rachel: floodwaters ripped through eastern kentucky. lawrence: max gordon joins us now. incredible scene of devastation. where are you? >> reporter: we rolled into jackson, kentucky, we had a harrowing drive, portions of the road have been eroded away as you drive in here. we are near the north fork of the kentucky river and i want you to look from the fox weather beast at what things are looking like at this hour. there is a lot of mud on the road as the floodwaters start to recede. we have a playset right there that has been tipped over and dragged into the street. incredible power of this water

as it flowed through these neighborhoods. so much damage and destruction. we are hearing stories of survival throughout this flooding event, people rescued from trees, rooftops, stories of loss, the death toll of this flood is expected to rise in the coming weeks, last update from the governor was 16 people dead. that number is unfortunately expected to go up. six children are confirmed among the dead, four from one family alone. we talked to the owner of a flower shop, clearing mud and debris from her flooded store. she told us she would rebuild and reopen but what was most difficult was not being able to be open in her community in time of need. >> one of the things about owning a flower shop is if there is a death we are there and that is heartbreaking to me. we've had several calls from the funeral home, can you do a casket? i can't.

against the da in chicago but i'm scared for the future because i don't know if the next generation of das will be on the side of victims as they are now. lawrence: is in a growl and poll fan i hope the pendulum swings both ways. i hope it swings in the right direction. one thing i will say, don't know the judicial system, didn't go to law school, don't know the intricacies of it and there's a lot of relevance. i do know people and i know you don't fix bad habits unless you apply vulnerability to say this person might be a good person committing crimes, hold them accountable if you want a chance at fixing their bad habits. rachel: dan bondgino lived through the broken windows and it worked. you can't reimagine human nature.

lawrence: the argument has been about reform. you have repeat offenders that never turned their life around. people who have been lifelong justice reform advocates are saying you are hurting the cause, this is not like the first step act, people who turn their life around, these are people who are empowered, people committing murder, violent crime, assault, thomistic violence, putting them back on the street with no consequences. all that in chicago, to put ankle monitors on and track them to the scene of the crime. rachel: i was married to a da. i'm a law and order person but when the criminal justice conversation came up i was open to it. i think you will close people down with this control.

terrifying new video shows sharks including great whites getting closer to the coastline than ever before as sightings increase. our next guest shot this footage with her drone 100 yards from the new york coastline. joanna is here to tell us more. >> reporter: good morning, thanks for having me. joe: you are a videographer. you spent a lot of time monitoring sharks, tell us what you see this year that you haven't seen in years past. >> i more a photographer. i was out there trying to capture photos, this particular day, sharks were extremely close to shore, and i have seen bunker fish and sharks a few hundred yards off but not this close.

we have had a ton of them along the shore. joe: there are different factors, one thing, there have been 16 in california, south carolina there were a couple, new jersey, almost 28, a high number free this year. any hypothesis? warmer water further north? sharks stay in warmer water, so do the fish, what might make this more frequent thing we are seeing? the fish are coming further in? >> in 2019, governor cuomo put in place a lot a commercial fishermen can't catch baitfish in nets. being that is the case we have a huge influx and this is the

result of that legislation. joe: if you let fishermen do what fishermen do this is into prop them. they are closing beaches because they are spotting sharks. do you see people taking this seriously? are people trying to get out of the water and not understand the threat? >> i don't think people understand the threat completely. i grew up here, i have seen sharks out there and still go in the water but on this day they were extremely close. you need to be vigilant. you can see these schools of baitfish from shore or when you're swimming because predators come from beneath and the fish jump and you can see them, definitely do not want to be anywhere near. joe: i hope people take it seriously.

mansion get on board with a bill that essentially attacks coal? >> what you've got to understand about this bill is it's not done yet. cinema has not weighed in yet and they got joe mansion and he went against his pledges. it raises taxes, he said she shouldn't do and even barack obama said we shouldn't raise taxes during a recession and it's a massive spending bill. earlier in the week they passed the chips bill. if you have the chips bill plus what they're trying to do in reconciliation, it's $700 billion in new spending. don't tell me it's going to reduce inflation. they're going to pour more money into the economy. what's that going to do? then the other thing is that's not going to reduce the deficit. they're counting on hundreds of billions of dollars in new revenue by irs tax enforcement, that never comes to fruition. i don't care what you say, it never comes to fruition. be ware of this bill. when this bill raises taxes on

