>> emily: the face-off over masks intensifying as more state governors defy the white house and rollback mandates. i'm emily compagno and this is outnumbered. i'm joined by my cohost harris faulkner harris faulkner and kayleigh mcenany host of kennedy fox business, hannity, and former white house press secretary at fox news contributor news contributor, ari fleischer. a list of democratic states enforcing mask mandates and schools is growing as the governor of massachusetts says

he won't extend it beyond the month. all of this at the cdc says mask policy should be done at the local level whilst explaining to the federal in place now. >> we continue to recommend masking in areas of high and substantial transmission. that includes much of the country right now in public indoor settings. we are taking a close look at this in real time and we are evaluating rates of transmission as well as rates of severe outcomes as we look at updating and reviewing our guidelines. >> emily: ari fleischer, a lot to unpack. >> ari: it is about time. we are so sick of this. here's the problem. it would be one thing if you are sick of it, but it's vital to people's health and we had to do it because it was so severe and so dire that if we did not do it, countless people were going

to die. instead, countless people have been getting the cold. this is enough for government to be on devcon one. you cannot go to devcon one to prevent people to donate from catching the cold. what are we going to do when this turns into a serious virus? more so than delta or omicron. the government has had to say you wear a mask. we were all wearing gloves and wash encounters and washing food. these things have gone way because they should go away. mask ring should away as well as well as on federal facilities and on airplanes. it's not dire. stop wearing masks. >> emily: a quick follow-up. how do you see this laying out on either side as we approach

returns? >> ari: one of the reasons that the public is exhausted with us and to the degree i saw this morning, democrats are seen as mask fundamentalists. it reminds people that one party went too far, had bad solutions, and review to do sensible things. the press plays a role. they have hounded republican governors when they stopped complying with mandates. when the democrats do it, the press gives him news coverage. >> harris: it's true. >> ari: that hypocrisy, every republican knows it and that governors of texas, florida, georgia, they lived under it. this is why the democrats are in trouble. >> kayleigh: but the cdc is refusing to budge and refusing to account for the country's shift in what ra is pointing out any k-12. >> kennedy: the federal government has botched us every

step of the way and the fact that we are in our third year and they are mishandling everything and putting blinders on in terms of science, it is hard to follow anyone when you have a bandanna over your face. very difficult. you can't see. rochelle walensky needs to resign, anthony fauci needs to resign, or he needs to be fired. kids are being held hostage with these masks. it does not make sense that you're going to open up entire states and go mask freak, but you cannot, in schools, where we have seen science demonstrating not only our kids poor vectors for the virus. they are not catching it the way adults are. they are not being hospitalized at the same rates and even less so now. but john hopkins had an extensive study which we have talked about over and over again recently that the mandates, the lockdowns, the masking, it has not worked. it has not done what it intended to do which was reduce

mortality. you have to list all of the mask mandates and if you have people in schools whether they are teachers or administrators, faculty, students, they can wear n95 masks. that is where we are at in the pandemic. if you feel you are at risk of getting sick, mask yourself and do which you can to make yourself safe. >> emily: harris, one of the democrats hypocrites, is holding her ground. she is being apologized for being mask lists but kid should be wearing masks. we will get your thoughts on the other side. >> i went to read to kids for an african american read and date. i followed protocols and told to get them a mask off because i was reading to kids listening remotely and we were socially distance. kids are socially distance for me. the excitement after i finish because it was so fun, i took a picture. that was a mistake.

