>> bill: okay. you look great in blue, right, as we have seen today. team blue. coming out hard and strong on monday night. >> dana: jimmy failla and kat, one of my favorite people. get ready for that. >> the number one show now. >> dana: harris faulkner is next. >> harris: he was armed to kidnap and kill. a california man accused of trying to kill brett kavanaugh. the democrats' unhinged rhetoric is to blame. i'm harris faulkner and you are in "the faulkner focus". 26-year-old nicholas roske could be indicted as soon as today. according to the complaint he was angry about the leak draft

opinion suggesting it was ready to turn the abortion statute roe v. wade. question, why exactly are democrat leaders dragging their feet when it comes to protecting judges and their families? >> there was absolutely no excuse not to provide that protection for all the justices. >> republican minority in the senate needs to push back and make sure those in charge of the law protecting our judges, somebody is going to get killed here if we don't change this. >> there is only one reason for protestors to show up outside the home of a public figure. to send a message we know where you live. we shouldn't be playing with this. we're playing with fire. >> harris: david spunt live at the justice department. >> we found out from the capitol hill producer the house actually will not likely be taking up a vote on protecting justices and their families today. the house is off tomorrow. so we may not see any action on this until next week with
8:02 am
further will enrage people to make sure that judges and supreme court justices are protected. this suspect in this case nick roske woke up in a jail cell this morning in federal custody charged with the attempted murder of a supreme court justice. according to that criminal complaint wednesday morning at 1:05 a.m. dressed all in black, nicholas roske got out of a taxi cab at the home of brett kavanaugh in maryland. spotted by two deputy u.s. marshals guarding the home. they saw him walk down the street. 30 minutes later he picked up the phone and called 911 and said he wanted to kill kavanaugh and was having suicidal thoughts. when police arrived they found a glock pistol, knife, screwdriver, pepper spray, crowbar, duct tape and nail punch to name a few. last night a protest outside the home of justice kavanaugh in maryland called ruth sent us aimed at protecting a woman's
8:03 am
right to choose in honor of the late justice ruth bader ginsberg chose to protest not even 24 hours after the suspect planned to kill and kidnap the justice. this is the same group that posted the addresses of the justices online. according to authorities roske said he found kavanaugh's address online. speaking of ruth sent us they said we're committed to non-violence. they'll talk non-stop about how our peaceful protest inspired this. what was the weapon, the california man had if it was a gun or knife police would say so. guess what? police did say so. it was a knife, it was a gun. pepper spray, a crowbar. all the tools there, nick roske right now in federal custody. technically he has not been indicted yet. grand jury hasn't been seated. it will come down soon. >> harris: david spunt, you will keep us informed this hour and if we need to we'll come
8:04 am
back. the alleged attempt to kill a u.s. supreme court justice brett kavanaugh follows months of talk like what you are about to see from democrats over that leaked roe v. wade draft opinion. chicago mayor lori light foot said it was a call to arms. what did she mean by that? vice president kamala harris said it is time to fight with everything we have. what did she mean by that? and senator chuck schumer said this. >> i want to tell you, gorsuch, i want to tell you, kavanaugh, you have released a whirl wind and you will pay the price. [cheering and applause] you won't know what hit you if you go forward with these awful decisions. >> harris: while that sounds like a marvel comic, again, what did he mean by you won't
8:05 am
know what hit you? and just today, this morning, senator dick durbin. >> let me just say this. i can't believe that a statement made by the majority leader months ago, maybe years ago, i don't know when it was made, was the reason for this individual deciding to stalk the supreme court justice. as a general rule we should all temper our rhetoric some and understand there are people who are vulnerable to that kind of rhetoric on both the right and the left. >> harris: after the fact. hum. senator john kennedy, republican of louisiana, and member of the judiciary committee is in "focus" now. senator kennedy, it's always easy to say what you might do when it is absolutely necessary and maybe they could have toned it down before when it was also absolutely necessary. >> well, this entire situation, harris, is really bad.
