approval of attorney general merrick garland and fbi director christopher wray. now, in a statement, the former president said this: these are dark times for our nation as my beautiful home, mar-a-lago in palm beach florida is under siege raided by a large group of fbi agents. white house officials claim they didn't know about the raid, no, really. telling fox news, quote: we did not have notice of the reported action and would refer you to the justice department for any additional information. now, for his part, the former president, who was on the stump for former alaska governor sarah palin who, as you probably know, is running for congress. well, he was doing that just hours after the raid on his home and he said this. >> thank you very much. that's right. another day in paradise. this was a strange day. you probably all read about it but very important. >> as news of the raid spread, supporters of the former president set up shop just

outside mar-a-lago showing their support for him even as fbi agents continue to swamp the premises. g.o.p. lawmakers are incensed here in washington and, yes, they are demanding answers. ohio g.o.p. congressman mike turner tweeted this: as the lead republican on the house permanent select committee on intelligence, i am demanding an immediate briefing you by fbi director wray regarding the national security risk that rose to the level of ordering a raid on the residence of a former president. meanwhile, mike pompeo, former secretary of state for this executing a warrant against expresident is dangerous. the apparent political weaponization of doj fbi is shameful. a.g. that would be attorney general, must explain why 250 years of practice was upended with this raid. i served on benghazi committee where we proved hillary possessed classified info. we didn't raid her home.

and this from florida senator marco rubio whose parents as you know are natives of cuba he is sounding the alarm. he said in a video the biden administration was, quote: playing with fire. adding this is dangerous because someone else will be in power one day and now you created the precedent for them to do this back to you. and therefore we would lose our country as we know it, guys. >> steve: all right. >> lawrence: kevin corke, thank you. >> ainsley: let's bring in jonathan curly constitutional law expert and fox news contributor. good morning to you. >> garage. >> ainsley: good morning. why a search warrant instead of a subpoena? >> that's a mystery to me. i'm not too sure why unless they were alleging that they feared that the president would destroy the evidence if he was given notice. but the president wasn't at the residence. this would seem to be easy issue to subpoena voluntarily disclosure and access to the

site. the access to the home was granted obviously before, two months ago. the national archives searched the residence and removed 15 boxes. it's not clear why this material was not removed. it's also not clear if there has been communication since then raising concern over documents that are considered still missing or possibly present at the residence. >> steve: sure, professor, given the facts a former president, something like this has never happened before. of course, the fbi can't just run in wily nilly, they had to go in front of a judge. and they it to present evidence to it probable cause and the judge signed off on it. and it makes you think that the fbi and the doj knew exactly what they were looking for and it makes you wonder whether or not somebody perhaps in donald trump's inner circle or somebody else close to the former president may have told them exactly what to look for and exactly where it was.

>> yeah. there has to be particularity in terms of these applications. they have to be specific. the court clearly found probable cause that there would be classified material still at the residence. so, that much we can assume. there is a law that allows for punishment up to three years for the concealing or retaining these types of documents. but that is a specific intent crime. it's not a negligent standard. you have to show in this case president trump or some other individual, specifically intended to withhold such material. we just don't know what the evidence is at this point. >> steve: right. >> those are going to be part of the questions asked as we go forward. >> lawrence: professor, it is common for former political appointees as well as federal officials to go back and forth on these records whether they decide to go back to public life. i think a lot of americans have

questions concerning why there was such a heavy hand approach towards donald trump vs. hillary clinton when we know for a fact there were certain records that were destroyed, that were under scrutiny. so, do you have an explanation for that? >> yeah. i just testified on the presidential records act, and this specific seizure of those 15 boxes back in february. this is an act that is not heavily enforced. certainly not historically been criminally enforced. in fact, some of the most egregious cases were handled rather lightly. sandy berger being an example. he actually stuffed documents in his socks and snuck them out of a secure location leaving them at a spot to be retrieved later. he received no jail time and just pled guilty to a misdemeanor. he wasn't even forced to lose his security clearance permanently. it was just a three year suspension. so this is an act that is not

