"the washington post" is giving them three pinocchios for that and the headline in "the washington post" is biden's false claim that congressional republicans want to raise taxes. >> brian: they have this new term ultra maga movement. what it is senator rick scott said i believe because he grew up on a very low income family, single parent family that everybody should pay into it. even it's a dollar people who make under 100,000. no one adopted this mitch mcconnell didn't adopt it. not one senator adopted it. you can examine whether you like it or not. but the democrats said i have an idea. let's just categorize republicans want to raise your taxes.

woman today in the daily mail she looked at six different stores. she called stores three hours away none of them in the specific kind of baby formula that her child can tolerate. so what is happening now is because wants to help other parents and people want to help other parents desperate to feed their babies. so facebook, there are a bunch of facebook groups where people in certain part of the country will go, you know what? i just found that similac you were looking for. give me your address and i will send it to you. so, essentially total strangers are buying in their area and shipping it and then when the parent gets it they will send the person -- lovely thing to do. >> ainsley: some have colic and stomach issues if you stick with one formula. certain formulas made for this don't have certain ingredients in it sensitive for these stomachs. if you switch formulas over and

>> ainsley: we are back with a fox news alert. >> the map hunt for an escaped murder suspect in the alabama jail guard accused of sneaking him out coming to a shocking end. todd piro joins with the details. >> a nationwide search for a former alabama corrections officer and escaped inmate ends in a car wreck in indiana. casey white slightly injured gave himself up police say vicki white shot herself i doing in a hospital a short time later. vicki white helped the convict escape after engaging in a romantic relationship with him that lasted years. the investigators say the escape could have been in the works for years saying vicki white would communicate with casey white while he was behind bars. then a few months ago, he was sent to the jail she oversaw to

stand trial for a 2015 murder. vicki white quickly sold her home for cash and announced her retirement from law enforcement after telling her colleagues she was taking casey white for mental health evaluation. she helped the 6'9" man walk out of jail. white was already serving a 75-year sentence for a violent crime spree in 2015 that included the attempted murder of his ex-girlfriend, multiple stolen cars, and the execution of a pet dog. he also confessed to 2015 stabbing death of 59-year-old connie ridgeway. ridgeway's son joined "fox & friends" earlier this morning shocked by the action of his mother's accused killer. >> i'm surprised that casey white surrendered himself. i'm sad what happened to vicki. i feel like she was kind of a victim in the situation. >> and casey white could face' the death penalty if convicted. back to you. >> steve: and todd, you know, i was reading this morning that she, vicki white, was facing 10 years in prison for having

assisted in his escape and he was serving 75 years already. and the sheriff there said concerned about coming back and facing family and co-workers as she was about facing the charges. >> you have to imagine that during the course of this escape she likely had a come to jesus moment. and when it all went down there at the end she had to make a determination albeit under pretty beings teniating circumstances does she go back and face these very people in the prison system that she was once part of and go back to face her family or decide to do what she did she decided to choose the latter. >> brian: people were amazed that know this guy that she was still alive. is he a ruthless killer. he will use her. out on the road she was alive and then took her own life. >> todd: when we first heard what happened yesterday, brian, we all had assumption based on what herb said this guy is going to do away her the moment she no

written a letter to the u.s. attorney in delaware david weiss who was placed there by donald trump. they are asking, hey, u.s. attorney, did nicholas mcquade, who leads the department of justice criminal division he used to work with hunter biden's lawyer who is chris clark. did mr. mcquade at the department of justice recuse himself? because, if he hasn't, that is a clear violation of conflict of interest, according to the republicans. >> two of the republicans you have ron johnson and chuck grassley, senators, they sent a letter to a.g. merrick garland. and this is a portion of it. this soaks creates a -- actually they sent three letters this association creates a clear conflict of interest. yet, the department has failed to provide adequate responses to answer the threshold questions about whether mcquade has had any role in the hunter biden criminal case and whether he has

been recuse from it. attorney general garland silence draws serious. a cloud can easily be removed if the justice department showed a modicum of transparency. >> steve: here's the thing. the senators wrote three letters to the attorney general. merrick garland never wrote back. that's why they are now sending this letter to the u.s. attorney of delaware david weiss asking hey, what's up? >> brian: right. the other thing is there is real mystery of who is sustaining hunter biden's lifestyle. they got this guy who is this hollywood attorney, who not only paid $2 million to pay off his taxes, good friend, is he also keeping him in his luxury lifestyle in malibu so he is able to pay hunter biden's $20,000 a month home in malibu, california. they use the word swank, not all of it some of it is rural. they also pay his other living expenses. and he plans on doing a documentary on hunter biden.

