8:00 pm
us online or on the podcast good night from south carolina. life liberty and the vendors up next one —- "life, liberty & levin" is up next. mark: hello america i am mark levin this is "life, liberty & levin" in this an inch and a half thick is that opinion and dissent of the supreme court decision of the gods case that has received so much attention and isn't it amazing as soon
8:01 pm
as the decision was issued that people were giving their opinions? you know they did not read it. you know nancy pelosi did not read this. yet she came out and made a poisonous statement filled with lies intended to provoke because the democratic party has had an entire plan of e-mails, get out the vote, grassroots operations, protest, many on commercials. you see that play out in anticipation of this decision that was leaked from a liberal clerk on the supreme court that i would argue. and incredibly important decision. why? because it is a constitutional decision that recognizes a court and accepts the fact it is not all-powerful. one of the great things about press washington lies he decided he would not be king. he could have been. he said no.
8:02 pm
i will follow the constitution. the activist on the court who lobby the court to basically turn the supreme court into a super left-wing legislature as a backstop to congress and the president and the bureaucracy. even if the left loses elections it cannot lose the issue and that's what's going on. let's start at the beginning. teefifteen on —- roe vs wade reversed almost 200 years of jurisprudence. almost 200 years there is not one word in this constitution, not one about abortion. not a word in the federalist papers about abortion. not any word of abortion during the constitutional convention in madison notes. so that had nothing to do with the decision of roe vs wade. roe vs wade was a long op-ed a decision looking for constitutional argument. they never found it.
8:03 pm
there is none. in his decision, harry blackmun one of the dumbest members of the court in the last 100 years said prior justices have looked at the first amendment, fourth, fifth amendment they looked at the night amendment, 14th wherever we look in whatever the justification and then he says roe vs wade it is a fundamental privacy right. but stick with me. there were limitations. the trimesters, the third trimester the science at the time for sure but the third trimester the state had an absolute interest in regulating or ban abortion. that case was overturned.
8:04 pm
roe vs wade was already overturned by a subsequent decision called casey. the supreme court went even further and basically allowed without getting in the weeds, abortion on demand if the state decided there would be abortion on demand. when the first draft was leaked in february, chuck schumer into the senate floor to put up a vote he knew would lose. what did the democrats propose? not to reinstate roe vs wade but a bill to allow abortion up to the last second of birth throughout the country. blowing away every restriction that exist in virtually two thirds of the states. this is a party that supports abortion, the most extreme kind, infanticide up to the last second.
8:05 pm
when you do partial-birth abortion, just as a reminder, i will not show the graphics, they take a very big needle, syringe, stick it into the soft spot of the top of the head of the baby, drain the brain out, turn the baby around, now dead and pull it out by its feet. that baby suffered horrifically. if we follow the science, that is a baby. we know the baby feels pain. if we follow the science, roe vs wade would have died with its own weight because viability as roe vs wade argued is more than the last three months as technology continues to expand. it would be the last two trimesters. so roe vs wade cannot stand within its own weight. the supreme court probably expanded it. overturning roe vs wade. the court says clearly this is only about abortion.
8:06 pm
over and over again. it's not about contraception. it's not about marriage. it's not about those issues. so nancy pelosi who did not read the opinion, came out immediately after the decision was released on friday and said it is about contraception. why? because most americans do not believe in extremist positions on abortion up to the last second like nancy pelosi does. like chuck schumer does. like the democrat party does. this party stands for infanticide. so she has to try to expand it so she wants to upset gay people, those who never contemplate abortion, those who use contraception, it has nothing to do with any of it. not just because the court said it but the rationale does not include it. abortion can be expanded in
8:07 pm
certain states under this ruling. this was a very moderate ruling. they basically said we don't have power. how many times have we heard institution say that? we don't have power here. it's up to the states. you figure it out and you handle it. which means you could have more lenient radical abortion laws that expand on existing lies in states depending on who selected. abortion until the last second unfortunately from my perspective is not only permitted that can be added in different states. now lower federal court judges cannot overturn decisions by the people's representatives in the state legislators. there's 1000 federal judges summer radical leftists. we have seen them and watch them. they are flesh and blood. lawyers in black robes.