coal production in west virginia, good luck explaining that to the good people of west virginia. rachel: meanwhile in china, they're building coal plants and by the way, the bill also is being touted by al gore because it has so much of the climate goodies that they want and is this the trick they take something called the inflation reduction act and they basically are tucking all the green new deal stuff into it because they know they can't pass it but put it in behind these? >> there's no justification by spending $700 billion with these two bills saying you're going to reduce inflation. i think it'll have the exact opposite effect and we're spending more than $6 trillion in this country, 25% of our gdp, one out of every four dollars in the country is being spent by the federal government. this is the problem, folks. the $1.9 trillion that you passed last year exacerbated the problem, pouring another $700 billion is not going to solve it and when you have

waters ripped through eastern kentucky. fox weather correspondent is joining us now from lost creek, kentucky. max, just incredible scenes of devastation from where you are. >> reporter: yeah, absolutely. right now we're in the fox weather beast and we're actually on a section of roadway that was under water just a day or so ago. we'll move a bit because i want to show you guys just some -- well, jaw dropping scenes. so off to our right here, what you're seeing are pieces of homes have have essentially built up as debris alongside the road. as we turn this corner here, what you'll start seeing are slabs of homes that are no longer there anymore. just absolutely jaw dropping to see the power of this water as it flowed through here. this is lost creek, and it absolutely overflowed its banks, overturning cars. we're seeing just, you know, devastation here. we are seeing nothing, you know,

just essentially mud slats where there used to be homes. we're hearing incredible stories of survival throughout the flooding event. people rescued from trees, rooftops and we've heard stories of loss with the death toll this flood expected to rise in the coming weeks. right now we are sitting at around 16 people confirmed dead, 6 of them children. that death toll unfortunately going to rise. we talked to one man who says he wanted to help his neighbors even after he and his family had to hold on for their lives as the flood waters rushed into their home. >> my house shifted and everything going to one side, we ran outside and i strapped us to the light pole for two hours and trying to get somebody to save us and nobody could help us. at that point i felt helpless, i couldn't do nothing for my family.

but china isn't being held accountable at all. why? >> well, fundamentally if you look at what -- thanks, lawrence, it's great to be here. fundamentally look at what china's doing. they're building a lot more coal pile. why? because coal is still incredibly cheap. so understoodmently we've -- fundamentally we've been told that solar and wind is much cheaper. not when the sun is not shining and wind is not blowing and not like china doesn't know. the real problem here in the way that we think about climate change is that we think it matters. what we well mening people in the u.s. and -- meaning people in the u.s. do when we put up an extra wind turbine and solar panel and feel good about ourselves, but the reality is the vast amount will come from china, from india, from africa, from everywhere else in the world so what we got to realize is right now the reason why we like coal and many others is fundamentally because cheap and reliable energy is what drives

globalization, and you can't tell people not to have that. what you need to do is to find a way to make green energy so cheap that everybodiments it, but you're never going to get china to do this unless it gets cheaper. lawrence: yeah, how do we do that? i mean, americans are having to pay so much money right now at the gas pump already. inflation is hitting us in every sector of our life. we want to do the right thing and be good stewards of the earth. what is the balance approach? >> well, so fundamentally the thing we need to recognize is you're not going to solve the problem by telling everyone: buy expensive sufficient. that's what you're telling them and then we end up with a society where energy is very expensive and we're much less well off than we otherwise could have been. what we need to do is what has always driven the american dream: invasion. innovation. in the 1950s, los angeles was terribly polluted because of cars.

which is different than what others have done in the past. i've been in all 39 counties many multiple times in washington state and building coalitions. we built a coalition over the last 16 months and i'm funded by the people of washington state, and i have taken the time, you know, to listen to the farmer in dayton, washington, and learn about how he's had to cut his budget because of inflation. i've talked to the small business owner in seattle where crime is having a massive affect on their employees and success as a business. a mom in kirkland worried about her child's education and the fentanyl crisis in our schools. i talked with a veteran in mount vernon who said i didn't leave the democrat party, they left me. we're on the right side of the issues and i'm hearing across washington state is patty murray has forgotten about us and we have real issues at the end of policy, bad policy is real people. we are building a coalition here in washington state all over the

rachel: he did that. what happened is he forget has flannel shirt in jersey lawrence: i forgot mine too. there's a lot happening on the foreign policy front and nancy pelosi announced she was going to head to taiwan and we know the dispute between taiwan and china. after that, this is what we got from the state media. if the u.s. fighter jets escort pelosi's plane into taiwan, it is invasion. the people's liberation army and firing warning shots and making technical movement of obstruction. if ineffective, shoot them down. they're saying just to be clear, she was speaker of the house, they're in session. as she goes, they're going to shoot the plane down, rachel. rachel: that's right. congressmen and women have been

