los angeles. we'll watch for it and cover it if it happens. i'm harris faulkner and you are in "the faulkner focus". the inflation rate last month rose 8.6% from one year ago. the fastest pace since december 1981. that's up from 8.3% in april. it is hot. i told you, it's running hot. the energy sector hit hard. prices there for gas, heating, electricity have skyrocketed. prices of meat and eggs surging the double digits. the white house is ignoring the people it's supposed to serve and they know the power is in the hands of the voters. >> every item when i go food shopping is 20% more post covid. so it is tough out there for everybody. >> doesn't seem to be stopping. oil and gas, i don't see that mitigating. so it is going to hurt. >> i do know inflation is very

high and everybody -- >> harris: larry kudlow warns brace for the summer. >> there is a lot of talk in both washington and wall street that we had seen peak inflation. there is no evidence in this report that we've seen peak inflation. in fact, kids, the three-month increases are now running ahead of the 12-month increases. that's a very bad sign. the trend lines are all wrong. >> harris: the biden administration was expecting this report to be bad. here is the white house press secretary out yesterday early doing damage control. >> we expect the headline inflation number to be elevated and have the war in ukraine have some effect on core inflation. despite these disruptions and the fact the numbers can be volatile we continue to believe the economy can transition from

what has been a recovery of the economy to stable, steady growth and inflationary pressures moderating. experts have been saying that for some time now. >> harris: she is reading out of that binder at the lectern at the white house press briefing every day. she is not seeing americans. the markets taking a tumble on today's horrible news. dow down 800 points already this morning. fluctuating between 700 and 00 plus. charles payne is in "focus." charles, you sat down moments ago before we started. we're in trouble. >> we are in a lot of trouble. larry laid it out pretty good because, you know, the experts, everyone thought maybe we would have peak inflation in december. then january, february, march, april, may. and it is persistent and won't go away. they created a monster, a beast. it is hard to -- >> harris: who created a beast.

>> the federal reserve pumped a lot of money to our economy. that money doesn't get into regular folks' hands. helps mostly corporations. that last bit of cash that the biden administration put in, the 1.9 trillion paying people twice as much money to stay at home than to go to work. the stimulus checks, all that created an environment where we just went out and spent the hell out of it and created these problems. on the wage side what happened is, of course, if people can make more money staying at home than not going to work then you have a problem for businesses. what businesses have tried to do is raise wages. that's how we have the wage/price spiral. this year small businesses lost employees every single month. they've lost employees over a quarter million. they can't keep up. amazon paying $25 the shop next door can't keep up. so it's all over the place. here is the interesting thing about the market and what it is telling us.

we went down 500 points in the dow when the news came out. >> harris: within seconds. >> we were moving this way and then another gut punch. >> harris: americans and what we're feeling. >> the consumer sentiment number came in at an all-time low. all-time low for 85 years, all-time low. all-time low. >> harris: what does that mean? >> we've never felt this crappy before. just to put it in a nutshell. we've never felt this crappy before. so we went down the extra 300 points. >> harris: so because the markets understand when people feel that bad and that dismal and that despair in their soul, it affects everything they do. >> sure. >> harris: everything we do. if i don't want to spend $5, $10 a gallon for some in

california now, right? if i don't want to do that. if i want to sit home and don't want to participate in the workforce and collect help checks i can sit down and that hurts us even more. >> that's what got us in this situation, right? how we ended up. ironically people may have to get two jobs to get -- really, check this out. a survey that came out. i want you to listen to some of this. 87% of people made an effort to find cheaper prices on products they buy. 77% have cut back on spending on entertainment or eating out. 77% put off purchases. 59% of people minimize the use of electricity. >> harris: how do you do that? >> keep some lights off. >> harris: in california they have a heat wave. >> think about that. turn off these lights. listen, when i grew up my mom said that.

we were perpetually in this situation. we haven't been accustomed to this in a long time. other surveys 9% of families are skipping a meal. 40% of families are saying a parent will choose to skip or evening will choose to skip a meal so all the children can eat. this is where we barrel through and this is scary stuff. this is scary stuff. >> harris: i'm taking notes as you are saying that and remembering here recently the treasury secretary janet yellen and remembering her recently and the ineloquent words she said. i'm sorry i got it wrong. yes, stop talking. how the michigan senator drives a electric car and can drive past the high prices. you told me 59% of people are making electricity decisions. has anybody told her that car runs on electricity? >> it comes from natural gas up

