already carved out a path of destruction as it moves toward the capital. in ukraine's second largest city kharkiv russian missiles rained down. 400 civilians have already died and zelenskyy says putin is committing war crimes over and over and pleading for united support from europe in a speech that drew applause and tears. >> it's a tragedy for me and every ukrainian, tragedy for our state. can you imagine this morning two cruise missiles hit this freedom square. dozens killed. this is the price of freedom. we have proven our strength. we have proven that as at a minimum we are exactly the same as you are. so do prove that you are with us. life will win over death and

[applause] >> harris: with me former u.s. ambassador to the united nations nikki haley is in "focus." fox team coverage, lucas tomlinson reporting from western ukraine and trey yengst in kyiv. trey, we begin with you. >> harris, air raid sirens continue to sound across ukraine as russia pushes forward with their invasion. we know today in the second largest city of kharkiv two cruise missiles hit a public square killing many people. authorities there on the ground say this was a direct attack by russian forces. ukrainian president zelenskyy today calling it a war crime. here in the capital of kyiv earlier tonight a television tower was hit by a russian missile. that explosion reverberateed across the city as civilians continue to stay underground. we know that 40 mile long

convoy outside of the city limits now a major concern to authorities who set up checkpoints around the city putting anything in the road they can, flower pots, pianos and even cars just trying to block this russian advance. we spoke to some civilians today trying to make their way out of the ukrainian capital. heart breaking scenes at the train station here in kyiv. take a look. >> familiar scene unfolds in the ukrainian capital. they say goodbye to his daughter and granddaughter evacuating to the city near the poleish border. >> we need to leave our homes to make our children safe. i never thought it would be like that. it is not a joke but hell. >> like thousands of ukrainian men he will stay and fight as the russian invasion continues. >> my family, daughter and granddaughter are leaving. i'm staying as i'm in the territorial defense. >> people are running out of time and a real understanding russian forces could surround

the city in a matter of days. the central train station in kyiv is a major evacuation point for people looking to go west. the mood here is tense. soldiers in the streets, civilians hiding from those russian bombs and everyone bracing for what could be bloody urban battle in the days ahead. harris. >> harris: trey, thank you very much. look at this incredible video. it shows everyday ukrainians in a southeast resort town challenging the russian soldiers in the central square taking over the town. they have no weapons as they shout at russian soldiers to go home. wow. nikki haley former u.s. ambassador to the united nations is with me here today. we saw the ukrainian president zelenskyy say he wanted to become part of the european union. i want to first get your reaction to that. how does that help him? >> well i think it helps him

because it infuriates russia, right? it puts more pressure on putin and lets putin know that more of the world is with him. they absolutely should let him in the e.u. that's a european decision. if you want to take about courage, might and inspiration, how do you not let the ukraine into the e.u. europeans will really think that way. >> harris: since we're on the topic of letting them into things are we at the point we would ever consider finland saying it wants to get into nato and sending weapons and doing everything it can to help ukraine? it realizes what are you crane is showing to the world. russia has a crazy man at the helm. >> we have watched him poison opponents in england and watched him allow chemical weapons in syria and watched him do horrific acts over the years bringing down the malaysian airplane. we have watched all this.

this should be no surprise to any of us. in terms of nato it is very different. e.u. is financial, right? nato is security. so you really have to think about whether -- which countries you will add in. that means we all go to war if they're invaded. we all go and take up arms if they are invaded. it is a different conversation if you talk about e.u. versus nato. >> harris: they know that. they say now would be a good time to get into nato. ukraine might want to do the same thing right now but that pulls us into a nuclear war immediately. on the hill republicans have introduced a joint resolution now to pull russia -- or to demand that russia lose permanent seat on the u.n. security council. you know, ambassador, i'm curious about how this puts pressure on him. >> first of all there is a lot we should be doing. i think that biden chose to get back into the human rights council. you are synth shoulder to shoulder with russia.

