ukrainians are fleeing the country trip. we are scared. we left everything and just run away. >> ukraine's president accusing russia of committing war crimes for at attack on helpless civilians. >> war crime attacking your neighbors. that's exactly what the united states prosecuted at the end of world war ii and he should be prosecuted for that ♪ >> we begin this morning with a fox news alert. annual apparent assassination attempt in ukraine's second largest city as a missile strikes a government building in kharkiv. ukraine now under assault from multiple directions as russian forces are closing in now on kyiv, the capital. >> brian: at this hour a 40-mile long russian convoy just outside the capital city of kyiv. day six of fighting is underway as ukrainians battle for their lives and their freedom against the russian invasion. 9 word coming as president biden is set to deliver the first

state of the union address of his four-year term. >> steve: the president facing multiple crises at home record inflation, border disaster and approval rating has been plummeting. we will have more on the state of the union coming up. but, first, let's go to mike tobin who is live on the ground in lviv, mike, as we look at that strike on that government building, that looks like -- i know it's been depicted as an assassination attempt, that's one of those decapitation moves. >> it certainly looks like it was a precise weapon that went in there. if you look really close, you can actually see the projectile enter before the big explosion. so it does look like it was aimed. one source says it was an attempt to get rid of the local leadership as it hit the regional administration building. no word on casualties from that particular strike but you have a lot of casualties in the town of kharkiv where that strike was. and that is because the town was

subject to indiscriminate rock fighter throughout the day. also indiscriminate a cluster bomb which is alleged to have been used in kharkiv. what a cluster bomb is a bomb that releases high in the sky and releases a bunch of little bomblets, it can spread over the area as large as a football field. considered illegal by most nations to use in warfare simply because you can't aim all the bomblets. you can hit the civilian population, particularly if you use in an urban area. you are going to get. bomblets don't all explode. they can explode with years to come with unintended target. west of kharkiv where you saw that oterka the town military base reports of a direct hit with artillery on that military base resulting somewhere around 70 dead ukrainian soldiers according to the information we're getting out there now. to the far south, kherson, there is a battle underway and appears a target is a bridge that

stretches over dnieper river. of course all eyes today on this 40-mile long convoy of russian personnel, supplies, and armament moving south from the border with la reduce. we don't have a lot of updated information on this convoy, the latest information talks about the size of it and also the satellite imagery says there is supplemental helicopters and infantry in the north across the belarus border. guys, back to you. >> brian: can i ask you, mike? if i just asked you just about lviv, what type of damage been done so far to that city. how populated is it compared to when it was before this war started and how many just have walked? >> as far as the population, the population is much thicker than it was before the war started

because so much of the traffic has come west. the attacks are going in from the knot, the south and the east and that drives all the refugees west. this is a depot before you get to the border. the train station here is just packed with people trying to get out. it's absolute chaos at the train station here. as far as strikes around lviv, there have been strikes to the north and south on the outskirts of the city. we haven't heard the air raid sirens for a little while and we are grateful for that. >> steve: absolutely. you know, mike, what we have seen overnight, you talk about the cluster bomb, there are also reports apparently vacuum bomb were used. those are both war crimes. at what point does the international criminal court start to look into and say hey, russia, you are breaking all the rules and somebody needs to stop it. >> mike: what can they do? if you can't stop putin from invading a sovereign nation. particularly you talk about the vacuum boments that would have been in the area of car chief

day. we are, the united states, actually subsidizing part of that because we continue to buy oil from russia. now russia knows we are turning the screws and i'm sure the president is going to talk more about that tonight as well. what he is expected to do, mr. putin is, he is expected to ask china to buy close to $100 billion worth of chinese assets in russia to raise the cash to keep the war and the economy running. now, as you look at that government building in ukraine that took the direct hit, there is one bit of really good news today and that ukrainian pilots have arrived in the country of poland, 70 jets have been donated from european countries and they are flying them back to ukraine, which is great. they are older russian made planes, there are 28, making 29 ss from poland. 12 from slovakia and 30 planes

