"jesse watters primetime" is starts in about five seconds. brian. >> brian: all right. tonight we start in ukraine where russia's onslaught bombardment continues major cities across the country have been pounded in some cases into dust as innocent women and children are caught in the crosshairs. in fact, they are the target. greg palkot is live in lavigne ukraine with the latest on the ground. greg? >> brian, we have heard some air raid sirens here tonight in lviv. last night the russians struck a

military training base to the northeast of where we are right now as the fighting continues across the country. the focus remains in that big port city of mariupol. the russian defense ministry told ukraine to surrender the city by early monday morning. they said no way. but street by street fighting continues. 90% of the city has been destroyed or damaged. hundreds of thousands with little food, water, medicine. it's truly horrible, brian. meanwhile in the capital of kyiv, there were more artillery blasts heard on monday to the north and west of the city as rescue workers dug through the rubble of yet another massive russian missile strike destroying a shopping mall, a high rise building associated with that. killing 8. russians said it was the military target. and finally, another show of bravery from the ukrainians. in the city of kherson that's the only major city the russians have actually captured. residents were out on the streets again protesting the takeover. russian troops were present. they fired shots. stun guns.

one resident reported injured. again, it's just the kind of bravery, solidarity and words that we hear from the ukrainian people every day here back to you. >> brian: they took kherson two weeks ago and still can't control it an important learning moment from the russians. they are in cowan tri that doesn't want them. thanks so much, greg. meanwhile fierce resistance has slowed russia's advance putin is reexamining his options so to speak. reports indicate the kremlin is using new weapons inside ukraine including hypersonic missiles which we don't even have here in the u.s. nor do we have missile defense to that yesterday, the pentagon played down the move. >> russia is also saying that it used a hypersonic missile at least twice in ukraine so far. is this weaponry game changer? >> i would not see it as a game changer. i think, again, the reason that he is resorting to using these types of weapons is because he is trying to reestablish some

momentum. and we, again, we have seen an attack towns and cities and civilians outright. we expect to see that continue. >> brian: unbelievable, right? looks like putin is just throwing darts on a board and hopes something hits. hypersonic missiles are not even used in close combat. more on that in just a moment. russia has clearly lost the momentum. now time for the ukraine to seize it putin's back is against the wall and shifting to plan b. does he even have one? i think it's called wreck everything. >> the russians have been pflum mixed frustrated failed to achieve a lot of their objectives on the ground they are stepping up what we in the pentagon long range fires bombardment from afar. >> brian: they can't win when close. david when faces goliath russia has been winning. russia rather fight women and children and possibly bomb some seniors the president have rallied behind president

zelenskyy he has been brilliant and message much resistance fantastic. they need more than well-wishes. in fact ukraine's president has appealed to world leaders in america, u.k., germany, canada, israel over the weekend. even the entire european union making his case for more aid and letting them know his fight is their fight. >> the ukrainians have killed more russians in three weeks than we lost in afghanistan and iraq in 20 years. i think we ought to go into this believing the ukrainians can actually win. and the way they win is for us to get these defensive weapon systems to them as rapidly as possible. >> brian: including some food and water. hear that? win. the ukrainians believe they will win this fight. they need weapons food and funding to keep going. their war is only beginning. russia turns its back on peace and next could have consequences that echo across the globe. >> we have to use any format,

any chance in order to have a possibility of negotiating, possibility of talking to putin. but if peace attempts fail that would mean this is a third world war. >> brian: no doubt. ukraine has putin on the ropes. let's give them the tools they need for a knockout before we find ourselves in world war iii. which would be damaging to the entire planet. general keith kellogg knows that already. is he a former national security adviser to president trump and is the author of war by other means. general, let's do an update on where we are at right now as we take a look at the big map here. we see a lot of red, but it is still on the outskirts here. and, you know, it's in a place where we thought if -- talking to you two weeks ago perhaps they have made more progress. overall where we see the blast is where the action is happening. we see kyiv. who is in control of the capital? who is in control of the capital is the ukrainians still. and they got the subway system

