supreme court draft opinion overturning roe v. wade. >> steve: that would be the group ruth sent us. lucas tomlinson is live in washington with the very latest. what do we know about this guy lucas? >> good morning, guys. if not for two u.s. deputy marshals standing guard outside of kavanaugh's home this story could have had a very difficult outcome. one arrested 26-year-old nicholas john roske from simi valley california had the following items on him. a glock, a knife, ammunition, zip tie, hammer duck tape. here is the timeline early tuesday morning exits a can cab by kavanaugh's home. spotted by otwo deputy marshals, he starts walking away from them down the street. 1:35 a.m. he calls 911 saying he wants to kill judge kavanaugh and he tells the dispatcher he is having suicidal thoughts. according to court documents they found his address online as

you mentioned. posted by pro-choice groups following the leaked draft supreme court opinion. kavanaugh and his family were home at the time. it's also believed roske thought kavanaugh would ease restrictions on guns at the justice department. president biden's attorney reacted to the arrest. >> we will do everything we can to prevent them and to hold people who do them accountable. for that reason, last month, i accelerated the protection of all the justices' residences 24/7. >> threats to federal judges have increased in recent years. the attorney general met with federal judge esther solace. herself the targets of a tack and attempted murder in 2020. she survived but her son daniel was shot to death at the family home by a disgruntled man. >> these threats are real. my boy and his death is a testament to what will happen if we do not do something to protect the judiciary.

>> despite the arrests protests are continued outside the homes of the supreme court justices. protests against law welcomed by the white house following the leak of that draft opinion. up. >> we believe of course in peaceful protest. there is outrage, i guess, about protests to date and we certainly continue to encourage that outside of judge's homes and that's the pot's position. >> the supreme court is expected to make a ruling this month or later july overruling roe v. wade. mitch mcconnell weighed in this from this potential assassination from the senate floor. >> this is exactly the kind of event many were worried the unhinged reckless apocalyptic rhetoric from figures on the court. >> threats have not been taken by twitter and urging the

temperature to be drastically lowered. steve, ainsley, brian? >> brian: lucas, what i don't understand from 1:05 in the morning when the marshals spotted these two and turns himself phone call 1:35. did the marshals get out of their car and follow him? did they lose sight of him? what happened? >> i had the same question, brian. it appears once he saw the marshals he walked down the street away from them. it does not appear that those marshals followed them. it was actually that call to dispatch, 911 that dispatched local police and that's who made the police not the u.s. marshals. >> >> brian: odd, isn't it? >> ainsley: what was in his backpack. all of these items, pepper spray, not only the gun, the pepper spray, the zip ties, the hammer, a nail punch, a crowbar. business tall like duct tape. it looked like he was planning. he admitted to police. did he have second thoughts he called 911 in the neighborhood i want to kill myself and i want to kill this justice.

>> steve: taxi dropped him off right in front of the house. and the house was posted online by a number of. and the ruth sent us did post the map showing the homes of the justices and later removed it said you can't blame us for his plan because we are nonviolent. there is a list of all the stuff they found in his bag he got out of the taxi not expecting to see anyone there and he freaked out. marshals in want from of judge kavanaugh's house in the morning. and the guy gets out of a taxi and walks toward the house with a suitcase and they go don't over immediately with. instead, i think he got a little scared. went down the street, freaked out a little bit. and that's when he called. at his initial court appearance in federal court in green belt, maryland yesterday where he was charged with one count of

attempted murder or kidnapping a u.s. judge, the judge in this case, who is presiding over the arraignment essentially, asked if he understood what was going on. he said i think i have a reasonable understanding but i would not say i'm thinking clearly. and then he told the judge that he is a college grad. i'm on medication. did not say why. did not say what kind of medication. >> brian: so listen to this: he was thinking about how far to give his life purpose and decided he would kill a supreme court justice. how this isn't the number one story everywhere on the planet but if you flip around, you look at the "new york times," it's not. "the washington post" it's at the top of the page. but it's not in the "new york times." and it's crazy. i think on some level the kavanaugh family must sit around saying i wish you were never nominated. has this been worth it? through the personal hell he went through three years ago to what he is going three now, did you see how close they are to his house pounding on the drums.