8:06 am
i think most americans have a moral compass. but sometimes we land in different places on tough issues. that's in part why we have the institution of the united states supreme court to tell us what the law is. and most americans say okay, whether i agree or disagree i accept the result. when the draft abortion opinion leaked, i was appalled. i was also naive. i thought most of my colleagues in washington, d.c. would be appalled. but they weren't. they immediately -- not everybody, but many members on the left immediately attacked the supreme court both as an institution and personally. and the mantra was burn the place down, celebrate the leaker, intimidate the
8:07 am
justices, kill the filibuster, pack the court. i was naive. i am still appalled at that. senator schumer did go on the steps of the supreme court. i was there and he named two justices by name. one of whom was justice kavanaugh. he said if you don't vote like i want you to vote on abortion, you will reap the whirlwind citing the book of isaiah in the old testament. he will suffer wrath. if you ask yourself where did this whack job who wanted to kill justice kavanaugh get the idea of doing that, just kind of look around at this place in washington, d.c. >> harris: you gave us a primer in the power of words when there are some among us weak enough to yield to them in the most violent pace potentially.
8:08 am
i want to move to this, more words. the "wall street journal," a quote, if america is more polarized than at any point since the civil war as progressives often claim, then the political class needs to take the risk of violence more seriously. your reaction. >> i think it's true. i think that's absolutely true. but it's not just -- how can i put this harris. it is not just violence that people are worried about. i think most americans right now are discouraged. they feel like their government and this place called washington, d.c. doesn't care about them. they feel like d.c. has let them down. they feel like american people feel like their lives and their futures don't matter to the people in leadership positions up here. and the american people are
8:09 am
worried about violence. they are worried about crime. they are worried about inflation. they are worried about the border. they are worried about their kids' education after the schools were all locked down for long periods of time. they are worried about their healthcare. and those issues are not being addressed. the issues that moms and dads worry about when they lie down to sleep at night and can't. yes, violence is one of the issues and it -- we're trying to address it. the mass shootings. i'm disappointed that half of the mass shootings that are so abhorrent to the american people are not being addressed. we're trying to address the mass shooting by these young alienated criminal crazy kids in the basement. but what about the mass shootings by gangs throughout
8:10 am
america? we ought to be trying to do something about that as well. >> harris: i talk about how many mass shootings happen every weekend in places like chicago particularly that city because we've seen so much. you are right about that. that has to become part of the focus as well on how to reach out to those people and share information about them when we know it's coming potentially maybe we can make a difference in a whole host of different levels. i want to get to this. because i do have a question why the january 6 committee doesn't look more like the 9/11 committee if in fact we're worried about getting to the bottom of things. so that committee is ramping up expectations for its first public hearing. it begins in prime time tonight. a spokesman saying the prime time event will be packed with new video, audio and other information proving that former president trump was at the heart of the attack. i don't know, senator, if we need an event.
8:11 am
what we do need maybe is the kind of hearing that gave us answers after 9/11. they are calling it a production. it is expected to be slick and dramatic with a former television news executive at the helm. republicans ripping the effort as partisan, as a witch hunt. >> this committee is all about seeking the truth. they are scramble to change the headlines hoping it will focus on the partisan witch hunt. >> nancy pelosi continues to politicize january 6 while ignoring things like high gas prices, inflation that's out of control, a border crisis. she discredited the sham committee before it even started and i think the american people have figured it out but their focus on attacking their political opponents, they don't care about the rules. >> harris: senator kennedy. your reaction. >> i'll say it again. i think most americans are very
8:12 am
discouraged right now. they are worried about inflation and crime and inflation and the border and inflation and their kids' education. i'm not saying that what happened on january 6th wasn't repugnant. it was. if you look up the word repugnant in the dictionary there is a picture of january 6th. i don't know a single america who is proud of what happened that day and the people who broke into our capitol are being seriously punished and they should be. now, if speaker pelosi and speaker pelosi is the house, wants to conduct an investigation, that's her business. i think she would have been better served if she had allowed the republican minority to nominate their own members so we would have had more of a balanced playing field. i think it would have given the investigation more credibility. i understand now that she is
