too long they've made no progress on gun safety reform." and it heads to the president's desk as you mention and has to pass the house. republicans are rallying position minority steve scalise urging his members to vote "no." we will see where that goes but nancy pelosi and a saying last night said, she intends to get this to a floor vote first thing in the morning, joey, carley. >> carley: griff jenkins live in washington, thank you. joey, it is historic that you have 15 republicans agreeing with democrats on anything, but you heard ted cruz the concern among a lot of conservatives, this would chip away gun rights. do you think it would? >> joey: the first glance hey bipartisanship in congress. you look at four of the five g.o.p. senators voting on this, little bit safer for them. most of the others years away from reelection. the majority on fox news poll, they support action on gun legislation but a majority of

americans don't know what that action should be. when you pull to get health they pulled towards mental health. there is a lot in that war is much to do with mental health as anything else here are the gun legislation, gun portion of this legislation, gun rights portion is gun rights laws. and it is my estimation it will end up in the spring court appearance but when you are absolutely right about that. what this bill does is called a super communities act purity give $750 million over five years for crisis intervention program. so, that money could be used by states to implement red flag laws, but they don't have to. >> joey: exactly. >> carley: it pushes their decision back to the states, which kind of reminds you what is going on with a supreme court decision in roe vs. wade. if you don't use it for red flag laws, you can use that money for other programs like mental health, drug in federal court. so, and failed to see how this would chip away at anybody's rights. >> joey: the biggest gun

advocate rights and legislation like this come it is reactionary. we have an incredible tragedy to my massacre happened. let's do something. so congress gets together to do something. if that tragedy happens again god forbid and hopefully it doesn't, but let's work through something else. that is where the chip away argument comes from. if they do this next time come it will come from somewhere else. however, if there were evidence or signs of broader, we should have the series we are having january 6th on this issue. if it is that important to americans, congressman, congresswoman nancy pelosi, let america people have a better look what this legislation does. >> carley: or discussion on this. >> joey: that is my opinion. the one think they were something called the boyfriend loophole, the domestic violence access has access for a long time. the idea is if you are married to someone who is domicile and you shall red flag laws enacted against you to take your second amendment rights away as a husband or wife they can do that but as a boyfriend or girlfriend they can't.

so one thing with legislation to get rid of the loophole so if you share that relationship and threaten someone from a red flag laws can be used against them as well. >> carley: red flag laws are interesting because one hand, you have florida implemented red flag laws after the school shooting with success. but people who are concerned about them said you are punishing the person before they are breaking the law. there are lady of mike a lot of people that say crazy things on social media but that doesn't necessarily mean they will act out in a violent way. on the other way, the thing that is so infuriating among many about hindsight, and when you look at the people through commit these acts of mass violence, there are always hundreds of red flags and their behavior. >> joey: absolutely. >> carley: a shooter slashing his face, shooting people with bb guns, the buffalo shooter who was hurting small animals. all of those things are red flags, and you just wish

somebody in their family would have said, "this is dangerous behavior and we need to step in. that person does not deserve that." >> joey: the republicans have done a terrible job of explaining because if you say this is a mental health issue and let's do red flag laws, oh, wait, but you can't do that because constitutional rights. to back yourself into a corner. the one think the republicans need to do a better job and it is excellent this bill, if there is a conviction, red flag action based on a conviction. if you are convicted of domestic violence, convicted of harming animals or threatening someone, hey, this person made a threat and plus take their guns away. the republicans need to do a better job defining that and it's in legislation with adjudication. that is what republicans -- that is constitutionality of red flag law. >> carley: and people who wrongfully accused somebody of violent behavior and get them into a situation where their guns are taken away wrongfully. we can't have that happen.

>> joey: absolutely. >> carley: something else happened when it comes to gun control yesterday. on the other side, the supreme court boosting gun rights for law-abiding citizens by shooting down a new york law that requires gun owners to prove they have special needs to carry concealed handgun for self-defense. new york governor kathy hochul lashing out after the decision was handed down. >> shocking, absolutely shocking. that they have taken away our rights to have reasonable research. we can have resurgence on speech, you can't yell "fire" in a crowded theater, but somehow, there is no restrictions allowed on the second amendment. >> carley: the governor's response with backlash from conservatives on twitter. when user writing "it is a great ruling and protection of self-defense. not everyone canst afford this a price to make the price of security. the constitution happened to you."