and i think they feel as though they are not encircled. are they right? >> yeah, brian. it's good to be with you. you are absolutely right. they -- to the south it's still wide open. they have not been able to encircle kyiv at all. you know, i'm sitting here, i think all of us who studied this kind of stuff for years. we are just scratching our head and said it makes no sense. the main attack should have been on kyiv. i understand he went for the outer -- the mariupol and donbas region and down to odesa. >> brian: right. >> the key to the whole fight is neutralizing the government of zelenskyy. >> brian: right. >> in kyiv. and taking the capital city of kyiv. he has done neither. this thing has gone. we are in our fourth week. you made a comment is he in plan b. i think he is in plan c and getting enormously frustrated that he can't do this. you can see that because the actions he has been taking by arresting the couple members, senior members of the fsb. he has lost, i think, five generals so far. he has committed his operational

reserve the best units he has got that are coming in from moscow which is saying to me very clearly he cannot get to the west. he will not cross the dnieper river. >> brian: dnieper river right there, right? >> right. and if he can't get across the dnieper and go to the west and by the way if he went to the west i think the elimination of his army. they will just eat him up in the western approaches. if you look at what is happening right now, he has got a major problem on how to settle this fight, okay where is this back door. how do we let him off the hook or give him an escape route? this week when biden goes to talks to nato allies. better sit down and say how da we give this guy an escape route. the second thing is i have no idea why we are not pushing this equipment faster. >> brian: i know. to the western part of ukraine. you saw those attacks going on

lviv and other places. iron dome, air defense iron dome over those cities. i'm shocked they are not there yet. go out to the three nato allies that have the s 300 system that the ukrainians are trained in. go to bulgaria, go to slovakia and go to greece and say give us those systems. we will help you withing is else later on. >> brian: i have we have our own in alabama. i want to bring you to the street map. only urban fighting we are seeing and basically 5:00 in the morning their time get out ukrainians, put your arms down and let you live. they stayed to fight. but look at all the places they are hitting? oh, let's hit a shopping mall. let's hit a hospital. hey, wait a second another hospital. what cowards? who is doing this? they stand on the outside and they bomb hospitals and then they go in and start knocking on doors and raiding refrigerators. i mean, who learns like this? what tactics are these? >> well, look, brian, -- that is not the american way of war. we just don't do that western

nations don't do that you are looking at the classic case to me of war crimes 101. when you start doing the things they are doing, that shows -- but it also shows a complete discipline of a fighting force. that shows you how bad his military is. because his military and his leadership should not be allowing this. this is just pure harassment. it's intimidation of citizens. and he is hoping it is going to force zelenskyy to budge or to break. is he not going to do it. this keeps going on. every day that goes by, putin is actually losing this fight. and he is going to lose everything if he keeps doing it this way. you know, what's amazing to me, you know, when the russians left or the soviets left afghanistan, and in disgrace years ago, that nation collapsed two years later. if he can't win this fight with an advantage of well over 10-1. i don't know what's going to happen to the russian military and the russian nation. but that should concern us. >> brian: i know general, whether it's turkey holding the talks or jerusalem holding the talks or like you brought up the

jerusalem president holding the talks because he is evidently biased and friends with putin. i'm wondering in the big picture if zelenskyy holds his place and ask for the donbas and crimea back. i wish people were as innovative as you are they would be in power right now. thanks so much general kellogg. >> thanks, brian. >> brian: all right. let's move ahead as putin's invasion gets bogged down pulls every tool out of the toolbox including hypersonic missiles. are they even effective in a fight like this. >> this discussion of hypersonic missiles is really a bit of hype. it is not a particularly useful weapon for this type of fight. those are meant to evade interceptors when you are shooting intercontinental ballistic missiles. as you start to close in on the enemy as happened in mariupol and kyiv, places like that. technology provides you less of an advantage and what becomes more advantages and close in block-by block fights morale,

