lockdown measures that democratic aboves had. they seem to be going along, or promoting the lifting of the draconian mandates including the forced masking of children. i thought it was fascinating because they said science had changed. that was not true at all. the science never said forced masking of children was a particularly great idea in europe this was not something they did. at least for a year we have known it didn't have tangible, much of an effect on people and the costs of forced masking of children and other people were so great. really hurting learning development of so many children. what we allowed our children to go through through the pandemic without a people having a good burden of proof that such measures were worthwhile is unforgivable. howard: parents know there were social and emotional costs. harold, some fellow democrats phil murphy, frustrations by fed up parents were at least a factor in his decision in his

state yet headlines like one in oh lit co, masks off, democrats try for a mask pivot not being critical at all. it seems to me the press changed its tune. >> first of all happy sunday, happy super bowl sunday. i look at this differently. ask both of you to think about this. here we are a year later, year ago i did not get the vaccinated. i didn't get until april, i'm boosted since october. four out of five americans have one shot. three out of five americans fully vaxed. two out of five americans eligible for the booster gotten it. hospitalizations and deaths are down. vaccinations are up. i think it is only fitting that we find ourselves at this moment. i know politics, for that matter other things may perhaps more heavily politics contributes to a lot of this conversation i would remind every american that it was covid not democrats or republicans -- howard: harold, i asking you to address why the media have

suddenly shifted their emphasis just as some of your fellow democrats are saying it is time to drop the mandates? >> that is what i'm trying to answer, howie. i think the fact we made so much progress. i'm one that roots for progress. i am one rooted for president trump when he initiated "operation warp speed." i'm one who roots for presidents when we find ourselves in foreign debacles. i root for biden as it relates to the distribution, figuring out ways to insure more americans can be vaccinated. so i just look at this a little differently. maybe the media is at fault for not sharing some of these things but i think the media has been pretty tough on some of democrats who shifted their positions. montage of some may not have been. some of the press i read suggests that we should be happy where we are. those who to mollie's point, who may have done things overaggressive way they will end up having to answer those questions. we saw a governors race in virginia last year where that was indeed the case. politicians who sided one waiver

sus another will have to answer questions to be held accountable by the public and voters. howard: mollie, now the mask mandates are dropping in delaware, connecticut, california and new jersey, i'm not seeing, you know it is not like the press is saying you know what? maybe we overreacted. maybe we went too far. maybe we didn't costs on kids who were vulnerable group but took democratic moves to change that. >> again republican governors using same science harold is referencing now forced masking with not good for their can children they were accused of murdering people. now that democrat governors are realizing the political consequences changed for their covid lockdowns, the only science that changed is the political science. parents are voting against democrats who have really strict measures keeping their children out of schools, forcing their masking, not having other issues in play as well but this is all about power.

the media coverage is only making sense if you understand that so much of our corporate media exists to support and promote ideas from the democratic party and make sure that they have power. and because of the power calculus changed, democrats are starting to lose seats that is why the coverage changed. howard: president biden is standing by the cdc with a history of muddled messages, refusing to change its stance on school mask mandates. nbc's lesser holt asked him in the super bowl interview at that about the democrat governors decisions. >> are those aboves wrong? president biden: hard to say whether they're wrong. scientists say masks work, masks make a difference. it is premature. it's a tough call. howard: harold the cdc is drawing media criticism but not joe biden. >> i think joe biden is facing his share of criticism. i would remind everyone masks did work. we had over, you think we would

have had more than 930,000 deaths? i think we might have. i'm glad we did not. i'm glad we don't have to have the conversation any longer. i'm happy death rates, hospitalizations are down. i'm happy governors on the front line of their states understand what voters and children need i'm glad they're making recommendations. hopefully the recommendations are rooted in science and what is best for our kids. i have two young kids and there is no doubt being out of school and learning remote had an impact but the risk i thought i was avoiding sending them to a classroom may have not been properly ventilated, we didn't have all the understanding we do about this virus. howard: i got to move on. >> was right thing to do i hope my kids and everyone catch catch up. howard: i'm totally pro-mask, my question how long you force youngest among us to wear masks all day. news breaking last 24 hours, mollie, special counsel john durham, in an indictment former clinton lawyer michael sussman

the clinton campaign that funded the operation, received some of information, weaponized it with the doj, department of justice. the media spent years lying and claiming that donald trump had stolen the 2016 election by colluding with russia. those lies caused so much damage to the country this is so much bigger than watergate. other than you mentioning it here, fox news covered it this weekend a few other sensible media organizations covered it. it is not getting any coverage. daily trip of crazy you russia stories. howard: point i want to put to harold. related to indictment. sussman pleaded not guilty. other than a handful of outlets not seeing anything whatsoever. how is this not news, harold? >> which think it should be news, howard. i wouldn't go as far as mollie but her point should be taken seriously all-out let's. i'm believer in the rule of law. everything flows from the constitution.

