unleaded gas, 24 cents per gallon of diesel. the national average for regular unleaded hovering around $5 a gallon. lawmakers in both parties say they aren't really certain this would make much of a dent. south carolina senator tim scott is skeptical. >> unfortunately the way that gas is ticking up every single week, that reduction in price is eliminated in about 12 days. what we need is to have certainty and predictability so that those energy producers feel like they can invest billions of dollars to extract the energy from the soil so that we can use it in our tanks. all we're doing is playing a game of moving things around but not actually impacting the marketplace long term. >> harris: that's why i question does it help biden's politics more? americans are changing travel and commuting plans to save on gas.

while the president is busy fighting with the head of a major oil company. wait a minute. which direction does he want to go in here? does he really want to help us? biden is bending to the far left of his political party and now pushing to eliminate our use of fossil fuels by sitting by where they are so expensive. senator scott said even if you lower it by 18 cents we've been on a rise of more than that for months, per week. there is the accusation of biden double talking when it comes to oil companies. watch this. >> so or 15 years from now we won't be using gas. it will be electric. you can't tell these companies please go flat out but we'll also wipe you out. there is an inconsistency. >> harris: that t "wall street journal"'s james freeman titled team biden's endless campaign to make energy expensive and

goes after biden's efforts to force companies to take on more paperwork on climate risk. we have more on that from the north lawn. >> president biden is expected to call on congress today to extend a three-month federal gas tax holiday even though the white house hasn't begun any sort of outreach to lawmakers to build support to pass this. at this juncture it looks like it is getting probably no republican support. senator tom cotton said the gas tax holiday is a gimmick worth 6% of the increasing gas since biden took office. meant to cover up the fact that dem policies have restricted supply and raised costs. even former president obama called a gas tax holiday a gimmick that allows people in washington to pat themselves on the back with no return and unclear how much americans will benefit from this. federal gas taxes are much lower than state gas taxes and

also some worry among economists that a gas tax holiday could increase demand and increase inflation. the white house is desperate to get prices down. the president is picking a fight with oil companies accusing refiners of raking in record profits while americans foot the bill. chevron ceo responded to biden writing your administration has sought to criticize and vilify our industry. these actions are not beneficial to meeting the challenges we face and not what the american people deserve. the president's answer, stop whining. >> president biden: he must be sensitive. i didn't know they get their feelings hurt that quickly. look, we need more refining capacity. this idea that they don't have oil to drill and to bring up is simply not true. >> industry heads have been clear they need a green light on policies over drilling, leasing, building infrastructure and regulation from the president, who once

vowed to end fossil fuels. even fed chair powell said it's part of the problem. >> if you pick up the annual report of any of the big oil companies, you will see that is something that is happening and it is a rational economic response to expectations about where future policy is headed. >> tomorrow energy secretary jennifer granholm will meet with the executives from these companies with a meeting that the president himself called and convened but he himself does not plan to attend. >> harris: i hope she doesn't break into giggling this time like often she does when asked about energy. thank you. senator mike lee, republican of utah, member of the energy and judiciary committees. great to have you in "focus." i want to start with the gas tax holiday. it would be 90 days, three months, 90 days. and the election, mid-terms are 139 days away. so biden would have to capitulate and put the gas tax back into play just days before his party goes to the mid-terms.

that seems political suicide to me. >> it does and it is. this is part of a shameless and affectless operation. it is his energy policies which have as their intended outcome driving up costs in fossil fuels, safe, affordable, reliable and in america plentiful fossil fuels to transition into other foreign-made sources of energy that can't easily be transferred into automobiles. this is a big problem. so he is wanting us to cover that up by shifting around some tax revenue. number one a drop in the bucket. wouldn't really offer meaningful relief. one of my colleagues just noted 6% of the increase in the price of fuel is represented by the 18.4% federal gas tax. this is a disaster all the way around and he wants us to cover it up. >> harris: you know, i wonder,

senator, if this backfires in some way, too. some economists we were just reporting this say this could drive demand back up when americans are getting ready to hit the road. maybe some will say i'm saving 18 cents, let's buy the gas now and hit the road which drives us into potential shortages, doesn't it? >> yes, it absolutely does given that president biden. we canceled the keystone pipeline and he has shut down oil and gas leasing. claimed to have lifted the moratorium but it's still in place with regard to 80% of all on shore leasing operations and the oil companies don't have quite enough to develop and he says he wants more but then he takes away from them the ability to produce it. he says he wants more refining capacity. if he wanted to do something about it maybe he ought to lift the moratorium and push legislation that would make it easier and more affordable for us to build a refinery. we could pass one of the reform measures like legislation that

i've introduced to streamline the approval process but no. he wants to shift money around and cover this up with a tax holiday. >> harris: you hit the nail on the head if he wanted to do something about this. that isn't very green of him if he doesn't let the prices continue to go up and he has to answer to the far left side of his party close to the mid-terms to help his, you know, downstream from the white house, his democrats win. yet he does this and it hurts them. back and forth. let's get to this. the president and white house officials have been pushing the recession is not inevitable talking point. press secretary jean-pierre says had this to say about the economic crisis yesterday. >> we see that the strength that we our -- the economic strength from the seen this pastier with the american rescue plan and what we have seen with the historical gains, that is going to help us deal