either you kick russian off the human rights council or the u.s. gets out of the human rights council which we did in the very beginning. secondly you are sitting in iran negotiations. you are sitting shoulder to shoulder with russia and china. do you really want to do a deal with our enemies? i don't think so. if we didn't learn the lesson from this we have to learn that we are not going to allow that to happen. when you talk about the u.n. security council, absolutely i would be railing right now to, one, not allow russia on the security council. two, not allow russia in the general assembly. they should be -- they shouldn't even get observer status at this point. this is all-out war and we should be treating them like the criminals that they are. >> harris: you bring that up and that's exactly the question, right? why are they allowed to vote against a resolution that condemns what they are doing? it makes no sense. >> it doesn't. if the u.n. ever wanted to man

up and grow a spine, this is the time to do it. because if they can do this to ukraine they can do it to any country that sits in that chamber and we have to look at this, harris. this is a learning moment for us. so there are a lot of things the u.s. should have done before this happened. but do you know who is watching all of this right? china. china is watching every country that is sending ukraine arms. china is watching how the u.s. reacts. china is watching who is sending intelligence to ukraine. and china is deciding that when they invade taiwan, how do they want to do it quicker, better, stronger? how will they make sure they can do this? while we're trying to defend ukraine at this point, don't take your eyes off china because they are getting ready to move and we have to be ready. >> harris: how can we be so sure they're in concert with each other? they were cozy at the olympics in beijing. >> absolutely. >> harris: they had to. it was days before this had

happened with ukraine. >> this played out in front of the world. what we know is china is a bit annoyed, right? it played out this way. they look at russia and think russia is being sloppy and think they are embarrassing them but china very much gets russia is the junior partner here and so china may try to distance at this point but they are as close together in terms of making sure they destroy the west as they've ever been. >> harris: i want to hear from if we can the ambassador to ukraine and what he had to say about getting into the u.n. he said this yesterday. >> russia is attacking hospitals, mobile aid brigades and ambulances. this is not the action of a state with a legitimate security concern. this is the action of a state determined to kill civilians. there is no debate. these are war crimes.

>> harris: quickly let's go right to showing everybody what biden has to do now. because he has got to balance where he needs putin, ambassador, with all that putin is doing. look, the international criminal court can go after putin at any point. they don't have to wait for the war to be over. if he is committing crimes they could do that. but what's interesting is from what i'm reading biden is leaning on russia to do the deal with iran. >> it is disgusting. this is absolutely disgusting. talk about not learning from your mistakes. first of all, biden is not doing enough. he needs to cut off -- even now he should be cutting off all russian oil coming into the united states. he can do it in one instant by opening up the keystone pipeline. the second thing is he needs to sanction every energy company in russia right now. i don't know why he is waiting. it is the one thing that is a sucker punch to putin if he

wanted to do it. and then completely eliminate them from swift. completely stop the venmo transactions. what are you waiting on? how many more team need to die before he says let's do this? then you are still going the try to talk about the iran deal? you will go sit in a room with russia and china? think about it. when the idea that biden would go ask china for help with russia sickens me to my core. when you go to one enemy to get help with other enemy, do you know how weak that looks? we have got to stop all of this embarrassment. at some point learn the fact that when tyrants say they are going to do something, we should learn the lesson they will do it. russia said they would invade in ukraine. they're doing it. china said they would take over hong kong. they've done it. russia says they want poland and the baltics next.

ukraine as families are forced apart. they hold onto each other until they board the train, bus or whatever they are getting on and in that last second they let each other go. of course, we know maybe for the last time hanging onto papa there. this kyiv resident, his daughter if his arms, his wife there. the bus headed to poland now. hundred of thousands of ukrainians have fled the country already and more are still trying to leave. they are trying to get to the border points like there in poland, which is the western part of the nation there. some of them have to trek far to get there. i was reading 34-mile trek on foot by a grandmother, daughter and her grandchildren. unbelievable but they made it. watch this. >> the state of the union is in sorry shape. >> not heading in a very good direction. >> what can you say? >> i'm not thinking about the state of the union.

