inside of a buffalo store. reporter: this tragedy happening at a tops grocery store in buffalo, new york. it was during a busy afternoon of shopping. authorities are investigate the attack as racially motivated taking place predominantly black neighborhood. >> he shot a woman, he shot a deek son. he shot another woman then he went into the store started shooting again. i don't know who he was shooting at because he shot at least eight people. reporter: a retired buffalo police officer aaron salter was hailed as a hero. he was working as a security guard and armed. he was gunned down after the his bullet failed to pierce the tactical gear. a mother after fire commissioner was killed in the attack. the mayor says the city is

devastated by the losses. >> this is the worst nightmare that any community can face. we are hurting and we are seething right now as a community. reporter: the shooting started in a parking lot after the suspect, 18-year-old payton gendron, drove from a town hours away. the police commissioner describing the final moments of the attack. >> buffalo police immediately responded engaged the suspect in the vestibule of the store. at that point the suspect put the gun to his own neck. two patrol officers talked the suspect dropping the gun, he dropped the gun, took off some tactical gear. reporter: gendron was arrested for murder and. a lengthy manifesto describing extreme racial hatred is linked to the suspect. of the 13 people shot, 11 were

black. the suspect live streamed the horrifying attack with a body camera on the social media platform twitch. a spokesperson for twitch says it was taken down within two minutes. new york city is on high alert after this incident with additional nypd officers to patrol black churches today. pete: pour risk. evil. retired buffalo police officer. he did everything he could. the guy was wearing body armor. carley: we're learning more about the victims. you heard one of the witnesses say that one of the people that died was a decon affiliated with a local church. another woman 86 years old. her name is ruth whitfield a mother of a retired buffalo fire commissioner, commissioner whitfield, said my mom was consummate mom. a mother to the mother list. she was a blessing to us all. she loved god taught us to do

you heard more from the yesterday mayor of new york city, eric adams, at a protest, he backs abortion up to the day of birth. that it is a woman's choice. what you're looking at is an extremism and radicalism, that is absolutely out of touch with the american people. carley: you're absolutely right. we're talking about how the abortion argument used to be safe, legal and rare. used to focus a lot on women's health and hear a lot about rape incest. abortions through rape account for one percent. incest is less than .5%. the conversation has become horrifying, it has become a personal finance argument. i should be allowed to have an abortion having a child wouldn't benefit financially. how can you make that argument, couple it with what eric adams said yesterday, when a reporter,

neighborhood and live streamed the rampage online. the fbi is investigating the attack as a racially motivated hate crime. former fbi investigator bill daly joins us now. thanks for being with us this morning. >> good morning, will. will: a ton, i would assume, a ton of evidence available for the investigation this morning. a live stream, a manifesto. what are law enforcement investigators doing as we speak? >> well, what they're speaking about right now, will, to go off to find out how the individual was so radically motivated of evil ideology. who else would have known about his planning? are there other people who incited him to do so or groups? i think very important they get that ahead of this investigation, for a couple of reasons. one, that it leads how this person or how the persons could be charged if anybody was complicit. helps us understand how we prevent future incidents happening if there are groups who have a simulated this evil

alexandra has a 20-month-old, karen has two children, serves as advocate for those of special needs and kaley gave birth in february. thanks so much for being with us on the program. kaley, start with you, someone like you has a new born, what has struggle been like? i assume there is specific type that fit your baby's needs, how have you made it through this? >> it has been been absolutely a nightmare to find formula. he is allergic to almost every type of formula i tried. he went through eight different type of formula in two weeks. trying to find the formula that she takes it is absolutely crazy because it isn't on the shelf anywhere. i have to get it shipped in from family members around the

country, able to feed her to give her bottles. pete: wow. alalexandra, your child is a bit older. you talked about how you faced it last year. this is not a new issue. >> this issue began in second half of 2021. i noticed this personally when i went to get my summer's formula in the summertime. i remember texting my husband i think there is a problem. as a pandemic baby parent, we were used to things hike this bubbling up-and-coming up throughout the process. quite frankly i didn't think anything about it. again you're seeing shortages on amazon and walmart. seeing the store shelves empty at particular times of my particular formula. my daughter went off the formula in the fall when she turned one. that being said, i think it showcases how the leaders in charge have had ample time to

