there are number standards. imagine being that cop, a high-risk job and it is going to get rough. and in the fog of war you have to make a dozen decisions, may be 100 decisions a split second and what you have around you? a dozen gawkers with phones while you in this fog of war have to think like what if i make a mistake, my career is over. do i punch this guy? do i do a choke hold? do i tase him? and meanwhile the people filming you are not lifting a finger, because it's just interesting stuff that we use. i think it is time to cease our obsession on law enforcement encounters, because what we always see is the last moment between the trajectory of a criminal and the cop that is job is there to stop the criminal. we don't see the criminals path that got there, so we are sitting there monday morning quarterbacking does not matter if it's one of these encounters but school shootings, we are only there to see that final bam when the cop meets the criminal.

him into a great. there is no reason to do that for a low-level crime. >> katie: for the basic thing for paying a fee for a subway ticket is the way that he reacts. to the left would say there are reasons why he acted this way. maybe some justifications in the background for the reason he committed the priors and also got so angry when it came to the police simply saying you can't jump the turnstile you have to pay for your ticket. there's been a lot of tolerance over the past three years of criminal behavior and not just petty theft which leads to bigger crime, but a violent behavior. and because the left has completely villain eyes the broken window theory that prevents things like this from happening. take care of the little stuff so it does not become big stuff we are in this predicament where the cops are engaging in violent encounters pretty much any time they try stop somebody. there was a hearing on capitol hill today from the senate judiciary committee and they were going through all the

statistics on police murders this year and how they are set for another record. one of the things that they mention too is that there per resisting of arrest and suspects running from police are at an all-time high. that immediately ramps up the temperature, goes to the issue of police wanting to try to hesitate and overthink what they are doing and trying to stop a threat and it turns violent almost immediately. and the officers who testify say look, we can get all of the resources that we need from you in terms of money, but if we don't think that you have her back, we can do our job. and that's what this has led to. >> judge jeanine: mayor adam said that he wants a special session of the legislature, the new york state legislature along with the g.o.p. that is called for that not to deal with cashless bail, which is the crux of the problem, but because the supreme court's decision which would allow people to carry weapons who have legal weapons and the spiraling crime, he wants to revisit that issue.

>> jesse: maybe he could do that second, but i think that cash bail is the real issue and if he did that and put pressure on the legislature and the governor, "the new york post" would be behind him, local fox five, all of the papers and they would buckle i believe. so a little advice right there to the mayor. when a police officer is squaring up with a suspect like that, his goal is to take the guy down and arrest him. the suspect's goal is to escape or land punches. so the police officer has to maintain his grip and if you have noticed, he is not putting him in a side headlock. he is not doing the under headlock, and he is not doing the choke, because those things have been outlawed. he is also not shooting for a leg takedown that exposes your firearm. so he is very limited in what he is able to do physically. we know that the cop can fight because he has good balance and he threw a nasty elbow when he was up against the nice overhand right hand, but he ate a lot of punches. yet to be thinking of yourself at the cameras were not there

and he was allowed to use these skills to this probably would've been over, because the cop looks like he has 50 pounds on the guy and where's the taser? the police officer's partners should've used a taser. i don't know where she was. and this guy knows the law, judge, because he has already had a gun charge. if you are in a school, think about it. if you know you're not going to get suspended or expelled for dealing drugs, for fighting, for cheating, you are going to do all of those things if you know it is only a demerit and the gangs know the law too, so they will give this teenager a firearm because they don't want to catch a felony charge and they are way ahead of the legislature, so until the legislature wakes up and figures that we need to start trying to lock up criminals instead of d populating the prison system, that is their goal depopulate in the prison system, they have to get rid of that idea and then we can fight crime. >> judge jeanine: what do you

think, jessica? >> jessica: i think that his partner was trying to make a valiant effort. had a female partner it looks like was attacked by someone. she was doing the best that she could, and i kept thinking while watching this, first of all, get off of your phone and help. i think that for everyone recording these kind of incidents, there is a lot. not saying that you should throw yourself in a fire, but if there are a bunch of people in that subway station and you can all at least gesture towards trying to help, maybe you could have saved a lot of trouble to the folks there. i think that there is a major misconception from people who are sitting in the capitals of the stations and people in charge of the reform for what could be making reforms with white voters on the ground thing. if you just did a simple focus group of the voters that you think are your main supporters, they may as well say i would still reelect you because x, y, and z reasons, but nobody likes this. there's not one person that i know.
