nine years in prison in russia. we will talk about this. she also got a $16,000 fine as well. so we knew that just moments ago with senator blackburn on with me, ari, that the judge had found her guilty. of deliberately taking drugs and of country and having them as he said with criminal intent. and now come with the prosecutors asked for between nine and 9.5 years she gets the nine years in prison in russia. senator blackburn pointed out that is going to be a very different than where you might see someone be imprisoned here. not that prison is ever easy, it is punitive. but in foreign countries, and countries that are not our friends, it is impossible at times to know what this young woman might go through. your initial reaction to this? >> ari: unfortunately she is being used as a pawn in big power relations. this is russia's way of sending

out to the united states, another example of how poor relations are between the and russia. you know she has admitted guilt, but typically want this to be transferred back to america. we would try her under american rules and american laws. russia did not want to do that in this case. it is a tragedy anyway you look at it. it is not the first time it has happen. these things sometimes happen in prisoner swaps and that is also a factor of u.s.-russian international relations. >> harris: having worked in the white house also just the experience of knowing as you said when things work and when they don't, sometimes is dependent upon the relationship we have with those countries. that's one of things senator blackburn leaned on hard about this, because we don't have a lot of leverage right now with russia. but knowing all we do is this process over now? i mean, part of what happened in the beginning, ari, is we didn't see her for a long time. what do we anticipate now? >> ari: this will probably

kick into higher gear behind-the-scenes now that there could be third parties negotiating. i will say this too, harris, it's a warning to all americans, where you traveling to russia? if things are all that bad don't go there. don't support them with tourist dollars. everything you have done morally in the ukraine and now as you watch your show trial. the disproportionate sentence. americans have no business going to russia. i hope we realize that. >> harris: it's complicated. you know, you look at her, wnba player, she was asked a question i guess before she she wants but she is making over million dollars money she couldn't in the united states. and had been doing that. so we somewhat know the answer to that. i don't know if you make the same decision after the invasion of ukraine. i'm not sure about the sensitivity. look at some of the decisions that nba players make with regard to relations with china, communist nation. i don't think any of us could guess what that money will pull

in. it's impossible to know the decisions they will make given the political circumstances than what they are sensitive to. what about a prisoner swap, though? does that work with a country like russia? >> ari: it really depends who gets a swap for whom at what level and how many people. no matter what is unsavory. part of the problem is justice really does exist in the united states. it may not always be perfect but it really exists. we have laws, we have a due process system. other countries have cash but you can if they catch american they will do what they can. that's part of the power relationship between the u.s. and russia in 2022. so, you know, harris, my heart goes out to her. no matter who she is, no matter what she did, she has now been convicted in russia and will be in a russian prison. but she did it to herself in some ways by going there and by doing what she did.

that is why my call is for americans, just don't go. part of the way you punish russia is to dry up every available dollar they can get. so i hope there is no reason for any americans to go there at all. and put yourself at the mercy of russia. >> harris: the president of the united states this is all breaking news now, has gotten involved in the brittany greiner situation after the judge has sentenced her to nine years in prison just moments ago. we were told he has called on russia to immediately release brittany griner. again, your white house experience really not now. how does that impact what is happening now? to hear directly? >> ari: doesn't. that the must've call. he's doing it for domestic reasons as he should. it's the appropriate call to action but russia will ignore joe biden. again, this is why it's all caught up in bigger issues. it's caught up in the u.s.-russian relationship. when joe biden says that, he has no leverage.

why will russia agree? your relations are bad. so it won't change anything for her on the ground. what will change for her on the ground is behind-the-scenes movement, negotiating actions by the state department. >> harris: i am reading up a little bit simultaneously as we are talking here because this is now moving quickly. very quickly. of the statement by president joe biden on sentencing of wrongfully detained american brittany griner now, today she received a prison sentence on this one more armed reminder for the world already knew, russia's wrongfully detaining brittany. it's unacceptable and i call and rush to release her immediately so she can be with her wife, loved ones, friends, and teammates. my mr. risch will continue to work tirelessly and pursue every possible avenue to bring brittany and paul whelan because you mentioned there are other americans too, home safely as soon as possible. your reaction. >> ari: that is the appropriate statement, but again it's for domestic purposes.

>> harris: what would that be? americans artie know she is not here. is that political? >> ari: he is making a moral statement that what russia did was wrong that she should be free and that's an appropriate thing for a president to say. that i go back to basics. will it impact pollutant? will it change russian behavior? the answer is no. because joe biden doesn't have leverage around the world anymore. you know, this part of the problem. when you have a president who is just not held in high regard and lacks leverage. it's also a reflection of russia's invasion of the ukraine with a thumb their nose at everyone and do whatever they want to periods why would we expect them to take our one prison when there acting entirely inappropriately with another country? it's why we need to be tough. so the lesson here more broadly used taking out on one prisoner that we need to have more military spending. we need more military readiness. we need to learn lessons about aggressors are broad. and joe biden is not doing

that is why i pled guilty. because i had no intent to break any russian law. >> harris: it is that intent part that comes into play in the united states. but we cannot control what russian court does. >> ari: at. i think she was counseled to say that in order to eventually hopefully soon be able to have the russians save some face and release her or do a hostage exchange, prisoner swap. having said that, for them to say you are right you admitted it aren't we benevolent we will do a prisoner swap. if she had been defiant and said this isn't legal this is immoral, then the russians would've had to dig in as well. so i suspect that was on the advice of counsel and/or state department officials. >> harris: she has also apologized to her team, to her basketball teams in russia and the united states, to her parents, to her spouse. she says she was aware of people talking about her as a political pawn but distanced herself from

this is an incredibly sad situation for brittany griner. setting aside from one moment her culpability, just comparing punishment to the crime. pretty greiner seems to have taken an illicit drug into russian. that she is now paying a penalty that you highlight today is close to ten years in prison. that is injustice. to see an american citizen detained as a political pawn as i think ari fleischer just characterized in russia for a larger geopolitical purposes is sad and an injustice. it is also worth pointing out for one moment, harris, the nature of injustice, brittany griner and many athletes have pointed out injustice in the americas justice system. i think today is a very appropriate time to take a bigger, global contextual look at the american justice system. to realize it is the exception in human history. what you are seeing in russia is par for the course. the justice system here is the

exception. our dedication to due process. it doesn't mean we are perfect, but this would not happen in the united states of america. >> harris: let's go further with that. because you know, i have said to senator blackburn and i said this to ari, when you are looking at a situation where athletes in particular, because there are other corporations in this too but we will focus on american professional athletes right now. those who go and do business in china and russia. they know the dangers perhaps, i don't know if they understand the optics of it all. when you look at that new look at where we are with soft on crime policies, where criminals are running free over and over and over and the juxtaposition between some of those same voices crying out for justice in america, and giving the criminals room and so on and so forth. then looking at a situation where if you get caught in another country you don't get me room. to get a cell.