cover every little development involving january 6th, but when mitch mcconnell takes on trump and calls it insurrection and rips the rnc over kinzinger and cheney that seems like a pretty good story. >> why so many republican voters were disappointed in mitch mcconnell because he accepted the media lie about this rnc censure. most republican voters would like republicans to site much more vociferously against some of nancy pelosi's attacks on republicans and how liz cheney and adam kinzinger helped that they lied and said this resolution said that rioting wag legitimate political discourse. that is a lie. they never said that they did critique the january 6th committee protecting first amendment activities. the media coverage of this committee has not been good. it has not been honest about this committee seized records of peaceful people, their phone records, their bank records,

their texts. these are people who committed no crime, are not even accused of committing a crime but are political opponents of people on the committee. that mitch mcconnell supported media lies speaks to why he is the least popular politician in america even lower than biden and kamala harris because people in the republican party want people who fight the media misinformation and lies that they're subjected to. not join with it, amplify it, give people an excuse to cover it more. howard: harold, that phrase, legitimate political discourse, "washington post" said it was added to the mid draft in middle of night. no one is sure who put it in. that set off media and republicans hard to entirely blame this on the press if you have top republicans objecting to that particular phrase in the resolution. >> i think without question, i think even when you add to that how i think the former vice president even came out and had some fairly strong remarks

at "the federalist" society around some of these issues. i think democrats should show some restraint here. the current infighting within the gop, we have a little current infighting in our own party. tension, conflict between moderates and progressives as we know. the real issue is dispute you nailed it, honed down on, dispute between mr. mcconnell and former president trump. i would agree with mollie republicans are better and politic is better talking about future, talking about policy, not just fighting media but perhaps that is part of it. you have to lay out a set of ideas. the real group you have to win over is independent voters. polling data coming days, coming weeks, eight months out, more than that looks like republicans have an ad dang. republicans democrats who can address covid, ukraine, crime, rising cost of everything from sausage to semiconductors that is the party that is going to win. if it comes down to whether or

not january 6th happened or not i think it probably favors democrats. howard: mollie, donald trump who calls mitch old crow among other things, said senate republican does not speak for the republican party, does not represent the views of the vast majority of voters. whether you like senator mcconnell or not though, does it seem the press is right that this internal low level warfare over january 6th, the committee and all that, has now spilled over into public view and is now in itself becoming a major issue that could affect the political environment this year? >> right. this is standard operating procedure for the media and other democrats. they love republicans who attack the broad republican voter and broad republican party. when you look at this situation of how the democrats and other media and other democrats are weapon is intoing the january 6th commission to attack their political opponents rather than deal with any of those issues harold mentions might be much of to the american people that is what republican

i'm not looking to shift the blame. joining us from dallas, steve crack care who writes a newsletter on the press. steve, seems to me sarah palin has a high political bar, she is beating "the new york times" in the court of public opinion? >> that is absolutely right. i think the fact that they even, this even went to trial shows that it cleared some level of legal hurdle, these cases do not normally. these public figures suing for defamation, libel, slander. that is what we're hearing. this sausage making she is exposing, what is happening at "the new york times" is fascinating. i will say, i you say it us deliberating right now. i think she is unlikely to win. there is still a chance. her lawyer said she will take a dollar as her damages. it is not about the money. i think this is exposing that i still think that public figures suing media outlets is a high standard and it is for a good reason. i worry about these kind of cases what might happen, the slippery slope. i don't want to see public

figures suing media outlets from fox to "the new york times." i think that sets bad precedent. what we need defamation, for things like nick sandmann who is not a public figure. who really was damaged by sloppy smears from the media not so much sarah palin. although it is making clear there is a real sloppiness happening at "the new york times." howard: it is of course a 1964 supreme court precedent that sets the bar so high with malice and recklessness. james bennett was fired by "the times" newsroom revolt about the tom cotton op-ed, saying to his credit i inserted mistakes into the editorial falsely accused sarah palin inspiring shooting in arizona that inspired six people and. bennett should have known at time because it was debunked six years earlier. >> the line, political incitement, the line was clear,

