what he makes of it. bill cassidy from louisiana. we have winston sears from the beautiful state of virginia. fair and balanced look at an issue that has galvanized the country. however will it go and what will be the impact in a split nation. >> a monumental day in america with the supreme court overturning roe v. wade. i'm dana perino with katie pave -- pavlich and greg gutfeld. this is "the five." the supreme court sending the issue of abortions back to the state. they overturned the 50-year-old ruling on roe v. wade which guaranteed woman to a federal

right of abortion. both sides of the debate gathering outside the high court as america absorbs the news. president biden coming out attacking the decision. >> it's a sad day for the court and for the country. know with roe gone, the health and life of women in this nation are now at risk. with three justices named by one president, donald trump, with a core of today's decision to upend the scales of justice and eliminate a fundamental right nor women in this country. it's a realization of an extreme ideology and a tragic error by the supreme court in my view. but this decision must not be the final word. >> for more, let's go to shannon bream. shannon, we were on television this morning together on "america's newsroom" as the news broke. you were able to quickly read the decision, discern it.

i'm wondering now how it's settled in for you. >> yeah, a couple of things interesting that this morning -- normally what happens with the supreme court opinion, we have all of the sound and fury and the groups will go away. we have the opposite. more and more people are showing up. they're chanting, vowing this is not the end. it's interesting to hear president of the united states say this can't be the final word saying this to the judicial branch, to the independent branch from him. right now the supreme court is the final word on this. the left has been putting this in terms of taking away a constitutional right. what the right has argued and what the court said, there was never a constitutional right to an abortion under roe. people were worried this had weak underpinnings. ruth gpsburg was worried that it was susceptible to challenge, exactly like what we've seen play out today. the president and the speaker of the house made comments to the effect that you have to get to the polls.

it's smart for them to march necessary this politically. they're saying the same things like same sex marriage is now a threat. they're pointing in a line to justice thomas. he said there's nothing in this opinion today, this abortion opinion that has anything to do with those rights. it will not impact them. should not. he says that he thinks the courts should engage in a different process for cases moving forward and he mentions banning the due process rights in cases like the one that made same sex marriage legal in all 50 states. so everybody that signed on to this opinion today agrees there's no threat. let me read something from justice a lee to to the other key opinions. he says we have stated that nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion. we have explained what is -- why that is so. rights regarding contraception. the latter as we have stressed uniquely terms potential life.

it's hard to see how we could be clearer. so while the left will continue to make hay out of that, the court has been very clear those rights will not be under attack because of this decision today. dana? >> thanks, shannon. you've done incredible work and have a lot of work cut out for you. martha, one of the things going into this is about 65% of americans believe that roe being overturned it was just banned all across the country. what we're trying to explain to people, this sends the decision back to the states. in some states like in new york you won't have any changes. in other states like perhaps missouri, for example, or even texas, you will have significant changes. >> that's right. and i'm amazed by how many people -- a lot of us and shannon spend a lot of time focused on the way that the justice as proven these sort of decisions. doesn't just -- they don't wake up and say we have a majority in the court. why don't we overturn roe v.

wade? they had a case before them. mississippi had a 15 ban. it was a shorter ban than in roe v. wade so it goes up to the court. they have to make this decision on it. more than half the states look like they will maintain their abortion rights and looks like about half of them will either ban or will have six week or 15 week bans, which is a considerable period of time. it's interesting in our polling, 54% of those say that they think it's right to ban after 15 weeks. that's close to four months of pregnancy. that says that seems like a reasonable measure, a reasonable point. so when you get behind this, you realize that it is going to be nuanced. there will be place theres the country where it's more difficult to get abortion. i'll point out one thing, that we have seen really a complete change in abortion in this country. more than half or 60% of abortions in the country are done by prescription pill that

comes in the mail. they're not done at clinics. that's one of the reasons that you've seen clinics shutting down. it's not just opposition to abortion. it's also that they have -- their business is shrinking. a lot of people say that's a good thing. a good development in this. we remember when bill clinton said he wanted to see abortion that was safe and legal and rare. that's not the voices that we're hearing on the other side of this debate right now. >> this decision has been derided as one that was not a decision well-made and an argument well-made. the ruth ginsberg said that. even though this decision leaked in a memo about 55 days ago, it still can be shocking for some that it turned out the way that it did. >> absolutely. i was one of those people that knew it was coming. i was on with you guys talking about it the day the opinion got leaked. i felt the pain of it, not just for myself but for millions of