understand and to digest this problem and to develop a solution. pete: karen, why is this happening and what are moms to do? >> well there are three main reasons why this is happening. one abbott, who is one of the primary suppliers of baby formula, had a problem where there was a bacteria in their formula. there was something that was going on at least four babies were injured and two were died actually as a result of really severe bacteria. so that was one issue. abbott laboratories is now saying that their problems are resolved. they actually close ad plant in michigan. they say they are going to ramp back up again. and as the pandemic, as other parents pointed out, the shortages due to the pandemic, the supply chain, also there is a trade policy that the u.s. has is causing the shortages also in terms of letting more formulas

in from other countries. those are three primary reasons why we do have a shortage. pete: kaley, you said this will impact your vote as a young voter. you look why this happened, how it impacts your vote, how will it impact? >> in my opinion this should have been uncovered long before now and the whole point of, this is just now becoming a an issue to the nation, being recognized by the nation blows my mind. i honestly believe if somebody would have covered this before now, any party, does not have to be the biden administration, if this had been uncovered before now we wouldn't be in the situation where we are. it it will impact my vote. nobody is wanting to help mothers who are working hard, going to every single store looking for florida.

pete: alexandra you said this will comb into the fall. kaley said either party is to blame. is biden administration is in now. is this where you point the finger? >> absolutely, biden administration supported inflationary spending clogging supply chain. my own congressman here, josh gottheimer he supported all of this spending. i think this issue strikes at the nerve what it means to be a parent. so i think that come the fall this is not a political issue for people. they are going to being angry at the people who are in charge and who are responsible for a, causing the problem partially with some of the spending but also failing to fix it. offering excuses. calling inflationary transitory. joking about treadmills not being available. now it is baby formula and the biden administration and

congressional democrats just don't have any answers. pete: karen, you describe yourself as a registered democrat but conservative on business. so as you look at this particular issue how do you lay out how we got here? >> i don't think it is just the biden administration but the government in general but the regulation how the formula is even distributed is a huge issue. unfortunately it is left to the parents and we're blessed because everybody is doing a good job in terms of actually being matchmaking, matchmaking formula with people that really need it. i do advocate for special needs children and there are a lot of children who need specific types of formula and it's the families are helping out, people helping other people. unfortunately the government isn't coming through at this particular time. people are supporting each other. pete: these are moments that you realize the government will not

about the interview with volodymyr zelenskyy. what was the security like, take us behind the scenes. >> we went to the presidential compound. carley, he is highly protected and it's a very thorough process. i thought i would meet a man who is exhausted, could not sit for 10 or 15 minutes wanted to have some idea where things were. he took over the presence of the room and he told his aides to give us as much time as we wanted to talk about everything and one of the takeaways you're seeing talking about now, during our interview he broke news that russia is blockading the black sea, that we'll have a food crisis, particularly for poor countries because of grains not able to get out. he told us at least two countries he would not name saying they support ukraine calling for sanctions hypocriteally behind closed doors negotiating with russia to

reporter: retired buffalo police officer, ehren salter was named a hero. his bullets failed to pierce the shooter's tactical gear. a 86-year-old mother of a retired fire commissioner was killed during the attack. the mayor says the city is devastated by the loss. >> this is the worst nightmare any community can face and we are hurting and we are seething now as a community. reporter: the shooting began in the parking lot after the suspect, 18-year-old payton gendron drove from a town hours away. the police commissioner describing the final moments of the attack. >> buffalo police immediately responded, engaged the suspect in the vestibule of the store. at that point the suspect put the gun to his own neck. two patrol officers talked the suspect into dropping the gun.