obviously was not clear. as you point out proven long before this. that is one of the most fast mating elements. talk about misinformation later in the show. talk about misinformation earlier. this is the kind of example of misinformation in on the left that becomes conventional wisdom. the person who shot gabby giffords was obviously inspired by pail sarah palin, inspired by politics at all not true whatsoever. this idea become as story. howard: "the times" said it was a bad mistake. we corrected it online next day. bennett admitted didn't do any research on his own or wait for the editorial writer to see the changes. what is the level of damage here to "the new york times"? >> i think it exposes the way these things operate. to be honest, the whole story is fascinating. james bennett was clearly the most wrong in this but the idea, the connection was already made in the editorial before even got his hands on it. this story absolutely nothing to

of the "n" word is another january 6th moment. here he is on the podcast characterizing the media in general as cnn in particular. >> if you're in business and your business is the news and you want to get more people to pay attention you should be honest and my thoughts for cnn, my advice to them. i don't hate cnn i used to go to them every day for the news until they started [bleep]ing on me. if you want to do better, [bleep] change your model. howard: rogan says people are drawn to his regular guy schtick that the media in his view are phony and lack credibility. >> yeah. when you use the word phony the first thing i think about is don lemon on cnn because watching cnn and their outcry over jeff zucker's resignation is having to me. loyalty comes up. one thing i hate is fake people. my rule of thumb. i am not fake. i tell it like it is.

i am honest to everyone as i possibly can be. you remember back in the day when chris cuomo and don lemon used to have the love-fests at every single show, it turned into a pod cost, love your brother, he had his back. no matter what chris cuomo did, whether right or wrong, obviously it was wrong, don lemon coming out being overheard on tape basically telling ceo of disney should not pay chris cuomo out, what kind of example says to everyone else, basically putting down his former buddy, interesting to see the loyalty. also interesting to see jeff zucker, i know the guy. he is a good guy. he is great at what he does. he is also very loyal. however it is interesting loyalty tends to break down when it doesn't suit you. that is another major pet peeve of mine people who lack loyalty when it doesn't suit them during the height of pandemic, that loyalty, was great. andrew cuomo and chris cuomo were getting great ratings.

howard: since you brought up the ouster of jeff zucker, so many cnn anchors have been emotional on air on town hall meetings punishment didn't fit the crime. he should have never been dumped disclosing relationship with a top deputy but not open to any criticism of how zucker handled himself. >> right. so jeff zucker was an advisor to andrew cuomo throughout the entire pandemic. howard: we don't know that for a fact. we don't know that for a fact. that has been alleged. >> i have sources, very, very clear sources that say that the cuomos and cnn were close, okay? there were discussions behind the scenes on how to handle these media conferences. the press conferences andrew cuomo was holding on a daily basis, who do you think he was getting advice on? those were news conferences. he is not in the news business. obviously getting it from his brother but his brother was getting blessing from cnn it worked. it was fine. until a bunch of elderly people started dying in nursing homes.

anymore. i said, is this a joke or what? this is not a suspension, this is a firing? he says yes. did you listen to the show. he said, i listened to some of it. and i said, that is just not fair at all. howard: you did get beat up on twitter, including some death threats? >> yeah. yeah. i didn't know i was such a bad person. i mean, one guy said, fing kill yourself. then i said, dude, let's back up on this thing a little bit. i coach my high school's girls golf team. i love the lpga. i like tennis. i like, women's volleyball, women's tennis and i said you don't have a right to say that about me. and he basically came back with, f-u, f, your wife, you are the scum of the earth. howard: that has to make you feel good.

the meat went on on twitter was total fabrication. i said it. through omission the point didn't get across. howard: you tweeted whoopie got suspended for two weeks about comments on the holocaust. do you see yourself now as a victim of cancel culture? >> absolutely. it is basically, trying to defend yourself about something that is totally untrue. and, you know, i didn't think there was even any suspension in order let alone a firing. i was, i'm still flabbergasted to this day. you know, it has only been four or five days. i lost four or five pounds not a good day to go on a diet, anyway i got canceled but i know it was parkly that i'm not a staunch conservative but i am a conservative. it is on my bio. my tweets are on there. i saw what they did. i saw how it went ballistic. but the fact is that they made me into something that i'm not. i don't even dislike the wnba.
