sussmann showdown. first trial from john durham's long investigation into the trump russia probe. >> todd: the jury was seated yesterday. some raise concerns about impartiality in this case. brooke singman joins us live. >> brooke: today is first full day of the trial of michael sussmann, the first trial steming from john durham's investigation into the origins of the trump russia probe. durham sat in the courtroom for the entirety of jury selection yesterday amid concern it would be difficult to find an impartial jury in dc, city that votes for democrats. the jury includes one federal employee who told christopher cooper they donated to democrats during the 2016 election cycle and said they strongly dislike former president trump, but both jurors claimed they would be impartial throughout the trial. despite concern about biassed

jury, the trial will reveal a lot about the depth of hillary clinton's involvement in the trump russia probe. >> already in pretrial situation, we've learned hillary clinton was response for the russia collusion hoax, we'll learn more about that and hopefully as much as we need to. >> brooke: sussmann is charged with making a false statement to the fbi for telling general counsel he was not doing work for any client when he presented data that demonstrated ties between the trump organization and russia's alpha bank, which has ties to the kremlin. durham alleges sussmann billed the clinton campaign. sussmann pleaded not guilty. durham's team is set to call two fbi special agents to testify and former clinton lawyer mark elias.

the democratic national committee funded the anti-trump dossier. it will begin at 9 a.m. eastern. >> carley: let's bring in tom fenton, president of judicial watch. tom, i think some trump supporters may be disappointed by this trial. it is not about whether or not the clinton campaign crafted this lie tying trump to russia and fed the lie to the fbi and media. it is about whether or not michael sussmann lied to the fbi about him working for the clinton campaign. it is being called narrow in scope. where do things go from here? >> well, you know, as has been discussed, there is evidence that has come up in the run-up to this trial in case that highlight hillary clinton's involvement in the lies and spy og trump in the white house

potentially. that is pretty dramatic and this is her top lawyer, there were two top lawyers for her campaign, one is testifying and the other on trial. it is hard for hillary clinton to escape accountability, however limited as you highlight in this case for the criminality targeting president trump. to me, the irony is that the fbi is coming off as the victim of the clinton campaign, certainly this lawyer, mr. sussmann, when who was the victim, but donald trump? he was the victim of crime. this will play out for the american peep and he will it's been playing out for years. now someone may go to jail as part of this criminal conspiracy against president trump. let's do a quick synopsis. tech exec accused of giving

michael sussmann data, he is on the left and michael sussmann brought the fbi unverified information that may have connected trump towers with alpha bank, he is charged with one count of lying to investigators. and there is hillary clinton on the right, what stood out to me, tom, what brooke mentioned and andrew mccarthy mentioned here. he says, durham will have enough evidence to prove the narrow crime he's charged. biggest challenge may be the jury in trust hostile washington durham may be the government's lawyer, this will not be a home gain for him. do you share his worry that durham's case just got harder based upon the venue they are in? >> well, as brooke reported, two jurors are presumably anti-trump or they confess they are not friendly to republicans or

donald trump. to the degree this case remains narrow about whether sussmann lied to the fbi lawyer, they may be able to achieve the desired result, a guilty verdict. if trump comes up more in this case or hillary clinton, the less likely sussmann may see a guilty verdict. i'm disappointed durham didn't push for a conspiracy claim against others including hillary clinton and he talked about this joint venture operation and many people don't understand this. hillcroft's campaign and the operation all fought the release of records about what they knew and when about what sussmann was doing and this operation they were pursuing against president trump. some information may come out now because it may not come up

at trial, but may come out subsequent to this because documents were handed over to durham. >> carley: you say you are disappointed sussmann didn't put for the conspiracy claim. you have former attorney kevin cline-smith. you have what is going on with igor denshenko for his work on the steele dossier. that is pretty much it and those people are on the periphery of what happened, it is not hillary clinton, it doesn't really come very close to her. why is that? >> i think hillary clinton is a protected person in washington, d.c. three years, three indictments, three prosecuprosecutions, not strongest record given resources put in place here.