price this morning. $4.47 as you wake up. that is two cents higher than yesterday. that is a full 16 cents higher than just a week ago and 40 cents higher than last month. it is on a steady climb. it has peaked as we wake up this morning. pete: yeah. it has been on an incredible increase even since the election of 2020 which it was at $2.13. so it has doubled in that amount of time. these are other items that our viewers are well aware of. if you've been, you traveled, been to a grocery store between cars, air fares, meat, poultry, eggs, coffee, everything is more expensive. then that last down arrow right there, average hourly earnings. so as you're spending more and average hourly earnings are going down inside of biden's economy right now. carley: will, give a little bit of credit for doing math on the

♪. carley: thousands of abortion activists march outside the supreme court protesting the potential overturning of roe v. wade but some are taking a more direct approach, demonstrating outside homes of conservative supreme court justices. new york congresswoman claudia tenney has been threatened before at her own home as the daughter of a new york state supreme court judge and she joins us now. congresswoman, good morning to you. you say the situation is personal. tell us why? >> good morning. i first just want to say, i want to give my condolences and deepest thoughts in buffalo and districts where this mass killer resided, his hometown. i'm sorry for everyone year and wish a better outcome for everyone across my district and communities in new york. this is a really tough issue first of all, our federal law,

15 usc, 1507 picketing or parading for intent to influence justices at their personal homes. my dad was a new york state justice for 35 years. i actually live across the street from the house i grew up in. it is somewhat suburban area with a dead end street. i was personally called one time by a litigant threatening my life over a domestic relations matter while my father was a justice. we never locked our doors. i think that what this shows. unfortunately this decision on abortion has caused so much angst but what it has really done is opened up our democracy where now this issue under the tentth amendment will go back to the states and people to decide. it shifts the power away from the power of the judiciary back to the legislature and the people which is a good thing. now we have to learn how to peacefully protest. we need to have a public debate peacefully in our public square. we learned to have to learn to how respectfully disagree to

bring that power back. unfortunately that something hasn't been happening in our communities. carley: that's right. if roe gets overturned it would be a stance that supports democracy. when you think about the security situation, the justice department was more than willing to investigate parents that were protesting at school board meetings. you would think that they would also want to investigate people who are targeting the homes of supreme court justices. so far radio silence. are you surprised by that? >> it is just unfortunate. i sent a letter along with many of my colleagues to call on attorney general merrick garland to investigate and enforce this. they used the, same types of laws, and went after parents who were protesting and legitimately protesting what was happening in virginia schools. you saw the people made a decision. they voted in governor glenn youngkin. and now we need to have this public debate. it doesn't, this decision, i can't emphasize enough does not make abortion illegal. what it does put that debate in

online describing extreme racial hatred also linked to suspect. pete: a retired police officer working as a security guard and the mother of a former fire commissioner are among the dead. the nypd ramping up security at black churches in response to the shooting. a off way to start the morning, reporting on that really evil, tragic incident in buffalo yesterday with. carley: it started at 2:30 p.m. eastern time ed yesterday, and the gunman allegedly shot four people, live streamed the shooting, shot four people outside of grocery store. three of them died including that former police officer who was really well known around the community. he was working as a security guard at the grocery store, and then he went into the store, shot nine more people, six of those died. her teen people were affected by this tragedy in total --

thirteen -- ten dies. eleven of the people he shot were black, two white. will: he live streamed the event on twitch and left behind a manifesto laying out his motivation and act ticks of what would go down, sadly, in buffalo. we spoke to chad wolf earlier about where the investigation might stand this morning. >> we're in the early stages of this incident and the investigation, so i think it's important to let law enforcement do their job. i think it's only natural for people to either jump to conclusions or really try to understand the motivations behind this, but there's going to be a lot of evidence at the scene, a lot of evidence online and other places. with we need to let police, law enforcement do their job, and i think we'll have some answers pretty soon. pete: yep, let's hope. and maybe our questions, there will be increasing questions about who may have known what and what warning signs, indications were there for such an evil act and i'm sure law

