but gascon blamed for violence as more and more violent criminals are released back on the streets, including this career criminal who was convicted of killing back in 2015. the killer serving six years of a 50 year prison sentence and was just rearrested on gun dui charges after a car chase. shocker. california attorney representing the family joins me now. kathy, let's start with the gun part of this. what is the point of pork gun control if gascon will not force the laws on the books? >> what you said is exactly correct. there are several gun laws right now that he will not enforce that he, in fact, ordered prosecutors to not file purity wall fell many out gun allegations at all for the serious ones that could really make sure that gang members and

drug dealers felt like there might be consequences if they used a gun. so, he needs to start by actually enforcing the laws that he took an oath to uphold. he's not a legislature. he is, in fact, the district attorney and enforce the laws he took an oath to uphold. >> todd: i don't think we will have see that happen anytime soon. now let's get to the facts of the case. i misrepresented the picture that was up on the screen. that was, actually, your client. that was mr. mello who unfortunately sadly gun down by reputed gang member. the gang member he got out of prison not just a few years earlier but decades earlier serving only six out of a possible 50 year prison sentence. how is this guy let out? >> well, it is absolutely outrageous. so he is one of dozens of people who committed a murder or

mergers and in a situation it was a gang member with a gun during the course of a robbery and convicted by a jury but the law changed and so we needed to come back for there to be what is called a transfer hearing done to essentially look at whether or not he should go to juvenile court or backup to adult court. the appropriate thing to do would have been to do a hearing and sent him back to adult court to finish his sentence. but unfortunately the district attorney ridiculous and dangerous policy the justice policy does not allow for prosecutors to transfer of the people who are under 18 when they commit a murder backup to criminal court. so mr. cachu and many others were released after serving a handful of the years of several decades of a sentence. what that meant is they were put

back into the community with no programs, no health, know anything and with no determination that they were safe to be in the community and, of course, in the situation mr. cachu is not to. so got arrested recently and lead law enforcement on a high-speed pursuit. when he finally crashed, they found the kind that they had seen earlier as well as quite a number of drugs. in fact, he was under the influence. so clearly, he is dangerous. there was another person equally released in a similar situation who has gone on to murder again. so his policies, gascon's policies never allow someone under 18 to be treated as an adult is really dangerous to public safety. it is horrific for crime victims. i can tell you that the family is very devastated by

mr. gascon's actions. >> todd: how can they not be? i understand the whole purpose of juvenile -- i was a third-year law student where the goal was to rehabilitate for minor offenders. we are talking about someone whose toy candy bar when they were 17th, not somebody who took another life! if you take another life, i don't care what age it is, you need to be punished. you can't be lit out after six years like everything is fine. my question for you, kathy, who are the people that think this guy george gascon is a good guy for l.a.? who are these people in the recall competition? >> well, i think there are some people for whatever reason, they have not been following the uptick in crime. as you may know, we have a incredible uptick in crime with murders and other assaults, as well as robberies and so on and so forth. so, for many people, if they do

watch the news, hopefully they make the connection to the uptick in crime is because of gascon's policies and holding criminals accountable. essentially, empowering and emboldening there emboldening them. that is what we have seen as a member of gang members and in this case, people under 18 when they commit crimes. so his, is, kit should be treated like kids. i agree with you, someone who steals a candy bar absolutely. we need to rehabilitate people like that but when you have done something so horrific in this case such as a gang murder with a gun in the case of a robbery, you need to be held accountable. otherwise, public safety is greatly endangered like it was in the situation. like i said, there are others who have also gotten essentially the same benefit who's now gotten out and murdered again. >> todd: and public safety continues to be in danger throughout the self.

want to bring up these numbers. this is the new orleans crime numbers, armed robbery 52%, murder 35.3, carjacking 25.4% and burglary 29.6% and knowing you've never been broken into before and seeing the numbers up like they are, are you worried about the direction your city is added? >> no. i refuse to let the criminals win. at the end of the day, you have to have more community involvement. i think, for example, for us, we try to be involved in the community. at the claiborne location, we hired a lot of neighborhood kids and became involved in the community. we hire a lot of ex-cons or people that just got out of jail. we try to make an impact. this particular store, we just open. so obviously, we didn't have enough time to be more involved in the community.