more than crude oil and it goes into the making of fertilizer. when she is patting herself on the back driving an electric vehicle she shouldn't feel too good. a lot of constituents aren't eating. >> harris: you always have some good news for us. i want to get to that. here is president biden's top economic advisor brian deese when he was asked about inflation just today on a competing network and he stuck to the talking points. >> today's number underscores the challenge we have with energy prices that you were just discussing. it also underscores why it is so important the president is doing what he is doing. making fighting inflation his top priority. the price of the gas at the pump is up $1.70 since putin amassed troops on the border. that's a impact of war. we have to stand against that aggression. >> harris: you know what i don't like other than a hollow apology that means nothing from

yellen and the others, it is just manipulation. i hate when they lie us to. do we think we're stupid enough to believe the war that started 100 days ago is the reason we've been in this sticky wicket for a year? >> it's insulting and embarrassing and hurts more when the average person is hurting. real wages when you adjust for inflation have been down minus 3.7,.us 1.2 and 8/10 percent, 1.7, 2.4, 1.9. they keep going down. i'm talking real wages. there is a nominal wage that you get in your paycheck and how far it goes in the economy. real wages have been down. the reason i point all these out i started with the month after that 1.9 trillion was signed off. real wages have gone down every month since then. we found out today in may they were down 8.3% and why people are suffering.

the committee showed never before seen video of the capitol breach and testimony from members of the trump family. there was also raw testimony from a capitol police officer who told lawmakers about the carnage and chaos as she fought the mob. republicans called the hearings a partisan attempt to distract from the biden administration's failings and here is house republican conference chair stefanik. >> it's a partisan political witch hunt. an illegitimate committee. no republican-appointed members appointed by the minority leader breaking over 230 years of precedence. it will do nothing to insure the capitol is safe and secure in the future. >> harris: chad pergram is live on capitol hill. >> hello, committee members say evidence presented at the hearing shows there is a threat to democracy and that threat

still exists. democrats accuse former president trump of trying to cling to the presidency at all costs. >> he was hell bent on telling a lie to the country and the fact that we have elected officials in the country who are still trying to deny the truth is shocking to me. >> despite the graphic video of the riot and testimony of the mob assaulting police officer gop members accuse the committee of targeting the former president. jim banks says it's an effort to keep mr. trump off the ballot in 2024. >> last night's hearing was a prime time dud. nothing came out of it that we didn't know before and didn't change anybody's minds. at the end of the day this committee is trying to prosecute donald trump for crimes that he did not commit. >> the committee is teasing what the public may learns in a trifecta of hearings next week including efforts by president

trump to challenge the election results dribbling out information could focus voters next week. >> it's really one of the tricks up their sleeve the committee has is the ability to reveal the information that hasn't been revealed yet so it is almost like they give clips to keep us tuned in. >> next week's hearings aren't in prime time and unclear if last night changed any minds. >> harris: television producer is doing the whole thing. lawmakers would pause like we do when we anchor a show and wait for the sound to run. we'll move on. chad, thank you. a republican who was blocked from the january 6th committee is in "focus" now. congressman jim jordan of ohio, the ranking republican on the house judiciary committee and member of the house oversight committee as well. good to have you in "focus." it didn't go all that differently than our recent conversations about pomp and circumstance. there was a lot of glitz and all of that.

the big question is did we get the answers that the american people really deserve about why the capitol wasn't better protected? >> we certainly didn't get those answers because nancy pelosi refuses to answer any questions or let the sergeant of arms testify who was there at that time. i think ms. stefanik and mr. banks are right. this was a partisan production put on by the former head of abc news. i don't think we learned anything new. for goodness sake, they had a democrat staffer giving a timeline on video. if a republican staffer were in a committee and put them on video and let them talk for a sustained period of time, can you imagine what the press would say? so i think the country sees it for what it is, a partisan political committee that the american people are focused on a lot of other issues. >> harris: i can't imagine what they would say if it were republicans doing that. they would call it collusion.

they would say it was a hand in glove situation. >> yeah. or the fact that there is no cross examination. there is never a committee that meets on capitol hill where there is not an opportunity for cross examination. the majority party get more witnesses but the minority party gets to cross-examine the witnesses or bring in a witness except in this committee. this is worse than what adam schiff did with the 2019 impeachment in the bunker in the basement of the capitol. we got to be in the room and depose the witnesses. when they had hearings we at least got to cross-examine the witnesses. that's not happening here and just a production selectively pulling out information we get no chance to see, presenting that to the american people in a completely partisan fashion and again, you just went through how bad the inflation is, 41-year high inflation. the american people care about what is in their paycheck and what they can buy with their paycheck. instead we get the prime time focus on a partisan activity.