with the recession. >> harris: i don't know. that felt like a word salad to me. what was she talking about? >> small handful of wall street billionaires? yes, the wealthy and well connected can get very rich in an economy like this one fueled by the federal government printing money it doesn't have. you know who else who does get hurt while they benefit? hard working americans of every stripe other than the extremely wealthy and well connected are made poorer and the people who can least afford it. i'm thrilled to hear she is speaking there to a small constituency of people who made great gains. everyone else suffered under a president who wants to impose his far left agenda at the expense of hard working americans. >> harris: you say she is speaking to a relatively small group who are still doing well. but even they understand where we are.

elon musk has a response to president biden claiming the recession is not inevitable. let's watch together. >> i think a recession is inevitable at some point. as to whether there is a recession in the near term, i think that is more likely than not. it is not a certainty, but it appears more likely than not. >> harris: more likely than not. experts are putting it north of 40% probability now. >> putting it north of 40%. everything the biden add ministration -- it drives up inflation. think about it. if he just suspends the gas tax for a period of three months, first of all he would extend the suspension before the mid-terms for the reasons you talked about a minute ago. even if it were just three months, there is a lot of revenue that still has -- we still have to pay for the

upkeep and maintenance of our transportation network and interstate system. where will the money come from? we'll have to borrow more and print more. you know what that does? it spikes inflation even more. that's why this is treacherous and wrong and we can't let it happen. >> harris: the california man accused of trying to assassinate justice kavanaugh is due in court today. he could get the roe v. wade decision by tomorrow. we all could. the pro-abortion group jane's revenge is promising a riot in the nation's capitol if the high court overturns that decision. authorities are continuing to allow illegal protesting outside justices' homes that endangers them and their families. the radical group rise up for

abortion rights held a protest yesterday. some might look at this as intimidation and also against the law. it's the same group that protested outside the home of justice amy coney barrett complete with dolls and fake blood props. i know that you have a new book that went up for sale this month saving nine, the fight against the left's plan to pack the supreme court and destroy american liberty. are you concerned about that especially now? what are your deep concerns? >> deeply concerned about this, harris. as i explain in saving nine and the reasons you just identified there is a massive group on the far left that wants to demonize and delegitimize and isolate the supreme court justices considering joining the alito opinion. you are right, there are many ways that the american people, most ways the american people can protest and demonstrate and gather are legal and constitutionally protected.

it is a criminal violation under section 15.07 to show up to the private residence of a supreme court justice to demonstrate, to try to influence them. that's exactly what is happening. and why these groups like ruth sent us and jane's revenge why they aren't being issued injunctions and not being prosecuted or at least investigated is beyond my ability to understand. why people who show up there aren't being stopped or arrested or threatened with arrest if they show up and do that is beyond my ability to understand unless, of course, they just want it. you know we know that because president biden's spokesperson a few weeks ago acknowledged that he supports these efforts. this is really troubling and explain saving nine the things i predicted when i wrote the book would happen where the supreme court was poised to overturn roe v. wade. the left would try to

imagine as we enter way beyond 100 days in this war, people are also looking to see well, is this the president to help that end? >> you know, i think we worked with the politics and we spoke a lot of british leaders came to hear the speech and what i was basically focusing on was, you know, we don't have time for distraction. we have been distracted long enough. at the end of the day we have a clear issue at hand. it is not the ukraine/russia war, it is the chinese/russian partnership announced 24 days before. they are transparent. their goal is to eliminate the west and allow themselves to be the leaders of the world. and we have to start stepping up and being smart. this is not the time to be soft. this is not the time to wonder what america is going to look like when she grows up. this is the time for us to lead and the world wants us to lead and they aren't getting that under biden. that's the part that makes

people nervous and that's the part that we have to change. >> harris: where is it going to come from? as you just pointed out russia is on the move. estonia yesterday let the world know that russia violated its airspace for the first time by flying a helicopter over its territory. that's not a high altitude. the move was definitely seen as provocative as estonia is a nato member. the country's defense ministry says it's the picture of the threat. how we see the russian threat. it has never been as serious it is now. ambassador. >> this is a war we have to win. this is not just about ukraine and russia. this is about the fact that this is a war on freedom. if we don't help ukraine finish this, this will be the beginning of a lot of those. we have to fight this as much as we can. they are not asking for troops. i don't think we should write blank checks but if they need long-range missiles give it to

them. give them planes if they need them. let this fight this war and let them win. if they don't win, if russia is able to gain territory, china will move on taiwan, russia will move on poland and the baltics. this will not end. and we have to make sure that we are on the side of freedom. now countries around the world are having to take a side. do they take the side of russia and china? or do they take the side of the u.s. and the west? they are going to take the side of the one they think can win. does the u.s. and the west look like we can win? do we act like we can win? are we making the moves to show we can win? i don't think we are. that's what has to change. that is the difference. when we do that, we will have more countries with us. when we have more countries with us and we show strength, we will prevent further wars. but until that happens, you are going to continue to see