known for robust criminal enforcement. that does raise questions as to all hands on decorated that occurred. >> ainsley: in different times now. would he be banned from public office if he is found guilty, according to the daily mail, if is he found guilty trump could face a maximum sentence of three years in prison. what is the motivation here. >> first of all, that was raised first by marc elias, who is the clinton campaign lawyer who is accused of misrepresenting the funding of the steele dossier and being involved in that whole scandal. i strongly disagree. there is a reference in the law of disqualification. but the constitution establishes the rules for impeachment and disqualification that follow. many of us do not believe congress can add to those gratifications. in fact, the supreme court has previously ruled states can't do

that with regard to article 1. they can't impose limits on members of congress. the same is likely true about article 2 and the president's position. so, i do not believe as hopeful as these tweets have been coming from the left, that this is a road to disqualification. >> steve: right. professor, do you think it is a coincidence that on the same day that they execute this search warrant is the same day that axios published those images of alleged ripped up white house documents in the bottom of a toilet? the white house, former president trump's team said that never happened. they denied all of that but, nonetheless, you know, a big maggie haberman story and axios story showing supposed torn up classified stuff trying to be flushed down the toilet. >> there has been an amazing sin synergy in timing. we saw that it with the january 6th committee and the grand jury moves by the

administration. it does seem to be running on parallel tracks. and in this case the media story did play into this argument that, well, maybe the president could destroy these documents. i don't know what proof beyond that media story you would have for that type of claim. the family has insisted that they were cooperating. this is not the first raid where the targets have said that it came out of the blue, that they were cooperating voluntarily submitted. we have seen these arrest warrants and search warrants issued when many of us have said why? why wouldn't you just allow this to be done voluntarily? >> lawrence: you know, professor, i think what a lot of americans are concerned about this morning, even the gloating in the media to have people that are a part of the democratic party to gloat about the president potentially not being able to run. i know you disagree with it, but the fact that they think that is

true, does that send chills to you as a civil libertarian as one that is a constitutional expert? it seems, it seems. i want to see the warrant just like you do professor. but it seems like political opponents are being targeted here. >> well, it is astonishing. you played the clip of the former prosecutor on another network saying this is the whole enwhich i la da to keep him from running again. it was a remarkable statement. because it's suggesting there is nothing wrong with the justice department raiding this property potentially charging this former president in order to keep him off the ballot, to have that political motivation. well, that is going to be rather, forgive the pun, hard for a court to swallow. but it's going to have an even more robust or pronounce the impact on many voters. >> they already have a distrust for the fbi because of proven

bias amongst some individuals in that department. and falsified material and misrepresentation in order to get the russian collusion investigation going. this would really fuel that distrust. and these types of actions are tearing us apart. and it has to weigh on the attorney general as to whether this was necessary. not getting the material back. because this classified material there, it can be a violation of federal law. and that material can be acquired. but the question is how it was done. and we'll learn more about that, i hope, in the coming days. >> ainsley: we have heard alan dershowitz said they better have a smoking gun. they better have proof. newt gingrich brought up the abuse of power issue and said if they can do this to a former president, they can do this to any of us, any american. you are a constitutional law expert. he said this is the future if the constitution fails to exist. kevin mccarthy, congressman

mccarthy vows to oversight -- vows oversight of the doj if republicans win in november. this was his tweet. i have seen enough. the department of justice has reached an intolerable state of weaponizing politicization. when republicans take back the house we will conduct immediate oversight of this department, follow the facts and have no stone unturned. attorney general garland, preserve your documents and clear your calendar. what is your reaction? >> the president. >> ainsley: start over. we lost the beginning of that? >> running, it's probably no longer existent and his followers are now entirely fired up over that prospect. what concerns me is that these types of actions cannot only divide us but fuel the age of rage. we have got to have mature voices that are heard and listened to in the days to come. you know, i am not convinced

