plenty of reasons for smiles. because in these tough times, sometimes you just need a moment to breathe. and with that, let's go to cross country. ♪ ♪ lawrence: on this inaugural edition of cross country on the ground in los angeles and houston as we cope with a historic crime wave in a few minutes you will meet a mother of a 16-year-old daughter who was gunned down shot 22 times while walking her dog, the dog came home but she didn't. the accused killer is back on the street. here's a quick look. >> my brother said let's take her to the hospital and when i tried, to pick her up i knew that -- she was not going to make it.

and i -- i just rather to my brother there was nothing we can do and i told my daughter that i loved her a lot, and that i loved her. lawrence: before we take you to the horrific scene in houston, we're investigating the tragic results that are happening when progressive d.a.'s let violent defenders back on the street. and many americans are asking, is america becoming a country where we put criminals before victims? >> sometime it is takes one case to help us change course. that's what brought me to los angeles. to meet with the sheriff of the county, the deputy district attorney, the story of brianna kupfer. stories all across the country even l.a. of victims that are being killed, shot, stabbed, and there's no justice for them at

all. you've got breanna that touches the entire country the guy that did it had a wrap sheet mr. smith he was allowed to be back on the street. why? >> simple, because every single time he gets arrested, they plea down the case to next to nothing. doesn't mean that crime doesn't happen. but every single time there's a question about -- prosecution, law enforcement did their job. they made the arrest but the case together presented d.a. and every single circumstance all of the different states, every time it was bargain it down to something as somehow that advances a cause of justice. it doesn't. it allows someone like smith to continue victimizing the community, until the point he commits one that is too far and her name tragically brianna kupfer. >> with a long wrap sheet you go and look at -- his shots, you know, the mugshots.

they're different ones. they're king the but never anything that said hey i've been reformed. i should be back out there in society. sheriff, can i take you back to crime scene of what was released to the public of him going through the alley. making his way to brianna sends a text message 13 minutes before and says shelfs eerie about this this something is weird she has a feeling there. he murder her cold blood and back through alley guess to 7-eleven gets a vape has a 30 minute conversation. angts like nothing has happened does that matter how you prosecute a person like that and see how cold blood they can be? >> i would hope for a deputy district attorney that is on their game that that will definitely matter. this shows depravity of the crime the wantedness of this that was like a casual take the dog out for a walk. nothing. in the fact that he went door to door -- he visited several places until

he wound up in her establishment by herself, a crime of opportunity -- lawrence: should citizens in los angeles or any major toc city feel safe? >> well, in terms of the law enforcement side, our many uniform be it blue, tan and green whatever uniform is across entire nation they're working hard. look at what happened to two nypd officers doing lord's work out there answering call and they paid tragically with their life. so they're out there. cops are out there nation -- doing their job. where wheels are falling off when it comes to prosecution side. lawrence: you're a democrat. >> yes. >> gascón is a democrat are you really a democrat then? >> i'm a democrat but of considered the blue dog democrat of the old days of jfk and fdr but this has gone so far to the left that they've literally left everyone in the middle

moderates, both on the conserve and liberal side like where did they go and extraism an far left is bad it doesn't advance publics interest. it doesn't resolve the pressing issues of today which violent crime, we need to have smart people in office and do the right thing for the right reasons, and these ultra progressive d.a. with their agenda are differing that. lawrence: how does it make you feel that gascón was a former cop? is that something in the law enforcement community a guy that wore the badge that had people under his command just like you -- i mean there's a lot of cops that don't want to do the job anymore because of d.a.'s like him but he know what is you go through on a day-to-day basis so how do you square it too? >> he blames he was doing wrong they think and had a change of heart of something i don't buy

that whatsoever he knows what's gong on on streets and he knows organize criminal elements multigenerational gang. he knows what they're getting away with and what their whole reason to be is. so pretending somehow they have a change of heart no. he had cor responding following that agenda because that put him in office. bankroll him. >> i've always said if you want to really stop this crime, you need three things. you need the police chief the sheriffs that's your law enforcement angle you have got to have your d.a. at the table but you need a judge to sign on and get these bad guys. from your point of view what do you think is going to -- take the stop the blame today we want it if you have full control -- you're on national news right now, to tell the public if toipght stop all of this crime in the country right now this needs to happen what would you tell them? >> three things have to happen actually. zero bail schedule needs to be thrown out. off the bat.