there a law professor john turley. >> this is a momentous decision for gun rights advocates and for the second amendment. you can't put the thumb on the scale as new york did and say, "show us that you have proper cause, including moral standing to have a gun." what the court really hammers at is that this would not be tolerated with other rights and the bill of rights. there is a tendency among some judges and many legal analysts to treat the second amendment if something less than an individual right. what justice thomas is saying here, this is an individual right with the other rights in the bill of rights. and we don't like shifting the burden to people to say proof you need to use this right. >> joey: now, president biden is heading to europe this

thank you, you depart. very, very embarrassing. brooke, thank you. let's talk about that meeting with the president of the u.s. oil and gas association. tim, good morning to you. the president said tackling inflation was his number one priority, but yesterday he met with the wind people are not the oil people. i'm sure you have some thoughts on that. >> first of all, i wish somebody would write on his cheat sheet, get out of the way and let the will and gas industry do what they need to do. you are right, we don't have emergency shortage of land shortage. but shortage of oil and diesel and gasoline. the reality is it is a hard decision. it is a change the president needs to go to the easy meeting rather than the more difficult meeting. but look, the response out of that meeting was i think the industry said we thought it was productive, it was encouraging. and washington speaking, of course, encouraging with a

colossal time but we are hopeful he will get out of the way. and hopeful he will ask for expertise in solving this problem. speak to tim, we have a video of congressman steve scalise calling out energy from the beginning. >> joe biden can't go back to when he was a candidate. he said he was going to stop drilling in america. he said he was going after the fossil fuel industry many of his top experts want to bankrupt the oil and gas industry. then they said they won, the day he took a oval office, they did exactly that to kill american energy. it is highly devastating impact on the middle class. >> and taking the length of president biden's administration is adversarial towards oil and gas while his administration saying, let's go to end. can we not do both and lineup restrictions and reinvest in oil and gas will also looking at renewable energy? >> well, absolutely. we've been saying that all

emergency power authority. it is used to did two things, one, it can remove bureaucratic and regulatory obstacles and get them out of the way. or two, the use to steer capital into an industry that is struggling to be able to build facilities. the president would be using emergency authority and exercising the bpa to overturn his own regulatory policy. and then the industry that he spent months and months trying to defund. guys, look at that. what it takes, i guess, we will go with that. i think it sounds counterintuitive without using the bpa. but if that is what they are saying, let's go for it. >> carley: that is right. it seems like energy executive say, "absolutely, this is exactly what we wanted you to do from the start." thank you for joining us, tim. >> great to be with you guys, thank you. >> carley: the administration living to forgive another $6 billion in student loans for

office. we will continue to hold those accountable for the driving, driving the violence in our communities when police make an arrest and charges are approved. in 2021, the office approved 90% and had a 75% conviction rate of adult felony cases in chicago and cook county. so i guess my question is, how does their state not match up with what you are experiencing in your town? >> it doesn't match up real well. and the fact that i was a police officer in cook county for 22 years. i know how those statistics work. in our community which is cook county, over the last five years almost exclusively, the violent crime that we have had has been committed by criminal offenders from cook county. this vehicular hijacking that we are talking about, two young women, they both had two children and their cars under the age of five and had guns pointed at them. three of the people we have

charge now all under 20 and between the three of them, they have 27 convictions in cook county for violent crimes. yet, they were still roaming the streets. >> joey: you know, you talk about your town in cook county being at odds with each other. he could count allegedly amaze their political pressure at the state level? is there any way to put pressure back to have these, what you call liberal d.a.s convicting key people in jail? >> well, it gets a little liberal at the state-level pure to have a governor that signed the safety act which is anything other than safe for for the people of illinois, which is allowing now for no cash bail in two years. it takes the fact and allows for pretax trial conferences that must be heard within 48 hours for all kinds of offenders that will be released back into the streets. it puts greater restrictions on our police officers. so, this is the state problem

that is also the city and county problem. >> joey: one of the issues real hot right now is gun-control, gun violence. politicians in chicago literally almost everyday from one side or the other, one set of politicians say that "chicago has evidence that gun legislation doesn't work." other politicians are the guns come in from other states. do you see that as a part of the problem for you? what would you suggest as a solution? >> it is a false narrative. chicago has had one of the most strict gun laws in the nation and yet, we have the highest rate of violent activity with f. again, as a 22 year veteran of the police department, i can tell you the criminals will always get their hands on guns. the really don't care about gun walls my claws, why would they? that is a major problem and it's not working. >> joey: the people of your town have elected you to keep guns safe. we hear about defund the police. that's been a big problem and chicagoans had its own problem with it.