protocols matter and protecting your kids is most important. undermining that was a mistake and i apologize. >> harris: what was a mistake? now we know there were several pictures. you can see the mantras there. this is unfortunate because she is in the political landscape for democrats. distancing herself while reading to kids, that's one thing. she is grouped in lots of photos where she has with other folks masked up. either masks work or they don't. in some states, the little ones are the only ones continuing to be masked up. why wouldn't she want to protect them and follow the rules? it is mind-boggling and it is more than one mistake. it happened several times. i want to hit something that ari said because i think there's a bigger issue we need to pay attention to. dr. walensky today did in fact

say that local municipalities at the local level, governors, whoever, can make decisions based on vaccination rates in their states and the number of cases. whether or not people should have those mandates, whatever they are, in place. she says we continue to do that which means it has always been. why did president biden go after governors that looked at their states -- i remember when florida had the lowest number of cases. last summer. you lived there. why was biden going after those governors on mandates and things and wanting several states to put mandates in schools and now, he is starting to say that we were following cdc guidelines. if the states can follow their own guidelines based on facts rates and the number of cases, why can't the white house? they listen to the parents. that's i'm going to guess happened.

there listening to the constituents. the numbers have come down. they are undeniably lower in new jersey. this time, they did not hang a flatten the curve sign at our taxpayer expense in my little town. we know the numbers are down. does biden get a pass for that after going after these governors? speech of the courts and with the whole time. the argument in so many of these states said that this is constitutionally a matter of local and state authority because it was not assigned specifically to the federal government. that is why they supported all of the things that the local republican officials were putting forth. now it seems that memory is short and the issue to this point is science. i'm going to interrupt myself to say that if that was the case, why did states like virginia passed a law that said it we will follow the cdc guidelines. whatever the cdc's as for our schools. somewhere in the entire translation, the federal government browbeat these states

into thinking that they had no power. the ones that resisted and the ones that you were the ones that succeeded. >> harris: they were trusting the science. there were trusting the cdc to not be political. not the constantly show us sausage making which only benefited politics. i'm fine with it being fluid, but if the only thing that fluidity gets you is a change in messaging to some political end, i am not in favor of it. >> emily: i heard you make the point last hour and it occurred to me as i'm in my office, i emailed the producers and said we need to find the sound bite because harris made an excellent point. >> harris: thank you. >> emily: about the way that governor desantis was treated. this is how will biden used to talk about the governors. >> president biden: masks make a difference. the last thing we need is a neanderthal thinking that everything is fine so take off your mask. forget it. it still matters. >> emily: neanderthal thinking. as governor phil murphy who happens to have a d behind his

name for a democrat? as he a neanderthal? this is so blatantly political from our president not following the science. ireland, u.k., denmark, they never mask their children. we did contrary to science. they wrote in "the wall street journal" where they looked at 90,000 cases and they found not a single case of student transmission to teachers. why are we masking our children? two words. teachers union. that's the only reason president biden will not say unmask our children. it is so political and there will be consequent as in november. >> emily: despite the actual science, remember the teachers walk out where they struck in chicago. kids were not remote learning heard they were not learning. >> harris: did you see what the mayor said today question work lori lightfoot question what she's blaming the high number of carjackings on remote

the freedom convoy. a group of canadian truckers protesting the country's vaccine mandate. yesterday, the group balked the ambassador bridge, the busiest north american border crossing. here in the u.s., the media's coverage has been totally one-sided. >> i know it sounds familiar. a threat to democracy, and insurrection, sedation. we've heard them called nationwide insurrection. >> it is being called and insurrection by son paralyzing the canadian capital. >> those with the freedom convoy say that they are staying put. >> it is a cult. >> yes, it is. >> kayleigh: total demonization of these freedom fighters. meanwhile, justin trudeau has denounced the protest but some of them spoke with fox news digital and they do not appreciate being cast as villains. >> it is disgusting for any leader of a country to vilify people for exercising their

think they're going to do. do they think they are going to arrest, prosecute, and jail every single trucker? we have been talking about supply chain crisis that we have here in the united states and obviously north america. it is a global problem. what you need for the supply chain to function? you need truckers. they are showing us right now how necessary they are. we need more truckers. we need more people to gravitate toward the profession so we can get our stuff. you are not going to force people who spend most of their time alone, especially these long-haul carrier, you are not going to force him to get a vaccine if they have already been sick, if the virus is weaning, and if they are expressing their medical freedoms. the hot truckers with the good beards, we definitely stand with you fellas. >> harris: today in the united states, not canada, is national pizza day.

