stand up and really be an actual model for change and you know what, let's fix these catch and release laws. >> carley: without a doubt pier the president expected to sign an executive order. i'm not sure if you heard this in just a few weeks and it would address the system of racism in the criminal justice system to things like band choke holds and no-knock warrants for federal agents. what do you think that would do for officers morale? >> i think it would be bad, we see those policies debated in the assembly in the state of new york and eliminating no-knock warrants would jeopardize officers. there is a procedure for a lot of this. you can't be putting handcuffs on law enforcement when they are doing an extremely dangerous job. their lives are on the line clearly. they need more tools, more support. we shouldn't be restricting how they can do it. obviously, we want to make sure they do it the right way

dr. matthew neil joins us with the details. dr. neil, thank you for being here. giving parents choice. >> i think it was a really a challenge of our school board. we have a new school board that came in in november and making sure the parents have that transparency in the classroom of understanding what is being taught and also the parents responsibility to voice when there is a controversial subject they would like to opt their child out of. >> todd: here are some of the topics that parents can opt out of that they want to become a controversial topics, sexual content and profanity, drug use in materials and may be polarizing along racial ethnic or religious lines. it seems logical to me. have you had any pushback? >> we are right in the middle of finishing up the policy and out on the community with support. and help us write the policy so we have a little bit of work to

do before it technically rolls out at the beginning of next year. but so far, asking for transparency is working really well. >> shocking concept. parental choice and parents eat, a great army look for success. how do you strike the balance, dr. neil wanting to give parents that choice but also on the other hand letting teachers teach? >> welcome i think it really rest on the shoulders of the teachers. we have amazing teachers and i don't presume to tell teachers what to teach. we have content standards that they know well enough. and it is really about giving a pathway for them to understand when they get close to the edge of a controversial subject, they can go to the administrator or essential, this is feeling controversial and i would like to teach it but what does that approval for doing that? an approval process but transparent communication to parents putting it on the shoulders of parents to choose to opt out of a subject.

while giving alternate learning assignment so not letting kids skip school for the day. the teachers have a responsibility and do a good job giving learning assignment to a child to fulfill the requirement of the standard. >> todd: your mission statement on this concept is so vital for every american right here right now. i will read it verbatim "the goal is student achievement, not validating a specific point of view." doctor, why have so many schools in the country got away from that notion? again, i was born and raised in colorado. i'm not sure about the rest of the nation, but i would say the parent choice, the option of parents. i don't know that we've gone away from it but really explicit about our parent support and our teachers in that relationship and the kind that partnership back and forth as the backbones of teaching itself and helping students learn.

similar crimes in new mexico. and technically, we had a chance to speak to the district attorney briefly may be he was just trying to prepare me, but he did mention at this debate, the sentence will be less than what we expect. and so we have had a lengthy discussion at the d.a.'s office and we learned that catching or apprehending a criminal and prosecuting him are totally two different things and it seems like the judges are willing to take the side of the criminal and make sure that all of their rights are protected. >> carley: i cannot believe the district attorney as you are grieving the loss of your son, be prepared that your the

sentence may not be as long as supposed to be. how did it feel when he said that? >> carley, i won't explain the district attorney. i think he is trying to do his best. maybe just preparing me for some disappointment. and you know my understand this is my first interaction with both the district attorney and in general, law enforcement. i'm realizing that both the police and the district attorney are limited by so many things. ultimately, that gets the lawyers and the judges that there are a lot of restrictions on what both the police department and the d.a.'s office can do. >> carley: you know, you say

that this guy from the suspect, he was driving drunk and may not be charged with a dui. he ran a red light killing your son and also injuring you. he will probably be charged with careless driving and not reckless driving. you say something clearly needs to change in what i just read. what is that? >> there are so many things that need to change. but at this point, i feel like a parent or a child who dies, i feel like the laws have been written to, first of all, get extreme protection to the criminal as well as people who support it or helps it anyway. and the second thing is the