quietly going to taiwan for awhile. so she was going on a trip to asia. she didn't announce, i guess, she was going to taiwan, but people kind of knew. then the white house, senator tom cotton leaked the information she was going in hopes she would not go. so once that leaked, then we got the statement that you just read, which is very aggressive. it's a threat, very aggressive on the part of the chinese and peter doocy was at the white house in the press room and asked what to make of the chinese threat. here's what that exchange looked like. >> an official who is associated with chinese state media is suggesting that if speaker pelosi tries to go to taiwan, her plane could be shot down. does the president have a response to that? >> i know you're asking

specifically about the rhetoric that we're hearing from china. but as it relates to the speaker's travels, something that we're just not going to speak to. right now that's a hypothetical. rachel: joey, it's a really interesting set up. you have the white house stepping on nancy pelosi's trip and now you have a lot of republicans coming to the defense of nancy pelosi and saying, i think she should take that trip. i'll take the trip with her. what's going to happen here? joey: well, i think it's funny. i think we have a rewind a bit. the last time a speaker visited taiwan was 1997 and it shows how different the world is now than 1997. but the taiwan defense treaty ended in 1979 but joe biden hasn't been in office for the last 100 years. one of the first things he said on taiwan is eluded to coming to their defense because of a defense treaty and he misspoke as joe biden does, and that was

the first public step forward in the escalation. china's almost responding to this mishap that joe biden spoke when he said that we have some sort of mutual defense history that we do not have with taiwan. i can't remember his exact words but had to walk them back after that. it just kind of shows you how important it is to have a president and a lead who are can be lucid and speak clearly and not put any kind of wrong messaging out there. does china understand at the top that he was misspeaking in that way? probably but he gave them red meat to use in this escalation we have where now china feels like they have leverage over us but can bully us around. it wasn't that long ago, a few decades ago we had the u.s. independence that was harassed in the water and all the air space and seas around and all the land is chinese sovereignty. so they stretch that had and don't adhere to the

international water perimeter and they posture and this is beyond posturing, this is threatening. lawrence: the question is not on the politics or the policy of the administration. the question is what would be the response to the threat? joey: yes. lawrence: the press secretary was asked, and she correctly noted: i know you're talking about specifically the speaker's coming from china, the threats coming from -- but what i want to talk about is the trip. i mean, the evasiveness. we're not talking about a republican here; right. and by the way, this is beyond politics though. rachel: yeah, it is. lawrence: this is a democrat official, the speaker of the house, and the president has yet to respond to the threat. mike pom pay, the secretary of state has dealt with china and nows how to respond to them.

listen. >> it's a dangerous way to think about america's place in the world and think some knuckle head chinese communist party can make a threat on someone third in line nor the presidency in the united states of america and change her travel plans to travel to a country she wants to go see and visit. it's part and parcel of a weak foreign policy. administration that's scared of its own shadow and this is less than 24 hours after the president's on the phone with xi jinping. this suggests that that call went poorly and xi jinping believes they can move about the cabin freely and intimidate us and i'm with nancy on this one. lawrence: rachel, when you have mike pompeo saying i'm with nancy and can't get the president, i don't think i heard mike pompeo say i'm with nancy at all. this shows it's an american issue now a -- but the president of the united states, he hasn't uttered those words. rachel: no, and i think a lot of people are wondering why.

in that statement that -- in the conversation that mike pompeo had, we don't have that clip on right now, but he listed some possibilities of why it was leaked, why his response -- joe biden's response was so weak, why the white house leaked it in the first place. one of the things he talked about is, you know, could he be compromised? could joe biden be compromised? why is he so weak? there's been issue after issue where joe biden has taken the side that benefits china over the side that benefits america and american workers. one thing to note that's important is taiwan produces some 90% of all the chips in the world. that might be why we had of course this bill come up to try and encourage production here in the united states, but it's an important topic. clearly china feels elmore boldened by -- emboldened by the way we've responded initially by the threats to russia and

ukraine and many people predicted at that time this is exactly what would happen and that china would become more aggressive, and i think the question to democrats is can they now not look at the world, democrats who voted for joe biden and there's some 80 million of them, can they not look at the world and say, oh my goodness, the world is so much more dangerous under joe biden than it was under donald trump. i think it's just so obvious. joey: well, i think part of the problem is there's a dysfunction between nancy pelosi and joe biden. i mean, obviously either joe biden feels like she is not doping him any favors by planning this trip and essentially going and that's why they leaked this, or she feels like they're not supporting her in doing her job, which is kind of odd considering they're both democrats and really the leaders of that party and nancy is pretty much given a rubber stamp to joe biden in his view maybe this is how she repays him by bringing him another problem. lawrence: yeah. i don't think when they -- if