8:13 am
going to hold prime time hearings. they are going to be produced by a former major television executive. >> harris: yes. >> i'm sure they'll try to make it look like c.s.i. miami so the ratings are high. that's their business. what i think people are worried about when they lie down to sleep and can't. >> harris: you mentioned inflation three times. no doubt you know from talking to constituents in our own state and what the polling is showing against president biden is that people are losing faith and have lost faith in him and his ability. >> it is gutting the american people. it is destroying the american dream. and we have to address it. it looks to me like the biden administration has just given up. i heard secretary yellen say the other day geez, i'm sorry, i know i told you it was transitory but it will be with us a while and i don't have a
8:14 am
solution. i sure admire the problem but i don't have a solution so just get used to it. the american people deserve better than that. >> harris: maybe we need to get rid of her then. somebody can do the job. apology is nice but only manipulation if you don't change your actions. >> i'm not saying this about the treasury secretary specifically but i'm wondering when is president biden going the start firing people? he needs to start firing people. >> harris: we certainly didn't hear any of what your questions are getting to from the president last night 118 days he only sat down with jimmie kimmel. we needed a journalist to take a stab at it. i'll bring you back. thank you so very much for being if "focus." always good to see you. the biden administration reportedly is planning to ship illegal immigrants to a town near many americans, might be
8:15 am
you. maybe even your own town. and the so-called border czar, kamala harris, singing the same old tune as the crisis rages on. a year since she has been near the border. the mid-term elections could hinge on another different crisis. look at this. >> every time we go to the gas station and it is $5, $6, $8. i don't see that changing until voters can vote this november. hopefully it will be a wake-up call for the rest of the president's term. >> harris: the layering on of problems. a new poll shows how americans feel, both sides of the political highly is how they vote. how they really feel about inflation. jason chaffetz in "focus" next. migraine attacks? you can't always avoid triggers like stress. qulipta™ can help prevent migraine attacks. you can't prevent what's going on outside

i didn't realize my dna could tell me if i had a higher chance for type two diabetes. so when my son gave me a 23andme kit, it was a wake-up call. this father's day, start a new health journey together with dad with $50 off every kit. buying a car from vroom is so easy, all you need is a phone and a finger. just go to vroom.com, scroll through thousands of cars. then, tap to buy. that's it. no sales speak, no wasted time.
8:21 am
>> harris: we hear it over and over as it becomes a reality. every state is a border state and now a new report says that the department of homeland security plans to send more illegal immigrants even deeper into the u.s. what exactly does that mean? well, they will start with sanctuary cities like los angeles and houston. the department spokesperson tells fox news no decision actually has been officially made on that. which makes me wonder have they already started doing it and they aren't telling us? vice president kamala harris delivered a speech yesterday at the summit of the americas where being countries didn't attend. she doubled down on the root causes of migration to the u.s. >> i do believe most people don't want to leave home. and so when they do it is
8:22 am
usually -- [inaudible] our strategy must include a priority that is -- [inaudible] these are the guide than principles that form the root causes strategy. >> harris: while those words were hanging in the air a giant caravan of thousands of illegal immigrants moved through mexico to cross into the united states. jason chaffetz fox news contributor, former utah congressman. first of all the absence of this vice president, a year since she has been anywhere near the border. speak to that if you would and also did she say anything skip the root causes, that will actually make a difference? >> it is interesting. she has been totally absent and doesn't understand it. it's one thing for me to say something about it or somebody else to say something. why not talk to the border
8:23 am
patrol? they are the ones who put their lives on the day 20,000 plus of them. why not talk to the border patrol? she won't meet with them. she could zoom. she has time to go overseas and do all these other things and run to california. she has time to go meet with the border patrol but she doesn't. what's interesting to me on a legal standpoint her definition of why the root cause is happening and what is coming across does not meet the credible fear standard that is required in order to grant somebody asylum. if she is right, which i don't think she necessarily is. i think there is a magnet in the united states. joe biden and kamala harris said come one, come all, flow across the border. nothing will happen to you. >> harris: she did say that and then she said don't come. >> but come anyway. the other thing that's happening is we're dealing with inflation. you and i talked about this but i wish somebody would do a good analysis and dive into this.