aggression by russia and china and continue to see iran move forward on nuclear production and north korea continue to cause problems. >> harris: quickly china sent 29 war planes into taiwan's airspace that's this week. it is part of what you are saying. the shark is on the beach of delaware. >> why did china do that? they are trying to make a move on taiwan. the best thing we can do is let's get in front of the situation. let's send taiwan the training for their military. let's send taiwan and work with our allies to get them the equipment they need. let's do it with our friends, not alone but let's all stand behind taiwan so much so that china doesn't think about making a move. the mistake with ukraine was too little too late. don't wait until it's too late when it costs us more money, time and weapons and sacrifices. let's get in front of it so we

never have to deal with that in the first place. >> harris: my opening question is this the president to get that done? all right. let's move. a group that's working to elect more republican women to congress says its women candidates are the key to a republican majority next year. we'll scroll them because there are so many of them. winning for women action fund has endorsed more than 20 candidates so far this election cycle and it has already seen success in a number of races this year including texas and alabama just last night. i have been with you when you've talked about women's issues and getting in politics. tell me about this latest trend where you see it going. >> it's an exciting time. we're seeing women really step out and say enough. there are no women's issues, they are all issues. women care about national security, they care how they feed their families and what

their wallets look like. they care about education and crime. women care about the overall strength of our country and what we're seeing is some amazing women step up and amazing women win. 11 out of the 15 seats in 2020 that we flipped were won by women. we now have more participation by women in this country than we've ever had. we're seeing more republican women step up and that's the key. because republican women are stepping up against cancel culture. they are stepping up against the woke culture trying to take place. they are stepping up for parents and security and stepping up to reduce crime and they are stepping up and they are winning. republican women are going to make sure we turn this country around. >> harris: quickly you were with nancy mace as she won her most recent primary challenge. i don't know if my team has it. there was a quick shout out on this. can we play it real quick? let's watch.

>> harris: election results are in and there is controversy down south. texas democratic congressman cuellar's win over a progressive challenger. liberal democrats are angry at the national party for backing a pro-life moderate. they don't like cuellar. he also wants the border security. in georgia, mike collins victorious in his runoff makes vernon jones one of two trump-backed candidates in the state to lose their races. across the entire primary

season so far 27 trump-backed candidates have won in competitive races while only 11 have lost. in alabama, trump-backed katie britt won her senate primary runoff against congressman mo brooks. alexandria hoff is live for us in alabama. that went back and forth. trump was first behind mo brooks and then behind britt. tell us about it. >> yes. i think it's really interesting. it is unclear really how much of an impact that last-minute trump endorsement had on katie britt's victory last night. she earned 65% of the vote but already considered the favorite going into last night and prior to the endorsement. what may have been more impactful was congressman mo brooks losing the endorsement. >> one thing is clear. alabama has spoken. we want new blood, we want fresh blood, we want someone who will fight for our

against democratic nominee. >> harris: los angeles county district attorney george gascon defending his office's handling of the case of the cop killer justin flores. that suspect. let's watch. >> the history of the suspect mr. flores, does not contain any evidence of violence. understandably many are angry, including myself. we all wish if we could predict violence. but the reality is that we can't. i urge everyone to insure that we do not overreact here and that we do the things that we known have worked. >> harris: flores had a long rap sheet. he was already a felon out on bail as part of a plea deal when he shot and killed officers on june 14th. he then killed himself. one l.a. county deputy district

it is a terrible tragedy two police officers are killed. i'm glad the gunman is dead. i come from a law enforcement families and when the thugs kill officers it is an attack on the entire community. we can't lock up everyone in society but we can lock up certain violent criminals and so i think this prosecutor will face an election which is appropriate and let the voters of l.a. decide if they like his policies or not. president trump signed historical criminal justice system reform law and focuses prisons an rehabilitation rather than punishment. i hope we can lock up people violent but help the people drug addicted get the treatment they need to get out of the cycle of violence to turn around things in the country. >> harris: you didn't try to blame president trump was going on with the george soros liberal d.a.s. $40 million to put them in place. we have one in new york, alvin bragg. i don't think anybody would get

it twisted in the way they are ore acting by president trump. >> universal agreement among law enforcement community we need to try to rehabilitate these people and even president trump signed a law that helped shorten certain offenses and focus on rehabilitation. when you murder a cop there is no rehab. you should be given the death penalty. we might not all agree on that. >> harris: this d.a. doesn't think he has a violent history but he definitely did. democrat led cities are failing on many levels. a new study finds our nation's capital is the worst-run city in america followed by san francisco and new york based on financial stability, safety, infrastructure and several other factors. meanwhile, violent crime is on pace to surpass levels in several major blue cities. new york city leads the pack
