listen, yesterday, we have heard the administration say yeah, we are working on it 24/7. what are they doing. >> brian: waited too long. >> steve: yesterday, the republicans on capitol hill called a press conference and they talked about the very latest here with joe biden not being age to provide enough baby formula for the country. so the republicans had a press conference and then out of nowhere, the white house announced that the president was on the phone with walmart and target talking about distribution of baby formula. and he was also on the phone with recket and gerber two baby formula manufacturers. >> brian: he has a bad staff. why is he waiting so long to do all of this. could have been three weeks ago, two months ago. >> ainsley: last february they closed abbott. >> steve: you just hit on it abbott is the big lab. the big factory that was closed in february. abbott apparently was not on the

phone call. why wasn't abbott labs on the phone call with the president? it was a company called wrecket which is much smaller than abbott and gerber. >> ainsley: abbott is the nation's largest formula manufacturer. they could production in. it will take two months if they do get approval to put it back on the shelves. >> brian: what was the president doing talking about a putin price hike in a farm he should have went right in front of the abbott lab. we have been through this because we had covid-19. you meet with the fda and say why did you pull everything off the shelves. you have got four recalls, what happened? how close are you to green lighting this? 12 weeks is not good enough. you have to pick up the pace. of course you don't want to sacrifice health of children because of that. that's why you pulled to have to begin with. you can't have red tape when it comes to baby formula. now they are quickly saying europe has got some formula, can we bring that in. great. is anyone ahead of the game in that administration? like does anyone have a child that could come in and say hey,

by the way i went over to rite aid and there is no formula. can someone give some real world experience do somebody at that white house because they thought probably only republican babies that needed formula so why do they have to bother? then they realized it the kids don't have to declare their party affiliation until they are able to vote. >> ainsley: elise stefanik the republican congresswoman from upstate new york she has a 9 modged son named sam he is formula-fed. the shelves are fairly empty in upstate new york and babies are going to bed hungry. the biden administration should have had a plan months ago and she calls him bare shelves biden and continues to pass the buck. >> steve: exactly. why didn't joe biden's administration in february, when they closed the plant. >> ainsley: the largest producer of formula in our country. >> steve: abbott labs produces 98% of the formula in the country is manufactured -- that

american babies use is made here in the united states. only 2% imported. so it's crazy that they are saying yeah we are going typically port all this stuff. but why when they closed that plant didn't they immediately say you know what? this is going to cause a problem. we know all about supply chain issues. this is the plant. they should have announced that in february. that's one of the things that jacqui heinrich pressed jen psaki on -- by the way stowed jen psaki's last day. why didn't the administration see it coming. >> we should have seen it coming the fda could have done more on the baby formula shortage. it warn fda top officials safety concerns in october they didn't interview that whistleblower until december. the recall happened february 17th. so is that timeline acceptable to the white house. >> i'm sure there will be plenty of time to take a look if there are any issues that could have been improved here. y i don't have any specific analysis of that at this moment in time. what i will note is that there has been work ongoing on this for months.

>> carley: back with your headlines. national gas prices hitting another record high overnight. a regular gal of gas costing $4.43 on average that's compared to just $3 per gallon a year ago. and when it comes to diesel, the national average price hitting $5.56 per gallon. that is a whole $2 higher than it was last year. now to a fox weather alert. mandatory evacuations underway in colorado springs as multiple

wildfires set the city ablaze. 1,000 people are reportedly already evacuated. one tiktok user reporting what looks like a fire tornado. the fire also prompting a temporary shelter in place order for the colorado springs airport. and in california, new images emerge of burned out mansions after a fire in orange county rapidly engulfs over 200 acres. no official update on containment of that fire. and the cause is still under investigation. and birmingham stallions stand out scooby wright had plans to be a firefighter before getting drafted to the usfl. wright made it all the way graduating the firefighter academy from santa rosa jr. college until the draft came calling. wright credits his success to a good support system and tonight the michigan panthers face off against the tampa bay bandits. the bandits are coming off a devastating loss last week after dropping to the birmingham stallions that score was 16-10.

five of them were giving away free crack pipes in addition to the stuff to help you. they are giving free crack pipes. the big get is did federal money buy those crack pipes to give them to all these people? >> ainsley: we have been talking about this. it's been in the news for weeks, if not month. jen psaki was asking about it over and over are our tax dollars paying crack pipes for addicts she said no they are not going to be in the kits. the free beacon went to five different cities on the east coast to see they got their hands on some of these kits and inside the kits were crack pipes. jen psaki is still doubling down and denying that crack pipes are included. listen. >> you said in february that no money from $30 million harm reduction program would fund distribution of crack pipes in safe smoking kits. the washington free beacon reported that they went to harm reduction in five cities and they all of those facilities had crack pipes in their kits.