8:08 pm
and is not up to them anymore to make these decisions. it is up to you to make these decisions. it is quite a moderate decision. this court could have held of an activist mindset of a different perspective that that is a baby. from the position of the court and the science it is a baby a woman is carrying and they could have said from there we will invoke the 14th amendment equal protection clause to protect a second human being involved in the issue, the baby. therefore abortion is unconstitutional. theoretically they could have made that decision. but it did not. they said we don't have any power. look at the tenth amendment. things that are not granted the federal government even at
8:09 pm
some point we have to accept the fact that our constitution is a brilliant document. we don't have to accept the radical left agenda coming out of law school or newsrooms or the democratic party. this is united states of america with a rule of law not the united states of america of the democratic party they ruled no matter what. they could have taken the last trimester and expanded it. they did not. they could have said it is equal protection issue. new york and california and those states which is pretty close to infanticide will continue. you will see abortion states popping up all over the place because they are obsessed with this issue. the democratic party has exploited this issue for political gain. you hear the mouthpieces like policy and biden talk about one and now they can define what a woman is.
8:10 pm
while destroying women's sports and identification their executive orders and regulations but now they represent all women. do all women support abortion on demand? do all women support partial-birth abortion up until the last second? is every person in every state support the laws in new york and california that are so radical and so extreme that they only apply to nations like north korea and communist china? is that with the women in this country believe? why we have documentary showing what partial-birth abortion looks like they are talking upright until the last second. but for the republicans out of west virginia they would have gotten it. ruth bader ginsburg has been
8:11 pm
quoted before. i don't quote her because she is a sage but she was a radical leftist and said more than once in 1992 law review or she was interviewed, roe vs wade "call that a political process moving in a reform direction and thereby prolong divisiveness when stable settlement of the issue. that's not the first time the court has done that. in dred scott an activist court basically upheld slavery. it took us civil war to undo that decision with over 700,000 casualties. plessy versus ferguson. the advocates for roe vs wade really are not advocates for roe vs wade but there advocates for partial-birth abortion and up until the last second. infanticide. it took over half a century to overturn everybody is separate but equal in the plessy versus
8:12 pm
ferguson case and what about brown versus education the supreme court ruled where japanese americans and those of japanese descent, 120,000 were uprooted from homes and businesses and moved to internment camps. businesses were taken from them. that was an unconstitutional decision. ronald reagan addressed that specifically with reparations from the property of those that were still alive for their children. the constitution wins for once. it is a grand day when the democratic party tries to destroy the court, the court stored on —- stood firm. if you read the dissent it is another long op-ed. it is an editorial. there is no constitutional basis for what they wanted to do. sadly, when you read chief
8:13 pm
justice roberts decision it demonstrates he is basically a rhino on the supreme court let's uphold the mississippi legislation but do we really have to go all the way? all the way? to do what? those five justices three appointed by donald trump said we do not have this power. how often have you heard an institution of the federal government say that? they should be celebrated rather than threatened. rather than have an assassination attempt on one of the justices. rather than beef up security to put riot fences around the supreme court. the same pelosi pushing radical violent agenda who set up the january 6 committee dragging the country through that. we have to think for upholding the constitution? who do we have to think?
8:14 pm
the man they hate former president trump. donald trump was not immersed in this issue before he was elected president that made a promise. put justices on the supreme court he believed would uphold the constitution especially in this respect. that's what they did. all three of them. but for the trump presidency this would not have happened. this is why he deserves far more appreciation than he gets. this is why, among other reasons he is hated and attested by the opposition to the constitution and civilization that want to see him imprisoned. never forget that. when i come back we have to guess. mike pompeo talking about communist china and former us attorney and we will continue