and jimmy kimmel did not ask him about the kavanaugh thing; however, obliquely, he did refer, joe biden, to what would happen if the supreme court acts against what joe biden wants. >> it's clear that if, in fact, the decision comes down the way it does and these states impose the limitations theioyns they ag about, it's gonna cause a mini revolution, they are going to vote a lot of these folks out of office. >> ainsley: republicans in congress are really putting pressure on democrats to actually act on this and to pass a bill. and, if passed in the senate they will put security guards at all the justices houses. they will guard their children and families. >> steve: good. >> ainsley: nancy pelosi won't bring it up in the house. >> steve: they are working on it. >> ainsley: and chuck schumer, he is the democrat majority leader and he told kavanaugh that he will pate price. this was back in 2020. listen to this. >> i want to tell you, gorsuch, i want to tell you, kavanaugh,

their righteous anger. >> brian: will what if they went to ketanji brown's house how quick would there be protection? >> steve: people who don't want are abortion they will be celebrating. there won't be a revolution with them. they will be dancing in the street if this happened. however it would be essentially joe biden's base who would be upset. and that is one of the reasons why apparently the national guard is mobilizing. they are saying hey, if the supreme court overthrows roe v. wade, get ready, we will give you the go sign. and we will send you to different places where there could be violence. just the fact that, you know, the assassination attempt yesterday happened, and, yet, those activists showed up last night and the federal government under the auspices of the attorney general, merrick garland, why he does not enforce the law of the land, because it

is a federal violation of statute to try to influence a judge and clearly that's what they are trying to do. and they have been doing it for weeks and the department of justice just sits on their hands because -- because they -- you would have to ask merrick garland but you got to figure we heard what jen psaki said earlier. we have no problem with peaceful protests. but, unfortunately liberation i think that guy out in california saw the peaceful protest and thought look how close i can get to that guy's house. and he did. >> brian: go ahead. >> ainsley: merrick garland? >> brian: spineless. remember they sold us merrick garland under president obama that he was this moderate justice that republican could say get behind? what has he shown that shows any moderation? that and janet yellen throwing herself on the hot coals saying i'm sorry i misjudged inflation are two examples of people that have to cover for terrible

policies for president biden. >> ainsley: the supreme court is going to have to make a decision on roe v. wade before they break for summer. that means the end of this month or beginning of july. jesse watters is predicting this is just the beginning. >> this is just the beginning. this summer is going to be ugly. that's why we have to get to the bottom of this. this could be a little criminal conspiracy that needs to be investigated. again, by the left's own standards. we might have to appoint a commission. we might have to hold hearings. we have a criminal leak. we have a group that's protesting outside the house. you have an attorney general that's not doing anything about this. you have a senator who is agitating. you have a white house who is giving this license. these people incited violence, possibly? and we need to hold them accountable if they did. chuck schumer, nancy pelosi, liz warren, anybody who has their hands on this should face

a spokesman for the air station yuma saying there was no nuclear material on board the aircraft despite earlier reports. two atlanta area preschool teachers are facing child cruelty charges for allegedly abusing their 3-year-old students. parents in roswell, georgia say they witnessed the abuse after logging into the school's camera system. video appears to show one teacher using her knee to bump a child while another is seen pushing a child's head, school officials are cooperating with investigators. and a chicago suburb has revoked the personal permit needed needed for upcoming pride parade there were not enough officers to provide security that short fall comes after banned uniformed officers from marching in the parade. the cops are not allowed to carry their service weapons or patrol vehicles. the aurora pride board has filed an appeal which is scheduled to be heard later today.

