this brand-new image coming in from the courtroom after the da moves swiftly towards justice with charges tonight. be back justice has already been done. immediately. arraigned on murder in the first degree which is the highest murder charge in new york state. it carries with it a life sentence without parole. >> joining us with the latest is ashley. >> police are still in the beginning stage of their investigation. videos are circulating online. just a warning to you and the viewers, these images are very disturbing. the 18-year-old white male drove for hours to carry out his attack in a predominantly black neighborhood. this horror began around 2:30 p.m. the witnesses described seen the shooter walk into the store with a semi automatic weapon wearing tactical gear. the gunmen threatened to shoot

himself. that was before eventually dropping his gun and surrounding. for of his victims were store employees and the others as customers out shopping on a saturday afternoon. >> this was pure evil. straight up, racially motivated hate crimes. from somebody outside of our community, outside of the city of good neighbors coming into our community and trying to conflict that evil upon us. >> pure evil broadcasting to the world wide web as the gunmen live stream that attack. he has already charged with murder in the state of new york. so far, no word on federal charges. we will be waiting on that. back to you be my thanks ashley. joining me now for buffalo, vice president tracy mcrae. thank you all so much for joining me this evening. i want to go to you, chief craig

you've covered a lot of these crimes and mobile jurisdiction. the first priority is securing that scene and making sure they can preserve all of the evidence they are. the next layer is notifying those victims families and they are waiting for some answers. >> you know what, let me just say thank you for having me on your show and my prayers go outs tragic situation. i also want to acknowledge another mass shooting. you are right, lawrence, there is a lot to deal. i have to believe, based on what i am hearing, that this suspect may have been racially motivated based on what we saw, depicted on his gun, i wonder what we will find out if we get into the investigation, whether or not he was in social media and if he

was in social media, why didn't someone say something and do something? i just do not know. what i do know, i'm hoping and praying for, we will hold him accountable. justice needs to be equal. there is too much of this and we have to stop it and we can stop it, but the only way we if we my criminals know there are consequences to their action. you have covered so many stories. we have had many conversations. >> we don't want to get into the manifesto just yet, but we will get into it later on. take the manifesto out of it, what was the lord on that screen on the gun was the n-word. >> it is incredibly hard to see this, to hear about this act.

here we are again where people are going out in their life and they are not coming back home. they are simply going to the grocery store. someone decided for whatever reason, to carry out this horrific crime. my thoughts and prayers go out to the victims who are waiting ones. this should not be happening in this day and age yet still we harbor hundred -- still we are here again. >> how do you prevent something like this from happening? >> you know, lawrence, you have heard me say it many times. we have a situation going on in our country where we have prosecutors and judges who are frankly woke. i don't want to politicize this tragedy, but let's be candid. i am sick and tired of judges who are trying to execute bail reform incorrectly.

we have prosecutors who think that they make the law and say we are not going to charge these criminals because they are just too many people of color incarcerated that is the wrong response. what about people who live in vulnerable communities who are suffering at the hands of violet predators. that is what the problem is, lawrence. we have got to do and serve people. we just are not doing it. >> we need to hold these so-called public servants, judges, prosecutors accountable. i've got to tell you, lawrence, i think in buffalo, new york, they responded quickly in addressing the suspect. let's talk about supreme court justices who have protests happening at their homes. it is a crime. >> it is a matter of law and

order. tracy, to read this manifesto, over 100 pages, to see some of the stuff that has been written online, this guy was very public with what he believes. i am curious, why did it anyone say anything? >> you know, he is a little weird, thought he was a little off, but we did not want to say anything, we did not want to get involved. like the chief said earlier, you have to speak up. these things are almost impossible to predict. they leave traces in evidence and crumbs out there people just need to recognize that and say something because now we have two people who are dead and they should not be. it is just like you said. holding people accountable, right. it doesn't matter what color you are, race, origin. when you commit a crime you need to be held accountable. because we all have to be

accountable for our actions. he has 18 years old. what does he have to be mad about? to do this. >> no excuse. >> thank you so much for joining me tonight. fbi assistant director, former director, thank you so much for joining me tonight. i want to get into the criminal profile because that will be a big part of what they are doing as they are collecting this evidence and reviewing that manifesto. you have been in the room when some of these decisions are made. what are investigators talking about right now with those prosecutors? >> if you are talking about the state investigators and prosecutors, they are gathering, doing their forensics, gathering the evidence. they have already charge first-degree murder. it is on video. i think the fbi in particular are looking at the motivation part, does it fit into hate crime? are there other charges, federal

charges that will apply? they will look at his manifesto, of course. go through it. any postings he has done. deleted postings. talk to everybody that they can talk to and then levy the boom. federal death penalty first-degree murder hate crime. i think that that will happen sooner rather than later, lawrence. >> assistant director, tell me about the standard, what is the standard to say that this is a hate crime? >> in this case you will have the elements of murder. the premeditation, the active murder, the basic elements of murder. the kicker in the enhancer in the lateral system is the motivation. they have to prove the motivation is a hate towards race, religion, national origin, that sort of thing. it does not seemed like it will be a big stretch here given what

i have heard so far. >> i want to get into the nitty-gritty. those of us that have public platforms, we can do better. i want to get to the politics of this. i do want to talk about the inspirations. >> from a law enforcement perspective, i have had 40 years in this business, i think my colleagues will say the same thing, dial down the rhetoric. every politician of every strike seems to want to come in on a situation like this and it really put fuel on the fire. i have seen this governor come in two or three times now, you know it is political. it just fires things up. you have the nut cases out there like this guy who see this going on. you see somebody stirring the pot tried to demagogue the issue rather than let the law enforcement professionals take care of it.