do that your fellow citizens. i do not support blocking traffic and interfering with the mobility of other people which includes they are giving health care in carrying out the things they need in life to be on time for. i oppose it whether it is occupy wall street or a group i'm sympathetic to work. go to goals with bad tactics. i think you alienate more people by doing this. it's fun to watch on tv and to have sympathy for a group you believe in, but these tactics backfire. i do not like them being done by anybody. staff the streets and do not shutdown the rights of other people to go where they need to go. >> kayleigh: if i look at the tactics of the police there and the government in ottawa, they are out and anyone attempting to bring support like gas to these demonstrators could be subject to arrest for giving them gas to keep their trucks and stay warm. >> emily: they are enforcing draconian laws coming out of the government sparked by a prime minister that has spun the

narrative as racist imagery. i respectfully disagree with ari and that they are protesting the only way they know how and they are protesting for liberty and the public health sector. i've to make a final point. it is not about government overreach, it's also about big tech. americans, we've a constitutionally protected right to donate money wherever we want politically because if you stymied that, it's political censorship and unconstitutional. clarence thomas warned against that last year when he said apparently a handful of big tech executives can remove a president from the public square digitally and that is what is happening here with truckers. i do not want to remove any support or the highlights from the millions of people supporting them. $10 million of donation that support these guys advocating for their own liberty. unfortunately, in stark contrast with their government is doing which is quashing them at every level. >> ari: they should get those

contributions, but they do not have the right to block traffic and interfere with others. protest all they want, but do not interfere with other people's right to a normal life. >> kayleigh: and police blocking supplies to get to them is stunning. i'm glad i live in the u.s. and not canada. g.o.p. leaders calling out the department of justice for going easy on a black lives matter protest or after he pled guilty to arson. why he is only spending half of the maximum sentence behind bars.

account of arson during the george led protests in minnesota. instead of getting up to 25 years behind bars, he got half of that even though at 30 years old, a dad died during that arson attacks. he was tragically killed when the pawn shop went up in flames. as we said, he has quite the wrong lap she did on my rap sheet. criminal convictions including burglary, domestic assault, and theft. he was under a criminal sentence at the time of the 2020 arson. i'm going to come to you first, emily, and lean on your legal acumen for where we should be in the case. there's outcry that he only got half of the sentence. talk about what he faced in what he got. >> emily: the maximum sentence guidelines were 20 years and federal prosecutors thought 12. so many people were so upset because the system works because

every player in the system represent the different function. you want the advocate for the defendant, the advocate for reducing the sentence, to be the public defender. you do not want the prosecutor to say, i'm quoting from the brief, "because the protests were mostly peaceful, that is one thing that you go in his favor." the reason the felony murder rule sets is because when someone engages in an on controllable felony like arson, it accounts for the fact that someone may die. this guy saying i did not mean to does not matter. when the federal prosecutors at up to count because he was under criminal sentencing for assault and three points for this, i don't care. the guidelines after all of that was 10-20 years and they only gave 12. they gave in the brief and generously said he maintains that he checked the building for lighting on fire to make sure no one was there. what i saw on video was this guy saying f this place were going to burn it down. those are not the words of

someone who's checked the building for a 30-year-old father who died in the blaze. this is an abomination of that federal prosecutor. >> harris: i want to bring this in. senate minority leader mitch mcconnell has said that he is putting on hold them on the mic nominee for u.s. attorney on minnesota. let's watch. >> i placed a hold on an attorney for minnesota because the person acting in that job recommended a soft sentence below the maximum guideline to a confected fatal arsonist be taking place in a political right at the time. >> harris: this is rising to capitol hill with mitch mcconnell. >> ari: i would like to go beyond this. i would really like to see a long, strong breakdown of all of the arsonists, all the looters, all of the riders from the