8:24 am
if you have millions of people coming put pressure on the housing industry, what will happen? the cost of housing will go up. there are ramifications of just pouring millions of people into the homeland. we all want to be compassionate but these aren't refugees fleeing from ukraine. these are people saying hey, this is a good deal. >> harris: some are but they can't get close enough because the caravans are organized by the drug cartels with wrist bands. you know. >> yeah. >> harris: from all your work on the hill you know these are organized groups of people because they are part of the economic structure of the drug cartel. >> the drug cartel is in the control of the border. for secretary mayorkas to go before the cameras and congress say they have operational control. that's a lie and not true. there is no border patrol agent that will tell you that. i have been to the border multiple times, ride alongs seeing what the men and women do. they will tell you upwards of
8:25 am
80 to 90% of the women that come across are raped along the way. it is the human trafficking. it's the human toll that they just totally discount. they don't even pay attention to it. how many times do we have to hear about fentanyl and drug problems and we concede the border to the drug cartels? come on. >> harris: i did not realize that that number was that high, 80 to 90% of women are raped. that's on this administration to turn that around. they are making new victims. all right. i want to get to this. okay. so inflation. we know it, americans are hurting. now the numbers are starting to show something deeper. national polling shows inflation is the most urgent issue. an emergency now facing the nation beating out gun violence and illegal immigration. one top economist not optimistic at all about the future not just now but what's coming.
8:26 am
>> inflation is going to get much worse. we're nowhere near peak inflation. this inflation is just getting started. we've had it for a long time in financial assets. now it is finally moving to consumer goods and has a long way to go. >> harris: jason, the goal is always to find solutions and now some of the best and brightest are saying those solutions are really far in our future. >> you have the commerce secretary admitting out loud she has no solutions. the treasury secretary saying whoops. it is one thing at the gas pump and it is painful to spend $100 to fill up your tank of gas to go to work. it will start hurting when it goes to food. people on fixed incomes. it is already going up off the charts. food is going to become more scarce and become more expensive. there is a direct consequence to the policies of the biden/harris administration. they can go run and talk to do this and that and go on jimmie
8:27 am
kimmel but they are not offering real solutions. that's the problem. they don't have a plan. that's why these policies -- all of a sudden they go on television to start talking about donald trump? do you think that will resonate with the american people? i don't. >> harris: it's a production, an event. something being talked about that's not a hearing. the american people don't get served and that's the goal with our elected leaders like yourself when you led the oversight committee. i want to say this and ask my team to remind me of the municipality. our team was reading this morning about an area where they are cutting back on their 911 calls. i will ask you for the name of that municipality. tell me in my ear. big trucks, emt and fire that goes to the calls. they are cutting back on some of that because it takes away from the city's budget to keep everything fueled. i look at new york city and all the calls they must get and how
8:28 am
you keep things rolling. isabella county, michigan. my heart goes out to both the people trying to serve the community and those who are served because the reality is cash flow. that gas is punishingly high. many of the vehicles running on $9 and $10 a gallon diesel at this point. >> the federal government could crank it up and print more money so they don't feel the pain of this. if you are a county, city, state, you are going to get this. you have to actually balance those books. these democrats who believe in bigger government, more government, more government services will have to start slashing these budgets because they will have to pay for the fuel for the ambulances and 911 and sheriff. that county it's the sheriff. they are talking about the sheriff not being able to go out on as many calls. >> harris: unbelievable and they handle it over the phone on 911 and puts so much pressure on the dispatchers, can you imagine?
8:29 am
good to see you in person. thank you. champion gymnast simone biles is one of 90 women who say the f.b.i. dropped the ball and failed in the case of larry nasser. they want the f.b.i. to pay up big. and what happened yesterday could have an ending in a horrific tragedy. >> justice kavanaugh is also the father of two young children so that's a threat not just to his life but it is a threat to his family as well. so this does need to be considered a crime. it is a crime. >> we want to go deeper on those federal laws that are already on the books. the safety of u.s. supreme court justices should be every one's concern. critics say politics on the left are looking the other way. andy mccarthy in "focus" next.