latest heard that he was loaned a million dollars and yesterday it was revealed it's $2 million what's in it for this guy the documentary sean hannity last night and had this observation about how hunter whose father is the president is constantly needing to be bailed out. >> john paul mac isaac was at mac book owner at mac shop turn over the laptop. what's curious about all of this sean, he talks about in the "new york post" the time hunter came, in going through his files, stumbling upon a file named income. and he talks about the extraordinary amount that was coming in to hunter, 880,000 one year, more than 1 million the next year. more than 2 million the next year. and somehow he didn't save. he didn't do anything appropriate with this money because he is having to lean on a lawyer for $2 million

allegedly according to the post. to pay his taxes. to fund his lifestyle. a lawyer that his friends affectionately call his sugar brother. we know he paid some of joe biden's expenses and joe biden paid some of his. this looks like a nefarious web. >> brian: no kidding. why would the irs and fbi be looking into this four for years. why does the fbi not know where the laptop is at this hour. >> ainsley: every time we talk about hunter biden story. he has had a lot of problems growing up. he is making so much money on all these boards and hanging out with these wealthy gazillionaires. >> brian: and a lot of hookers and strippers. >> ainsley: the south park deal, he brokered that deal for the guys $1.5 billion. it's almost like they all hang out together and take care of one another. >> brian: right. >> steve: the lawyer, ultimate live what we started with, the letter that has been written to the u.s. attorney, it will be interesting to see if he does respond to the senators to say

[chanting] when do we want it? >> now. >> if we don't get tnchts shut it down. >> if we don't get it. >> shut it down. >> steve: there you have got pro-choice protesters outside the home in the commonwealth virginia supreme court justice samuel alito making their angry message quite clear. >> ainsley: comes as the senate is set to vote on expansive abortion rights bill tomorrow expected to fall well short of the votes. richard joins us now to talk about this. good morning, richard. >> good morning to you. >> ainsley: what's your reaction to this? we saw this is the third justice that people have stormed into the neighborhood filling up the streets and yelling things in front of their house. >> this is the first i have heard of it tells you the dangers of what happens when there is an early release of an opinion. this is not simply a disinterested statement of the

truth. it's an effort, i think probably to intimidate the justices and other justices that voted with them to change the way they voted. only thing they can do is ignore it at this point i don't think any legal action can be taken against the protesters. there is always a fine line between protesting on the one hand and intimidation on the other. so somebody like myself who wrote about this as a legal issue now finds himself in the middle of a political stew which is not exactly my standard beat. >> steve: you know, we haven't visited this particular issue in this format for a while, richard, but there is a federal law that makes it illegal to picket or protest in front of a member of the court's home if the intent is to influence. we have not yet heard from the attorney general of the united states. i mean, clearly, when it's peaceful, that's one thing. but, given that there is a federal statute you would think they would realize maybe we shouldn't be doing this because

it's it's against the law. >> maybe she should do it because. i don't believe it will hurt. one of the difficulties that you have in this case is the president has made his position perfectly clear about how much he supports the protesters, and now you have a statute like this, whoever clear it maybe, it's going to be dependent on merrick garland the irony of a supreme court justice now being attorney general quite apparent. it's up to him to essentially say that you have to either disperse it or back police there in one form or another. very difficult on this she what's going on. long history of fine line between protest and intimidation including a recent supreme court case from a couple of years ago where there was a statute which said well, can you have protesters come within 30 feet of entrance of an abortion clinic. the supreme court wrongly said they can get that close as long as it's not intimidation. in my view you need clear lines on cases of this sort. i don't know exactly where they

are standing, but certainly if they are going to impede ingress and egress it's going to look like something of a crime as far as can i tell. it's very difficult from the distance to do this. i hope there are no counter demonstrations. i wouldn't want them. what i would want people to do is to back off from. what you said it seems as though these things are taking place over the night. right? so it's after dark and it's before morning, which simply makes it more aggravating. it's very ironic to be talking to me about something which is shall we say not normally my beat. i have done a lot of history on this particular problem where the question has been with respect to labor unions and picketing and so forth. this issue goes back to 1896 and the famous case vague monday and gunter. very sharp picketing intimidation or picketing was information. that particular conflict and the fine line between the two of them continues to dog us now 126 years after that particular decision came down.

