can you think of any other president that's done as much in one year? name one for me. >> brian: a lot. if anybody was there. he meets with historians so often i'm sure they would have been listing 44 others. did he try to do a lot, he didn't effectively do a lot. one of the most sincere comments, steve i heard is when he said i had no idea republicans weren't going to work with me on anything. really? he didn't hear about opposition party? he didn't watch donald trump be fought every step of the way? he reached out one time. he actually got a result bipartisan deal and as was brought up with a very astute question was mitt romney just said over the weekend when it came to election reform you didn't even call. so don't say that you had no idea that the republicans were

going to obstruct him. they have a different agenda. they might not be bad people. they just don't want to have a bernie sanders like-run government which means a lot of the stuff that was way to the left like build back better and the radical voting reform and blowing up the filibuster does not resonate with them. i don't think they need to apologize for that nor do i think he sincerely has -- sincerely surprised by it. >> steve: he made it very clear yesterday in some of his opening remarks that the best way for prices to come down in america because of inflation and the supply chain, which he said, you know what? it's messed up, we're going to fix it he said the best way to get those prices down is to pass build back better. which he said will pass but just in chunks. and regarding republicans, what he said that got a lot of people going who is he talking about, he said there are five u.s. senators who are republicans with him who privately say hey, i completely agree with you on

all the things you are pushing for because they are so fair. but i'm afraid that if i say that and support you, then a donald trump-backed primary challenger will knock me out of my job. so i'm just going to zip it up. mark levin had this observation about what we all saw yesterday last night. watch this. >> there is like two americas here. the democratic party that lives in this sort of cacoon and the rest of the nation. there is inflation. he says it's no big deal. we didn't talk about he schools today. crime mentioned that's true. the borders totally out of control. the issues that effect americans across the board. >> ainsley: yeah. he is right. inflation is not just affecting republicans. it's affecting liberals, independents, production. it's effecting all of us and these businesses that can't get

>> carley: good morning. back with your headlines. a driver is charged after two marines are killed and a dozen injured in a military truck crash in north carolina. police say the vehicle year turned while attempting a right turn, ejecting its 17 passengers. a second military truck reportedly could not stop and hit one of the service members. the 19-year-old marine, who was driving, has been charged with

one count of exceed ago safe speed and two misdemeanors counts of death by motor vehicle. the fbi says it conducted, quote: court authorized law enforcement activities amid reports agency search congressman henry cuellar texas home. the fbi called it ongoing investigation but provided no further details. agents reportedly snapped pictures and carried large bags out of the home. cuellar spokes person saying the congressman will, quote fully cooperate in any investigation. he is committed to ensuring that justice and the law are upheld. the ncaa aannouncing update to transgender athletes to fall in line with u.s. and international olympic committees. each sports national governing body will now determine individuals' are participation with ongoing review and recommendation by the ncaa. the policy will be effective immediately. caitlyn jenner speaking out on

saying, quote: the statue row moats racial heirachy. the museum has long found disturbing it will be sent to a library in north dakota on a long-term loan. it is still going to be outside a library just no longer in new york. >> brian: absolutely sickening, been there 80 years. this is a guy responsible for creating the museum of natural history. his relationship with booker t. washington what he did for african-american relations while not having a perfect record, no one did in those times as our 26th president is without peer. for them to take this down is so insulting especially this new mayor comes in he has to know this is idiotic things the mayor did do to move teddy roosevelt out. some day we will sober up and understand the idiotic things we are doing. that is going to be the subject or part of a fox nation series ray kelly grew up in that area, the police commissioner did a

special on what police commissioner roosevelt did and we were in front of that building, and it was boxed. it was boxed, as if people were going to be offended to see teddy roosevelt on a horse, absolutely incredible. so we are going to look at that next week. i will talk more about that. first things first. the other thing we have been talking about in new york city is death and destruction of the way of life. and areas in which were normally almost crime-free when you talk about broadway and times square. but that has not been the case. now, over to los angeles, where this d.a. has gone out of his way to make sure criminals have rights. therefore, criminals are out. now, yesterday, we have been over the last three days been talking about a 24-year-old aclu student who world in a furniture store and stabbed to death. yesterday some good news. that suspect was apprehended in pasadena by the pasadena police. and it turns out his record is even longer than we thought. he has been an offender and a

career criminal. in fact, his last offense, one of his last offense was actually in san diego. and this is a guy that normally, in a previous time, would never have been out and about, but as a transient homeless person, ainsley, he attacked again and this woman is dead because of permissiveness that we're witnesses here with these d.a.s. >> steve: and in fact she was stabbed to death. she was murdered one week ago today. and so, you know, they did circulate these images. in fact, according to the papers out in los angeles, apparently this guy was in a restroom of a restaurant and somebody recognized him from police department photos that the lapd had been circulating. they called the cops and he was taken into custody at a bus bench nearby in pasadena. i hope the person who dropped the dime on this guy and got the

