congress to take action without republican support. we have fox team coverage on the breaking news this morning. brooke is standing by with the blowback. >> carley: we began with doug in washington. >> good morning, this is a leak the likes of which may be unprecedented for the supreme court. there have been protest for and against outside the court pretty much all night long. we may see this and probably will see this gather steam through the morning. this draft majority opinion obtained by political could always change because it is a draft, but for now the wording is very clear. just a samuel alito referring to 1973 decision roe vs. wade, roe was egregiously wrong from the start. the reasoning is exceptionally weak and the decision has had damaging consequences. far from bringing about national settlement of the abortion issue, roe versus casey with a debate and deepen division. the reaction has been swift from

both sides of the debate. >> this is bittersweet. on the one hand it is sweet because we are vindicating the constitution, and the babies who have been unprotected by the law. the better part is the way this was leaked. this is an utter disgrace in terms of how it was released. >> it would trigger the laws in over 20 states that have already said that they will outlaw abortion in their state. it will create a packed work of laws across the country. >> the senator references a patchwork of laws that congress to pass something to and this is where president biden stood on this back in 2020. >> a woman does have a right to choose. i would, in fact come if they rule it to be unconstitutional,i would send to the united states congress and it will pass, i believe, a bill, excuse me, legislates roe v. wade and justified kc.

it is a woman's right to do that, period. >> and there was already a push from senator bernie sanders to eliminate the filibuster to try to pass abortion legislation with the support of democrats alone in the senate. casey and joey, back to you guys. >> so many political implications to this and the fact the fact it is leaking to have the same day the official start of the midterm election season, very notable. doug, thank you so much, brooke has much more as democrats are celebrating the leaker, brooke. >> that is right, guys, the former clinton staff are celebrating the brave clerk for leaking the draft of justice samuel alito striking down roe v. wade and hail mary attempt to change the court's minds but republicans say those cheers are at the expense of the integrity of the highest court in the country. listen.

country." the fbi expected to be in the investigation and thesaurus causing this controversy, carley, joey. >> joey: broke, thank you. let's bring in line all roads, fighting for life. if this is a decision the supreme court researches and overturns roe vs. wade, it will go back to 50 different states from 50 different legislatures and governors to pass laws but what does that mean for pro-life movement and people like yourself advocating against abortion as being the law of the land? >> will commit would be a huge step in the right direction for states to at least, at minimum, have the right to protect children and their different vicinities. right now abortion on demand is the law of the land whether red state or blue state where pro-life or not. you cannot do abortion restrictions the way many states want to because of roe v. wade.

roe v. wade actively with abortion all nine months without any limit and now since then, there have been dozens of states that have tried to put limits in place and had trouble doing that. so roe v. wade does receive this huge blow and in fact from a real decision coming down the pie, it would mean that they could finally have abortion pans that they been wanting to have for decades. and that liberty of the states and also for the rights of children and the women who deserve the right to life just like you and me. >> carley: you know, reading through the bombshell politico report the the author says no draft decision in the history of the court disclosed publicly while the case is pending. it goes on to say the unprecedented revelation bound to debate over what was the most controversial case on the talk at this term. they certainly got that right. this leak is supposed to

intimidate justices into changing their minds, do you think that is a possibility of happening? i see you shaking your head no. i agree with that. >> listen, this was an attempted act of intimidation because pro-abortion side of the far left in a frenzy right now. they were sacrament of abortion, they want to protect abortion and killing of preborn children at all cost. so i think this act of intimidation will ultimately fail. because pro-america is strong and justices on the supreme court that we have potentially five or six of them, up to six of them who see the constitution as they want to defend the constitutional right to life, given to us by the virtue of being human. so, i'm very optimistic the supreme court will not get into intimidation tactics but intellectually honest and undo the damage, illogical decision

source within the supreme court were to give this to them, they really have no choice but to do it, it would be journalistic malfeasance, if they didn't. def con1 to liberals, abortion law could be returned to states and start mobilizing now. it is virtually guaranteed, you will see massive protest in cities across the country as early as this weekend if you read things yoenl and buzz happening there. this story from media perspective, this debate will dominate the news cycle for many days and weeks to come. wait until you start to see headlines and the op-eds once because this broke 9 p.m. eastern last night. probably by wednesday, you will see hyperbole, like you would not believe and scotus blog, here is what it said about the