summer of 2020 and what they got. how many das went easy on them because they thought it was a righteous cause and therefore, because there was a peaceful protest somewhere else in the city, you are entitled to loot and entitled to burn and entitled to riot. no. and i'd like to see that compared to january 6th convictions brought there. the public should hear whether or not justice was fair. if you broke the law, the book should be thrown at you. especially when you break the law for violence, rioting, looting, arson. i don't think we have had a full and fair account of what happened in the summer of 2024 sentences. a lot of local das and state why das and das have gone easy because we've seen across so many municipalities, they want to go easy. i would like to see accounts for

all of those involved in the numerous attacks. it was the first or the second greatest amount of damage to the united states in history for civil disturbances. the only one that could've possibly been greater was the los angeles riots. 150 federal buildings, government buildings, were attacked. it was not just the precinct and minneapolis. >> emily: we do have an account from portland where there were 96 cases brought by the trump administration. 47 were prosecuted. half of them were dropped by the incoming doj. quickly, to your point about peaceful protests. that was not peaceful for oscar stewart jr. who was burned alive, a father four. he texted his mom and said i'm going to protest. they searched for eight weeks. a father three and married his high school sweetheart. not peaceful for him. it was not peaceful.

>> emily: and the sentencing of those 47 referred cases were reduced to community service and advocating for community members to vote. there was not sentencing for those referred for actual prosecution. it's a joke and a letdown of our society and criminal justice system. >> harris: you mention oregon and kennedy, your strong ties there. before i was in the l.a. riots. i was living there and i'm from portland. the u.s. marshals cannot get legal support, some of them from their own department of justice. someone who was attacked several times in portland by antifa, none of those people were arrested or charged even though they know who they are. oscar lee stewarts life matters. it should matter. the guy who set the place on fire, when you move up to that level of active arson, that is no longer a peaceful protest. that in and of itself should be a determination for equal justice under the law which we

they need more people. we know the story. part of the story is are you encouraging or at least allowing to happen, more people to be addicts because of what we have flowing across the southern border? are we sending the message that we do not care if you get hooked, we will help you stay that way. what i'm not hearing as part of the program, and maybe i'm missing it and i need to read further. i am always volunteering for that. these sites are for people to go get cleaned needles. are they also giving the methadone? are they doing things to get them off of some of these drugs? if you are only feeding the habit, what do we know about criminals? the more you love on them, the more they will hate on you. i do not want addicts to not get what they need because we are trying to place ate them. i need to read more medically, but we bring a lot of drugs into the country and there are very dangerous ones.

>> kayleigh: and what's confounding about the sights, emily, is that taxpayer dollars are going to breaking the law. the trump administration challenge the sites and the third circuit stood with the trump administration saying that although it may offer an innovative solution, local innovations may not break federal law. that makes sense as well. speak to every dollar of our tax dollars going toward this administration is a dollar wasted. number one in every sense of the word. secondly, for it administration obsessed with root cause is, you would think that they would go to the root sources of this opioid crisis. why don't they stymie the flow of drugs across the border? why don't they stymie the flow of drugs coming from china by international mail? why don't they put the drug dealers behind bars? why don't they address long-term solutions for addictions and pharmaceuticals? >> harris: tough on crime policies won't let that happen. >> emily: we are seeing a

complex issue with very clear data points that could be addressed and nipped in the bug being ignored for a performative action that the left is obsessed with to say we are going to givn crack pipes so we will stop over dosed debts. you know it stops overdoses question work stopping drugs. but in drug dealers behind bars and taking a firm stance against china and mexico. the list goes on. i've no faith in his government to do so. >> harris: vice president emily compagno. she found what kamala harris has been looking for. root causes. >> kayleigh: in one year alone and one state alone, they connected enough funds in all to kill 200 million people. that is the root cause. >> kennedy: the root cause is the drug war that has killed 500,000 people. prohibition does not work and it does not work with guns or substances. none of this drug war you does anything for people in the