>> harris: democrats and politicians in general, most recently with this particular president when he was a candidate said that things were going to be better and he would be able to handle a lot of things all at once. who said they couldn't deal with the economy now and looking this in more of a nation like a 9/11 investigation. they promised they could walk and talk. we are trying to see if they can actually do that. i want to get to this because i understand house republicans are now going to launch your own investigation into why there was such lack security at the capitol, for example. and that any democrat is welcome to join. let's watch and i'll come right to you, congressman. >> the capitol was not secure that day. there was a systemic breakdown of security and leadership within capitol security. the top levels of the capitol police. >> we want to get to the bottom of why this capitol was so ill prepared. we won't say democrats won't be on committee.

we won't issue subpoenas for going after political opponents. >> harris: how would that go? you would open the door to any democrat, that would be like it is supposed to be for 230 years. >> if the american people put us back in control we'll put the investigations so the american people get the truth and do it in the way consistent with the constitution and get the facts and answers to the country they want to have. why wasn't our capitol, their capitol, secured like it should have been in light of the fact that president trump offered the national guard to speaker pelosi. my hunch is when they said and spend a summer doing that you can't say we need more police force here on january 6. that's probably the motivation why they decided to do what they did. why the f.b.i. and d.o.j. is targeting moms and dads at

school board meetings and americans tax returns leaked and no longer have a border in the southern part of our country and people flood in the country when it used to be secure? the american people want answers to those issues and we'll make sure they get them if they put us back in control. >> harris: just as a journalist and observation and talking with other people on the issue, here is one to throw in. how is it that we as a nation can tolerate our democracy being tricked and toyed with, with a leak from the u.s. supreme court? i know you have a lot on your plate there. you can add that one. >> or an assassination attempt on a sitting supreme court justice. that never happened before someone trying to kill a supreme court justice outside his home. that is something that needs to be investigated as well. >> harris: 100%. so there are the five of you,

four other members of congress plus you have been subpoenaed and none of you so far has committed to complying. that deadline is looming. where are you on that today and did you see anything last night especially when you see the former a.g. william barr, is there anything that says i want to get my voice in there? >> we really sent a letter in response to the committee to chairman thompson and laid out our concerns. the main concern i have, any person would be reluctant to go in front of a committee that has proven they will take information and lie about it. information about me. they altered the evidence and misrepresented and lied to the american people. so much so the committee said we regret the error, which is government speak for we got caught lying. any committee that has done that and so partisan as we've talked about and for the first time in american history would not allow the minority leader to place on a select committee the individuals he had

threatening to assassinate justice brett kavanaugh at his home. in washington, a bill to beef up protection for justices and their families is now stalled in the house. house speaker nancy pelosi defended her decision not to bring that to a vote until next week perhaps. watch. >> you said that justices are protected but there was an attempt on justice kavanaugh's life. >> they are protected. this is about staff and the rest. >> isn't this about security for the justices. and arm man showed up near justice kavanaugh's house. >> we're working together on a bill that the senate will be able to approve of. nobody is in danger over the weekend because of our not having a bill. >> harris: nice to know that we have someone who is clairvoyant in the house because she didn't predict this assassination attempt. if she did she didn't speak of it. that's pretty dangerous stuff to say that oh, they will all

be okay and are you not part of the process of keeping them okay. the white house says president biden condemns threats against justices but in the two days since the kavanaugh arrest the president has made no comment on this despite multiple opportunities. the suspect, nick roske from california is charged with attempted murder. rich edson is live for us in washington >> good morning, harris. federal prosecutors say nick roske showed up in front of kavanaugh's home with a pistol and knife and called 911. the white house says president biden condemns this in the strongest terms but we haven't heard directly from the president about it. the republicans say this incident should prompt house democrats to pass a bill that provides protection for supreme court justices and their families. a bill the senate passed last month. >> it's exactly the kind of event that many worried the

unhinged, reckless, apocalyptic rhetoric from prominent figures toward the court going back many months and especially in recent weeks could make more likely. >> nancy pelosi says the house will continue their version next week. they want to extend protection to supreme court staff as well. others say there is no rush. alexandria ocasio-cortez said i feel it is insensitive and sends the wrong message for congress to move swiftly on that matter but not swiftly to protect our kids, talking about gun measures there. a leak draft opinion appeared in "politico" last month leading to protests in fronts of justice's homes. the decision overturning roe could prompt a surge in violence. the supreme court is finishing up its term and is expected to release its final abortion decision in the coming weeks.