i'm just wondering if the white house can say if any taxpayer dollars paid for these crack pipes. >> no federal funding has gone to it. this policy does not allow for crack pipes to be included. i would just note that this is a bit of a conspiracy theory that's been spread out there. it's not accurate. there is important drug treatment programs for people who have been suffering from what we have seen as an epidemic across the country and money is not used for crack pipes. >> brian: attack the crack problem let's make the pipes perfect. okay. so they are included in the packet. she denied in february they are in the packet. actually was very dismissive about it and now sits there and says it's not included. does she think somebody is secretly sneaking in new crack pipes? >> ainsley: this is crazy, it blows my mind if your child is addicted to a drug do you give them a kit to help them continue their addiction? no. >> steve: the question becomes she just said and it was very clear at the end as you look at the drug problem, you know, it's an epidemic across the country,

the question is, she just said there is no federal money being used for it but you look at according to the free beacon these organizations like in baltimore the charm city care connection got $200,000 worth of government grants in 2019. here in new york city, one of the places they got the crack pipe from, they got $20 million in federal fund since 2004. in d.c. $20 million. since 201. and the department of homeland or whether health and human service was asked what organizations are getting federal funding? and they said we're not going to tell you for confidentiality reasons. you think if the federal money is going into somebody's pocket, don't you have a right to know whose pocket it is? >> brian: right. so the washington free beacon said it's just not true. we have done our study. we have done our research. the crack pipes are there. and it's hard to imagine being

members that can't get in stores in texas, new mexico. they go to work and they are unloading pallets of baby food out of tractor trailers. it's outrageous. if you have to sum it up this is exactly what america last looks like moms are panicking in florida and several other states. >> ainsley: how did the government get their hands on all of this formula when moms here legally can't get their hands on tnchts this has been happening for months. biden's shut down. one of our largest manufacturers of baby formula. they did so without a plan to backfill the 43% that this manufacturer makes up in the marketplace share so, again, no surprise to any of us, biden doesn't have a plan. so they shut this plant down. no plan to reopen. no plan to refix it.

they don't address the regulatory environment or tariffs contributing to this they have a broken supply chain. so, seeing, this they started sourcing an additional amount of baby formula to a company more than 1,000 infants that are in custody along our southwest border. and it's just infuriating because, again, this is putting american moms, dads, and kids last. and no one is arguing that we shouldn't have this for those babies at the border but biden invited them here. he has created this crisis. he has created the supply chain crisis. and he has done nothing to address it and it is infuriating. >> ainsley: are you suggesting that maybe the government knew about the shutdown in february and then they just never said anything and they started hoarding the formula. >> listen, they created it. biden's fda shut this plant down with zero plans in place to get it back online and operational. then they have drug their feet along. in fact, this week, when questioned about it, the press secretary laughed and said i'm

morning, so just before 6:00, he announced that essentially it sounded like things were on hold with this purchase. but in the last couple of minutes, he just tweeted an update. twitter deal, i'm still committed to the acquisition, teleprompter is going all over the place. as you can see, twitter, this is what he did at 6:00. twitter deal temporarily on hold pending details supporting calculation of spam bank accounts. do indeed represent less than 5% of users and the reason he said that is because twitter says, you know, 95% of the users are real people. he thinks the number could be less than that which would impact the price. then he just now tweeted, still committed to acquisition. big question is whether or not he's going to pay what he said he was going to pay a couple of weeks ago. >> ainsley: we were thinking, what do the bots have to do with if they're 5%, what do they have to do with him purchasing this? we had charles payne on and he explained it beautifully. listen. >> charles: let's say you went

f.d.a. on when it could reopen. but yes, in the meantime, the white house, the biden administration is trying to get more formula on store shelves. the president spoke with c.e.o.'s of major retailers as well as formula makers, gerber yesterday. the administration announced the steps it's taking right away. it's encouraging manufacturers basically to simplify the varieties they make to boost production. increase formula imports from other countries, and crack down on price gouging. the defense production act is also on the table. >> i think when you look at the defense production act, you have to ensure it would actually achieve what you're trying to achieve. we're also looking at that as well. and we have been working, this is one of the reasons obviously the president called c.e.o.'s today of some of these vital companies to determine what more can be done? >> the white house says that formula companies have made more product in the past month than