8:30 am
8:35 am
>> we need to do something to protect all federal judges across this nation. our justice system is in trouble and judges stand on the front lines protecting democracy. if i sound, you know, upset or motivated or just flabbergasted probably it is because i am. daniel has been dead now for 20 months and 21 days. my only child. it boggles my mind. >> harris: she is a mom. federal judge salas with a very personal plea there. her son was murdered at their home by an angry attorney. roske said he was planning to kidnap and murder kavanaugh. we wait for that indictment
8:36 am
today. a new op-ed is calling out house democrats for sitting on security for u.s. supreme court justices. house speaker nancy pelosi was pressed on that just a few minutes ago at her weekly news conference. watch. >> you said that justices are protected but there was an attempt on judge kavanaugh's life. >> they are protected. he was protected. it's about staff and the rest. the justices are protected. you saw the attorney general even double down on that. >> harris: well, activists continue protesting at the justice's homes even after the threat against kavanaugh yesterday. a couple hours after news broke of the arrest of the suspect, the pro-choice group ruth sent us tweeted this in reference to justice kavanaugh. we're protesting peacefully at his home again tonight. that's a federal offense.
8:37 am
andy mccarthy, fox news contributor, former assistant u.s. attorney for the southern district of new york. so andy, i want to lean hard on this. yes, there is movement, they want the house to do something. something on capitol hill. but we have 18 u.s. code 1503 and 1507 that are meant to protect all judges and jurors. why is this administration not leaning in and using the laws that are already on the book without the excuse of well, we just can't come together on capitol hill? they don't come together on everything. we already have law. >> we do have law. they aren't enforcing it and they aren't enforcing it because they're politically aligned with the people doing the protesting. they aren't upset about the protesting. they are upset about being asked why they don't enforce the law. in our system, the judiciary is the non-political branch, right? our line with respect to
8:38 am
judicial proceedings is not violence. you are not allowed to protest outside the home of a justice, a juror, not just supreme court justices, judges, jurors, main witnesses in trials. the reason is we want legal cases decided by the rule of law not fear, favor or intimidation. it is common sense. you don't have a free expression right to protest on the lawn of a supreme court justice to try to affect the outcome of a litigation like the dobbs case. that is not free speech. that's obstruction of justice. >> harris: do you see the people dancing in the video? i don't know if you have a way to look at the monitor. this was hours after the alleged attempt on the life of justice kavanaugh and this is like a rally for them. it is more than just -- look at them. beating a drum there. it is a party.
8:39 am
and yes, it is peaceful but you say that's not the line. the line is they should not be there. what's the penalty? >> the penalty for just parading or picketing is what the statute says, you can get up to a year in jail for it. if you rise up to obstruction of justice the penalty for that can be up to 20 years depending how serious it is. >> harris: we have to get to and i'll ask you to stand by. house minority leader kevin mccarthy responding to house speaker pelosi. let's watch. >> a threat after schumer made his threats on the supreme court. jen psaki said it was the president's position to go to those homes. i have no idea why the democrats have held that bill for one month. i have no idea. i think they might be playing politics. speaking of that, speaker
8:40 am
pelosi's select committee on january 6th is unlike any other committee in american history. in fact, it is the most political and least legitimate committee in american history. it has used congressional subpoenas to attack republicans, violate due process and infringe on the political speech of private citizens. it has been caught altering evidence, including the text messages of our ranking member jim jordan. it has permanently damaged the house and divided this country. let's be honest, it is a smoke screen for democrats to push their radical agenda. you read just in axios just this week, the battles internally. they want to federalize elections, talking about their real outcome of what they want to achieve, abolish the
8:41 am
electoral college. all the while that the democrats are ignoring really what is affecting the american people. the highest inflation in more than 40 years. record high gas prices. double since president biden has taken office. lack of baby formula. unsecure border. fentanyl coming across. now the number one killer of americans between the ages of 18 and 45. let's be very clear. the violence at the capitol that day was wrong and we've repeatedly denounced it. keeping the capitol safe is not the point of pelosi's illegitimate select committee. there the beginning the select committee refused to investigate the real circumstances that led to the riot. including the lack of security around the capitol.