i'm thinking about the state of the world. >> it's the worst in my lifetime. i think the country is divided, i think people are hurting, and i think the government doesn't care. >> harris: some americans with a dim view of the state of the union. president biden is set to give the biggest speech of his life. it comes with the back drop of record high inflation and putin's violent war on ukraine. the president is expected to pitch climate initiatives as a inflation solution and tout economic progress. voters don't buy it. a new national poll shows only 37% of people approve of the job president biden is doing. that is a new low. that is an all-time low. that is a hurdle for tonight. and only 17% say the economy is

better under his watch. some ask how they find 17%. republican senator john barrasso out with an op-ed. his state of the union speech cannot hide the crisis he created. the american people don't want to listen to a fairytale. security is unprecedented tonight. the building fenced off. humvees patrolling. roads closed down and national guard troops at the ready. ari fleischer. i was there over the weekend and you could see them prepping. but now you can see them in place, all of that ahead of -- we'll get to it -- what they think will be some sort of a truck protest. let's start with the president's job tonight. what is it? >> well first from the biden point of view his opportunity tonight is he will be watched by 40, 50, 60 million americans.

his most-watched event since his inago ral address when he became president. a rare moment for the president to have the attention of the nation. his problem, however, harris, think of it like a student who spent helps first year getting ds and fs as sophomore year he says i take a test tomorrow and a chance to improve my grades. you don't have a chance to improve all your grades but one grade at one moment in time. and that's the problem you have when you are an unpopular president with an unpopular agenda where american people have turned on you. one speech alone is never enough. it is a blip and moment in time. he needs to use it to rebuild, to start to get back. it alone won't get him back. >> harris: centrist democrats are unloading on progressive congresswoman tlaib for her plan to give a response to president biden's state of the union. and it's interesting because normally it is the party of opposition goes right after and

they will have that tonight. it will be the iowa governor. after that somebody in biden's own party who is far left of him is then going to give the rebuttal. it is almost like having an opposition party in your own. new jersey democrat told axios it is like keying our own car and slashing your own tires. >> it is worse than an opposition party. it is a socialist party. there are four or five self-acknowledged socialists in the house of representative and one in the united states senate. this is a real problem. on policies they are the definition of radical and part of the democratic coalition and they don't get denounced and the problem is joe biden has been getting tugged to the woke far progressive left as a result of listening to them. so this is part of a split inside the democratic party and a devastating one for them and has cost them centrist democrats who are all becoming

republicans. >> harris: the anti-mandate truckers in unity who got things started in canada against their government and mandates for vaccine are expected to make a convoy, some of them already on their way and see them on social media. how seriously does the president take their message about mandates when you are just now starting to see some of them fall away on the left side of the party? >> big opportunity for joe biden tonight. if he uses any of this speech to announce we're taking down a series of restrictions we've all lived under with covid that can send a signal to america the skies will brighten. things will get better. we're sick of covid and joe biden needs to lead that charge and needs to call every federal worker back to the workforce. why are they still working from home? he needs to send signals of normalcy on covid. i don't know if he will do it, though. he seems to like talking about covid. >> harris: ari fleischer, thank you. you've written many speeches and leaned in to give helpful hints along way i'm certain to

>> harris: new information from our national correspondent jennifer griffin. a senior defense official is telling fox that 80% of the pre-staged russian troops are now inside ukraine. and the russian military convoy heading toward kyiv is not making any real movement at this point. we can watch this by satellite obviously and that's because of ukraine's resistance and russian troops running out of food and fuel because it is taking them longer than they thought they would make the 90-mile trek. jennifer also is saying that putin's forces may be considering a pause to regroup and re-evaluate. they've done that once reportedly. we'll stay on the news and appreciate the update that

there? who protects these refugees if the russians move in there, the forces? >> well, harris, none of those 5,000 u.s. troops on the ground in poland will be coming into ukraine. forbidden from the commander-in-chief. however, it should be noted that only women and children are allowed to leave. all military age males are being told and ordered they cannot flee. a decree about president zelenskyy. they are needed to fight the russians. no american troops coming to ukraine to help the refugees. a big development if the russian forces come south to cut off not just a refugees leaving but the vital supply lines that come in. no charters and fedex, they aren't coming to ukraine. no aircraft coming in. any supplies are coming in over land, harris. >> harris: all right. thank you, lucas, very much. that is a disturbing development. we'll get it later this hour and we have senator joni ernst

