republicans incumbent in key races. congresswoman lauren boebert beating coran by a landslide and will go against adam fresh and utah senator mike lee defeating becky edwards and will face evan mcmullin endorsed by democrats and setting up what could be one of the most competitive races in decades. >> carley: battle for senate control looks like it is coming down to six key states. republicans hope to reclaim majority come november. jim mcglocklin joins me to break down the current state of the six races. the six states are arizona, georgia, nevada, new hampshire, pennsylvania and wisconsin and republicans need to gain one seat come november to reclaim

the majority. tell happen? let's dive into arizona, senator mark kelly versus somebody to be determined come august second and mark kel seraking in a ton of campaign cash. could he possibly keep a seat? >> democrats can raise money, they are raising a ton of money. if i'm mark kelly, i am scared. he is in the mid-40s. virtually all the incumbents for democrat are not just under 50%, significantly under 50%. mark kelly will have a problem. you have kim layman, mark bernavic, the attorney general is running. >> carley: name recognition. >> right and blake masters and he has the trump endorsement there. jim layman has been running a

spirited campaign, i think it will be similar to the primary, it will be close. >> carley: warnock and herschel walker. trump doesn't really have the sway in georgia the way he does in other states. >> what is driving it is because joe biden is president, his negative will drive numbers in this race and the other senate races right now. negatives are in the high 50%. the republican only has to get 80 to 85% of the negative to win and most polling right now has herschel walker ahead of rafael warnock. >> carley: warnock has a lot of money, herschel walker has football -- who will win this race? >> i think adam laksalt has a

let's look at the current temperatures across the nation. we've got the 50s in seattle, fargo, 67 in new york, still very warm across the south and some showers and thunderstorms that are going to come on in to the southwest as well as the upper midwest and the gulf coast. we'll talk about that in a moment, but zooming into the upper midwest is where we see potential for some hail and perhaps damaging winds, isolated tornadoes today. we are not talking about a severe weather outbreak but we could see the potential for the stronger storms from the rockies up towards the great lakes. keep that in mind. area to watch, of course we are into the hurricane season here. i don't know if this is going to be named, but regardless if it gets a name or not we are still going to be dealing with it over the next five days, the potential for breezy conditions and heavy rainfall for texas and louisiana. you have to watch this over the course of thursday, friday, into the weekend, because we will see the potential for flash flooding as the biggest concern. your forecast, very warm for much of the country, a lot of 90s on the map and with the

usually we have 20-30 applicants and this year we only had six. thankfully six was enough for our ocean staff, but i see it definitely being an issue going forward. >> this is a nationwide shortage. it is not just new jersey, so why is this happening? >> i don't know. i think there's a couple factors here. one, with the youth now, they specialize in sports, so sports takes a precedent as opposed to when we were younger and their parents wanted us working. i think that's one of them. the other reason is i think there is a big commitment to lifeguarding. there's a lot on these kids' shoulders and some of these kids don't want to make that commitment. >> a lot of local municipalities are barely treading water just financially coming out of this pandemic. is there a problem here just being able to pay lifeguards to come out to do this, or is it just a motivation problem? >> that is also it.

lucky for us, our mayor and counsel this year in 2022 increased our salary and wages for our guards, so we had quite a few returning lifeguards and that is why i think we are not in that predicament this year. but they didn't do that, we would definitely be in trouble, as well. >> if you are in new jersey and watching right now and you have kids at home that are itching to go to the pool, what are the chances that pool will be closed because of this lifeguard shortage? >> well, depending what state you are in, but definitely i've been hearing new york is very short there and they will be limiting the hours. i just don't think they have enough to man it for eight hours a day. >> all right, dan. this is an unfortunate issue. i was also reading it could be because of covid, because it takes some time to get certified and some of those facilities shut down over 2020, so it could take a long time to get back up and running.

"the new york times" says president biden is irritated by democrats who won't back him to run for reelection in 2024. with the administration calling it a "lack of respect from their party in the press." >> joe concha joins us now. this article starts with a story how president biden was so excited when he heard that bernie sanders wasn't going to run in 2024 that he invited him over for dinner. do you believe that? do you think this is true, that joe biden actually wants to run

for reelection? >> i believe maybe he does. it's kind of lien you you try to take the keys away from your grandfather when he hit that signpost for, like, a third time, or back to his car into something. and you say, you can't drive anymore, and he's like, you are not taking these keys for me. perhaps that's what we see from joe biden. it's funny he sees bernie sanders as the big threat considering bernie would be in his 90s if he were to run for president and actually win two terms, which is not with the president of this country needs. i believe many democrats believe joe biden closer to his 90s would be in the second term that is a prospect most americans would be uncomfortable with. the lack of respect thing, when you are polling lower than any president in polling history, from truman to trump, respect has to go away. it's like the new york jets who haven't won a super bowl in something like 53 years saying, "hey, where's my respect?"