enforcement is looking into those things as well. but this morning we remember those victims and that deliver. his maim was aaron -- his name was aaron sulter who did shoot at the shooter. unfortunately, the shooter was wearing body armor and ultimately killed the security officer in return. we think about all the people i -- affected in buffalo. we have a longtime resident as well. on another topic at the border, the fate of title 42 is expected within days as groups of hundreds of illegals continue to flood our southern border. will: states like texas are forced to take matters into their own hands, striking a deal with mexican officials on the that side of the border. carley: bill melugin joins us with more. >> reporter: as a federal judge decides what to do with title 42, illegal crossings are shooting through the roof here

at eagle pass. take a look at this video, a large group with of well over 100 illegal immigrants crossed right in front of border patrol, right in front of the texas national guard. this was the fourth day in a row we've seen this exact same thing happen with a big group of more than 100. happened about 11: 00 in the morning day in, day out. this was another group that crossed illegally and is then climbing over a chain-link fence with barbed wire onto private property. this is a fence that the state of texas put up in an effort to deter migrants from crossing. that fence did not offer a whole lot of resistance. they climbed right over it. then take a look at this video, another massive group, this time about 150 in total again crossing here in eagle pass. these were mostly colombians, venezuelans and cubans, many of them smiling, waving to our cameras knowing a lot of them will likely be released into the

u.s. under the biden administration's catch and release policies. back out here we are learning of a new unprecedented agreement that the state of texas has reached with the mexican state directly across from eagle pass. texas is going to give razor wire to mexican authorities there and the national guard is going to train the mexicans on how to deploy it on their side of the border for enhance hasn'r security. that's expected to start in a matter of days. pete: you see that fence with those humvees? that's texas dps. now, texas is negotiating with mexico to give them razor wire and show them how to put it up on their side of the border, all things the federal government should be doing and it isn't. carley: go ahead. will: i was going to say we're going to need to have this conversation increasingly as we look at the prospect of title 42 being rescinded. immigration numbers continuing to explode, the conversation over what states can do. we've begun the conversation

here on "fox & friends", can texas or arizona declare an invasion and ina -- avail themselves of the constitutional authority to do the what the federal government will not do. carley: right. and it will be an invasion when you think about the numbers that are expected if title 42 is overturned, 18,000 a day. that will mean that border patrol will be absolutely overwhelmed, incapacitated to handle the situation. one thing that i was reading about is that the biden administration -- there's a federal judge right now that is looking at title 42, said that he's going to make his determination on whether or not it will be overturned before the may 23rd deadline, and there is some reporting that the biden administration is hoping that the federal judge actually rules against them because they know that -- pete: that's leadership. carley: right? because what that would mean is they could say to the proifg side of their party, well, this was out of our hands. they know if this does get overturn thed, that a this will

be such a crisis their watch, what it will look like is the haitian migrant situation. we remember those images of them under the bridge and how devastating it was for everybody involved in that. but it will be up and down -- pete: what a sham. even melania trump talked about it comes down to leadership. leadership is not hoping a court rules against you so you should do something you should be doing. and maybe you're right, if title 42 does go away, that's the moment at which texas says this is an invasion, and we're going to have a constitutional showdown to do what the federal government wants. will: we need to have that showdown -- pete: i agree. will: as was brought up in our conversation with chad wolf earlier, title 42 is a sham. here's what i mean. it is designed to protect america from covid spreading through the process of illegal immigration. covid is no longer the threat represented when title 42 was

put into place, and i think the biden administration is looking to be bailed out by a judge if they know they need to enforce the border because something is going to happen that is going to dramatically impact them politically. but at the same time, they can't enforce the border without the papered-up protection of title 42. pete: correct. will: follow what i'm saying? they need to keep title 42 under the protection of covid so they can actually do what their job is because their progressive base won't actually let them do their job. pete: their non-policy policy is not doing the job that it should. will: right. pete: when you see that picture of the folks climbing over the wire, we should just call that the biden wall. that is the bide biden wall with. the state of texas had to put that chain-link fence up which isn't stopping anybody. carley: a border wall that taxpayers had already paid for. and one of the catastrophic