the ambassador to ukraine stood up and read final text messages between a russian fighter, a russian soldier in ukraine, mom thought that her son was being trained in crimea. instead he was fighting in ukraine. this was their text exchange just before he died. >> i would like to read from the screen shot of the smart phone of a killed russian soldier. >> why has it been so long since you responded? >> are you really entering into training. >> that's the mother of the killed soldier. >> moments before he was killed. >> mom that i'm in ukraine. there is a real war raging here. >> i'm afraid would he be

bombing all of the cities together. even -- even targeting civilians. we were told that they would welcome us and they are falling under our armored vehicles, throwing themselves under the wheels and not allowing us to pass. they call us fascists. momma, this is so hard. this is several moments before he was killed. >> steve: that's just heart-breaking. and so much of what he said are things that have been reporting over the last six days. and that is, you know, putin completely under estimated the ukrainian resistance. he also overestimated their reaction he thought when the russian tanks rolled into ukraine where have you been so

long? come on in. we can hardly wait and get rid of this government that didn't happen. >> ainsley: did he think that or telling the soldiers? >> steve: that's a great question. absolutely. he under estimated the app. tight that his own russian people have for protest. it's edge bare wassing for him the thousands of russians are taking to the streets protesting. then again, they're also freaking out of the russians are trying to get their cash out of atms, the big worry if you are an average russian right now is that vladimir putin is going to turn your country into north korea or iran and be completely ostracized from the whole planet. now, with marco rubio, you know, he is privy to intel briefings. he can't tell us most of this stuff there have been members of congress who have discussed what is publicly known, so this is according to the intel community where the state of the war is right now.

the russian forces have behind schedule, we knew that the ukrainian resistance is fierce and that is because of russian equipment failures we know that 75% of the russian forces are inside the country of ukraine, here's the important part. they expect a second overwhelming wave of attacks to start very soon and expect shear numbers of russians to flatten the resistance. it appears with that 40-mile convoy north of kyiv, that you can see right there, with those tanks and armored vehicles, the plan is to circle the city, to shell the city, and then the troops will move in and they will fight street to street against the ukrainians. >> brian: they only have a week's left of javelin and stinger missiles. unless we can get them rapidly, these people are going to be gradually choked off and wiped out. the question we have to ask ourselves is we just going to

let that happen and say wow, isn't vladimir putin crazy? aren't the russians relentless and ruthless? then ukraine becomes a war zone. signed application to join the european union. whose aspiration even though their government was far from perfect and probably didn't hit all the criteria was to join nato who, when asked from the mom, the 60-year-old mom to the 16-year-old kid their aspirations were to be part of of europe not to be part of repressive russia. even russians don't want to be part of russia. we will have to sit there and watch. and as much as we are beginning to move now and how heartening it is to see europe act the way they are and canada to shut up. refuse all russian oil while we sit on the sidelines and think about it? when we watch germany finally get involved. you wonder how much more prepared they would have been had we acted over the last two years when they took the donbas region in 2014 and they took

crimea in the same year. the missiles they have right now and the anti-tank weapons are from the trump administration. they were getting for the most part small arms that were initially targeted for afghanistan. but we pulled out and turned it over to taliban so we no longer wanted to give them. plus, the afghanistan had most of our arm. s because we left them behind. so we are rushing now to do something we should have been doing the last four years. >> ainsley: people are asking why don't they send them nor javelin missiles put them on carriers. blow them up so they can't get into the city of kyiv. where zelenskyy is allegedly hiding out. he keeps phoning in to the eu last thursday. he phoned in and said it might be the last time you hear my voice. they are coming to assassinate me. he is asking eu. he is saying that takes years. they rejected that plea. we know that the kremlin is sending in 400 men that are part of this group, the wagner group that are now in africa.

they are being sent to kyiv now to go and find zelenskyy. assassinate him. assassinate the cabinet and mayor of kyiv who is that boxing champion and his brother. they are all on the list. we heard that call of that young man or that text message to his mom and he is saying we are targeting civilians. well, yesterday there was a video going around that is really hard to watch. especially for me because i have a 6-year-old. a 6-year-old little girl in unicorn pajamas being rushed into the emergency room. she was the target of one of these russian missiles that flew into her apartment building or wherever and she was in cardiac arrest and her mother was crying and even the doctors and the nurses were crying. one nurse had to put her head down and the doctor looks at the cameraened assessor the phone or whoever is recording it says putin you did this. did you this to the 6-year-old child. i want you to see this video. >> brian: kharkiv. question is gradually suffocated and gradually wiped out. to say do what you are saying,

