♪ ♪ >> kayleigh: this is "outnumbered." i am kayleigh mcenany here is my cohost, emily compagno. also joining us, carley shimkus, rachel campos-duffy, and ben ferguson. a very dangerous campaign of intimidation and harassment may now be about to unfold in the fight over rel v wade. as the radical left looks to target the conservative justices on the supreme court after the leaked draft opinion on abortion. while security fencing was put

around where they work but not continuing on our southern border, there's that. now we just learned there is an increased police presence outside of the justice's home. here's why. some left-leaning groups are directing protesters to show up at the doorsteps of six "extremist justices." even the streets where they live with their families, and a police are bracing for violence. emily, it's two groups pushing people to go to the homes of supreme court justices. one is called shut down d.c. they want a candlelight vigil. a march to justice kavanaugh and roberts' homes, and urging protesters to go to the homes of the extremist justices. you can't make this up. >> emily: my issue with this is the implication of that and the galvanizing people to show up at the doors. you can protest all you want in those public spaces but we all remember what happened to the federal judge esther salas in 2020 when her son was shot dead

on their doorstep because of a disgruntled attorney. i'm not saying that all of these peaceful protesters, that it's an automatic line to violence, but that's the worst-case scenario and nobody knows that more than judge salas, and that's why she introduced state legislation to protect judges from having the information doxxed, exactly. there was a federal analog. at the time critics said we have to have publications available because we need to report on bad actors in the judiciary. is that what this is? supreme court justices who ruled in line with the constitution, they are all of a sudden bad actors and therefore held vulnerable to this? is a questions that need to be asked. who is funding these groups? when they say there's a stipend, who is it? we know black lives matter is contributing in part, and other organizations, but why won't they condemn the violence and secure peace by groups like we demand justice, who been down

that road before? >> kayleigh: and why haven't we heard a condemnation of the white house? here is jen psaki who don't even condemn the leak. watch. >> does the white house especially condemn this leak? >> i don't think we have a particular view on that other than to say that we certainly note the unprecedented nature of it. what we are mindful of, it's up to the department of justice to determine what, if any, actions they will take. >> kayleigh: meanwhile, adam schiff saying, "that sideshow." they want even condemn the leak. >> rachel: of course they won't. they've been fund-raising in record time off of this. don't forget, this is the abortion rights lobby. this is big business. this is what this is about. by the way, this won't be the first time in u.s. history that people have profited off of deciding who is human enough to enjoy the rights we all enjoyed in the constitution. they want to blow up the system. look, abortion is a human rights

issue of our time. the pro-life movement, as you know, many of the foot soldiers in this movement have been toiling patiently within the system trying to change the culture of life and trying to change the politics behind this issue, and they have a huge win because they put their trust in a guy that i got calls from people going, "how can we trust this guy?" and they are like, you know what? we've tried all the other people, we are going to try donald trump, and boy, did he deliver. here we are, the portions aren't over, it has to go back to the states. but if you look at the pro-life movement they have not been about blowing up the system, they've been about justice. it's a pro love movement and the pro-american movement, unlike, i think, what you're seeing on other side.

steel and i can't help to think what the porters reporters would be asking. does president trump condemn this violence, this march, this leak? and where i would dodge the answer, they would be a follow-up. >> that's a great situation and nobody handles those situations better than you. the rhetoric is so inflamed right now. after this opinion was leaked, obama said many of americans woke up in fear that their essential freedoms are at risk. i didn't know that. what's clear is that opponents of roe want to punish women and take away their rights. the hysterics are not based in reality. what samuel alito's draft opinion said is that the people should decide how abortion is regulated. that's the most pro-democracy stance ever. then when it comes to abortion itself, you hear the "my body,

my choice," the overturning roe would hurt poor women, then it spins into it's not just about abortion, it's about gay marriage and contraception. the pro-life stance is really simple. all it is is, yes, but you're killing a baby. and what roe v. wade does is it says you can have an abortion up to 24 weeks. that's six months. you see in a six-month sonogram. you have ten fingers, ten toes, you have fingerprints. >> you have a baby bump! >> carley: the baby already has an identity. cori bush, who i believe is pro-choice, told this really compelling story once about her birth story. it was a traumatic experience, and god bless her for going through it, but she had her son at 23 weeks. it was one of the most pro-life stories i've ever heard in my life. there is a lot of inflamed rhetoric on this, and rachel, i agree with you, the other side is simple. "but you're killing a baby." that's all it is.