cops there does get the $250,000 reward that was put out there. but, nonetheless, you know, we have been talking for a long time about how a lot of these people in positions of authority, particularly d.a.s kind of look the other way, no consequence for crime. a statement from the l.a. county d.a. george gascon's office yesterday was it is tragic and heart-breaking that brianna kupfer was murdered while she worked. it is a tremendous loss for her family and friends, the community and los angeles county. we are working with lapd and will review the case as soon as as it is presented to us. and, ainsley, the sad thing about this story is the randomness to it. but, also, when you think about it she wasn't supposed to be working that day. she was off but wound up working because she wanted to cover for somebody. she was going to take a red eye flight to los angeles that night to celebrate a birthday with

some friends and there's her beautiful family. but the thing is, brianna kupfer was murdered simply because she went to work. had she not been in that store when this career criminal came in, she would be alive today. >> ainsley: yeah, i mean these woke d.a.s can say it's tragic, it's heart breaking but it's their policies that are allowing these criminals to get back out on the street this guy had a lengthy rap sheet, extensive criminal history. assault with a deadly weapon. assaulted on a police officer. trespassing, possession of a stolen vehicle. misdemeanor larceny. possession of stolen goods. at the time he was free on $1,000 bond. he is now being held on a $2 million bond. but, her parents are wondering if this guy, if these days had just done the right thing and if they had -- when you have that many things on your rap sheet,

you have that many mug shots, more than 12 or i think we counted 12 yesterday, then why are you out on the street? this girl could have been alive. she had her whole life to live, her whole life ahead of her. the sheriff alex villanueva speaking out about this. listen. >> ever been released. he would have been -- i think he was arrested, possibly for possession of stolen items. used to be a felony, now a misdemeanor. got out on a ticket in october. and just a few months later he is killing brianna, you know, right at the start of her life. we have an open air mental asylum. we have become so used to seeing people behave erratically in public it doesn't draw attention someone gets killed. we have been desensitized to the fact that people need help. they cannot be safely walking amongst us. that's just a fantasy. >> ainsley: i remember talking

to rudy giuliani and i asked him how he cleaned up new york. he said if we saw anyone that was homeless or anyone acting erratically out on the streets maybe with mental illness, we would send our officers to go and pick them up and put them in a facility whether homeless shelter, but he is right. that sheriff is right. all we are seeing in new york and l.a., you walk around. you see homeless people. people are screaming random things at civilians walking on the street. and we just continue to listen to our music or hold our daughter's hand and keep walking. we don't even pay attention to it anymore because we see it all the time. and we need to do something to clean up these streets so that innocent victims are not killed. >> brian: right. >> ainsley: what about the victim, jonathan atomy is asking. a veteran l.a. prosecutor and big critic of gascon of that d.a. who is also former boss suing him as well. he says the d.a. needs to stand up and fight for them, the victims. prosecute these victims to the fullest extent they deserve a voice and justice no.

parent should have to bury a child. >> brian: fox news digital found out he has a long history of mental illness. no kidding. he should have been locked up and satellited away. we can't go around and arresting the homeless. we need cops in power to arrest the homeless. mentally i will. the family of four rough times got thrown out by slum lord. that's the old story from the 1930s. it's not the story in 2022 when it comes to the homeless subculture plaguing the cities, every major city in this country and has a lot to do with all-time highs in homicide records that is also plaguing this city. so, just real quick on hunter biden, the u.s. secret service is evidently being accused by senator ron johnson as well as senator chuck grassley of covering the fact that he was traveling around the world and he was basically being covered about the content of what he was doing. in fact, here is the statement right now from chuck grassley in a letter to the secret service

director james murray. in applying the redactions of a secret service they hid names and information containing email conversations regarding hunter biden without any proper legal jurisdiction. we determine even though hunter was on secret service protection from january 2009 to 2014, the secret service did not produce any communication regarding his trips to places like kazakhstan, spain, italy, mexico and russia. which now we have the secret service covering for hunter biden along with all the networks? this is absolutely unbelievable. do they not understand that the secret service one day republican also be in charge and unredact the redacted portions of this? >> steve: yeah, keep in mind though, brian, it was a year ago his father became president of the united states. things happen when your dad is president. what chuck grassley and ron johnson are upset about is the fact that they asked for these documents, which about were

death in 2019 while trying to steal iphone. three teenagers convicted in the attempted robbery and killing. weaver was the last to be sentenced. major-a student of varner college was just 1 years old at the time of her death. the supreme court clearing the way for a congressional committee to access trump era white house documents related to january 6th. justices voting 8 to 1 bins to deny a request from former president trump to block records from the january 6th committee. this means over 700 documents related to the attack on the capitol will be transferred to congress. a group of pennsylvania parents outraged over this photo showing a school employee taping a mask to a child's face. the north penn school district says the serious matter is being addressed with the employee. a spokesperson for the north penn stronger together facebook group tells fox news, quote, the fact that our school district leaders did not immediately

