>> a big win for religious liberty this morning. supreme court siding with a former football coach fired over praying after football games. i'm emily compagno. here with my co-host kayleigh mcenany and joining us this morning, julie banderas, kennedy and brian kilmeade. the high court's decision could strengthen acceptability of religious practices in other school settings. joseph kennedy is from washington state, he sought to kneel and pray on the field after games. the justices deciding 6-3 saying

his prayer was protected by the first amendment. he joined fox, for his first interview since the big win. >> if you had to do this all over again, you would? >> yes, i would. i would think a couple times before i do the whole seven years and losing the first five times, but 100% worth it knowing i fought for the right thing and ended up winning and knowing justice is done and freedoms are good. >> kayleigh, justice gorsuch saying the free exercise and free speech clause of the first amendment protect expression like mr. kennedy. >> that is what the constitution said, this is the first win for this coach, congratulations to them and victory for people of faith everywhere. let me put this in context.

in 1962 and 63, the supreme court evicted god from schools. from that moment on, what happened are series of defeats for people of faith. 1952 case, majority cited today, the case said we agree the state may not establish religion of secularism in the sense of oshg posing or showing hostiity to religion. in the edwards case, case that said evolution, if you teach evolution, teach creation, made a teacher remove a bible from his deck in the roberts case. >> that is the point drawn, gorsuch saying the constitution council mutual respect and tolerance not censorship and oppression for religious and

have children in catholic schools, our children are taught to pray before meals and give thanks, the fact this man was having to fight against a war people saying teachers would be discriminated against if they were to pray before lunchtime. you can't do that in public? they are not spreading and sending out leaflets, they are practicing their own faith. brian brought the greatest example, imagine if he was muslim and said at a certain time during the day, it is time to take a break and pray, do you think they would have fought against that? >> we have an answer, the teacher forced to remove his bible from his desk read a book about buddhism and the school did not admonish him, there is proof of that. >> julie: absolutely there is a double standard and the left is attacking religion, in every

way, shape and form. >> kayleigh: if you read the majority opinion, the players came to join him on the field, they said he was fired from his job for three incidents of kneeling silently at the 50-yard line. it was him taking a knee in silent prayer, something we have the establishment clause in the constitution, schools cannot establish religion, you can exercise your religion freely, you don't check your rights at the schoolhouse doors. >> you can take a knee to protest issue but not in prayer, that is sad. >> kayleigh: justice gorsuch wrote nor does proper understanding of the establishment clause -- for special disfavor acknowledging christianity and individual public prayer has been the subject of censorship and suppression. final question, in terms of football, the teams, coaching and mentoring students,