do you feel your police department is where it should be and what can the state or local community do to help you out? >> we have a phenomenal community, phenomenal police report. obviously, this particular case with this hijacking, they have little to go on. and yet, they built a strong case of evidence. fortunately, it is being prosecuted in will county and not cook county. so we have a chance to see here. the community supports the police. i represent republicans and democrats alike. this is not a partisan issue. this violence is happening and happening to everybody. but these liberal policies are really making them very unsafe for all of us here in illinois. >> joey: mayor tim balderman, thank you for joining us and stay safe. >> thank you so much for having me. >> joey: yes, sir. all right the the nation's capital on potential decisions to strike down roe v. wade. and the threat for violence from radical pro-abortion groups were talking to fbi agents on the

gets overturned. do you think law enforcement can prevent anything violent from happening across the country? where they equipped to do so? >> absolutely think they are equipped to do so. the interesting thing about groups like this, especially about this one in particular. they are projecting and they will attack. they are projecting, i mean it is pretty well-known where they will attack because as you see, they only attack typically in the liberal grand cities because they have basically economy there in chicago where the police for some strange region can't chase people doing violent crimes. so, i think that is what you see. if you do something, it is going to be in the liberal cities in the country. but that doesn't mean that other states and other city should let down their guard. law enforcement has been told this is going to happen. you should assume it is going to happen. if these people come in, this is

an important point. if they come in an attempt arson and if they attempt to do anything extremely violent where there is an imminent threat of loss of lives were serious body bodily injuries, those are standards for use of deadly force. and this is what the law enforcement needs to remember and this is what the second amendment was created for. >> joey: we have a tape from the white house of denouncing violence. let's take a look. >> again fight violence and destruction of property have no place in our country under any circumstance. and the president denounces this action. actions like this are completely unacceptable, regardless of our politics. >> joey: will the criticisms that we hear from republican law simply the white house or the administration might go after white supremacy or january 6th, but not taking this seriously. there seems to not be a lot of rest. do you feel the fbi is doing

enough where will this be left to law enforcement? >> i think it is clear, joey, we have seen the doj, the fbi, and all the law enforcement indices under the doj and many law enforcement around the country have become so politicized, that they are not going to react to things like this. when it comes to white supremacy and insurrection, a lot of the stuff is made up, quite frankly, by the fbi and doj. and i think what we are seeing here is whenever joe biden or the white house says "i denounce something" or he says "i promise" or "i mean this sincerely" joe biden, there is a light coming out of his mouth. the same people that back these groups in privates are the same people that will denounce in public, amp politics, law enforcement." >> carley: just not the fbi getting involved in the attacks already happen but also local police department here at the thing that i find strange is

there has been firebombings that have taken place across the country. to our knowledge, nobody has gotten arrested yet. a lot of these attacks have been carried out in the middle of the day. and you would think that there would be cameras in the area, possibly catching license plate or something. why are they getting away with this? >> just like whenever appropriate or easy for them to cut off the cameras, that's when it seems to occur for the left. i think the reality is we are looking at what happens in the united states when it comes from violence from the left, we are looking at planned harassment. we are looking at violence directed towards the government, which is actually insurrection. and we are looking at groups that are carrying out in february 2021, there was a timed article about the shadow campaign that won the election. and they said in there, these are leftists that run the

becoming california law. tell us about this bill and what it would do. >> well, what this bill does essentially is it has trans advocacy groups, training doctors and employees of every insurance company in california, and so it is having the trans groups with a doctor and medical community. such that, gender care will be the only care available to any person in the state of california. >> carley: wow, you think there are other alternatives to this. as a matter of fact, your daughter has a story that a lot of people who are pushing gender confirming carrot don't want people to know about. tell us what happened to your daughter. >> so my daughter came out as transgender a couple of years ago. every single doctor in the state of california, every therapist,

every school counselor that we met told us that we needed to affirm her gender identity. i decided to ignore it. and we went and found an out-of-state psychiatrist who helped us. my daughter desisted and no longer identifies as a male or a boy. and she is happy in her female body. that is more unlikely to happen as these laws continued to be passed in the state of california and everywhere in our country, pushing this gender affirmation model, especially on children. children, teenagers change identity. they change their ideas like the wind. and we are not permitting them to go through their natural puberty, they are natural, you know, identity exploration where medical lysing, immediately

medical lysing them. >> carley: erin, what happened to your daughter and your family is unbelievable. imagine if you did go along with her initial feelings on this. she changed her mind. and the big fear is there are parents out there that do go along with their child is feeling at the time and there is no reversing that later in life. has that ever happened to anybody who you know who was a little boy who wanted to be a little girl, went through the process and recredit it later on? >> sure. there are stories that are coming out. there is a young gal in california and she had a double mastectomy. she went all before the age of 16. and now, she regrets it. she may be sterile, she doesn't know. but she certainly will be with those body parts for the rest of her life and she's only 16. i don't know how that could possibly happen.