>> rachel: that's well said, carley paid what is not well said is talking about the legitimacy of the supreme court. >> we are all right to talk about the legitimacy of the to be in court. >> what does this mean for the supreme court? >> in a word, illegitimacy. >> americans will rightly conclude that their voices and their votes no longer matter. >> are these people really a bunch of politicians in robes? >> it's insane that supreme court justices can lie in their job interview without any repercussions. >> decisions about what you can do with your body are now being made by four old dudes and a woman who thinks "the handmaid's tale" is a rom-com. >> they should raise every one of those babies. this all started because of this [bleep] electoral college. >> kayleigh: here's what you don't expect. listen to the white house press secretary on whether it's

the legitimacy of the decision. >> if the supreme court moves to strike down roe, should americans be prepared to accept that decision as legitimate? and would president biden accept that? >> i can't speak for what actions could be possible on the legal front. i would point you to the department of justice on that. >> it sounds like you're saying yes, that he would consider it legitimate. >> there's not even a decision. we don't know the validity -- we know this is a leaked document and not the final opinion, so i can't speak to that hypothetically at this point. >> kayleigh: so they won't accept it, sounds like. >> ben: democrats cut themselves in a big problem this year. remember, it was my body, my choice. and they said it's no longer your body and your choice, because we want to mandate vaccines. then they said they couldn't decide what a woman was. so i can identify as a woman, so you can't say it's a woman's right to choose anymore because now men can be women. so the only thing left for democrats to do at this point

was to say, okay, we will personally attack the supreme court, endanger their lives, their families' lives, and that's how we win this thing. there's one important thing we are missing. the democratic party, there is no distinction between extremist groups and democratic party. the actual democratic party, there is no difference now between extremist groups and the white house, because the white house knew this was going to come down. i believe this was orchestrated from the supreme court. i think they realized the only way they can win this is through actual violence. they don't condemn black lives matter, they are tearing down and torching cities. they do not believe in life anywhere as long as it means they can get what they want. we need to treat the democratic party and the white house the way they need to be treated. these are extremists who say that we will hold you hostage as a country and, after you at your homes until we get our way. and we will silencing online and try to put you in jail everywhere we can. that is the democratic party

wasn't for them going after specifically mothers and saying, "get out of your kids school and shut up about what we are teaching your kids." >> and they are saying lgbtq kids are going to be segregated for other children. and when asked where is the proof, here's what she said. >> the president said today, what happens if you change the law saying children who are lgbtq can't be in classrooms with other children? what is he talking about? >> i think, peter, we have seen extreme laws that target lgbtq families, and their kids across the country. i think he is saying we don't know what they are capable of give and what they have done to date. >> which state is trying to segregate lgbtq children in the classroom? >> i think we have seen laws that are incredibly discriminatory. that's what the president is referring to. the fact that he doesn't know what additional steps could be taken by extreme wings of the party that would rather divide,

rather than work on issues the american people actually are focused on and actually impacting them. >> i didn't hear a statement. >> rachel: this is made up. she is doing some cleanup. he talked about the talking points, this is not on the talking points. this was just biden and when of his crazy moments or he's losing it. and now poor jen psaki has to go clean that up. i remember back in 2012 when my husband was running, the democrats had come up with the war on women. you know what? it did work back in those days. i could see republicans running around making sure that they were not having binders full of women, everybody was trying to cover themselves. we have been so desensitized because everyday americans including me -- i'm hispanic, and i've been called a racist and all kinds of stuff -- we are also desensitized that this stuff doesn't work anymore. and they look so pathetic right now. they look so pathetic because what the american people have been very clearly saying is,