coming up. we're bringing you new video as it comes into fox news. you are looking at what happened earlier today when russia's foreign minister began to speak at a meeting of the united nations human rights council in geneva. ambassador nikki haley says russia has a seat on that council, human rights. the irony and horror is too much to bear inside the room. ambassadors and diplomats staged a mass walk-off when lavrov spoke remotely. the senator joni ernst the member of the armed services committee. welcome in "focus" today. i am rushing a bit because i want to get straight to the news which is disturbing with lucas tomlinson told us. they are five hours away russian forces headed to the one point they would want to choke that off and with your military background coupled with your leadership on the hill you can give us an idea what it means for supplies and what it means for people trying to get out.

>> yes, absolutely. i did serve as a logistic and transporter and understanding that if they are able to cut supplies off, if they are able to cut off food, water that goes to the -- plays into the humanitarian crisis and able to cut off ammunition, any armaments and weapons going into the areas it spells deep trouble for the ukrainians. they are in a world of hurt right now. we need to make sure we're able to push all necessary supplies to them but this is very unfortunate. we have been so slow to react as an administration in making sure the ukrainians have absolutely everything they need to defend their homeland. so you are absolutely right, harris, we need to make sure that supplies, logistics are given to those ukrainians. a dire situation. >> harris: i started this hour this newscast by calling them

terrorists. who hits a refugee point? that's tribal. >> absolutely, harris. i have always thought that vladimir putin was an autocratic thug. now he is a murderous autocratic thug. the world is not going to take kindly to this type of action. and i hope that the sanctions that we have been able to put on him, on his oligarch friends, those continue well on into the future. we should not let up. we also need to take the additional step of sanctioning russia's oil and energy supplies. we have yet to do that. we need to do that right away. he is still surviving off the revenue streams coming in through those sources. >> harris: let's talk about u.s. energy and our dependency on them. 595,000 barrels of crude a day. $58 million a day going to pay i would imagine in some parts for putin's war. you know he is not using the cash to feed his own people.

>> no, absolutely, harris. what we see from this administration is a focus on a deranged climate policy. there is no other way that we can explain this where we have cut back american energy production and have become much more reliant on russia and other nations like russia. here we are allowing iran through these negotiations to lift off those sanctions and become part of the energy market again. this makes absolutely no sense. i would love for joe biden and john kerry to explain this to the rest of the united states. >> harris: the white house is trying to defend it. let's watch. >> this keystone pipeline would take years for that to have an impact on prices. there are a range of reasons why the president opposes it but it wasn't functioning, isn't functioning. it will take years. he is committed to clean energy jobs. the keystone pipeline isn't

even really functioning. it was only partially built. i certainly welcome you to present your data of all the thousands and thousands of people who won't be getting a green job. >> harris: senator, what is fascinating about what the white house press secretary just said there it would take some time to get keystone xl. she didn't use xl that's what it is. keystone plus up and running. when it does it's 830,000 barrels of crude that we would generate just from that action alone. are they not thinking of the future here? >> again, it is so deranged. so let's stay dependent upon foreign sources of oil, primarily russia, while we could be ramping up our own energy production. never mind that she says it may take a year to three years. that's better than remaining reliant on russia. you know, when they talk about their green energy plans, it will also take years upon years to get to that point.

so why not unleash american production today? let's put american workers back to work. let's open up that keystone xl pipeline. let's allow american energy to dominate rather than again be reliant upon somebody like vladimir putin and russian oil. >> harris: quickly, tell us about a vacuum bomb and why in the world would putin go there. because he knows he can't do that. >> no, he should know he cannot do that. and this is so disturbing. it is something that the ukrainian ambassador brought up in our ukraine caucus meeting yesterday. it is deplorable and what we need to make sure is that we are giving the ukrainians every opportunity to fight back. he has put -- vladimir putin is indiscriminately targeting innocent civilians, women, children, the elderly.