this raid was necessary to acquire this material. and i would really like to see why this step had to be taken. >> steve: professor, you know, it was years ago we heard about strzok and page at the fbi and we heard about andy mccabe and we know about james comey. they are all gone. but the finn of today is run be by director christopher wray who was appointed by donald trump. and i have heard a number of, you know, people pontificating over the last 12 hours or so saying that the fbi has been weaponized. you know, there are a lot of people that regard the fbi as the finest law enforcement agency in the world. do you think that the fbi is political and has been weaponized against former president donald trump? >> i would not paint the entire fbi that way. we should all be proud of the work the fbi does. >> steve: 100 percent. >> it doesn't mean we have to be

blind to the problems we have seen. there are serious questions involving the whitmer kidnapping case and entrapment and conduct of fbi agents in that case there are other issues recently that raise questions as to the potential bias of some people within the department. we can look at that without declaring the entire department it rotten to the core. but, you know, the concern amongst citizens is that you mentioned peter strzok who was famous or infamous for saying that he had an insurance policy in case trump is elected. well, for people that remember that, their concern is that this is another form of indemnification. it is another insurance policy being played out. we don't know that to be the case. people shouldn't dismiss that as legitimate concern. that's the reason i think that attorney general merrick garland has a duty to protect the integrity of this investigation. nobody is expecting a wholesale disclosure or a press conference like james comey, but i think he

does have a burden to come forward and answer a few of these more procedural questions as to why this was necessary to assure people that this isn't a form of bias or a new insurance policy being taken out on the former president. >> lawrence: professor, i'm so glad that you set it up that way because i think there is a difference between the rank and file agents that do their job on a day-to-day basis and the leadership which are normally political appointees in the fbi. even christopher wray just testified before congress and said some of the allegations of the investigation with hunter biden in the way that it was handled is deeply troubling. that was a quote from him. but, i have to say, professor, this is not the first time the fbi has chosen a political opponent. they have a long history of choosing people to go after all the way down to dr. martin luther king. there has been troubling allegations about that so my

question for you now that it has gone from left to right, is this the time now for some sort of reforms to the way the fbi conducts its business? and i want to be clear, i'm not talking about the agents at the local field offices. there has always been question with the political leadership in the fbi. >> yeah. i do think that the fbi is still lacking transparency and that it is also not forthcoming with congress on critical issues of this kind. you mentioned hunter biden. that's a serious concern. you know, there are issues raised as to another agent who was accused of down playing these allegations at the outset. essentially scheduling aspect of the investigation. more importantly, merrick garland has much to answer for in the failure to appoint a special counsel. i can no longer think of a plausible argument against a

special counsel in this case. we have more evidence of the president meeting with business associates of his son in the white house. now, it appears quite clearly that his denial of any knowledge or involvement of these dealings seems rather demonstrably false. that means that he may have lied about an influence peddling scheme that may have acquired millions of dollars. yet, the attorney general refuses to appoint a special counsel. and the benefit of that for the president is huge because a special counsel would likely come with a report. even noncriminal matters would be part of that report. like influence peddling. so, to answer your question, yeah, there are serious issues here that are -- >> ainsley: i think we lost him. >> steve: i think he is done. >> lawrence: that's the live tv for you. steve: we had a little broad band problem there. we thank jonathan turley from the d.c. area talking about the

before we move onto the next thing is she fought a battle with breast cancer for over 30 years. and she was on this program, she was suffering but she knew that life was short and she had go out and live it and she was always -- she had so many different projects and so alive and such a wonderful person. her house is actually across the street from my house where i used to live. and everybody loved her. she was a great neighbor. >> ainsley: in that movie transcends generations we have all watched that movie and loved it, grease. she was dawrlg and to meet her in person when she came to "fox & friends" was pretty shocking because we had been watching her for years. rest in peace. >> lawrence: such a true testament to never give up and fight it all the way to the very end. often we have the phrase that they lost their fight. i think she won. 30 years going against cancer. she definitely won that fight. >> steve: olivia newton-john, we