women across the country that depend on safe and legal access to abortion and to women's healthcare more generally. ruth bader ginsberg had a problem with the opinion. she's not had a problem with the right to abortion. the original case was a privacy case. it was 7-2. the chief justice was appointed by a republican. it's something that has gotten lost in the conversation. people are not using the privacy word enough here. i firmly believe that if this was a case, if men were the people that were carrying the children, that this would never have happened. i think that women are being put in a terrible position. the statistics are clear about who this is going to affect the most, women that earn less, predominantly women of colors. there's a lacksness to the idea that it's just easy to cross state lines to just go get an

abortion. in west virginia and arkansas, all abortions were cancelled moving forward. they're not just for women that got pregnant by accident because they slept with the wrong guy. it's medical reasons, protecting the life of the mother. some of these states will have no exceptions for rape or incest. it's hard to believe for the conservatives -- i saw ted cruz on earlier touting the ruling. that if one of his daughters got pregnant because she got raped, that he wouldn't do everything in his power that she wouldn't have to carry the baby to term. the hypocrisy is beyond comprehension here. republican women get pregnant, too. i'm not saying we can't have a conversation about 15 weeks, 20 weeks. a lot of pro choice people have numbers like that. when this goes back to states, 13 of which have trigger laws that go into effect right away, that means that at six weeks when they don't have you come in for a heartbeat appointment at

that point, women are putting in an unfair position. i was on martha earlier. we were talking about what gorsuch and kavanaugh said. an susan collins said that she was misled. row v wade was the law of the land. he deceived the senators and the american people. kavanaugh as well. there's language from language from amy coney barrett. >> and jonathan turley pushed back hard. katie, there's a lot of women that support this decision and a lot of women that have fight for this ruling to be overturned and sent back to the states. >> yeah. a number of pro life organizations, almost all of them are run by women. the susan b. anthony list, the march for life and the narrative is that women disagree with this decision. that's not true. >> martha: this for pro life activists today is a huge

victory that they've been working on for five decades, this is something that they believe is far overdue. it's an injustice. this has been corrected at a federal level. the fact is this is being sent back to the states has expanded democracy by allowing 50 state legislatures to debate this to be accountable to the people in their states about what they want to do. and the fight for the pro life activists and the pro abortions activists is not over. they have to convince people in their states that an abortion ban with some exceptions or no exemptions, that that is politically feasible and something that the people that live in that state want. the tenth amendment says anything that is not in the constitution specifically is sent back to the states and the people that live in those states. that's what has happened today. and also when it comes to how yes get to this moment, blame democrats for this in a way. ruth bader gpsburg didn't want

to retire. she could have retired earlier. could have been a democratic seat. hillary clinton lost to donald trump after taking advantage and taking for granted the campaign, not working as hard as she could have. and harry reid changed the rules on the filibuster. so it's easier to confirm justices. it's not over. this will continue at the state level and pro life groups led by women will continue to fight it. >> there's one -- we want to play this for you, this is alexandria ocasio-cortez. this is her take today. watch. >> what the supreme court justices chose to do, endanger the lives of all women and all pregnant people in this country. not only that, they have chosen to strip rights from men, too. >> all birthing people. >> must not forget the birthing people. they're now the most important

new york. so that is how stuff works here. right? and i also think that the decision was a great rebuke to the leakers. i believe it was leaked by the dems because it went to politco. didn't go to national review or fox news. and that was with the expressed purpose of foreshadowing liberal outrage that would intimidate and influence the court. it just didn't happen. the court gave them -- the ruling showed you can't scare the court. that is great. it's too bad that biden doesn't seem interested in dissuading any of the hysteria going on right now. what if men could get pregnant? you can't prove it. aren't men getting pregnant? >> birthing people. >> we should defer to them, jessica. we should defer to them. birthing people get the final say in everything. >> i think you do know what i meant about that. >> but it's that hypothetical cliche' that i hear. it's like, you know, well, we've been fighting wars forever.

threats and intimidation are not speech. we must stand against violence in any form regardless of your rationale. >> katie: dana, for six weeks, we've seen the white house encourage intimidation outside the justices home. now homeland security says there may be real violence, he wants to get ahead of it. >> dana: the attorney general could have arrested the protesters. it's all federal law to protest outside a justice's home. they didn't do it. now actually the attorney general went to kyiv and i'm all for it. go help support the ukrainians. but on your way out, could you issue a statement to the department of justice to do their job and enforce the law? they didn't do that. so now there was no deterrence. now biden six weeks later, nobody is listening to him at this point. if there's violence, immediately