ainsley, would be really to start world war iii and vladimir putin couldn't care less, it seems. he will probably be safe. but, if you bomb that convoy in ukraine of all russians as poland, then you are starting war between poland and russia. then we go to poland's aid. >> then you are talking about world war iii. >> ainsley: ukrainian soldiers get those in poland. >> brian: ukrainians can do whatever we want. if we bomb nato gets involved then it's world war. it literally is world war iii. it's amazing. we are the civilized people. we don't wanted world war iii. the guy perpetrating all the carnage death and destruction doesn't really care about that. >> steve: that is why it is so complicated. and that's why it is so heart breaking. the president will tonight and you will see his state of the union address live on fox at 9:00 p.m. eastern time. he will talk about inflation. he will be pushing build back

inflation. what are you going to be looking for. >> look, what is he going to do is he is going to try to take a victory lap very undeservedly. is he going to do what he did with afghanistan is try to paint the world as though there were no other alternatives other than what occurred. everything else it was inevitable action that these things happen in the globe. ukraine, inflation, border, afghanistan, these things had happened. what i would like to see out of him is real, real solutions to what's going won supply chains and inflation here domestically. you know, look at the fuel tax, the 18 cents per gallon the 14 cents cents per gallon diesel. look at the excise tax on truckers. help relieve the labor issues going on. look at the fact that the fed is still literally printing money in the midst of the greatest inflation. there are so many things that can be done to help alleviate this pain on the american people. the self-inflicted wound. >> brian: real quick.

putin. here is my two take aways from that first of all, i'm surprised and i think vladimir putin is surprised, not just at the resolve and the fighting spirit of the ukrainian people but of their desire to look west. you know, student of history, enjoy reading about history, the history of ukraine, which technically by the way means border land is focused east. intrickly tied to russia and the soviet union. culturally linguistically, politically, militarily, it's a little surprising to me that i see athletes across the world. ukrainian athletes, soccer players, mma fighters, politicians zelenskyy, be so interested in looking west. until can you consider the economic implications and there is a lot of economic implications including a lot of oil and gas off the coast of crimea, which they want to be able to sell to the eu, which is a threat to putin. that's my second point. if you are vladimir putin and you are looking at this. it's not just about nato. it's about the eu.

needs to travel. we don't have a lot of new information about it we know it has to go through a point that could slow it down. we know through the satellite imagery that additional helicopters, tact helicopters and infantry have come into the north of the belarus border to supplement the russian forces that are in that area. further east, a town of kharkiv. remarkable video missile makes a direct strike on regional municipal administrative building there. one source says it was an attempt to get rid of local leaders. will no word on casualty but the visuals of the destruction plain to see. we do know that there were many civilian casualties in the town of kharkiv as it was subject to relentless and indiscriminate bombing. just west of that location. owe term and condition can a name of the town the information coming out as many as 70

ukrainian soldiers killed because of that artillery. further south keeping a close eye on the town russian forlingses are fortified with the mainland where they could move north. back to you. >> steve: mike, before you go, i was reading this morning in some of the reporting going on over there that apparently to reduce their losses, this speaks to the fact of how effective the ukrainian resistance has been, but apparently russia is going to be shifting to nighttime operations to reduce their losses because they have not gained control of the airspace. have you seen any evidence of that so far where you are in lviv out in the western part of the country? >> we haven't seen any street-to-street come bat in lviv. there have been strikes on the outskirts.

lviv has not been subject to so much of that combat on the ground. in terms of what you are talking about combat at night, fighting always gets worse at night. and if you have more technologically advanced army. the nighttime is going to be their friend because it provides cover. >> brian: mike, the other thing is the russians for the most part, unless they borrowed them from afghanis because we left so many behind, the only the elite forces have the night vision glasses. so you are fighting at night without the advantage that our forces have, right? >> i don't know the extent to which the ukrainians have night vision, brian. >> ainsley: mike, i'm looking at the map here first it was crimea. then they moved into the donbas region. then they are moving into kharkiv. now we know they are heading into kyiv. they already took over chernobyl. you are west of that are the folks there on the ground worried that the russians are going to start coming your way?