i think the party wants a younger candidate. we are hearing more about gavin newsom possibly running if biden does not. imagine what that bumper sticker would look like, guys. "i could do for america what i did for california." the bench is then at this point. >> if i'm joe biden i'm sitting there thinking, i'm embracing all these policies you've pushed on as moderate jail. isn't it disingenuous that he's taking the blame for these failures? i know he's not done well and some of these crisis, but some were created because the policies he embraced from the l. >> completely. energy independence, for example, canceling the keystone pipeline minutes after he takes office. but he is pushed against progressives and the party and i give him credit on this. when they are screaming about expanding the supreme court, we are talking from nine to 13 justices, and then progressives have the majority, he has said to his white house spokesperson, no, we are not going to do that.

so he has stayed somewhat come if you even want to call it moderate, moderate on an issue like that. but overall, yes, he has bowed to the demands of the party, spending trillions for inflation, which is not how economics works. that is what is doing him in right now. all the spending that has put us in the position we are now as far as inflation. >> new york congressman alexandria ocasio-cortez is being mocked about getting abortions on federal lands and the white house is trying to clear up the facts. watch this. >> the baby steps, to open an abortion clinic on federal lands. >> we understand the proposal is well-intentioned, but here's the thing, it could put women in providers at risk. there is actually a dangerous ramification to doing this. >> so you are the crowd gave aoc big time applause but conservatives were quick to react. tom elliott tweeted, please run

on turning national parks do abortion directories. another journal is posted this joke, abortions in yellowstone, and mollie hemingway said on twitter that democrats' actual positions on abortion's are way too extreme to politically benefit in a post-roe world. jail? >> i love how she continues to make all these demands. one nonpartisan study found not too long ago that she is one of the lease effective members of congress, yet she is treated by the media, carley, as if she has some sort of major player in the party. when it comes to getting things done, she is great at generating likes and retweets on social media, but as far as getting things done for her constituents, the biggest thing on her resume was keeping amazon out of queens and the bronx which would have generated something like 40,000 well-paid jobs in her district. this is a person who is also his will and no steak. when democrats lose the house and likely the senate and probably the white house, aoc being the leading spokesperson

♪ ♪ >> carley: four are dead and 150 people i heard after an amtrak train was sent off the tracks after hitting a dump truck in mend and misery. but one local farmer says the tragedy was preventable and warns about the unsafe rail crossing months before the accident. that missouri farmer, mike spencer, joins me now. good morning to you. you say that this crash was only a matter of time. why is that? >> we have farmed there ever since, oh, the early '60s. we had crossed there are numerous times of the equipment. we have to cross there. we actually farmed the ground where the accident happened, and we have about four different crossings in that area that we cross extensively to get to our

farm ground. this is a river bottom land along the grand river in sheraton county. we have crossed there was machinery enough that we knew it was dangerous so we had contacted the higher-ups, i guess you'd call it, with the railroad, but to no avail. >> carley: can you describe what the section of track looks like and why the truck driver might not have seen or heard this train coming? >> it's very possible he possibly had seen it. i would say it was a little bit late, possibly, when he'd seen it. the track runs at an angle to the road. the road runs north and south they are. the railroad track runs southwest to northeast at a real sharp angle, as you can see on the picture. there is a very steep incline. the level of the road is probably 9 feet lower than the

track, so he had to keep his momentum up if he was loaded. the road is probably soft. we have had that with rains in the area over the last couple weeks. i would say that just in the experience of crossing there myself that he had to keep his momentum up, and it's very possible that he had seen the train at the last second coming out from behind some of the brush that had not been cleared back, and probably maybe even panicked, missed a gear, stalled out, probably. it's really hard telling. >> and i believe he was hauling gravel, so maybe it was a slow moving vehicle. the bottom line here is there was no light or gate stopping him. so he went through, kind of wrong place, wrong time. i hate to ask this question because sometimes there is no one person to blame, but do you think there is anyone to blame for this?

