from us. >> harris, thank you for having me. look, we're at the second act of a multi-act play and the last act hasn't been written yet. yesterday was the first act. the act where putin sent his forces into the republics in the eastern part of ukraine and took them over. the second act was today when the president of the united states finally said this was an invasion. remember, until this morning we did not call it an invasion. it was an incursion. the next step will be over to putin. now we're heading up the escalation ladder. it will be very concerning and we better have a good team in place and thinking through where this is going to end because if putin believes that he can continue to escalate and that means we're looking at probably a major invasion of the rest of ukraine with everything that comes with it. he believes he can the sanctions won't hurt him at all and built up a huge cash reserve. and when you look at what is happening with nato, they talk
8:07 am
about well, especially the european union. they talk about well, they've canceled or set aside the nord stream 2 pipeline. there are still pipelines coming into europe. the northern pipeline still feeds germany and baltic pipeline feeds the baltic. they haven't shut down any gas coming into europe. they haven't turned on the spigot to the newest pipeline. nothing has changed in europe economically. when we start moving forces and sanctions, if he believes he can evade it and it is not going to bother him he may take this to the next level. the next act. this thing is not done. we're in the very early stages of this. >> harris: i haven't heard us take an act yet. the acts have been by putin. i wrote them down. did i miss something? >> nope. no, you're right. we haven't. that's the reason why i will be interested to listen to the president today at 2:00. what is he going to say and has he brought the alliance with

invasion. internationally that means another nation invaded another sovereign nation and taking land by military force. we are there. the brits said it last night it was an invasion. this takes you to another level. when we've said we won't stand for -- we're okay with an incursion, what will we do about an invasion? if putin believes we won't do very much or only sanctions it will be the next act. he may go for a much larger use of force into ukraine. he really wants ukraine. he said that last night when you listened to his rather amazing rambling speech and what he said even six months ago when he wrote an article and spoke about that. he is very determined to bring ukraine back into the russian hold. >> harris: what we did learn from his speaking and ram blinks through translation he had a conversation with bill clinton at one point as president when he told him that well, would you consider russia? he said i asked would you

i was shocked and disturbed and as i began to look into seeing whether or not the executive team of the d.a. knew about it. it seemed clear that nobody knew about the contents of the jail call. the content of the jail calls was something we did not know about. >> harris: an advisor to los angeles district attorney george gascon denying reports his office knew anything about the damaging jail house recordings which actually prompted the d.a. gascon to reverse his position on a controversial case. gascon had said he had only heard of the tapes last week when the fox reporter reached out about them. the prosecutors told the "l. a. times" the office knew of the recording for several weeks.

the times reports gascon changed his tune on the plea deal only when he learned fox news would push play on that audio. chief correspondent jonathan hunt reporting in l.a. now. jonathan. >> the question here is what did the d.a. know and when did he know it? it is important to point out that no one has alleged george gascon or anyone else in his office had heard the tapes before the d.a. decided to try the hannah tubbs case in juvenile court. at least one prosecutor in his office said some of the top aides were aware of the tapes at the end of january around the time of the sentencing hearing. that prosecutor also infers that the d.a. only admitted he was wrong in the hannah tubbs case and only said he would shift policies on some particularly disturbing juvenile cases after fox news

said we would air types like this where tubbs in a conversation with his father mocks the fact that under gascon's policies he would not have to register as a sex offender. >> don't worry about it. i'll plead guilty. they will put me on probation and it will be dropped and done, done. i won't have to register or doing nothing. >> for an offender you don't have to register? what will they do to you then? >> nothing. >> we told the d.a.'s office last thursday we would be airing those tapes. he says that's the first he heard of them. one day later on friday, without mentioning the tapes, gascon announced he would change his approach to some juvenile cases and yesterday told the "l. a. times" referring to tubbs if i had to do it all over again, she would be prosecuted in adult court. gascon, of course, is facing a

second recall effort. the first failed to get even half the required signatures to trigger a recall election but the renewed effort, harris is far better funded and has the vocal backing of many current and former law enforcement officials. >> harris: it will get interesting. i capitulateed on this one. thank you. raymond arroyo fox news contributor and attorney in "focus" now. your initial reaction to the flip-flop by this d.a. >> my initial reaction is let's look at the case. this man, tubbs, who transitioned and now says he is a female, he used his self-identity as well as his age to get a lesser sentence because gascon had already laid out an agenda where he would give these perps a lower sentence. this has been his pattern as d.a. this 17-year-old tubbs assaulted a 10-year-old in a denny's, harris. this person had battery, drug

possession, a list of other crimes. your self-identity should in no way affect justice and the way the criminal justice system deals with you. that's what happened in this case. george gascon is why he is trying to course correct. they're about to throw him out of office in another recall attempt. >> harris: thank you for breaking it down. i want to get to this. hunter biden's ex girlfriend spilling it to a grand jooury saying she was told to withdraw thousands of dollars by him from an atm and they partied at lavish hotels from coast to coast while hunter biden was using drugs like crazy. that's according to a report in the "new york post," which says her five-hour testimony stems from a federal investigation into whether hunter biden committed tax fraud. they are pushing hard against the president's son now. what are they finding? >> they are looking into his business dealings in china. whether he paid all the taxes.

the rosemount, seneca and consulting group he used as a front for a lot of outreaches. watching the grand jury, the string of ex girlfriends going to the grand jury looks like an episode of morey povich. they is a lingerie designer who goes by weed slut 420. this was after a stripper who he fathered a child while dating the widow of his dead brother. look, hunter biden very sadly is a lost soul who obviously strung out on drugs. the question is did he use his name to gain influence abroad and to gather money for not only himself but the rest of the biden family. that laptop will come back to haunt not only he but the president as well.

we'll see. >> harris: where we are with china and russians now the connections he may have given access to anybody he put himself into bribe able situations based on his behavior. we've gotten into that before. thank you very much. before i leave i want to tell you coming up at 1:00 p.m. eastern the president moved up his update on the ukraine crisis by an hour. president biden at 1:00 p.m. eastern.