>> they are very worried about that. and there is a terrific resolve among the people out here. there is an underground, that is boiling up. what they're doing now trying to supply the fighting forces where the fighting is more intense. they are doing things like make camouflage neglect to hide the weaponry. making molotov cocktails and shipping it off to kyiv. everybody here is in it. there is a tremendous resolve. they say it's much different than 2014 when the russians were able to take crimea. really unopposed. with no consequence. they say this time it's different losing a piece of the homeland. they are losing their homeland and they say this time around they do have better weaponry. >> steve: mike, are you of the opinion, with what have you talked to with people there in lviv, that what the russians are trying to do trying to come in. trying not to blow up as many buildings as they possibly can because they want the people to be on their side when this is all over. >> well, it seems a miscalculation on the part at

exports. >> putin has taken a lot of body blows. but now is the time to punch him in the face. >> peter: we expect to hear a lot about foreign policy this evening. we don't expect to hear that. >> sanctioning energy would effect russia's income stream, certainly that would be a reason to do it, but it would also have extreme consequences on the world energy markets particularly for our allies in europe. >> peter: staring down a potential fossil fuels plans to move the country off fossil fuels and that is being sued by 15 energy producing states worried about the impact on their bottom line if the president pushes electric vehicles and people start using less gas. the attorney general of texas sums up the suit like this. these severe new rules propose by the e.p.a. are not only unnecessary but they will create a deliberate disadvantage to texas and all states who are involved in the production of

right now. this is basically the red area, will continue to be the areas which are occupied, claim to be occupied by the russians and thought to be. this is where the -- a lot of the attacks are happening. if you see what is going on here, kharkiv getting really shelled in a way not been shiltd the previous 96 hours. through today. he wants to take the second biggest city of 1.4 million. are they sending troops through there? yes. where are they thelgd to the capital. keep your eye on this area. this is poland. this is where most of our armaments and are rations that are going to be coming through. aid committed by other countries some going through poland some through romania, which is below. and coming in through this area. guess what the russians are doing. the russians are deciding to send attack helicopters to that area and start blowing up some of these caravans of aid and

weapons. and if it's western caravans, and they are blown up. the question is that an attack on one, which is an attack on all when it comes to nato? so that's what we'll focus on. as we move ahead, the real focus will be on this. yesterday we were telling you this caravan, i don't know if you see closely. all different vehicles, some carrying people. some carrying armaments. some are self-contained artillery. it is now from four miles they said oops, we made a mistake or it just expanded. it is now 40 miles. and where is it heading? it's pretty clear. they are heading as i clear that out. to kyiv. now, what they want to do what vladimir putin wants to do is encircle this city. what he needs, they say, is 40,000 to 80,000 troops to do it. closer to 80. he doesn't have it. he had 115 all. they say a third are fighting. the other two thirds are supply. the other two thirds are resources. so he doesn't have it yet.

this convoy that has been moving south toward the capital. of course an ominous sign of what could very well be the next stage in this conflict next stage in this invasion. dramatic video to the east showing a direct strike on a regional government building. some sources say it was an attempt to kill the regional leaders in that particular building. it was subject to indiscriminate rocket fire. video evidence of what appeared to be a cluster bomb. a cluster bomb and something that breaks up in the sky and explode really over the sides of what could be as large as a football field. these are illegal because they are indiscriminate. they could drop it into an urban population. chances are, you are going to end up with civilian casualties. there is a page to battle taking place they're focusing on a bridge that spans over the

from slovakia and 30 from bulgaria. if the ukrainian airports are going to have a fighting chance, this is going to help them. >> it certainly is. i am glad to see a lot of e.u. members stepping up. i think they can do more. you got russia right on your doorstep. this is a fight for your life. a lot of people denied that until the moment it happened. it is clearly the case now. the e.u. has agreed to look at ukrainian's e.u. membership. that could be significant there that does require some kind of assistance to them. i think ross, i think putin in particular has clearly miscalculated. this is a bigger fight than anticipated. they lost thousands of troops. that's more than we ever lost in afghanistan. we need to continue to make this as painful as possible for them with that kind of legal aid we are talking about on the economic pain we are inflicting on them.