8:42 am
they also ignored the left wing mob violence which led to riots and loss of life across the country that summer. when house republicans proposed investigating these facts, you'll remember on january 12th we put it to the floor and every single democrat voted no. when i sent pelosi a letter after they voted no she did not respond for three months. then she jumped to create a select committee. not only that, she rejected the minority's picks to be on the committee. that's going against 232 years of a tradition in this house. you reject the minority to have a say in the committee.
8:43 am
who did she reject? congressman jim banks, a distinguished afghanistan veteran. she rejected congressman jim jordan, the ranking and maybe soon to be chair of judiciary committee. now why she rejected these qualified republicans, she appointed radical democrats. you ever spend time to see who is on it? she appointed chairman thompson who to be clear objected to the presidential electors in 2005. she appointed congressman raskin who also objected to the presidential elect tors in 2017. let's not forget what else he said. he called for president trump's impeachment not during his term in office, but between when he was elected and being sworn in.
8:44 am
then she appointed congressman schiff, just saying that name should be enough. but we watched what schiff has done to our country. the years of lying about the russian hoax, the changing of evidence we found as he went from the denying of the hunter biden laptop. our future rests on the ability of americans to trust our political system. to have safer streets, to have affordable food and gas, and to have confidence that their elected officials are listening to real concerns. now democrats are using january 6 to avoid accountability for making the whole nation less safe and less prosperous. you know it, you feel it, you see it every single day. every single day the food prices go up along with the gas. not sure if we caught another
8:45 am
individual coming across the border illegal that's on the terrorist watch list. not sure if there is anybody else who wants to try to assassinate former president bush. not sure if the plane from australia bringing goat milk to feed the children of america. that's the america we have today. i don't see any prime time hearings set for gas price, for battling inflation, feeding our children, for making the streets safer. you know, even in the hometown of the speaker, this tuesday, they recalled their d.a. based upon the democratic policies of not upholding safe streets. and don't think it was republicans rallied together. you know how many republicans are registered in san francisco? 6.7%.
8:46 am
low and behold, i'm not sure if using taxpayer money to hire a former abc executive who took his time to withhold information about epstein, if they're doing it for their ice cream but i do know the american public will not be fooled and i do know the republicans will not be deterred. we will continue to focus on the parts that america wants us to. to make america energy independent, to make our streets safe and our schools again, secure our border, to know that america and the next century will be ours. with that, even though speaker pelosi has rejected republicans' ability to participate, we said we would get to the bottom of this. we said we would not brush it under the rug and we have not. we continue to investigate.
8:47 am
leading that, which would be our ranking member on this committee, is chairman jim banks. he is a veteran to afghanistan, serves as the chair of our largest conference inside the republican conference and has continued to work on to make sure this this building will be safe and in the future this will never happen again. i give you jim banks. >> i thank the leader and as you said, the american people know that this select committee is already a fraud. democrats aren't investigating january 6th. that's already very abundantly clear. as the leader said they are trying to use the select committee as a trojan horse to abolish the electoral college, to intimidate president trump's aides, to block him from ever appearing on the ballot again. and to prevent his supporters from participating in american
8:48 am
democracy. gas today in my hometown in columbia city, indiana is $5.25 a gallon. in washington the democrats' priority is an hour long made for tv special attacking president trump. americans aren't buying it. voters see that even -- >> harris: we've been watching first the minority leader kevin mccarthy at his weekly news conference responding to house speaker nancy pelosi, and now they are talking about obviously the inequities and really the pomp and circumstance of what we'll see in prime time tonight of the january 6 committee. that was from indiana and congressman jim banks. i want to move now to andy mccarthy and bring him back fox news contributor and former assistant u.s. attorney for the southern district of new york. i want the talk about the real goals here that we should have for the committee and get your reaction quickly and we'll move to the next topic.