prop 47 which laid foundation for decriminalizing so many they thinks needs to be thrown out or rewritten entirely it blew up in everyone's face. the author of prop 47 is our d.a. george gascón, and he took that and doubled down on that and decided not to prosecute hardly anything so now we have all three of those elements they need to be changed. lawrence: what do you think about the state of your city right now? >> well we're in a crisis right now. at least when it comes to public safety. and other health related affairs, we have rising crime especially homicides. a lot of shootings, we have homelessness everywhere. it's not a good time in los angeles. >> you deal with a lot of crime. what is your perception of your boss the d.a.? >> well, i think my boss has implemented a lot of bad ideas in the last year that he's been

district attorney. he has implemented policy that he calls criminal justice reform. but it really amounts to nothing more than decars ration efforts. he is not charging obvious crime. he's advocating on behalf of people to be released it from prison sooner than they should. he's not meeting with victims he's not allowing d.a.'s to attend patrol hearings. he's undercharging offenses including violent offenses not charging special allegation and special everything he's aimed at reducing prison jail population. has nothing to do with helping people. has nothing to do with transforming lives and does not have anything to do with helping to uplift lower economic underserve communities. he's masquerading that way but it has nothing to do with that effort at all. lawrence: you're taking him on

in the sense of you're speaking for the public that you swore an oath to present. what's been the response from the d.a. to have not just view, other deputy d.a. as well that's been outspoken. >> for sure. glans are you going to lose your job? >> i don't think so. we have we're well protected here in los angeles county we have civil service protection when is i speak out against him or really against the policy, i guess my big question is -- lawrence: is he upholding state and federal law right now? >> no. absolutely not. our district attorney is nullifying important law he's doing it explicitly and unapologetically he's not charging special circumstances. he's not charging gun allegations, he's not charging gang allegations. he gang unit we have to gang crime. he wants to see fewer go to

jails and prison and let a lot of ones who are already in there out before they've properly been rehabilitated. >> you got signed a big case that you can't talk about brianna and it really touched the heart of the country. do you think that is a turning point because when you put a face on it seems like the reaction from the public is it is much different and when you have someone that -- her case, for her life, text her friend -- do you think that may be the recipe to a lot of this highlighting the stories over and over again -- >> i think that's what you all need to do in the media certainly we're trying to do it from the public service end. glans we don't want to make it political. but when people see this, they want to recall the district attorney and there's been names that should challenge the district attorney and you at the top of that list. >> what the people say. >> i'm flattered by that and i've been in this office over 20 years i love what i do i'm committed to public service and mitted to working on the entrance of the people and then victims as well. lawrence: recall happened. and the voters say they need someone that they trust that has a proven track record of fighting for the victims and not the criminals would you accept that call? >> i certainly hope to be in position to accept that call if that happens. lawrence: you're going watch this interview -- i know he does because his wife saw other interviews they often release a statement so with him watching right now, since duct take meetings with anything, and you speak for victims. you speak for a lot of your colleagues that feel look they don't have the necessary support. d.a. watching right now what would you tell him? >> what i would tell him is -- sit down and let's have a

conversation. first and foremost, as district attorney, why aren't you mitted to following the law? will you follow the law? where do you find the authority to ignore the law? because district attorney gascón were following the law if he were doing everything under the law that he could to make fuss safe, he would be in a much better position right now because -- hengd go before the people and say crime is going up but i'm fighting for you. i'm pulling no punches. i'm doing everything the law allows to keep the community safe he can't do that. i defy him to do it go out get with the people. stand before them and fix the list saying you're doing neferg your power to keep this community safe. lawrence: wow. up next, it has become abundantly clear there's a war on cops in america.

but i promise, we promise -- that your death won't be in vain. i love you to the end of time. >> and you've been there. tell us about it. >> i have. it's heart wrenching to hear her say those words that another family has to go through this. i stand by her words. you know, our prosecutor is not doing her job prosecutor cross country are not doing their job in holding people accountable. the man that murdered my husband was on probation for two armed robberies he committed one armed robbery was on probation committed second arm robbery given a sending probation. how does that happen? he should have been in jail if he was in jail by husband may still be alive today. and -- these -- the policeman are doing their jobs i have to give it to them when i was an officer we did our

jobs we loved coming to work we arrested criminals we went out and hunted them down and found them and then to take hem to the court, and -- the prosecutors don't prosecute or judges give them light sentences for violent crimes they're committing crime has to be illegal again it is ridiculous that criminals are walking the streets i know in -- in chicago alone i was just told you know yesterday i was in chicago, and they were telling me that there's murders. there's 30 murderers walking streets with ankle bracelets on right now. they should be sitting in jail. they should not be out wandering in the public. it's heart wrenching to know that these victims families see these murderers back on the streets and wondering if anything is going to happen. lawrence: sergeant, seems like earlier past couple of years we were having a conversation about citizen when is civil liberty were violated what going to do with certain bad actors involved