gag, a joke. one has nothing to do with the other. pete: yeah. this is in the keel school district. rachel campos duffy, if she were here, she'd be saying if it's happening in wisconsin, it could happen anywhere. in -- this is in between milwaukee and green bay, it could be anywhere, wisconsin, where this is happening. and here's the thing, will, here's how the school district replied when the parents brought up what's happening in the school. this is a statement from kiel school district to wluk news. they said the kasd, their school district, prohibits all forms of bullying and harassment in accordance with all laws including title ix. goes if on to say it will continue to support all school regardless of sex including transgender status, change of sex or gender identity. so based on that statement, the school cricket standing behind -- school district standing behind sexual

harassment charges for the wrong pronouns. carley: we're talking about filing a title ix complaint against middle schoolers, eighth graders. and the student switch his or her pronoun to they in march. and then in april the three eight graders maybe called the student by he or she, didn't use they, and that's why all of this is going down. so even if those three kids -- we don't know, but even if they were bullying the transgender student, that's a situation where you pull the kids aside and talk to them, not file this, this title ix suit against them -- pete: it shows -- carley: insanity. pete: by the way, doesn't even mean the student in question is transgender -- carley: gender-fluid. pete: nonbinary, anything you want. you can just change your pronouns, and then everyone else in the school is -- will: interesting point. what about i as a male decide my

pronounce are whatever i choose them -- pete: you can absolutely cothat -- do that. will: i don't have to be a member of a marginalizedded community to change my pronounce. then you are going to be filed with sexual harassment -- pete: remember title ix? it was to make sure women had equal access to sports and activities. now title ix is being used to go with gender pronouns. carley: that's exactly what the deputy counsel is saying for the wisconsin institute for law and liberty on this title ix suit. there's a group that's defending these students. he says title ix sexual harassment typically covers race, dating violence, quid pro quo sexual favors, really egregious stuff. there's nothing even remotely close to that alleged in this case. but you go back to the parent, will, whose quote you read, and you hear that your 13-year-old is being, you know, charged with this egregious sexual harassment

claim, and you're thinking what did my son do, where did my son or daughter go wrong. and tut that it's this, and you go, okay, it's not about my son, where did the school go wrong? will: i want to read more about this. i want to see the nature of that title ix sexual harassment. we're looking at here there should be some conversation around malicious prosecution. this is bullying. i don't know what the children did to each other in misgenderring each other or not using the right pronounce. again, emphasize children, middle school. but any adult that thinks this is appropriate should be investigated. this is, you want to talk about bullying, you have now engaged in one of the most agrege juicer forms -- do egregious forms i can imagine, coming down on middle schoolers in such an inappropriate fashion. loss of job, los angeles are of job with -- loss of job at a minimum. pete: could be there were punk kids bullying somebody.

more. the public's interest and probably durham's interest as well is about so much more. let's talk first about michael sussmann and lying to the fbi. tell us what you think the strength of durham's case is, and what is the potential penalty for sussmann? >> you know, he's facing up to five years in federal are prison, and when you decide to go to trial, you also lose all of the benefits that the federal code has to offer for someone that's cooperating with the government. i'm not sure durham expected that this would go to trial. i think his plan was to charge sussmann, be able to use this case and hopefully have him cooperate to give him the broader and bigger picture of the conspiracy that involved perhaps even hillary clinton and her campaign. will: yeah, that's fascinating. so what does a conviction do the in that? if you're right, and i suspect you are right, again, this case is about much more in going deeper. if, for example, sussmann is

convicted and sentenced to those five years, do you think that in turn makes it likely durham can get more access to information or perhaps then at that point sussmann looks to participate, help out in what is the prospect as the trial goes along and approaches potential -- if it does -- approaches potential conviction? >> yeah. i think durham is playing, you know, he's playing a chess game right now, and he is trying to set the scene for future cases. he's been able to pierce the attorney/client privilege, and he's been able to see documents and e-mails and things that i think are helping him put together that larger picture. but once the conviction occurs -- and he does have enough evidence, will. he has enough evidence to make this conviction, but assuming the conviction occurs, at that point sussmann will have a large incentive to help and cooperate nord to lower his sentence -- in order to lower his sentence before the judge. will: right. really quickly to follow up, do
