>> sean: musical authorities have released the first of troublesome videos from showing the immediate aftermath of the fatal film shooting sinemet photographer, alec baldwin, what a terrible tragedy that took place here. i keep looking at your screen and footage shows alec baldwin raise rehearsing with the weapon and handling the gun moments before the fatal shooting and here is alec baldwin speaking to authorities after a senseless tragedy. take a look at this. >> i don't want to do this anymore. and i'm the one holding the gun in my hand. everything else taken care of. where are you now? she hands me the gun. i'm assuming she did everything right. like she did the last two weeks. i put it in the holster slow for

rehearsing. i turned, cocked the pistol back. and then he starts screaming. >> [indistinct] >> sean: here with reaction fox news analyst gregg jarrett and former florida attorney general pam bondi. when you look how he handled this, i don't know what you glean from those initial conversations, but then there was a period of time he said he was going to hand over his phone and he didn't hand over his palm. that took quite a while. then you have the stage interview, i thought it was rehearsed. obviously it was coached by law years. now, getting more information. is he in legal jeopardy? >> he is, especially in the

civil suit. potential criminal and mainly the civil suit. because prosecutors and police will tell you you get your best evidence moments after an incident happened. they brought him in and i want to commend the officers. they brought him in and read him his miranda rights and let him go. did you hear anything, sean and the initial interview and he didn't know he was being recorded, by the way much more meaningful. anything in the interview where he showed remorse for alina hutchins or the other man shot? nothing. it was about alec baldwin and alec baldwin thinking he was smarter than this detective and talking his way out of it. they sat there and let them go. that was good police work on their part. contrast that with more scripted video with stephanopoulos. he said he is remorseful, crying, months and months later. so, i understand why her family is extremely upset. he showed no remorse without the

victim or the other man shot with the initial interview. it was about him getting himself out of trouble and talking about how his family come there and have fun and be entertained until the investigation was over. >> sean: what a great analysis. greg, let's get your take on this. >> what is key and the police interview is alec baldwin says, they always give me a pole gun and i assumed it was not loaded. you cannot assume. the standard in the industry is that the actor always checks the gun. that is in the union rules. that is the excepted duty of due care to ensure the safety of others. the breach of that duty could rise to the level of criminality. the standard is that the actor watches the armor and the prop master inspector gun. once it is handed to him, he does the same thing. he doesn't assume that they got it right.

that could be a fatal assumption. he is supposed to open up the gun, checked the barrel, checked the cylinder make sure there is a blank and not a live round. so the question becomes, is that the breach of the duty at the approximate cause of the deaths of alina hutchins? i think quite clearly it is spirits have been the question is, does that rise to the level of gross negligence which constitutes involuntary manslaughter in new mexico? that will be up to the district attorney but the fact the occupational safety bureau found that this is an out-of-control set. that there had been two misfires prior to the fatal shooting and everybody knew it including baldwin means that baldwin had an elevated duty to do care to inspect the gun and he failed to do that, sean. >> sean: last word for pam. do you believe it has a potential to get to gross negligence? >> i do what i think gross

negligence or second-degree murder reckless disregard of human life but the burden is so much higher beyond reasonable doubt. the civil suit is proponents of evidence much easier to prove but as gregg said he was in charge and six people walked off of the set because of safety concerns. and then he didn't interfere with stephanopoulos and tries to distance himself even more by saying he didn't fire the gun but cocked the trigger. ballistics can also toe otherwise. >> sean: one thing to add to this, was an easy executive producer on the set and in charge of all of this? >> derelict of duty. and he was on notice. >> double jeopardy in a way. >> sean: the great points from analysis gregg and pam hear it a lot more "hannity" coming up afterr this.