unfit and i was better off dead. thank god my mom did not listen to these people when she got pregnant with me at age 16. my daddy stepped up to the plate and yes we did struggle. there were good days and bad years. i remember one week my parents could not afford the gas bill so the water was cold. i was so embarrassed because my parents had already said the basketball team could stay over after our friday night game. i tried to make every excuse in the world to prevent them from coming. i was finally forced to tell them the truth and they still came. you can say i was quite the precocious child or such a smartass. always wanted to debate. i needed to look good doing it. i had to be in a suit. when we could not afford it, we would go to the thrift store. sometimes it would be a little big but my mom taught me how to sew. we just made it work. today i am the youngest person and lack person to have a cable news show.

have. >> i will tell you right now i don't think that they have either. i hear some of the democrats another networks about how somehow getting rid of roe v wade is supporting white supremacy. completely ridiculous statement. if you look at the data, 40% of all babies aborted in united dates are black babies. black babies are 12% of the population. if you are being supportive of white supremacy then you are supportive of planned parenthood and the current abortion agenda in the united states. you would actually be opposed to abortion if you want the black population to grow. where we are at in our country as we are finally having the political debate that the supreme court in 1983 stopped us from having. i think it will be healthy for the united states overall because there are various opinions with respect to abortion. it is high time the american people had a thing to say. giving the american people, all

grocery store. remanded without bail on murder charges. he wore tactical gear and traveled four hours to the tops friendly market in a predominantly black neighborhood a retired police officer working security at the store among the victims. the shooter live streamed the attack on mine. the fbi is investigating this horrific violent attack has a racially motivated hate crime. now we have a criminal defense attorney with us. thank you for joining me. your first time back in studio. you can really break it down for us. what is going to be the process for him, when will he put in his plea and we see the criminal justice system run its course. >> no big surprise here. prosecuting this kid will be easy. preventing this from happening again is where we really need to focus. even at this early stage, this

is as defenseless of a crime i have seen in my entire career. he filmed it. we know what he did. we know it was him, we just do not know why he did it. in terms of his motive, that's almost the least important part. he has already been arranged. he has already entered his initial plea. he will be charged at minimum 10 counts of murder. he could end up, at the end of the day, getting 10 life sentences without parole. he will only die once. it doesn't matter if there are 10 life sentences, whether they charge it as a hate crime, that does not matter. we cannot kill him in new york. we no longer have the death penalty. he will spend the rest of his days in prison. >> what about the federal charges? >> that could change the game. if the feds get involved in they already are and they think that

they are there to prosecute him as a hate criminal, as a hate crime, they could elevate this. federally, they do have the death penalty available for certain crimes. they may decide to prosecute him both ways. he could face federal criminal charges. that is not going to be the end of it. there will be a whole lot of civil liability to go around. what really has me boiling right now is the fact that he was able to stream us on social media. the fact that he could put a murder manuscript on social media. these things do not happen in a vacuum. he did not wake up, jan, get some coffee and drive. i wish he would have violated sub vehicle traffic law so a cop could have pulled him over and prevented this by happenstance.

>> the manifesto's pages. he could have started this plating when he was 17. the evidence shows that his parents knew about some potential attack and did not alert authorities. are they liable? >> potentially come out they are i am not talking guns. where the teachers, where the parents, where the people that see this odd behavior and do not do anything? especially the parents who are responsible for him. he most recently had to have lived with them. why do we not focus there? where did he get the gun? how did he get them? how do you raise a child and not know that he is a murderer waiting to happen? i don't understand that. >> you know some of the talk will already be is he going to say he is not mentally fit? where do we go from there?

>> that is the only potential defense he has. is he legally insane? i will go out on a limb and say that will not be a viable defense for him. look at how planned this was. from the gear to the travel to the gun to the targets. this was so plant he cannot be so mentally insane that he is not legally responsible. he will spend the rest of his life in jail. my heart breaks for these families. all of our mothers. >> it's okay to have you in studio. next i asked west virginians about what they thought about biden's america. you don't want to miss what they had to say.

country, when i hear from them every single day, they don't feel like the biden administration is listening. >> well, listening is the hardest part. it's easy to talk a much harder to listen. in west virginia, the president's approval is 18%. colonoscopies have higher approval ratings. this does not say it's forever voted republican, bill clinton won their 1996 because clinton was smart enough politically at the time to pivot. declaring big government was over. working with speaker of the house at the time, they passed reform. democrats and republican now calling a balanced budget amendment. so, while it is never a smart idea to say anything is guaranteed when it comes to predicting elections, it is just so difficult to see. the perception of joe biden. to walt, too incom when he had

think -- i think they have a pretty good relationship. joe mansion's number in west virginia are incredibly strong. he has represented as a moderate democrat. >> mansion is doing well with his voters. the same voters that biden promised he would govern. so, the american people seemed like they are being fair. it seems like every opportunity that the president gets he dashes mansion. even during his speeches. no, he does not call them by name, but everywhere he knows the two senators he is talking about speemac i think that there are frustrations in a 5050 senate with anything requiring these votes. a lot about that joe mansion has been on the other side of his caucus on is something that the president has highlighted. i think that they are still avenues for successful legislating in the next 178 days where we can get access of that build back better agenda.
