recommending masking indoors particularly in schools. they say you still have to do it. white house press secretary jen psaki was force evidence to defend the cdc yesterday. they pointed out that democrat governors are treating the agency's guidelines more like suggestions than the gold standard. >> does the cdc run the risk of becoming irrelevant in the eyes of many americans? >> i don't think the federal experts on health and medical advice should be irrelevant. >> cdc calls the shots here. not like he measures tradeoffs. the economy, mental health, people's behavior. >> we're going to listen to our doctors and medical experts. >> harris: tucker carlson calling out democrats on the about-face on mandates. >> over the course of less than a week the same people who have systematically turned america into a quarantine camp suddenly out of nowhere started calling in unison for medical freedom.

white house speech writer and "washington post" columnist himself. good to see you today. first of all, please weigh in on the suddenly among blue states. >> well, the examiner op-ed is right. 70% of americans say it is time to accept that covid is here to stay and we need to get on with our lives. they don't want to see what happened in virginia in off year election happen in all of their states come this november. so they've never been following the science. there has never been any science to back up school closures or mask mandates for children. it doesn't exist. our friend marty makary looked and found there is not a single study that shows that masks reduce covid transmission among kids. there is, however, a new u.k. study that shows that covid was never more dangerous for kids than seasonal flu even back in early 2020 during the height of

the pandemic. germany has reported that not a single healthy child in the entire country has died of covid. not one. we don't have the data here because the cdc doesn't track it. we know covid is no more dangerous to children than the seasonal flu. time to take off the masks, no science behind it. time to stop the school closures when a new variant comes along and start to learn to live with covid. >> harris: i want to catch the nuance you put in there. this is what they've been telling us all along. doctors, if your child or someone in your household as a comorbidity, is not as healthy as they could be then it has always been a concern. what germany and other countries have found that is not the case for healthy children. you just said it. a "washington post" piece now with, quote, this about democrats dumping mask mandates. this is politics, of course. the will of the voters is

important to track. but allowing the impression to set in that politics is the central driver for change and an impression hard to avoid at this point democratic leaders are undercutting their ability to respond to the pandemic moving forward and undercutting two years of rhetoric. so how could this backfire? what do they mean by that? >> first of all, it's a ridiculous claim. the reality is what's reduced the trust of the american people in the public health establishment is not the influence of politics, not that they've been listening to the voters but getting the science wrong from the very beginning. the public health establishment. this is on par with the failure of the intelligence community before the 9/11 attacks to see the attacks coming. and this has been -- that pandemic has killed far more americans than 9/11 ever did. almost a million americans have died. the health establishment wasn't ready. didn't have measures to place to deal with a pandemic when it came.

shortages of ventilators and the rest of it. for over a month, for six weeks they said it wasn't spreading because they were using the wrong -- flu surveillance model when it was spreading. they were checking for people arriving in hospital when it was spreading so they completely missed it. screwed up the testing at the beginning. cdc contaminated its own tests. they said don't wear masks up until may. they told us masks don't work, masks -- you will touch your face more and spread the virus. they said it was spreading from drop lets. go down the list. they have gotten everything wrong every step of the way. closed down our schools when kids weren't at risk. so i'm sorry the fact that now finally the democrats are responding to americans who are saying we've had enough of this and need to get on with our lives. that's not what help the credibility of the public health establishment. >> harris: the observation, we've been getting letters from schools and everything is what is coming down the pike in new

york. the new york governor says we'll get away with indoor masking but i will wait until after the february break to take a look at what is going on in the schools. they know they have all that data now. but they will take the pulse of the teachers union. speaking of which the chief of the largest teachers union said this about getting rid of masks in schools. this is interesting, watch. >> i am in favor of an off ramp on masks. the real issue becomes is the spread low enough so that there is no dissemination or transmission in schools. >> harris: the second largest union. i'll correct myself randy weingarten there looking for an off-ramp but only if it's perfect. >> no spread. i'm sorry, again, the data show that for kids under 18 and that was actually at the start of the pandemic. today anyone under 50 years old

covid is not more dangerous than the seasonal flu. do we have mask mandates for seasonal flu and shut down schools for seasonal flu? of course we don't. we have to stop treating this. for kids this is no different than seasonal flu. if anything less dangerous. we have to stop treating this like it is a pandemic anymore. the pandemic is over. covid is with us and we have the tools to deal with it. we have treatments, vaccines. things we didn't have in march 2020. we have multiple layers of defense. >> harris: my question would be for that union leader this very simple one, what are you looking for in terms of zero? in china they had one village where they got to zero and tested one person and suddenly had 98 cases and shut down a province of 4 million people. we aren't china. we won't roll like that. i don't know what the teachers union is thinking that it will look like going down. all right, down the road. let's get to this.

what the ice numbers show is pretty remarkable. in a nutshell for fiscal year 2021 ice deported the fewest people we've seen in years while at the same time we had the highest number of record setting migrant encounters down here at the southern border. now that activity is really starting to pick up once again. look at the video we shot right here yesterday in la jolla. we're once again seeing the return of these consistent family units showing up here and walking down this road to give themselves up. dozens of them each time multiple times a day. some are pregnant women. some bringing young children. a lot of nicaraguaians lately. most of those people are being released from custody because the nicaragua government won't accept them back via title 41 after a slow month in january where we're starting to see it pick up again. look at the video. we came out here last night and saw the same thing. coming day and night.

more family units. this will be problematic for border patrol. their resources supposed to be out patrolling the front lines will have to be doing this paperwork and processing all over again. plenty of other action on the border as well. look at these photos out of border patrol's el paso sector where they made a massive human smuggling bust. a big rig trailer with 132 migrants crammed inside being smuggled. the migrants from guatemala, honduras, ecuador, mexico. some were expelled via title 42. look at this out of del rio sector. in a matter of two days border patrol found two 5-year-old girls traveling alone. one from guatemala guatemala walked across the river alone. another a 5-year-old girl from honduras who arrived with three other children.

they sometimes give the president of the united states a list of who will be in the room but all of the directives and all of the trouble that he is getting himself into, i mean, what is that about, david? >> great question, harris. the problem for the president is that when voters have decided you are incompetent and taking the country in the wrong direction, there is not much you can do to get them on board. the president now looks deep into the numbers and you'll see democrats now disapprove of the job he is doing. he doesn't have a single person in his administration that can effectively promote what he is trying to do. >> harris: apparently not. 40 republican lawmakers are calling on president biden to take a cognitive test. the exact one president trump took in 2020. in a letter to the president himself the lawmakers say his quote mental decline has become more apparent over the past two years. bree, your reaction.

>> look, i don't think that -- i agree the president should probably take the cognitive test. >> harris: you do? >> president trump set the precedent before. i believe he should take it. but i believe it is also an attack on his age and mental capacity. president biden has proved numbers and numbers of times that he is ready the take the country forward and the proven track record to do it. he should take the cognitive test that president trump took but i also think as of right now it's a major attack on him on his age and mental health. >> harris: there are a lot of older people who want to run for president. all of them are at that 70 mark like hillary clinton. >> i don't think it should be attack on his age. >> harris: what do you make when you see the president, when there would seem protecting him from taking questions when we've seen him make several gaffes.