security and law enforcement was brought in and instructed how to utilize warrants to remove parents from those meetings and remove parents from the school campus. this is a very real and, in my opinion, ironically the radical approach. when we have our president saying the radical aspect is heaven forbid the supreme court justices restore power and authority back to the hands of the people, the radical segment is right now and they are saying that average americans are the enemy and they are taking away power from the people and putting it into the hands of the government and mainstream media are simply amplifying that narrative that we are below them, we are the enemy, we are worth nothing. >> kayleigh: don lemon, 'tween tray for. that'll work well. if you thought the resurfacing of this tiktok video is bad enough, there is now a new video of nina janco it's raising serious questions about how the biden administration came to choose or to lead its

jankowicz called it hunter's laptops are a trump campaign product, and she posted tiktok videos where she sang about misinformation and praised senator elizabeth warren. now who we are learning that she dismissed concerns about critical race theory in schools. watch. >> critical race theory has become one of those hot button issues that the republicans and other disinformers engaged in disinformation for profit, frankly, making money off of this, too. >> emily: clearly she's totally neutral. but the sheer number of revelations have critics raising the key question, did anyone that jankowicz? yesterday senator kennedy press alejandro mayorkas about what the department did know about h. >> she said that mr. hunter biden's laptop is russian disinformation. she vouched for the veracity of the steele dossier.

was the department aware of her tiktok videos? >> senator, i -- >> they are really quite precocious. [laughter] >> emily: racial? >> rachel: they are quite precocious. we think her voice is not bad! that said, very early on we started hearing when this disinformation board came out, they started talking about or explaining it and rationalizing what was happening at the border, that they wanted to deal with disinformation at the border. and i'm thinking, these are the last people, they want the truth about what's going on at the border? i thought it was very curious. and good on jacqui heinrich who, in her press conference with jen psaki, asked her about it. because she asked a question that telemundo and univision wouldn't ask. what exactly does this board and home insecure to have planned for all the disobedient hispanic americans, many of them democrats, sheriffs, people living there, and mayors,

telling the truth about the chaos that's happening at the border? why is mayorkas doing this to them? what is going on there? they must have seen some awful poll numbers paley seen them coming out. they are very concerned about hispanics being disobedient and they want to silence them. i believe that's what this board is trying to do. >> emily: given how transparent that was, how is it that she somehow was the eminently qualified pick? what happened to that vetting process? i did knew and didn't care, or they didn't know, both which are equally problematic. we saw a video of her equating all republicans with disinformation propaganda. >> ben: she's extreme and qualified at lying and at disinformation, and she's extremely qualified at making other people and their views look like they are somehow extreme.

yes, of course they vetted her. they knew they were getting. they didn't care about what she said because it fit their narrative. she said the steele dossier was propaganda. she was wrong and she lied. she's an expert at lying. that qualified her for this job. i was looking at the list of things she said, that not only was the steele dossier legitimate but that we need to stifle free speech online, and specifically she sat online. the reason she said that, he also said she wanted to bring back the fairness doctrine. if you look at her resume, this is exactly what they were vetting and looking for. you had to find someone who has anti-free speech, someone who would say the hunter biden laptop wasn't real in this position. she checked all the boxes. if you put together what this administrator wanted, in the vetting process. so the idea that she wasn't vetted? no, she is the perfect candidate for this. they got who they wanted and now the tax dollars are paying for this. they are going to after parents, people at the border, legitimate

news stories. she got two of the biggest stories of literally this entire administration the last five years wrong and that's why she was qualified for the job. >> emily: carley, in typical fashion, they are concentrating that power into the hands of one. this is such a departure from the decades the u.s. has had in terms of their approach to disinformation or social abdication, and its inter-agency work. it's collaboration of multiple people, multiple agencies, to ensure it's not in the hands of one person let alone one absolute liar who has ironically made her tiktoks. >> carley: is like you read my mind and what i wanted to say here. the state department already has on the call the global engagement center. i was looking up exactly the definition. the coronation exposed and countered foreign disinformation efforts aimed at undermining and influencing this policy in the united states. we already have what they say that it disinformation board is going to do.

