politics of all of this. and i think what they are doing is they say they will appeal this but at this point they haven't issued a stay. as you've noted, what's going to be the difference in the next two weeks? it is the 11th circuit court of appeals now mostly, i believe, trump appointees which means this would likely get to the supreme court. i think that's good. because we don't want this to happen again. we don't want the cdc to be a tyrant and a dictator and that's where these judicial decisions, that's what will be cleared up. this is like another afghanistan, if you will. every single thing they've done has been a disaster. this decision is a disaster. they will lose at every court level but it makes it look like they are fighting and they will fight to the he little rock shun and that's the extent of it. i believe we'll still win on this. >> harris: there is room for the criticism that there is no love for corporations from this

position, it confirms the politics of it where you don't have to wear it for two weeks but now you do wear it for two weeks. it's the authority, and this, that and the other thing. it makes it worse to be on it and then off it. fascinatingly the one comment from a commentator this will hurt our return to normal. getting back to normal will hurt the return to normal. what happened to biden's we're going to overcome covid and get back to normal. what they want is masks to be normal. this is an issue about control. this is why the american people haven't liked it. putting on that mask and people on our flights without a mask, it reminds you of the impact of them. that is going to set in for these next two weeks and there will be -- maybe they want the divide in the country. some people have liked the government being able to issue these orders, regular leftists want to reinforce government control. and they need a fight but this can't be it. it is harming the country.

>> harris: look no farther than your school boards to figure that out as you have seen people come into communities and sit on those boards who might have an agenda. i want to get to title 42, though. because all of this is happening with the back drop of as i said, still a pandemic. in countries where their vaccines have not proven to be as effective as here and there is a lot of conversation about how many shots you get, that's not what this is about. what this is about is if you have a prayer's hope of protecting yourself from an onslaught of people who aren't being tested and all of that title 42 help keeps them south of the border. today there is reporter from bill melugin that, well, you know, some of the border officials are telling their crews go ahead and relax some of that alalready. go ahead and don't apply title 42 already. may 23rd isn't even here yet.

i can tell you that under this administration, they took a secure border and pretty much just ceded everything to the criminal cartels. getting rid of title 42 is going to be the equivalent of handing the key to the front door of every american who the criminal cartels. that's how chaotic it is. they are doing this because there are no consequences. a couple of days ago we had an agent assaulted on the arizona border. he fought for over 17 minutes. he was assaulted. there was blood. and right now -- they are trying to figure out why they have not decided to go forward with prosecution under this administration where it is empowering the criminal minds. empowering criminals to come into this country including the cartels coming into the united states. >> harris: i want to pause there for a second.

you and i have done immigration town halls together and talked about this conversation down to the border, all of that for years now. in the last year, i hear an urgency in your voice. while we don't know why they aren't adjudicating for prosecuting that case, i'm sure you have some thoughts. >> harris, i'm heartbroken. i am seriously heartbroken. as somebody that has seen the men and women out there putting their lives on the line. i have lost friends there because they've been attacked by the criminal element. to see this administration completely turn their back on those men and women, turn their back on the families who lost loved ones out there working and turned their back on the american public i'm heartbroken. you have had me on here so many times and spoken about the issues happening down here. i've been infuriated, angry, frustrated. right now i am heartbroken.

and you have liberal columnists piling on it further depresses the democratic base leading to a november election where republicans surge in turnout and democrats stay home. >> harris: marc thiessen is fox news contributor and former white house speech writer and who if you were in this white house your fingers would be breaking from all of the cleanup that you would have to be writing about and fixing. >> it's crazy. >> harris: let's talk about this polling. let's talk about what it looks like to hit the reset button. >> so first of all, i mean, the democrats are trying to have it both ways in the biden administration. they are suing to restore the federal mask mandate on planes because the covid emergency is not yet over. but they are lifting title 42 at the border because the covid emergency is over. so which is it? is the covid emergency over or is it not?