those are your headlines, steve, over to you. >> steve: thank you, carley. fallout concerning the upcoming ruling that could overturn roe v. wade. a man from california, 26 years old yesterday admitted in federal court to officials that he wanted to kill justifiable brett kavanaugh after being taken into custody outside of his house. and hours after the left wing activist is charged with attempted murder, dozens of pro-abortion protesters marched outside the judge's private residence there in chevy chase, maryland. fox news contributor jonathan turley joins us right now. jonathan, you know, so fresh off of this assassination attempt and there they are about 15 minutes ago i suggested i wonder why the attorney general merrick garland wasn't enforcing that federal law to keep protesters away from the outside of judges'

houses but you have a good reason why there would not be. >> i think there would be a first amendment challenge. this law talks about protests not just outside homes but even courthouses. they are intended to intimidate or influence a proceeding. well, if you interpret that broadly you could arrest people outside the supreme court building. i think that courts would very likely adopt a narrow interpretation of that law. and so garland may be reading that -- those tea leaves and saying we are not sure we could make this stick. there are first amendment cases that cut the other way. that doesn't mean that this isn't wrong. i mean, the problem is we often talk about what is illegal. and not what is just simply indecents or grotesque. and that's what this is follow threat will, a go stand outside door with a glock 1:00 a.m. and go to returning to protest is

you won't know what hit you if you go forward with these awful decisions. >> steve: what do you think of that? ever. >> well, they now know, don't they? when you say stuff like that you will reach a certain number of unhinged number of people who believe it's a license for them to mete out their own o -- i don't think that what senator schumer intended i don't think he endorses violence but it's the recklessness of this language and also the failure to speak out. the white house couldn't even muster the courage to condemn the leak, to condemn people protesting at these houses. the president of the united states didn't have that moment of simple decency where he said enough. this is not something that we need to do in order to have our voices heard. and in the meantime, you have a lot of these groups like antifa on the left, which have been

lionized by some. minnesota attorney general allison said he thought antifa would put the fear of god into the trump administration. house judiciary chairman jerry nadler said that the even existence of antifa was a myth, something that the fbi director said no, it's real. this is one of the most violent anti-free speech movements in the history of the united states. and that's the problem. it is easier to incite a mob than it is to control it i think democrats are beginning to see that there's a price to this. when you pander to the mob. >> steve: well, and you know, it sounds like the national guard is preparation for the decision from the supreme court that are going to mobilize and fly people wherever there is trouble and we heard the president of the united states say yesterday on jimmy kimmel, mr. turley if roe v. wade was overturned there would be a mini revolution. >> right. and we also had senator shaheen who said there would be a

story gold star widow and track and field coach dana lyon along with her attorney mike rose. dana, thanks for joining us and telling your story. first off, you had the tragedy happen to you in your life in 2014. can you explain? >> sir, thank you so much for having me and hearing my story. in 2013, actually, my husband and i were both deployed at different locations in afghanistan. and a few days after christmas, dave was in a convoy and en route back to home base when he was hit by a v bid. and so two days later i was able to escort him home for our freedom flight. intended heading home state side. we were met with a number of friends and family and teammates at dover air force base and ended up being [inaudible] air force academy. >> brian: the air force said hey, we are going to take care of you and they convinced you to start coaching again.

didn't they? >> no. absolutely. yeah. so even like at the reception right after dave's funeral there was a gentleman and a number of people from the department who said hey, why don't you come back to the family? you are a 2006 grad. you are one of our most accomplished female athletes two time national championship invaluable to the program and love to have you back as part of the family to take care of you. >> brian: you liked your job and then you found out you lost your job. why do you think you lost your job? >> well, you know, it's interesting because the only conversations i ever had revolving around my job had to do with me not getting the job. the former coach or head coach who tragically passed away this past march had a conversation with hr director and one of our sports supervisors that said now that we can't [inaudible] the what's your job performance like. and of course head coach like a father figure to me outstanding. she is above expectations. she is invaluable to this

real life for our next guest whose home is being taken over by a squatter. danielle cruise joins us now. you had a squatter, you decided to fix this place up and sell it as you go to do that your contractor goes in and what did that contractor discover? >> well, when he walked in to check out the roof, he realized that there was a young woman who had moved in all of her belongings and thee took over the home. >> brian: you say no one blockings there. there was a leak there. he explores it someone is living there of course you are going to toss them out. you go to toss out the squatter and what happened? >> when the police arrived, we told them the situation. and they said unfortunately, their hands were tied. they could not remove her. they couldn't prove that she was trespassing. even though all of the locks on the home had been broken and changed but with illinois laws the squatters are more protected than the actual homeowners.