training, leadership. >> brian: that's a four star general. if this fight comes down to morale and leadership. i'm going to go ukraine no doubt about it and the points. what other option does vladimir putin have left? let's turn to former navy seal congressman dan crenshaw of texas. congressman, your take on the state of the war and the urban fighting in mariupol right now? >> look, i largely agree with general kellogg. putin appears to have gotten in way over his skis. he is losing this war. the only reason he is at the negotiating table whatsoever, i think zelenskyy is doing the best job he can and making public statements, for instance, that he won't give back donbas and crimea. now, in the end, will he? not sure. he is doing the right thing as far as negotiating with putin. putin is now more and more negotiating from a state of weakness. and losing support domestically as well. and i also agree with the other statement. what putin is trying to do is

desperately show the west that he has these hypersonic missiles and is willing to use them. as was just noted, they are not particularly useful. they were unnecessary for that target that they were hitting. but they are trying to send a message. they have been trying to send messages to us consistently. now, again, like i said on your show last week. he is not our national security adviser. president trump on fox news this morning said the exact same thing for the most part. listen we don't have to listen to putin every time he says you can't do something. they are increasingly in a state of weakness. the ukrainian morale is high. we need to get them the weapons they need. there are plenty of people willing to fight but they remain under armed and without the equipment they need for the most part. >> brian: the thing is, do you agree, dan, that we have to win? meaning we, meaning ukraine? because if vladimir putin stayings in power. age to keep a portion of this country. in order to stop civilian deaths and i can understand president zelenskyy seeing every woman and child forced to leave or be

killed and seeing these bodies i just have to end the carnage. if he is able to leave with the south or even more than he started with he will declare a victory. he has to come back stronger in a couple of years. >> he may. look. this is what i try to tell people who say well, look, he just wants be a little bit more. he just's a little bit more. that's what they said about hitler, too. look how that turned out. again, i think putin has made a mistake even going for kyiv yet pretty clear is he not going to get it. ukrainian need to fight this in mariupol grand last stand. strategic mark for putin because it creates that land bridge between these break away regions and crimea. so, it's worth fighting for. zelenskyy knows that. >> brian: absolutely, dan, i think it's important to know they called in our ambassador today in russia and said you are in danger of breaking off relations. really? because we called them war criminals. every day they wake up they are

after 17 months of calling hunter biden's laptop russian disinformation. the left's narrative on hunter is imploding as the "new york times" verified last week what we have known all along hunter's laptop is in fact real and no surprise the people who tried to debunk the hunter story are hiding. look at the front page of the "new york post" wouldn't let him

hide over over the weekend confronted all intel experts who called the story hunter disinformation. jim clapper, john brennan and leon panetta and mike hayden which is when the laptop revelations first came to light. this is what they brought us back to quotes in actual letters. emails reportedly belonging to vice president's son hunter has all the classic earmarks of russian disinformation. we do not have evidence of russian involvement, just that our experience makes us deeply suspicious that the russian government played a significant role in the case. they have no evidence of any of that. but that didn't matter. the media took that letter and ran with it, giving articles like this. hunter biden story is russian disinformation. dozens of former intel officials say. when the "new york post" requested retraction from the intel officials over the weekend no answer with notable exception jim clap his or her instead of retracting doubled down saying quote of course he rubbed his head 20 times and took off his glasses i stand by the statement

made at the time. enough said. no wonder cnn pays him all that money. author and investigative reporter peter schweizer thinks hunter is looking down the barrel of a federal indictment. watch. >> i think this "new york times" piece, the fact that they got cooperation with team biden and probably from the hunter biden legal team is an indication to me they are extremely concerned that he is going to be indicted. >> brian: so that's why they did it george washington law professor jonathan turley joins us now. jonathan, what do you think about that theory? i know you wrote a lot about this even since this came out. do you think the "new york times" is trying to get ahead of an indictment? >> i think it is. you know, only so long you can deny something that is staring you in the face. i mean, if they waited for a possible indictment, there's a good chance that an indictment is going to rely on the laptop. and so you have got to beat this to the punch. you have got to admit the laptop is authentic even though everyone has known that for virtually 17 months. i mean, many of us were writing early on saying, wait, we have

all heard about the money influence peddling of the biden family, particularly hunter, people on these emails were you a then case the emails. and at the same time, you had these experts saying you know, this looks like it is just russian disinformation. you can ignore it. >> brian: some people watching right now say hunter another problematic child of a famous politician. gets himself in trouble and the emails are real. what's the big deal? if you read miranda devine's book. if you read these emails, what will you find that's so disturbing that might lead to other people not on crack? >> look, i have been a critic of influence peddling for decades. this is how the elite in washington makes money. they get foreign interest and corporations to give money to their siblings, to their children, to their spouses. the bidens have made a virtual cottage industry of this. they are infamous for this type of practice. a lot of it is legal.