8:49 am
>> harris, i think it's very important that january 6th the capitol riot be investigated and i think it is tragic the way that democrats rigged the investigation. i was very supportive of a congressional investigation but when i prosecuted terrorists in the 1990s, even people who were horrific mass murderers, they got lawyers. they got people who were able to put their side to the extent they had a defense to make in front of the jury. to have a fact finding panel where you completely exclude the mainstream republican position and there is nothing from their perspective on it, that's not the way we're supposed to do things in the united states. both sides are supposed to be represented. and i don't know what on earth problem they would have had having jordan and banks, jim jordan and jim banks on that committee. if they were pro-trump, so what?
8:50 am
let the facts come out and then we'll judge them. >> harris: i thought it was an interesting comment from mccarthy. he said potentially in jim jordan you could be looking at the next speaker of the house. you can imagine one current speaker knowing there will be a red wave. i keep using the word potential because we aren't there yet. but we'll see what happens. she won't be in office and the guy she is trying to keep off that committee will be, you know, basically with her job. she may be in office but not the speaker any longer. he potentially could be. the politics really are at play here. one of the main questions continues to be -- i know with discovery in a courtroom we would get this. nancy pelosi, why didn't she have more backup, better preparation before that day when they were already getting communications there could be some problems? your quick thought on that and we'll move forward. >> there has been two senate committees looking into that.

it was at troeshous performance by the security forces. i don't think it forgives the other things that went into this but it is clear if they had robust, confident security, maybe this wouldn't have happened at all. if it did happen, it would have been quelled a lot quicker than it was. >> harris: there is a story that began breaking yesterday afternoon getting a lot of attention. gold medal gymnasts who were assaulted by larry nasser. they are going after the f.b.i. for more than $1 billion. they say the agency failed to stop nasser when it first learned of the accusations against him in 2015 and he targeted young women and girls for more than a year before finally being arrested in 2016. here is national champion gymnast maggie nichols. >> in 2015 i reported to the f.b.i. and i was told that usa
8:52 am
gymnastics would handle it and nothing happened in over a year. so it was -- they definitely failed me and all the other girls. after i reported larry nasser was still able to abuse so many girls every single day which is super scary to even think about and very disappointing. >> harris: can you be successful in going after the f.b.i.? >> i don't think so. look, the f.b.i. performed disgracefully. those agents shouldn't work there. you don't have a due process right to have a federal police agency conduct an investigation. you don't. i feel terrible for what happened to these young women but as a legal matter, i don't think they have a case against the f.b.i. >> harris: quickly, on with me a few minutes ago was jason chaffetz and he has written a foxnews.com op-ed. he said the d.o.j. will not

prosecute their own. they have been at the recommendation of inspector general told to prosecute agents in other cases and it's what you say, they won't do it. >> harris, unless they get political pressure. if the republicans take over congress, one of the things they have to do is what they never do, which is take an axe to the department of justice's budget. you want to get their attention? that's how you do it. >> harris: thank you for being in "focus" and the breaking news on capitol hill. good to see you. we have this breaking news now. earlier today authorities arrested a republican candidate for michigan governor in connection with can january 6 capitol riots. ryan kelly will make his first court appearance today. they stress he is innocent until proven guilty in a court of law.

we'll bring you any new developments as we get them. >> president biden: this is not your father's republican party. it is a maga party. >> can't you issue an executive order? trump passed those out like halloween candy. >> president biden: i don't want to emulate trump's abuse of the constitution and the constitutional authority. republicans don't play it square, why do you? guess what? if they do the same thing they do our democracy would be in jeopardy. we have the fastest growing economy in the world, the world. we've reduced the deficit last year by $320 billion. inflation is the bain of our existence and inflation is mostly on food and at gasoline. if you take and look at all the costs a family has on a monthly basis it also includes healthcare, prescription drugs, childcare, all those things. i'm proposing that we, in fact, reduce the cost of those things.