that were a part of the state. but it seems like that conversation evolved to straight up anarchy i want to put this graphic up there so you can see sergeant because you wear badge still. the man shot as well as being killed. what is it like being a cop today, sir? >> hey, i can't even begin to describe what it is like being a police officer now aday. we have young officers going out there every single day to make a difference in their community but going out there with target on their bang and let me tell you how bad it is. we've had 25 police officers shot this month. that's already a 38% increase over last year, where we had 346 police officers shot in this country historic numbers. and ambush attacks are up 115%. the fbi just released a report that said 2021 was the deadliest year for law enforcement for intentional homicide in 20 years. the violence is getting worse and worse and it is time for

congress to act. and pass the protect serve act to make it a federal crime to assault a police officer, because we know damn well that these local road d.a. are not going to follow through on cases we saw just saw on previous segment we have people who have shot a young girl 22 times. and they're out on bond, how does that dirt bag get out and it is happening over and over again in our communities and it is driving our violent crime, we just had 15 cities that had highest murder rates in recorded history. and i am telling you folks, these rogue d.a. bought and paid for by george soros are not going to stop lawrence there's no one no one not kids not victims not police officers -- that they won't sacrifice from the alter of their woke aghtd it is abhorrent disgusting and needs to stop. lawrence: i know you're connected connected with a lot of cops i have a few more seconds left i hear from cops every day many of

cosmotology so that was her succeed year. lawrence: take me back to the day where peanut comes home. >> he asked me i was talking a show she asked me if she could walk peanut. i asked the time and she said 8. and i said -- i said okay. but hurry up. i said 20 minutes. walk him and come back. which it was -- right it is not far from here. and just come back. i got out the shower, maybe 10 minutes, 15 minutes later. my brother came in and said, i heard a lot of gunshots. call diamond to see if she's

okay. i got up, i called her twice. straight to voice mail i didn't like it because she would always answer my call. or my text messages. lawrence: that was unusual. >> right everybody started -- you know, running around and peanut. i don't know how he door open like really hard. so he said okay there's diamond. but then my son screamed and said peanut got here by himself and that's when my heart dropped. >> peanut is her dog. >> reeght. my heart dropped. but i start, i threw phone and i started running. towards, you know, screaming her name. i just want my daughter. but a lot of blood. i started giving her cpr.

and i just -- i just touched her hands and my brother said let's take her to the hospital and when i -- when i tried to pick her up i just knew that she wasn't going to make it and -- and i just rather i told my brother there was nothing we can do and my daughter that -- that i loved her a lot, and that i loved her. and i was just screaming at her i love you and i love you -- and momma is here and you need to go just go. and she left. she left -- glans did she look at you? >> she had her eyes open.

but she didn't talk or move. and i did, i tried that cpr and -- i mean, she was hardly, hardly breathing but i know she heard me say momma was there. that she didn't die alone, i know. because if she did close her eyes by herself and that was -- so i know she heard. and i know she knew she wasn't alone and i thank god for that. glans now you find out they arrest him. but then they let him go. they charge him let hill out on bail. >> my heart dropped. my heart dropped. i -- i couldn't believe, you know, i just my daughter, my diamond.

she's not getting a second chance. she's not why should he? lawrence: did they call you to let you know that they were going to put him back out on the street? no call -- >> no. no call. i mean i found out by the news. she didn't deserve one, one bullet. but instead got more than 22. so that's execution. lawrence: more than 22 bullets. we remember talking before the interview do you feel like there's going to be justice for your daughter? do you think he's trying to escape? >> of course. >> what makes you say that? >> because he was ready to plea the country.

progressives harassing joe manchin really breaks my brain. because trump won west virginia by 70% do you really think that joe manchin is beginning to sign on to a green social spending bill when he's the senator in west virginia state who constituents make money off of coal and natural gas no. so the problem within the democratic party isn't sinema or manchin, it is the fact that biden is trying to play progressive president when the country and the senate is evenly divided. lawrence: bill alluded to this yesterday on the show. it seems that bill maher didn't change a lot of these politicians manchin has been this way for years. sinema as well. but seems like they're on the brink of leaving democratic party because democratic party left them. >> that's absolutely right that is also something that james carville talks a lot about. progressives are energized and loud but they certainly don't represent a majority of the

party. and right now the only number that president biden needs to kaish is 32. that is his approval rating in pennsylvania. that's not his approval rating in west virginia or another southern conservative state. he won that state in 2020. and he's at a 32% approval rating right now. which means that a lot of democrats or i should say a lot of independent and democrats see democratic party as way too liberal right now. lawrence: way too liberal and they go crazy. they go crazy and i think -- you know if someone is a libertarian and trying to pull both sides accountable give me any hope. >> quickly do you remember when kyrsten sinema was harassed in a bathroom stall and president bidessen asked if he con dheams type of behavior and he said no it is just politics for you. that's not politics. you can -- you can get your point across without harassing people -- and that would be politics then
