folks in the house. that carries two -- four year jail term if she is convicted for dui they got to do blood tests on her prep sure they did at the hospital with got to find out what her blood alcohol level was. and you got to find out there any other types of drugs in her body. the good news for anne heche perch is very fortunate, and california even if there severe property damage, that does not enhance the penalties for herbert that is still charged as a misdemeanor. but, the reckless driving which i'm sure she's going to be charged with, that typically is a misdemeanor in california. but gascon has a discretion to charge that as a felony. and if he does that carries up to two years in jail as well. lawrence: are going to continue to file the investigation we do not of the test of the blood but there are pictures of circulated what appears to look like alcohol bottle. we do not know that for sure yet. lauren, what else can you tell us from those in hollywood. a lot of support from those folks on social media now.

but if something was going on in her life, was her anyone talking about that? >> yes, i mean anne heche has been working on bunch of different projects lately. but none of them are studio motion pictures. anne heche is working on a lifetime movie she was on the judge on dancing with the stars in 2020. she is doing a lot of different projects we are not used to seeing her as an audience. we are used to seeing her big movies like psycho and i know you did last summer. think she has been struggling for a while now. and like you said, a lot of slippers are coming out on social media and supporting her. and offering just positive messages for her. tom jean was a big supporter of hers. she was dating him in 2020 actually when i had interviewed the both of them. they broke up recently. he is all for her hand and says she's doing fine in the hospital but she's going to recover.

biden administration directly. we have had several discussions with the state department over the past year, since my brother has been detained. but we have not yet heard from them that they had designated him as wrongfully detained. >> let's talk about that. there is a law now the 2020 law the hostage recovery act and accountability act by the state department. and it requires them to notify and designate if someone was wrongfully captured. so, what are you hearing? >> well, we have talked to the state department on many occasions at various levels. we hear they are considering his case but they have not yet designated him as wrongfully detained. and as of this moment, we have not heard why they haven't.

as you know, my brother had 17 grams of a medical marijuana he was sentenced to 14 years and a hard labor camp in russia. >> have you heard from him? how is he doing? is he is in good condition or not? >> i do not think he is in good condition, no. the only way we hear from him is through letters. we have not spoken to him in a year. never had a phone call from him. we write letters through a prison letter writing system. so it certainly goes through the sensors written in russian and translated by cellmates or google translate if it is on the side of the atlantic. but that has kind of the been the limits of our discussion with him.

it is a very hard to get real information from him. >> lisa, do you feel like you and your family are being treated fairly by the united states government? >> i do not know how to answer that really. i would say we took a low profile with this case initially. the state department as well as our lawyers advised us to do so because we are trying not to make mark an asset. but once he got sentence in the middle of june to this egregious sentence, we knew there was no hope for him to work to the justice system. we had to get political pressure to get him home. because the legal system was not working for us in russia. lawrence: ought to be clear on this before we go part you are encouraged by the administration and the state department not to make a big stink about this

because you did not want that to be used as leverage. that is no longer working which is why you're coming public comment is that right? >> i would say was the recommendation of everybody we talk too early on in the case. we were really hoping for leniency and we are hoping to not make him an asset. but clearly the russians have done that. they are clearly targeting him because he is an american. they have given him this egregious sentence that is way beyond proportion to the crime. until we now know we cannot count on the russian legal system to treat them fairly. and we need to count on the american government to help get him home through some kind of prisoner exchange. and that starts with him being designated as wrongfully detained. that is what we are asking for progress we need to get all of our people back. this is unacceptable. we know putin is a monster with got to do whatever we can to get

ago when i was a detective in new york city. this is nothing new that happened here. here you have a mother, who had cold french fries. she talked to her son on the phone. he comes to the location we have a young kid working there, got himself a job. he is a good upstanding citizen. gets a shot and killed by this useless thug. the catalyst to this whole thing was the mother. i haven't heard anything about the mother being arrested yet. >> you should probably be arrested for agitating this entire situation. you patrolled the streets for a while. everyone that i talked to in every city that i visit, are all upset. from all different backgrounds. yet that media does not focus on this. >> no, it doesn't. i do not know why. thank god we have you and fox news that talks about the things that happen all the time.