it's all corrupt. and so the media comes along and says well, we are not sure there is a crime as if millions of dollars of corruption is not enough. part of the problem with what the "new york times" has done is they said look, these are, okay, authentic, but then there are critics. if they are authentic. then maybe we should talk about what they say. what they implicate. you have the president of the united states being referenced with code names like celtic and the big guy. and they are referring to intermingling of funds. referring to some of this money going through hunter being used for his father. they are talking about meetings that contradict the president of the united states. so no one -- now they are at that point where they are accepting this, but they are not really talking about what it means. and why we should have a special council, someone who looked independently at this issue. >> brian: right. it involves ukraine, russia, romania and china. besides that countries that we

are are really not that much involved with. this all matters to international relations with the president of the united states. and where is the irs? where is this money now? >> what's astonishing here and this is part of the issue of saying well, influence peddle something a virtual sport in washington. it is but nothing like this. i mean, this is really the all-star game of influence peddling. we are talking millions and millions of dollars. we are talking about various foreign interest and shady connections. this is really breathtaking. it's sort of the way hue hue deanygot the relevant to dir got the media to play along. now they are having to acknowledge the fact that there was an elephant. he died someone bunched him from internal bleeding. i don't know if that helped this

story but i knew a little bit about him. i am going to read your stuff ifi want to know what's hg next. thank you so much. >> thank you, brian. >> brian: let's turn to dana loesch. the other part of this freeze everybody's account that used that new york story including the "new york post" account. they froze it until the election was over. damage done. >> yeah. and, brian, so good to see you. and you are absolutely right. i was one of, i think, there were like a cup pell thousand people had their accounts either suspended or i think even suppressed after because we eitherring about the "new york post" story or reshared a link to it or share a link to someone else who wrote about it didn't matter. it didn't matter how you spoke about it, you were targeted and you were suppressed. brian, fun fact, do you know the whole bird watch thing that twitter has where you can fact check other people on twitter.

all of the people who had their accounts shared for "new york post" legitimate and credible reporting none of us are eligible because we had been wrongly suppressed before even though jack dorsey came out and said it was wrong he never did anything to rectify it they don't care about truth. tech companies colluding with democrats and biden campaign to shut down everyone and prevent discussing it brian, you know how that works. if you are prevented from talking about it you want to talk about it more. if you are told you can't discuss it, you want to discuss it even more. especially so when there is a giant pile of evidence suggesting impropriety and corruption on behalf of the biden administration. >> brian: dana, remember, i had william barr on saturday and he said joe biden lied on the debate stage when he said this is russian disinformation. he knew those emails were his. he knew those were his son's and his laptop. instead of coming up with legitimate answer, he said no, they said it's russian information 51 experts said it was russian disinformation.

so he is playing out the story line, lying to become president of the united states. >> yeah. i wish that bill barr if he would have thought all of this -- if he thought this the entire time i really wish he would have said something. >> brian: he did at the time. >> yeah. i mean, the 51 intelligence experts, brine, this is where i get really unnerved as just an american citizen it doesn't matter if you are on television or radio. you had all of these intelligence experts made d.c. men referred to i think is great by the post. people who never were held accountable when they themselves violated the law. you talked about this brian here and on your program to the radio program. talked about james clapper this guy committed perjury talking to congress whether or not he was collecting information on private people part of nsa's catchall. >> this is the guy who comes out. signs the letter saying it had all the hallmarks of russian disinformation. what hallmark of russian disinformation. we have got to stop allowing democrats to do this knee-jerk

