looking temperature map with a bunch of red on that ignores another expert analysis. the worst heat waves on our planet weren't happening now, they actually occurred 40 years ago. according to researchers from the university of bristol in the united kingdom, there have been greater extremes in the last few decades says the lead author of this new paper. notice the climate controls wailing about how this is the worst heat wave effort don't acknowledge what happened in europe almost two decades ago, 35,000 people died because of extreme heat. yet the left and its media allies want strict government controls on how business operates and eventually on how we as free citizens live. it's more fodder for liberals to call for the senate to be abolished as this writer for "the new york times" argued today -- because they blather on about extreme heat?

the question came up yesterday and a friend of mine who clerks with me said that's not going to last long. is it that clear cut and could the concern about the court be the reason for the hesitation by the biden administration? >> it is troubling to hear some of the rhetoric in the last 48 hours. you have a u.s. senator say the chains are off president biden now. why? because congress didn't yield to his demands. you have others just today who moved the court packing bill forward to. the message seems to be that we support the system so long as it yields to our demands. you look at the climate change issue, the administration tried to go at this in a unilateral way with the epa case which was handed down by the supreme court. they lost by a considerable

measure. the supreme court found the biden administration exceeded its constitutional authority. they went to congress and saw climate change and other measures there, that was blocked by not just joe manchin but about half of the senate supported his position. what's the answer now? they are going back to where they began and said the president should go at it alone. in a madisonian democracy it's often as important how you do something is what you do. what they are arguing for is a single person government, they're asking for the president to yield this authority alone. that is a very dangerous thing, it's convenient but it's a remarkably shortsighted viewpoint and when you have these members of congress calling for their own circumvention, their own planned obsolescence, it's something james madison would never have

imagined. he believed you could have ambition fighting ambition. here the ambition is to become a nonentity in our branches system. >> laura: they don't want to take any of these tough votes and to be held accountable for the votes -- that's part of it. at the same time, i think people have forgotten you and i talked about this before but this idea of an emergency being declared to, we were very concerned during covid on the state level when to governors were declaring emergencies to circumvent the legislature, we still have the emergency on a federal level in effect today two apparently this is going to go on forever, no end to the covert emergency and they may try to lay the new emergency on top of the covert emergency -- what is next? the racial emergency, i can see that coming. speak of the danger is how these things are being implemented, i agree with the president on many environmental issues but it's very important for me to see the

system work. that means taking these matters to the representatives of the people. is not enough to say they didn't give me what i wanted. the system is designed to force these divisive issues into congress and forge a compromise. if you can't you've got to forge a new majority in congress. we have midterm elections coming up. the only thing you're not supposed to do is to give the concentration of power in the hands of one individual, that's what this entire system was designed to avoid. this emergency approach is just a fancy way of saying one person rule to have the president do what they couldn't get done in congress and couldn't get through the courts. >> laura: they used to say that trump was acting as the dictator -- now who's the dictator or want or wannabe dictator? great to see you as always, thank you. this hysteria pulling us backwards doesn't just relate to climate but also back to covid.

effective public health apparatus in this country or in this county. where we are, this public health director who is not a real md, she has a social justice phd has gone out and now she's been caught red-handed saying that people are dropping dead left and right and using that as justification to impose a mask mandate again on adults as well as children just before school starts and using a foundation of lies. she has been convincing people, many innocent people to believe her, and say yes i will mask myself and my kids because people are dropping dead to. this is not just usc's medical center, this is where i used to work as a volunteer, this is los angeles county, this is their own county hospital, a public hospital that cares for the poorest and sickest people in the entire county. if there were to be people dying, they would've been dying at this hospital and they are not in their own chief medical