remove this educator from any classroom responsibility may be a bigger and more shocking offense. my goodness. steve, over to you. >> steve: that's something. carley, thank you very much. parents in beaverton, oregon are outraged after discovering their kids school is offering a genders and sexualities club to students as young as 9 years old. >> these kids are far too young to be worrying about the subject at school. they should be learning about different lifestyles with their parents as is their right. >> why would they have these elementary students sign contracts without parental knowledge and consent. >> you cannot tell me that raleigh hills is being run, this club is being run by students. this club is very clearly directed by staff. >> steve: well, some parents worry that if fourth and fifth graders aren't considered too

wrong with it i think this further goes to show we are right in standing up. we are right in continuing to fight for this. we are right to say no because we don't -- this is like grooming. this is tantamount to grooming. if we saw this in any other -- if we -- any other circumstance, i think we would all say no. you can't show these kind of things to our 9 and 10-year-olds. we would want to call the police in some instances. >> pete: what one of the parents pointed out was, this is forming a club and giving presentations at the age of 9 on issues of gender and sexuality, probably not just the idea of a 9-year-old. and yet, the school said because it's during class time, parents don't need to be notified? what is that mindset? >> it's the terry clarify mcaul. parents you birthed them, you shelter them, you clothe them, when they are in our care we will take it from there. parents all across the country,

certainly in duval county are saying absolutely no. not only do we birth our own children but we get to say what they should have, what they should be taught and how their day should go in a classroom setting. just because i send them off to camp does that mean that i don't get to have a say what they are doing when they go to camp? no. i have a say in everything they do because i'm their parent. >> pete: when we send kids to school sending them to democratic camp 8 hours a day and deprogram when they come back. you mentioned terry mcauliffe here in virginia for miseducation of "america live" summit. you have been such a voice for parents. speaking up for the rights of parents and kids. what's going to be your message today at the summit? >> my message is that parents have the right, and you don't have to be afraid to speak against things like critical race theory. you don't have to be afraid to speak against things like queer theory, which is another thing creeping in which is tied to instances we just saw in

truck drivers out on the road. that is what we are looking for. we are not looking for any 18-year-old, we are looking for very professional minded safety, those kind of people to look into a pilot program. >> ainsley: do you have any standing up from 18 to 20 years old? >> we actually do, i have carriers contacting me because they want to know how to get in a program with 18-year-olds. we want more so if anybody is interested in signing up as an 18 to 20 year old, we want to see if you would be a good fit for the program. >> ainsley: i know the teens must be experienced by another company driver and electronic breaking and recording devices and up over 65 miles an hour. so if someone else is in the truck teaching them, how long will this take so we can get teenagers in a truck by them self or is that ever allowed?

they can't do it, but they said congress did through some vague statute that they refer to give information to hhs for health care workers. i completely disagree with the conservative majority and i don't know how they came to this conclusion. so, let's fix it to make it clear. so in this building no mandate for health care workers act change the social security act to make it clear and the secretary of hhs has no authority to impose mandates or drugs on health care workers just because their facility takes money from medicare or medicaid. make it clear so they can't do this anymore. why is this important? we have heard the stories. we hear from the districts that health care workers are losing their jobs. and understaffed. we heard we are short nursing homes, 420,000 employee shortage in nursing homes right now. and so to do everything we can to keep people employed, and by the way, most of these workers getting fired have natural immunity. they have been dealing with the

chuck grassley and ron johnson have written a letter to the secret service director because ainsley and brian what they are looking for is through the freedom of information act, they asked for a bunch of documents but you know what? the secret service sent the documents back to the congress -- the senators and so much of it is redacted. these kind of redactions do not apply to members of congress. it might apply to the general public but not somebody like this. >> that's right. they said the secret service did not provide information on his travels in 2010, 2011 and 2013. he was under protection from the secret service while his dad was vice president and from 2009 to 2014. the years they did provide they were redacted. they sent a letter to the secret service and said in applying the redactions the secret service -- other

information contained in email conversations without legal justification. we determine even though hunter biden was a secret service -- can we go to the next screen protectee from january 2009 to july of 2014 the secret service did not produce communications regarding hunter biden's travels for 2010, 2011 and 2013. the secret service's lack of communication during these years raises questions given that secret service travel records show hunter biden made trips to china and other destinations around the world including russia, italy, spain, mexico. brian, i don't think they are allowed to give congress information that's redacted. i believe that's something that is -- that congress can read and they aren't allowed to talk about it necessarily but they are questioning why these redactions. >> the secret service has a job to do and produce documents and chronicle trips and journeys and it resolves around our