we don't need two. it's either release of time and money and a bureaucracy or this board will be doing something different. the differencing is very get into a bunch of questions that i think really have yet to be answered. and we have known about this for over a week. >> kayleigh: i would just say jonathan turley pointed this out and he has a great point. when you look at these pieces of disinformation in the last few months, it's the border-whipping incident rails border patrol agents were accused of whipping migrants. you have folks like ayanna pressley who called it white's premises behavior, maxine waters, worse than what we witnessed during slavery, and they were met with our nation's horrors. and others silence in the white house. maybe instead of singing you could start with that whipping incident. >> emily: kamala harris weighed in, too, and they disbanded that units. so another underfunding and weakening of the support we have

dollars in student debt and biden is resisting such lobbying. the vice president has been increasingly wary of becoming part of the public face of the administration's response." rachel, defining the president and distancing yourself from student loan debt or from joe? i don't know. >> rachel: she is distancing herself from jail but also there are reports that jill is the one who has never forgiven kamala harris four, during the debate, suggesting that joe biden was racist. remember the whole bussing thing? where we are all desensitized to it on the conservative side, on the liberal side it's that they still really care page so she's never forgiven her for that. and i think this tension grows, because jill biden, a spouse is very important in the relationship so there's a lot of influence.

jill biden has even more influence on because she's like a visiting angel. [laughter] i think this is maybe more about the girls than the president. she's by his side correcting him... >> ben: telling him not to read books, i'll do that for you, keep waving! >> kayleigh: i would be upset, too, if someone called my husband a racist. kamala harris has become increasingly desperate lender approval hit 28%. they said as a result she was growing impatient, whom she blamed for letting her down. they even initiated an audit of her office. >> ben: i'm not surprised that joe biden saw what i think a lot of americans saw, which is kamala harris might be the most undisciplined vice president and political major candidate in our lifetime. she goes rogue on everything including the people that work for her. she goes against everybody telling her advice, so they quit, because while you work for

someone who never listens to you? i think on the student debt she said, this is my brand. i want to forgive $1 trillion plus in student debt, i want to have it be $55,000 or $100,000 household or even more. and i think she realizes, $8,000 were $10,000 isn't enough. i'm over hard-core socialist and this is my platform going forward. it's all she's got left. >> kayleigh: something else she has left, apparently this new book by alex burns from "the new york times" coming out. they said harris began seeking out advice from beyond her inner circle. one of the people she turned to was msnbc's morning joe. >> emily: this remind me of, in football, when someone hurts you and if you strike back you are the one who gets penalized. all this does or does it reflect poorly on her. whatever intention there is, whatever she doesn't like about the president, she is responding

in a way that will reflect only poorly on her. she doesn't want to be seen with him. that's not a good look. she is the first successor should anything, god forbid, happen to our president. we need a show of unity and we need her to be ride or die, and we need to know that behind the scenes there is an excess of information and a unity we can depend on. so this isn't a good look for her politically or personally but it's also disappointing and frankly a little frightening for us watching this unfold. >> ben: it shouldn't be that public. >> emily: it's like watching your friends fighting at a bar, who are a couple. >> ben: al gore, who did not have a relationship with bill clinton at all in the last year or year and a half, even shut up and stayed silent about it when he was running for president. he knew it was important to say he's the guy, i'm the vice president. >> kayleigh: it's important to have a confident vice president. president trump knew that mike pence would lead the task force and do a good job.

>> carley: i remember when kamala harris got covid everybody was like, how is the president? and they released a statement that said they haven't been in close contact for some time. [laughter] of course that makes sense. they have been away too many well-sourced reports about friction within their offices for it to not be true. and it makes sense. kamala harris, the reporting says that she feels like she's being set up to fail because she was given the border job, and biden's people feel like she's unprepared. i understand where his people are coming from but it's also his fault for choosing her during the democratic primary. only 7% of california democrats had harris as their first choice, and he tells her for identity politics reasons, and look what's happening now. >> kayleigh: and now there is no inevitable person to come after president biden. people looked at kamala harris and said, "no thank you." coming up, big gaps in relationships. not a big deal, or taboo? hey, maybe that's why there's tension between biden and