>> well, i put the burden on bnsf railroad, because we had contacted them numerous times over the last 7-8 years and really pushed hard on it the last three years. we thought we had the green light to get this crossing fixed. i had pushed really hard and met down there with our three county commissioners. one of the gentleman, an engineer from the railroad, and also a mo dot safety specialist from jefferson city, our state capital. we were supposed to get started on this last july 1st. we had all the permits in place. we asked get a hold of the landowners to get permission to encroach on their property to build this approach up, plateau it out so the traffic can get up and level with the track before they crossed, and we had

permission from the landowners within two hours. >> they wanted to get this done, too. bnsf says they can't determine where these crossings go, so they are sort of putting the blame on the missouri department of transportation. and the cycle continues. but the bottom line is that this is an absolute tragedy and your heart just breaks for everybody involved. mike, thank you so much for joining us this money and sharing your perspective. we really appreciate it. >> you're welcome. thank you, carley. >> thank you. 37 cities within los angeles county have issued votes of no confidence on progressive district attorney george gascon. the devastated community of el monte also doing so after two of its own officers were killed in the line of duty earlier this month, many blaming that tragedy on gascon soft crime policies.

i mean, you. >> a fox business alert, new data shows consumer confidence in the economy dropping to his lowest point in 16 months as inflation takes a heavy toll on american spending power. >> cheryl casale and from fox business here with the details. good morning. >> good morning to both of you. it's not a surprise to most consumer confidence hit a 16 month low as americans grapple with sky high inflation from their groceries to their gas tanks. the latest read on inflation, as you know, is sitting at 8.6%. that rating of 98.7 for customer confidence was worse than economists had expected and these numbers would likely actually be worse than we saw if not for the tight labor market right now keeping wages higher. otherwise we would expect this to be even worse.

"we the undersigned come to you today to request immediate and effective action on the threat to our basic human rights of the overturning of roe v. wade. we ask amazon, the world's best employer, to actively defend." they're asking for time off to grieve and they want amazon to make a public statement rebuking the court's ruling. no response from amazon as of yet. >> that last one may be the only realistic. they're not going to stop selling and half the states in the country, ever.

one way or the other. >> governor evers is a pro-abortion activists and the attorney general and they will file suit in dane county wisconsin. that's the most liberal county in the state. they will find a sympathetic judge and they will be successful in that local dane county court, but this will then be appealing go to the wisconsin supreme court and they'll make a decision. but it was interesting, joey, this law was passed in 1849 banning abortion and criminalizing the abortionist but not the mom. democrat say that's an old law and it should be off the books. what's interesting about politics is, if you don't like a law, every legislature has the right to repeal, but it is still good law. the republicans assembly in wisconsin, the politics looks so good that it might be a vetoproof majority even if tony

evers was to win reelection. it looks like the republicans would be in the driver's seat on abortion. council i was reading some of the celebrity reactions to this decision and singer pink says if you support roe v. wade, don't listen to her music, and the leader of green day, billie joe armstrong, said during a concert in london, "f america, i'm effing announcing dominic renouncing my citizenship." >> there's been a lot of promises to go to canada and australia and were not citizenship. i have no problem with that. maybe they should go to venezuela or cuba and see how great their liberal socialist marxist policies are. i think that would be fantastic. i don't think any conservatives will stop them from leaving the country. again, this is emotional. the pro-lifers like myself have dealt with roe v. wade since 1973 and out with it, for the most part, in a really peaceful way. where there has been violence with pro-lifers, it has been

>> in some ways that hands are tied. we are in litigation right now. he mentioned the asylum program, the biden administration is trying to put aside federal law and we are trying to get it enforced. we are waiting for that decision. i'm hopeful the supreme court will get this right and we can support this law that should require the biden administration to stop most of these people and say they are here. and that it administration transports them around secretly around the country. we are trying to stop that. it's a significant number of illegals crossing the border. >> looking at this incident specifically, no matter what you think about illegal immigration, these are souls that were lost in a horrific way. what is the story behind a tractor trailer being left abandoned that way but then locked inside? do you have an investigation to find out who specifically is responsible, who drove that truck and how it got there? >> i know that local law enforcement in san antonio is investigating right now. i think they have three

potential suspects. i don't think we have the whole story yet and hopefully we will. this is not a surprise. we expected it to happen again. and the policy of the biden administration, protecting the border instead of allowing this to happen on a regular basis. >> carley: how critical will it be, that remain in mexico policy, they are supposed to make a decision very soon. how critical is it to maintain border security? the president should be in preventing the policy he's not. >> it's fundamental. it's one of the main things the trump administration used. you can look at the numbers two years ago down significantly before that. it's ignoring federal law and the president can ignore federal law, passed by a duly elected members of congress, i guess you don't have immigration law and the president can lead in any but he wants. that would be a huge problem if that happened. >> carley: you heard karine jean-pierre say the