company called wreck it, they're so much smaller than abbott that produces about 42%, 43% of our baby formula. why wasn't abbott labs on the phone call with the administration? >> brian: why wasn't that president in front of the chain link fence over the past two months and say we have to find a way? there's only four companies that supply 95% of the baby formula in this country. we can't have all four being held up by the f.d.a. unless we want to call up france and say do you have any extra? >> ainsley: if you weren't watching fox last night, this news is going to shock you. she tweeted out a picture that she got from a border patrol agent. the picture on the left. and it says the first photo is from this morning at the ursula processing center at the u.s. border. shelves and pallets packed with baby formula. the second is from a shelf right here at home, one on the right. formula is scarce. this is what america last looks like. she is saying that they are giving the formula, all these pallets of form larks to the

illegal babies down on the border. meanwhile, so many american families can't find the formula on their shelves in their stores. >> steve: what terrible optics. ainsley talked to congresswoman in our first hour and she said this. >> i received a text message from several different border agents sending me pictures and videos of stocked warehouses, pallets of baby formula. these agents themselves have families and they have family members that can't get this baby formula in the stores. in texas, in arizona, new mexico, yet they go to work and they're unloading pallets of baby food out of the back of tractor-trailers. it's outrageous. if you have to sum it up, this is exactly what america last looks like. meanwhile, moms across the country are panicking. they can't get their hands on formula. and no one is arrange -- arguing that we shouldn't have those babies at the border but biden invited them here. he's created this crisis and

created the supply chain crisis and done nothing to address it. >> brian: "the washington post" said this is a ridiculous outrage. the shortage of formula is a serious issue the administration is seeking to address. wrong, they're two months late. that's what she's saying, this is it. anyone who suggests as a result of biden policies is reckless out of touch priorities. no, it is four pinocchios, saying that. not really. if you -- look, anywhere that the president is cracking down on what's happening at the border. there's no sign of it. we've had all time record lows and they continue to flow. and if the president has his way, in one week, it's going to quadruple. you know how much formula we're going to need then? how many unaccompanied minors that we're dealing with that need that? his policies did lead to this situation and it is terrible optics. and the governor of texas is among the people outraged. not just the congresswoman. >> ainsley: he's always reacting. once he finds out the problem, then he says, oh, now we'll have

to find a solution. it takes forever. we knew about this in february. this is the largest formula manufacturer in the united states. we knew they closed down in february after two of the children died and linked it to salmonella. why didn't they go in there and clean it up quickly? the f.d.a. said this is pretty quick if they're going to reopen it. but they could have gone in there. had so many different osha individuals or whoever does the work to clean it up. and get this formula out again because they knew that this is the largest manufacturer and it closed down and now he's reacting to it? >> steve: they needed a plan. they didn't have one. and that is why they're scrambling. look for them to cut the red tape and open that place in no time. meanwhile, the washington free beacon has had a series over the last couple of months. back in february, the government allocated $30 million for harm reduction centers to essentially put out these little kits that would help people who are

addicted to drugs. at that time, jen psaki said absolutely no, there are not crack pipes in these kits. well, washington free beacon just recently went to five different metropolitan areas here in the northeast and discovered that in the, you know, the harm reduction kits are free crack pipes. so we've got free formula at our southern border and free crack pipes. she was asked about this yesterday. jen psaki was. today is her last day. and she said this. >> he said in february that in money from a $38 million harm reduction program would fund distribution of crack pipes in fake smoking kits. the washington free beacon reported they went to harm reduction in cities and all those facilities had crack pipes in their kits. i'm wondering if the white house can say if any taxpayer dollars paid for these crack pipes? >> no federal funding has gone

to it. this policy does not allow for crack pipes to be included. i would just note that this is a bit of a conspiracy theory that's been spread out there. it's not accurate. there's important drug treatment programs for people who have been suffering from what we've seen as an epidemic across the country and money is not used for crack pipes. >> brian: right. the problem is it is. patrick of the washington free beacon did the investigation. asked the questions. and found this out. >> this is the exact messaging they did when we broke the story in february. oh, no, no, no, no, no. the pipes are not in the kit. and happily, the media pushed this narrative. they printed the press release. but what we decided is actually to go out and do the real work and figure out what is a smoking kit? we went to five different cities up and down the east coast and we found, of course, yes, a crack pipe is within a crack smoking kit. that's the whole point. you smoke with a pipe. >> steve: it really comes down to is the federal government buying crack pipes for addicts?