8:55 am
my mother used to say out of bad something good will come. >> harris: what is the silver lining of inflation that's crushing the economy? the president blame game and i don't know what that was. the president continuing to point fingers at his predecessor because when you don't have a plan you point to the other guys. republicans who are currently in congress for the crises. all of them, numerous taking place under his watch. voters don't buy it. a new poll from quinnipiac reveals just 33% of americans approve of the job he is doing while 59% disapprove. that's independents, republicans, democrats. a party strategist meaning his political party, the democrats, now calling on biden to step up and take action. a quote, it is really simple, be the bleeping president. we took the bad word out. i realize it's tough and you are drinking out of a fire hose every single day but there are things you can do to control

the public perception and they haven't done any of that end of quote. power panel now. acu chairman matt schlapp. marie harf former state department spokesperson under president obama. marie, i come to you first. you are transparent about what you can and can't defend. jimmie kimmel 118 didn't see a sit-down from the president and that's where you go. >> he has done lengthy press conens calling on every media outlet across the spectrum. i think president biden speaks to the american people quite a bit. >> harris: did you think he did that well last night? >> i think what he did well is say look, there are challenges. inflation is a challenge. there is a bunch of reasons for that. they can try tackle some of them at the federal level through the president. some of them the fed will try to tackle with interest rates. some of them are global. he also said we have seen economic growth. it is important to look at the
8:57 am
whole picture, not just one piece of it, harris. >> harris: let's look at one picture. matt, was the president trying to talk us out of the fact that food is so high right now and compared to everything else that american families spend on, you know, it is just food and gas. he does realize he can't realize without food. they are confused at the white house about baby formula. >> they have no policy answers to what is going on with inflation because the modern day democratic party, which has embraced all the free wheeling socialism only knows how to spend their way out of it. what he has to do is take the blame for the $2 trillion emergency covid bill that he pushed through with democratic votes and it fueled the inflation and the spending down throughout the covid lockdown period including under the trump presidency. what we have to realize we have to come up with other solutions besides the big budget busting bills. i would just say joe biden going to jimmie kimmel got a
8:58 am
standing ovation, they love -- jimmie kimmel kept saying we, we, we. he is in bed with the democratic party. it made joe biden feel good to be with his homies. he is living in an alternative universe. go talk to real americans. they are very troubled. >> harris: maybe they need you to do some of the messaging you used to do for the administration because they're failing. we have been touching on gas prices and i want to go deerp. outrageous prices affecting how first responders are doing their jobs. one example. the national average per gallon of regular unleaded now $4.97. it goes up between a nickel and a quarter every month or so. we're headed to 5 in no time. the pain worse in the state of michigan. the average is $5.21 and it is affecting people. you heard us talking about the
8:59 am
sheriff's department there in isabella county changing how the deputies respond to non-urgent calls. i want to get to you just to respond to that. the president needs to say something, marie. >> the president has spoken a lot about high gas prices and how they are doing a number of things to try to bring them down including tapping the strategic reserves. >> harris: that hasn't helped. he promised 10 to 35 cents a gallon it would make a difference. you realize even if they did that by the week now we couldn't keep up. matt, your quick thoughts. >> if we allow this to come out of the strategic petroleum reserve something like nine days of our demand. think about this alone. if we finished the keystone xl pipeline. it would have been done by the end of the year and replaced all the fossil fuel product america imports from russia. you can't cancel all these projects and say you will reduce gas prices. all those prices will hit the

roof and it will get worse from here. >> harris: i'll bring you both back. we had breaking news this hour. good to see you, marie and matt. thank you so very much for watching "the faulkner focus". up next after the commercial break "outnumbered." actually, right now. >> kayleigh: this is our number hello, everyone i'm kayleigh mcenany you here with emily and harris faulkner also joining us what we gabbard and guy benson. welcome everyone after nearly four months without a major media interview president biden chose late nights jimmy kimmel for his first network sit down, what a hard ball his friends who was also elected. and although kamel was fawning for the most part he did admit he was frustrated more progress has not been made on guns and other key issues. but