highest court. republicans have questions if she is really the best person for the job which senator ted cruz made clear today has nothing to do with race. >> this is not about race. we will see democrats in the media suggest that any senator that is skeptical of your nomination, that questions you vigorously or dares to vote against you must somehow harbor racial animus. >> if that were the standard, i would note we are sitting on a committee where multiple members of this committee, the senior democrats on the committee happily filibustered judge janice rogers brown. a very qualified african-american woman nominated to the d.c. circuit. >> brian: so what will the senators be asking the judge in the next coming days? the questioning is going to be cut and dry. nothing too personal. senator cruz made it clear the hearing process will be clear unlike what we saw from kavanaugh. >> this will not be a political circus. this will not be the kind of

character smear that sadly our democratic colleagues have gotten very good at. judge jackson, i can assure you, that your hearing will feature none of that disgraceful behavior. no one is going to inquire into your teenage dating habits. no one is going to ask you with mock severity do you like beer? >> brian: hopefully. tim scott is the republican senator from south carolina. senator, your thoughts about day one? i know you were traveling a little bit but they want to make it clear, the republicans, they are not going to get down and dirty like what happened with kavanaugh. were they right to say it? >> well, there is no doubt that the big media wants to make this into an issue of race and gender and the stench of the hypocrisy from the left is undeniable. what we are going to focus on are the concerns we have about her philosophy as a judge. we are going to focus on how

does did she rule in the past and why were some of those rulings overturned by a higher court. we are going to focus on making sure that america's supreme court gets the justice they deserve. this is not biden's supreme court. this is not the progressive supreme court. this is america's supreme court. and so i can tell you that republicans will dig into her record. we are interested judge not what she looks like. did a good job of making sure we lay out the parameters for this confirmation unlike the democrats who literally want to assassinate the character including of our supreme court justice coney barrett. >> brian: i did love her biography. i thought it was well-done well delivered. i love a legitimate background stories. let's see if she can answer the questions. i disappointed when asked if

court-packing was okay she did not answer. should could she not comment on something that would diminish the impact on something she wants to be on? >> that's the kind of question we need have answered though. brian, you are hifingt the nail on the head. what we have to do is make sure that she answers legitimate questions and every single question we ask about her philosophy is important. every question she gets on her cases, those questions are important. we should never deny the american people the information they need to see to know who is coming to the court or why we are going to deny her a seat on the court. both sides need to be heard out. >> brian: senator, you are moving legislation now. you have at least 20 republicans supporting you in the senate to try to protect workers. gig workers. people who want to do their own thing. have you seen since the pandemic a big push to unionize. in what respect is this and what does this legislation read like? >> well, the most important part of this legislation is realize that we are going to focus on

the future while the democrats are focusing on the past. we literally understand that workers want the flexibility in their schedule and they want to build a workplace around themselves. we can help them get that accomplished through my legislation. so i'm really excited to see the progress that we are making on making sure that legitimately today, employees decide when they work, how much they work for, and the benefits they get whether you are an independent contractor or employee. we want a workplace that is conducive for your priorities. >> brian: what did you see? for example, uber, people want that to do gig economy uber eats, uber drivers. the lyft all of a sudden attacked by legislators? in what respect and what do would you do to block it. >> let me just say great question, brian. the pro-act, which failed in california, the protest liberal state in the country, failed by

20-point margin. they are trying to bring that failed legislation to the national scene. where they literally require every employee to join a union or pay dues to a union whether they are a member or not. they want to take those union dues and use them for political purposes. 90% of the money goes to democrats while 40% of the union members vote for republicans. we have to break that stronghold that they currently have. they want to through the pro-act eliminate 27 states right-to-work laws. in other words, ushering in a new wave of unions. that is wrong for our economy. wrong for our workers. and wrongs for our country. >> brian: tim scott, man of action. get on board. when you get the majority, if you get the majority after the midterms you will probably have more momentum if you can't pass it originally. senator, thank you for joining us tonight. >> yes, sir. >> brian: straight ahead, when