perhaps even in the next few days. harris. >> dana: rich edson, thank you very much. we welcome jonathan turley, law professor at george washington university and fox news contributor in "focus" now. let's start with the speaker of the house and when she says absolutely nothing will happen over the weekend, what does that communicate to you as a law expert? is she capable of predicting the future like that? >> well the optics on all of this are perfectly horrible not just for the speaker but for the president. the fact that the president hasn't even spoken directly publicly on this alleged attempted murder of a justice is really quite breathtaking. this is the same president who seemed to rush to a camera to declare, for example, the border agents guilty when a completely false story was issued that they were flogging migrants at the border.

he declared their guilt and said they would be punished. there was not any delay in that effort. but here you've got an alleged attempted murder of a sitting member of the united states supreme court. the president went on kimmel and other programs, gave interviews. we haven't heard from that anything from the president. he has had these opportunities. >> harris: every time he gets on marine or air force one he has the opportunity to turn to the press who are always there and say blah blah blah. his office is across the hall right past the roosevelt room from the white house press office. he could dart in there to a press briefing. there are a host of opportunities with our democracy taking a punch which happens when you look at the highest laws in the land.

section 1507 of the u.s. code title 18 states whoever with the intent of interfering, obstructing, impeding, or in the intent of influencing any judge, juror, witness pickets or parades in or near a building or residence occupied or used by such judge, juror, witness, shall be fined under this title or imprisoned not more than a year or both. why isn't that being adjudicated? >> well, i think there would be a very serious first amendment challenge if you just arrested people protesting outside the homes of justices. we can all condemn that as we should. >> harris: there is a law against it. >> well, the law says that you do it with the intent to interfere with a proceeding to intimidate. if you read that too broadly you could suggest that even protesting in front of the supreme court would trigger that law.

>> harris: somebody's home is different. >> it is different but the law, i think, would be narrowly interpreted by the court. i think people are making assumptions about that law that i don't know will bear out in court. i think the primary issue we need to deal with is the fact that we have no moment of clarity coming from our president, from many of our leaders. in fact, every public position seems to confirm this isn't a great priority. but of course it must be. it is not that these justices will yield to the mob. they are some of the most principled people you will ever meet but it is an attack on the rule of law to try to harass and intimidate. the problem with that law is that it specifically is assuming the intent is not to protest but to intimidate. you know, these people would have a defense under the first

amendment and it might prevail. there is a chance of prevailing if arrested just for protesting. >> harris: pickets or parades 1503, it includes that. look, you are the law professor but what i know as a journalist is sometimes these things when challenged they get a look from the bully pulpit. why not press where you think you can to get these people off the front lawns of justices? by the way, it is not happening for the liberal justices or not being applied equally. what we don't want to know or think is that it would be a difference if they weren't conservative. we want the law to look at them the same. why not push and challenge? i would want you on my side if we did that. even if we didn't win we would get their attention. i want to turn now to the january 6th hearing we saw last night. the produced event. i just spoke with congressman jim jordan who was blocked from being on the committee and he had harsh words. >> a committee that meets on

capitol hill where there is not an opportunity to cross examination. the minority party always get a chance to get witnesses and cross-examine them instead of this committee. >> harris: your reaction. >> he is right about the lack of any opposition, any opposing view. this was a multi-play by speaker pelosi and she robbed a certain legitimacy that comes from having both parties present. we have had a very divisive issues go into these types of investigation from impeachment, pearl harbor, other issues that were potentially embarrassing to one party or the other but they have always allowed this bipartisan membership on the committee. you really did see last night what the lack of that type of balance produces. i was disturbed that some of the quotes being presented were

heavily edited. they edited out president trump saying he wanted people to go peacefully to the capitol. it doesn't excuse what he did but that's a good example of framing this in really an inaccurate way. so the question i think for the congress is whether they lost a real opportunity here. you know, i'm not sure how many people tuned in. but a lot of people probably tuned out once they saw how really one-sided this was without any pushback, without any opposing views. >> harris: look, we got the word narrative from the house speaker nancy pelosi. she said you are going to see how we built the narrative. that's a quote. so clearly if you are building narratives and not building a trail to the truth, those are sometimes very different things. almost exclusive of one another if you are manipulating it. jonathan turley, thank you. good to have you in "focus." >> thank you. >> harris: now that san francisco has voted to recall