>> joey: we have reaction from mark levine tweeting the leak continues the marxist war on civil society. and andy mccarthy says if this story is true, the court should issue a statement right away. what we have are two different issues, the fact this decision on roe v. wade may come out and really be controverial and turn things up, we have the leak itself, so regardless of the issue, the fact the leak happened, people are reacting to both. what does this mean for the court moving forward? do they get the chance to issue this decision without controversy? >> joey: that will be impossible, without controversy part, it would be controversial, even if it went through the normal process and joey, the supreme court had 61% approval rating 10 years ago, it has lost 21 point and when you poll

fbi will get involved in investigating who the leaker was and when we find out who she or they were, you can imagine that the reaction will be very divided on the decision to leak this report. they will be hailed a hero by a lot of media outlets. >> joe: oh, yeah, when you go online that is exactly the word that is being used, this person is a hero to the left, anyway, for getting this information out, for being a whistleblower who is brave and possibly put their career on the line and you saw conservative reaction from jonathan turley or andrew mccarthy, this is going to be big, there are barricades put around the supreme court when this story comes out and november midterms looking like red tsunami coming in the house. for the first time, democrats are energized, but so are republicans.

allowed to fly a flag, this specific organization because it was religious was not allowed to, but the supreme court ruled that inconstitutional, is that correct? >> yes, the city of boston for the last 12 years had a policy where civic organizations could petition to fly a flag, have a ceremony and in fact we flew the gadsden flag, with the rattlesnake that says "don't tread on me," in 2013 and 2014, with no problem. we upon have the christian flag, a simple flag, you might see in the back of me here. because the word "christian" was in the petition application for the permit that is when we were denied and the city said we could have a ser moan and he bring christian flags, we just couldn't put it up on the flag

knowledge. this is just so outrageous that this draft opinion was leaked. it is clearly an attempt to influence the outcome. be prepared for the scorched earth tactics of the left on this issue. they believe the ends justify the means no matter what laws or norms they have to break and be prepared for a kavanaugh-like approach to the supreme court on this one. they are going to burn it down, as you are hearing activists say in order to try to stop this. what is such a shame, many pro-life activists and people who believe in the sanctity of life abided by the law for nearly 50 years, even though they believe that child's life was being unjustly taken, but i would not expect the same courtesy from the other side for our nation's system and for its rule of law. >> joey: congressman, democrats

are pushing for a full-blown power grab, urging congress to take action without any republican support. bernie sanders is tweeting, congress must pass legislation that codifies roe v. wade as the law of the land in this country now. if there are not 60 votes in the senate to do it, we must filibuster to pass it with 50 votes. you are a republican in congress, do you think this is something democrats can do and will try to do? >> i think they will try to do, it is ironic if you read the draft opinion, it is saying this is purview of lawmakers, but you are hearing the left saying lawmakers should be taking action. i don't see it getting through the senate at the end of the day, this is going to be burn it down, scorched earth, whoever we have to trash and whatever we have to rip up in terms of this country's traditions and laws, they will do it, the ends justify the means.

>> carley: congressman, it is primary election day in ohio, how does this leak impact midterm election and does this give democrats energy? >> i don't see it impacting the primary in ohio necessarily. >> carley: across the board going forward, depending what the supreme court says, if they overturn roe v. wade, how would that impact the midterm elections? >> oh, look, i think that is one reason it was leaked in order to politically impact the elections and what the democrats are hoping is this will reenergize a base that has been so disappointed with the biden administration, that was one name of this leak. >> joey: congressman, let's turn to ukraine, a topic you have been passionate about. yesterday i spoke to brett velicovich, he made this shocking allegation. >> i hope when president biden

border, we lose all visibility and losing chain of custody and don't know where it is going and how effective it is. on the visit from biden, look at the irony there, the obama and biden administration blocked the javelin, refused to send the javelin in 2014, when russia invaded. only president sent this is the in and now biden is going to a defense contractor and try to take credit. >> carley: congressman from ukraine to china, chinese officials held a meeting last month looking at ways to protect their economy in the event the west sanctions china the way we have russia, does that mean they are already preparing for an invasion of taiwan? >> they are absolutely preparing, preparing militarily, diplomatically around the world and preparing economically.