they have to put that out or else it will continue to simmer. when maxine waters says screw the supreme court, we'll defy them, the way to do that would be to leave to it the states and be organized. i think they have a fundamental problem. the left has long had this disconnect with getting a lot of money from a small group of people on this issue. the voters are not necessarily there for them. if you look at the issues and any of the elections recently, like the primaries, what is the number one issue. crime, gas prices, food. education. miss ago couple others. then it's like climate change and then abortion. so this is really -- this is obviously seismic. who knows. in november on election night, might be saying abortion is the number 1 issue? it's find it hard to believe. >> katie: jessica, these

lawmakers could tell the states to figure this out. congress could pass laws to do it. the last law was so outrageous that democrats that have a complete majority can't get it passed. so the message is to get out and do what since legislation is off the table for maxine waters. >> jessica: you need to be specific when you tell anyone to go anywhere. there's nut cases amongst all of us. who have mental health problems and political extremism is a terrible mix and the left and the right have them. was happy to see president biden to be so clear about this at that particular moment. i've gotten this question a lot today about doing this in 08 when obama had the super majority. why wasn't roe done on a

national level? they would take too many things for granted and people have only so much political capital. he knew the aca was his crowning achievement. so it's really big deal and important but now we're looking back at so many decisions like ruth bader ginsberg not retiring, nuking the filibuster and saying to ourselves, we have some things that over 60% of americans agree with to some level. i'm not saying up until the point of birth but in the first trimester. now we're staring down the barrel of half of the states restricting this at the six weeks mark. it's not the number 1 issue but has jumped 17 points since the leak came out. this will matter. >> katie: martha, the debate about this issue is very heated and the left just seems like they don't want debate on this. i'm on the board of enlightened women. it's a group of pro life

conservative women. the conference had to be cancelled because of the violence. doesn't seem like they're open to much debate in the wake of this decision. >> martha: i'd say if you're in favor of choice, you should be in favor of choice. so someone wants to go to a pregnancy center, if they want to carry their baby to term, you should be in favor of protecting that right as well. so really makes you question, are you just pro abortion or are you truly pro choice? the other thing i would mention is that i look at president biden and nancy pelosi that are both catholics that claim to be practicing catholics. i didn't hear once from either one of them today, look, my faith is on the side of ending abortion in this country. but i respect that this is the decision that has been made. but from the courts and i respect people's rights to protest, why don't they say that? why don't they ever mention their own faith? i looked up.

it's been a long time since president biden has brought this up. seems disingenuous to not say that at this point especially say that in the context of we believe in peaceful protests and make sure that no one is hurt in the carrying out of your protest over this weekend. it would be nice to see some respect for their faith in terms of the way they're talking about this today. >> katie: greg, here we are today, businesses in downtown d.c. are boarding up as we speak and preparing. the question is why would they be doing that? what is the purpose of the fence outside the supreme court today? >> greg: for viewers of this show, violence is never acceptable even though will be no fan mail friday. but you have to deal with that. now, if they choose to bump my show, which we taped with dana at 11:00 p.m., if they bump it, then all bets are off. you can burn the whole place down. okay? burn it all down. i'm kidding actually.

we never have to tell our fans or republicans don't riot. have we ever -- dems rage. it's one word. right? is there any other kind of rage? we learned that violence is actually an effective tool in influencing justice. you witness the ferguson effect. after the floyd -- during the floyd riots, they were shielded from exposure because the right kind of protests. they're all the right side on that side. side guy walks around in an unguided tour january 6 and he's in jail for life. we've seen this on the left, campuses shutting down, speakers targeted. trump supporters attacked early on. none of that stuff matters. violence is their own language because they felt above and beyond debate. that's the problem these days in woke culture. debate is no longer necessary. you get violent because those

a nationwide abortion ban. they cannot be allowed to have a majority in the congress to do that. but it such a contradiction. yesterday to say the states couldn't make laws governing the constitutional right to bear arms. today they're saying the exact reverse. the hypocrisy is raging. >> martha: so jessica, clearly this has been assessed as a powerful tool for the mid-terms. if you fire up people on this idea that the supreme court's m.o. is to ban abortion across the country rather than an assessment that it didn't belong in the constitution in the first place as a federal right, how fruitful you think that will be for democrats for the mid-terms? >> jessica: there's some

projections that we can lose up to 60 seats. on the margins, it will make a difference. it's not so much the message about that suddenly you won't be able to go and have an abortion. it's that your vote matters. whoever is in charge gets to pick these people. we have a lot of young conservative justices on there now. donald trump didn't pick old people. he picked people in their 50s. you know, they're going to be around for a while making rulings like this. so i hope that that is the main thrust of this. that every single election, when you look at the mid-terms, if they take back the house, there's your chance to codify some things on a legislative level. and i think that's where we should be going. yes, the matter to make your own healthcare decision matters a lot. >> it seems that the action is within the governor's office and the state legislatures. that's where this goes.

