we are seeing a systematic extermination of people because of their national origin that is by definition a , whether you call it a war crime or a . the pictures today out of butcher are absolutely horrific. they are stomach turning. they are inhumane. this administration needs to take a stance that is strong. it needs to take a stance that this is in the united states will lead every effort to collect evidence and ensure that we bring the perpetrator, vladimir putin, to justice. now obviously that is much easier said than done because the challenge is, for example, you think about the international criminal court, neither ukraine nor russia are member states of that court. so how does the trial proceed in that venue to have to go somewhere? there are ton of technical questions to be answered. you know, it's interesting because niall ferguson wrote the following in bloomberg and i found it interesting and i want your comment on it. he said quoting here the biden administration not only thinks it's doing enough to sustain the ukrainian war effort but not so much as to provoke putin to escalation.

i fear these assumptions may be badly wrong and reflect a misunderstanding of the relevant history. and he goes on to talk about the nuclear threat and he thinks that , you know, there's no pacifying putin, that he's going to do what he's going to do. what do you think? yeah, i think neil's right in that regard really. there is no predicting where vladimir putin will go. you know, there won't be a quick peace. i've said this on before. there won't be a quick peace here it is in putin's interest to keep the rest of the world guessing. and quite frankly, the only way that putin can understand the dire threat that he is under is if he recognizes that the united states and other countries are taking this seriously and that does include calling what's happening in ukraine a . so i absolutely think that we are probably not ascribing to putin enough enough concern that he is going to do whatever it takes to escape and evade. and at this point it's our responsibility to hold him to justice into account means the peace talks go on .

but what do you think, loni? is there a diplomatic road out of this ? well, it's going to be complicated one , because whatever ukraine agrees to is going to have to go through public referendum in ukraine. so vladimir putin is going to have that as an out apparently and i think from putin's perspective it's going to be very, very difficult for him to accede to giving ukraine any kind of territorial concessions . so this is going to be a difficult one to say the least. i don't see a quick solution certainly, although what's clear is vladimir putin has seen significant defeat in ukraine. he did not expect to see the level of resistance he's seen and frankly, it's the courage of the ukrainian people that's come through during this conflict. indeed it is that always good to get your insight. thank you for coming on , sir. we appreciate it. thank you , chris . meantime, judge ketanji making history as the first black woman to sit on the nation's highest court late monday, the senate voted to discharge

united states strategy of declassifying intelligence going back to when we were discussing russia's plans for invasion of ukraine and the united states, which was declassifying reams of intelligence about that . but look, this has been russia's playbook. past is prolog. they did this to grozny shortly after vladimir putin became president. they've done it to syria. they just have different or lack of real rules of engagement of the sort that we have in the united states. i can tell you i served three years in war zones with the u.s. military. we take great pains to ensure we're striking military, not noncombatant targets. that's just not the way that the russians operate. they're trying to subdue the ukrainian population and they're trying to do it by instilling fear as a result of these indiscriminate attacks. barbara, attacks as they are, does this intelligence directly tie putin to these atrocities

know that russia bombed a maternity ward in mariupol in that drama theater. again, they've been doing this throughout ukraine and even though they've redistributed some of their troops, they're still launching long range missiles against ukrainian cities. and i really i fear that the worst is yet to come. the there's more of a policy requirement here for the biden administration that they label it or war crimes, whatever they wish. i would just i think president biden needs to speak to the russian military, spoke to the russian people in poland. he needs to speak to the russian military and tell them, listen, stop taking orders from the kgb guy in the kremlin to commit these war crimes against ukrainian civilians. do that and there's a chance for us to normalize relations with russia. but you've got to stop doing this . and i think that's that's when this ends is when the russian military stops taking orders from vladimir putin.

recognized that they made some pretty egregious strategic errors, not to mention just the tactical errors when they came in originally they split their forces in four different directions, basically making sure they didn't have enough to succeed anywhere. they've now recognized that . and now that they see that the best chance they have tactically is to potentially surround a pocket of up to 40000 ukrainian soldiers opposite the donbas area. so that has been probably the highlight of the last two weeks for the russian military as they basically put a freeze on all the other areas for the most part now they're sending in reinforcements both from repositioning troops that were up in the north around kyiv and sue me and they're now bringing it as you mentioned, bogner group are bringing in volunteers even from syria and they're bringing up forces once they have closed off the last part, mariupol up into the south part of that pocket. so they are pulling out all the stops to really try and win this battle.

and colonel, if we can put that map up again, you can see there, as you mentioned in mariupol in the south where the russians are obviously having a lot of success in occupying that area. but then in the northern part, the donbass and above it in the area in kharkiv, that's certainly an important battle that we're about to see play out because that would mean if russia can occupy that , then they can bring forces down and try and sort of outflank and close close in the ukrainian troops. that's exactly right. now i think that's exactly their plan is that they want to continue the pressure that they've had from the donbas, from the luhansk and donetsk area on the front side of that . and then now they want to bring in troops from both the north and the south simultaneously to try to link them. and ghofran from behind ukraine recognizes this and zelenskyy has been sending reinforcements from kyiv all the way down into the back side of it to try to

forestall that . so everybody recognizes this is the next big fight and i bet within the next three to four days you're going to see lots of engagements down here and it'll be interesting to see how this turns out. >> colonel, i found it very fascinating. you wrote in an op ed that you believe this redeploy to eastern ukraine could actually put ukrainians at greater danger, expose them to greater danger. why? because if russia is able to close that pocket that we keep talking about, there's a huge portion of their forces, possibly 40 to 50% of the remaining active duty troops. if russia closes off those, they can basically just starve them out because they won't be able to get food, fuel or any of those kinds of things. and then russia will have all the rest of its forces which then they could potentially go back up to kharkiv and actually take that city. and then again, kyiv could come into danger. so it's not out of the woods yet. there's still a lot of fighting to go in just in the last