no doubt what went on. in my view, where has -- was hillary clinton brought before a grand jury? was obama? was joe biden? they were all involved and they all knew the allegations were false and they went to the fbi, they went to the cia, in the case of obama and biden, they authorized action against trump and been zero accountability from durham's side in terms of asking questions. i'm not sure if they have been asked questions let alone gone before the grand jury. >> todd: time suggest curious, midterm around the corner. going forward, what dominos do you expect to fall following the sussmann trial. >> if this is the beginning, i think many of us will be happy. if it is the end, they will be

we don't need you to be around in the second term, plus given his performance, polling primarily in the low to mid-30s, i think 39% with nbc news over the weekend. 33% with quinnipiac, not the numbers you want when somebody is running for president. given all the leaks that came out of kamala harris's office and given that simone santd sanders barely lasted a hockey season. now she is telling people to put their names on leaks. she may have been white house press secretary, but chose to jump ship when things got tough, i'm not taking her opinion seriously in terms of defending the president, she could have stayed at her job and she did not. >> carley: president clinton's

>> todd: here we go. big primary election day kicking off in five states across our great country. >> carley: battle in pennsylvania, three gop contenders jockeying for senates nomination. one of the highest-profile primaries of the season. >> todd: host of lawrence jones cross country joins us live from millford, pennsylvania, he will be talking to voters today. good morning, sir. >> lawrence: good morning. it's a big day here. this race is heating up. i'm so curious on what the voters are going to say. dr. oz is running and barnette and dave mccormick. one is endorsed by president trump, dr. oz. barnette has pro-life groups and tea party groups supporting her and dave mccormick has a lot of

trump appointees, former trump surrogates supporting him. it is anybody's game. issues that matter to voters, there is economy, inflation, how that is impacting them. crime facing the entire country and what is happening on the border with fentanyl coming across. we will gauge who voters are going to vote for today. we saw neck and neck race going on in west virginia and we were able to predict who was going to win by being at the diner. they let us know who the majority of folks were going for and when election night rolled in, we saw who was able to win that race. guys, so excited to be here today, folks are waiting to come into the diner. >> carley: this is exciting. have you talked to anybody to see how they feel about this race? it has split the republican

party into three chunks. >> lawrence: you know, just preparing for this, i was making a lot of phone calls, just so i can gauge it tochlt me, right now, carley, it seems like it is a race between barnette and dr. oz. i think some of the mud that has been being swung back and forth, i'm not sure and you see a lot right now coming from dr. oz's camp. they feel like barnette is not electable, she cannot win and folks on the ground say people made the same argument for donald trump. some mud may have helped barnette, where the race goes, i don't know yet. when i talk to folks, i will make some type of prediction. >> todd: typically low turnout for primaries, there is a lot of buzz in this race, we're talking about it. nation is talking about it. will that drive up the voter turnout to numbers we haven't

seen in primaries before? >> lawrence: let's talk about that, todd. the reason there is hype on this race, two reasons. number one, the direction of the country. people are upset, republican and democrats, independents, you see the president on the national level is underwater. number two, is the fact that people felt like they were robbed in the last election, not because of votes, but there wasn't a clear campaign based on policy and people have buyers remorse. there be turnout for those two reasons alone. >> carley: it is one to watch. we got to leave it here, but the progressive candidate is expected to be congressman connor lamb, the more centrist candidate. unique story lines on both

breaking this morning, elon musk announcing his deal to take over twitter is on pause. >> todd: musk raising questions about the number of bot accounts by twitter saying there could be a lot more. cheryl casone is here with more. a lot going on this morning. >> cheryl: a lot happening overnight. it is all about the bot, the message from elon musk to twitter. here is the tweet, 20% fake spam accounts, four times what twitter claims could be higher. my offer was based on estimates being accurate. this deal cannot move forward. specific performance clause gives twitter the right to sue musk if he has financing from the bank, remember, but he doesn't close the deal. that is important to bring up this morning. >> carley: and it is a billion dollars. do you think the deal will go

through? this is a negotiating tactic to draw the price down, is that what is going on? >> cheryl: i do. the stock has been under pressure since the strike price was 54.20 and now below that as far as markets are concerned. he has negotiating power. there is billion dollar break-up fee. there is leverage on both sides. he is right. you have to monetize bots. well, you can't, you have to monetize actual users. twitter is an ad-based platform. you don't have a company to buy if you can't monetize the people on said platform. >> todd: i'm sickened this is part of a long game from elon. >> carley: do you agree? >> cheryl: yep. >> todd: staying with the elon block. elon pulling no punches when it comes to president biden. listen to this.