>> dana: republicans have done well the last 12 years in state legislatures. and actually the most popular politicians in america today are the republican governors, most in the northeast. that's where you start to see new talent arise. and leadership. you don't know who it will be. i'm curious about the hispanic vote as you've seen changes in texas. they're not just going from blue to purple and then to red. it's straight to red. do not pass $200. they're going to vote republican. i'm not sure how this issue will play into that. watch the media misrepresent -- it's very frustrating. we do we have to be the ones that read the bill and nobody has to? it's not fair. it's unnecessarily hurting the ability to have civil discussion. we have proven that you can do that here. i encourage everyone to think

about this with grace and dignity and recognize that people have strong feelings whatever their feelings may be. and to try to work this out. my last point is, now that the court has made this decision, nobody can just say, well, it's in the supreme court's hands. no, it's not. now it's back in your hands, the people's hands. so make your voice heard. >> martha: katie? >> jessica: mid-terms are usually changing elections. abortion is a big issue for democratic base voters. the problem is that 90% of people are being affected by gas prices. 85% of the people say that inflation is destroying their budget and causing problems when it comes to future planning and retirement. those issues dwarf it. and democrats will use it as a political talking point as joe biden did and nancy pelosi did. democrats have gone from saying abortion should be safe, legal and rare in the 1990s to today.

note a single presidential candidate running as a democrat say they support any kind of restrictions at all. if you look at the senate races where democrats maybe in pennsylvania, for example, that question will come up. the majority of people do believe in aborgs restrictions. most of them at 15 weeks. democrats believe in no restrictions. if republicans make that clear because the media says abortion is banned and they don't talk about the restriction argument, they can probably push it through. this will be an issue. >> greg: i mean, it's a legitimate political question. will the ruling energize dems the way the january 6th hearings won't energize anybody. but it's kind of strategy to get you to root against your own interests, you know. i sure home i don't get what i want. then that will really upset people. they'll come back and just be angrier. the left never does that. we're always expected to be the

ones that we better not get what we want. if we get what we want, oh, boy. the pendulum will swing. the fact is, you know, the democrats and the media have never thought about their mission creep on abortion or guns on their mission creep on biology. i mean, think about like, again, the pregnant men. now feminism is no longer feminism unless you accepted a hierarchy. so what if it has an effect, right? is that going to change anything that you want? it shouldn't. but they want -- the media wants you to believe that. they never ask that of the left. they never say you think this stuff will hurt you? that's what happened with youngkin, right? anyway, those are my thoughts. >> martha: more on what the supreme court's abortion ruling means for the mid-terms and what top democrats are saying about it today.

>> greg: welcome back. democrats now trying to make the mid-terms about the supreme court ruling on abortion. >> this fall, roe is on the ballot. personal freedoms are on the ballot. >> to me, the answer is simple. it's november. it's the ballot box. >> i think roe v. wade is the law of the land. that's what november will be about. >> make no mistake, again, it's all on the ballot in november. >> greg: you know, i don't blame them, katie. the economy is in the crapper. they have a president that can't complete a sentence. you have criminals that don't complete their sentences. so why not bet all of your money on killing unborn children?

>> katie: i think this will fall flat. they're making the argument that this is on the ballot and you need to elect more democrats. democrats are in charge right now. they voted on a pro abortion bill that failed because it was so extreme and was -- would allow partial birth abortion and late term abortion across the country. they said it would codify roe when it expanded roe. so we're in charge, haven't done there yet but get us more? i don't know. >> greg: we saw the democrats going after parents calling them domestic terrorists. we saw these nearly violent school board meetings which were terrible. now you're going after unborn children, jessica. has the democratic party no longer the family for parties? >> jessica: i don't think -- >> greg: a party for families. >> jessica: we were. that's you guys. it's conservatives -- >> greg: yes or no, jessica.

>> jessica: i object. when the leak happened, conservatives focus on the leak. they didn't want to talk about the implications of this. think there's a lot of republicans in purplish districts, people that supported them in 2016 but voted for biden out there where this ruling will matter. there's a way to capitalize on it that way. that's what i prefer to say. >> greg: what do you make of this martha? we haven't talked about this yet. >> martha: i do have a new thought on this. it is -- it is that i think that katie is right. one of the things that happened with the leak, came out earlier, it diffused the acceptance and understanding over a longer period of time. the people fired up on cable news networks don't represent the rest of the country. abortion has been declining. up to 20% the last 20 years. with these over the counter medications that can end a pregnancy quickly, it's not the