they can't have it both ways. their position effectively right now is the covid emergency is over for illegal immigrants but it is not over for the rest of us. that seems to be a not politically smart approach to this whole thing and democrats understand this. this is why you have this revolt among democrats on title 42 because they realize that the only thing that is preventing biden from seeing the full consequences of his disastrous policies of the southern border is title 42. he got rid of all of trump's other border policies. got rid of the remain in mexico poll syracuse he got rid of the safe third country agreement with the central american countries. he effectively stopped deportations. they've dropped to the lowest level in history. so all that's left is title 42 between us and open borders and then he would have to really face the consequences of having millions of people crossing the border. so we haven't even seen it yet, the impact because of title 42.

it's not -- let's tick off all the other issues. the other issue is crime. the crime wave is getting worse. new york had one of its most violent easter weekends. it had record shootings. what people are starting to figure out is that the border crisis is related to the crime wave. the dea did a study that showed that the influx of fentanyl coming into the united states has fueled the crime wave because most of the -- in 34 cities they found that the rise in gun violence is directly related to drug crimes and drug cartels and the gangs that are working. so the border crisis is fueling the crime crisis which means it is not just border states vulnerable democrats like senator mark kelly running in arizona. it is also maggie hassan from new hampshire, as far as you can get from the border. she just went down to the border and had her picture taken in front of the border wall saying we need to build

how did we get here? i feel like amber heard's lawyers should have done a better job of limiting the evidence that should have been introduced in this case. you just mentioned about amber heard being violent against johnny depp. she is not being sued for assault and battery. why that is even coming into evidence? because her lawyers have allowed that to come into evidence. >> harris: what about the cameras in the courthouse? as media we get to see something that we really haven't seen like this since o.j. simpson. what does it do for the case of either of them? >> it glamorized the case and turns it into a tv set. you saw, for example. johnny depp standing up in the testimony box the other day and showing how his mom was acting before she died and falling to the side. you would never see that in a regular courtroom. but when there are cameras it lends itself to theatrics.

>> harris: you mentioned the three cases, important topics. divorce, those are very intimate topics. we heard about their sex life and the drug-fueled existence and now saying it was her perception. you don't go to rehab on your own island unless you rehab from something. it is a circular argument. you mentioned personal injuries and very important topics we usually don't witness. are we seeing more than we should see at this point? >> excellent point. absolutely. harris, in every jury trial before a trial starts, there are what's called motions in limine lat-in for limiting evidence. good lawyers can make or break a case by filing these motions to shrink the case into the evidence they believe is relevant in the lawsuit. again, heard's lawyers should have been filing a mountain of these motions to block any evidence coming in, for example, of amber heard being violent with johnny depp. remember the comment he made

about -- about her lying about nail polish being on a napkin. her lawyer should have done a better job. this is a free for all. one other quick point it will also hurt depp. he opened the door now to all of this testimony about drug use. >> harris: audio tape comes out at 20:15. they were recording each other and she was recording him surup tishously but always came clean when he was recording her. you would have to live with him to know it to be true. there is a lot of tape. they aren't shy about the cameras, we'll start there. her audio shows that she was admitting that she had been violent on audio tape. now, i don't know how that comes into play because you are trying to do a defamation case. i'm saying these other topics are really important divorce, personal injury. but she could still walk away from that $50 million penalty he wants her to pay him because he hasn't proven defamation yet.

>> right. what depp's strategy was and it's risky, is that he engaged in character assassination against amber heard, okay? there is a concept-in-law called inadd miss able character evidence. heard's lawyers should have blocked it. what depp's lawyers got in was character evidence of amber heard. you heard the testimony. depp said i'm divorcing you. you want to punch me and she punches him and throws the vodka bottle at him and hits him. in a real courtroom without cameras and good lawyering i don't think any of that should have been coming into evidence. heard will have to go on the offensive now. she has to character assassinate depp. at the end of the day this case will be decided with what you mentioned. text messages, audio tape and witnesses, forensic evidence. >> harris: some of the witnesses could include elon musk who dated her previously.