>> ainsley: richard, i know roe v. wade you have said in this new fox nation episode it's called fox nation 101 overturning roe v. wade. you have said why you believe roe v. wade was incorrectly decided. tell us why. >> well, the original decision i think everybody believes in some sense was incorrectly decided. what happened is they had no secure textual basis for what was going on. indeed they weren't even sure whether it was enumerated or uneenumerated right. if you are going to try to overturn the law in every existing state in the united states and have a very wishy washy opinion it's going to give you criticism. the general view has long been that rules like this have been long established are not to be overturned by judicial behavior. this is quite different therefore from the situation with respect to privacy in griswold decided previous year where every states but connect cut had legalized the sale of contraceptives not only to married people but single people as well. this comes as seismic

shock. what you try to do is figure out what the rights are and try to invent the trimester distinction do what you will first trimester, most dangerous. then some limited powers over the second trimester and then after that complete control by the state over the third. this proves to be unstable. >> steve: yeah. >> this proves to be unstable and they change it to undue burden with respect to casey. this is kind of making it up as you go along. it is simply the definition of liberty normally has to be juxtaposed against the police power and the protection of the life of the infant whether it's unborn child or a future child you can debate but nobody ever thought that was a state interest that wasn't worthy of protection. now it gets demoted to the point where it's virtually nothing because the period in which there is the greatest power of the individual is the period in which abortions are most likely to take place at will. this has been a constant struggle. and the reason why it is so alive today is the people

for a former alabama corrections officer and that escaped inmate ends in a car wreck in indiana. the inmate casey white who was slightly injured gave himself up but police say vicky white, the prison individual there you see there on your screen shot herself dying in a hospital a short time later. vicky white allegedly helped the convict escape after reportedly engauging in a romantic relationship with him that lasted years. investigators say the escape could have been in the works for years as well saying vicky white would often communicate with casey white while he was behind bars. then a few months ago, he was sent to the jail that she oversaw to stand trial for a 2015 murder. vicky white quickly sold her home for cash and announced her retirement from law enforcement after telling her colleagues she was taking casey white for a mental health evaluation, she then helped the 6'9" man walk out of the jail. white was already serving a 75-year sentence for a violent crime spree in 2015 that included the attempted murder of his ex-girlfriend, multiple stolen cars and the execution of

i'm at a truck stop so it's a little outside. >> steve: it's better that you're at a truck stop and not driving at the time. shelly, what are you hauling right now? >> we mainly haul aluminum, food grade aluminum for like cans for food and beer and drinks. >> steve: sure. so we know how the supply chain works. if you, shelly, are hauling aluminum and the price of your diesel goes up, then that means the price of cans and cars goes up, too, right? >> exactly. on average, it costs -- a truck averages five to seven miles to the gallon. so fuel costs alone at $1 or just over $1 per mile. >> steve: mike, what does your company haul a lot of? >> thank you for having me on again. we specialize in hauling l.t.l. food products, anything frozen,

gary, from where you sit, joe biden is going to have an address later today to talk about how he's going to help people all across the country when it comes to gas and oil and stuff like this. what should he say? i mean, what practically what does he need to do to help people in your industry? >> he has to open up all the drilling and we have to be able to get oil from our own country, not from somebody that hates us like all the countries that we're buying barrels of oil off of right now. >> steve: yeah, sure. shelly, in addition to trucking, you also run a non-profit called "trucks with room to spare." how has that been impacted by the high cost of gas? >> well, you know, we work with non-profits that can't afford freight rates as it is. and we work with volunteer drivers that most definitely, most of the time, they pay their own fuel costs.
