fox news chief breaking news correspondent trace gallagher is here with the latest. trace? >> jesse, the man who is in jail charged with raping a 10-year-old ohio girl is 27-year-old gershon fuentes a guatemala immigrant according to immigration and customs enforcement or ice is in this country illegally. he was arraigned today and being held on $2 million bond. police say fuentas has admitted raping the girl on at least two occasions and considering the child just recently turned 10 and was six weeks pregnant, it's likely she was impregnated when she was 9 years old. police were notified about the pregnancy by child services in franklin county, ohio, who in turn were notified by the girl's mother. the 10-year-old crossed state lines and went to indianapolis for an abortion and was cared for by dr. kaitlin bernard who apparently leaked the girl's story hot indianapolis star tribune during an abortion rights protest. dr. bernard is now facing a hipaa violation for sharing the story. during a news conference

attacking the supreme court decision overturning roe v. wade, president biden said the girl was forced to travel to indiana after abortion was restricted in ohio but the ohio attorney general says ohio's abortion law has a medical emergency protection clause that would have allowed the girl to remain in state. it's unclear why the ohio a.g. was unaware of the rape case considering columbus police were notified back on june 22nd. we should note franklin county, ohio, where columbus is located, is a sanctuary jurisdiction where illegal immigrants are protected. ice has filed a detainer on fuentes so, if he is released, they would take custody but if he is found guilty, he could spend life in prison. jesse. >> jesse: thanks a lot, trace. prime time covered this story heavily on monday. put on the pressure and now we are glad that justice is being served. why isn't anybody talking about bringing the child rapist to justice? are you telling me no one is trying to arrest a child rapist

in ohio because i know ohio and they don't tolerate that there. if there is a 10-year-old child abuser out there on the streets of ohio, he needs to be brought to justice. and if so-called doctors are covering up child rape, they need to be prosecuted. ohio detectives did their part but there is a still a lot of unanswered questions besides the girl not needing to cross state lines to indiana for the abortion and whether the alleged rapist immigration status played any role in the cover-up. kaitlin bernard, the abortion doctor, who performed the operation in indiana has a legal requirement to report the abortion to both child services and the state's health department. because a 10-year-old isn't able to give consent sand therefore a rape victim. and from what we can find out so far, this indiana abortion doctor has covered this up, failure to report is nothing new though for dr. bernard. according to reporting from pj media she has a history of