community at large. and if there has ever been a period in american history where we need to transition and transform the negative and raise the recognize voices of the majority of the american people across the board who support our law enforcement professionals and who want to build these bridges. that time is right now. >> lawrence: such a beautiful statement, reverend. patrick, i want to go to you because the reverend is absolutely correct. there are so many beautiful stories. recently we have seen law enforcement start to highlight the positives, the good that we see on the day-to-day basis. the 95% above interactions. where is that coming from? >> well, look, there is no doubt we are in a very difficult time in law enforcement. we have spent two years of dehumanizing law enforcement officers. and the reality is there are some 800,000 law enforcement officers across this country that suit up and show up every day in communities across america. and make such a difference in the lives of the people they

national archives then i'm pretty sure you don't need such a dramatic made for tv raid by the fbi. unless, you know, you are attempting to put on a grand political show. it's probably no coincidence, ainsley, that this happened on the day of richard nixon's resignation nearly 50 years ago. 8 august 1974. no connection there whatsoever, right? and, look, if attorney general merrick garland and the biden justice department has enough to charge donald trump, then just go ahead and do it. otherwise, raids like this smell like they should like the partisan b.s. that are forcing more americans to distrust our institutions as a whole more than any time in this country. check this out, guys, all right? gallup finds that institutions now that are trusted the most, small businesses, the military, the police, and medical institutions. we can all get behind that here is what is at the bottom in terms of trust. the presidency, newspapers, the criminal justice system. big business, television, and congress. i think that says it all. and why if this is a nothing

burger with no bun this will have a boomerang effect on the narrative on which this raid seeks. >> lawrence: you know, joe, the happiness, 9 glee we were just talking about, the motive, we have to question the motive. if this was a celebration of the criminal justice system or something like that, then this is something we can get behind. but the motive behind this is that donald trump may not be able to run and that's what they're excited about, right? >> that seems to be the case here. and you heard the quiet part out loud a couple of times yesterday, lawrence. on television. that appears to be the goal here. but the big question is, i suppose, is, you know, is this administration wepsing agencies that are suppose to be under political orders? because we are are merrick garland's letter, and you heard about this on this show a lot. designating parents care about child's education and curriculum being taught as potential

domestic terrorists. merrick garland never apologized after that was exposed. you mentioned it before, lawrence, i thought it was a good point. fbi members, not the ronk and file as you pointed out but those at the top politically control pro-mizeed. are they acting as the biden administration's own law enforcement people? for example, given his rhetoric in two anti-trump books after being fired by the fbi, does anybody really believe james comey as apolitical as fbi director? hobby andy mccabe fired by the fbi leaking to the press. mccabe as a katyushay job at cnn now. john brennan can't tell a difference between him and keith olbermannman. they seem so partisan after the fact. why should we believe they were partisan when they were in those positions of power. >> steve: joe, they are all gone out of public service. the person who heads up the fbi right now was appointed by donald trump. >> correct. he was kind of at that point he

had fired james comey so he had to take somebody from the agency. maybe that wasn't his first choice and that's a very good point. >> steve: he was appointed by donald trump. >> i understand that completely. i don't know if trump was such a big fan of him though that based on. >> steve: not today. >> not today, certainly. even when he was in office. i think marco rubio, steve, says it best. after today's raid on mar-a-lago what do you think the left plans to use those 87,000 new irs agents for, right? so, again, we are seeing government agencies that have being increasingly weaponized. and i think that the american people are ultimately uncomfortable with that as they should be. >> lawrence: yeah. even the fbi director has said some of the allegations are troubling when he was testifying before congress just last week talking about the hunter biden. we have the fbi director. the man that's in charge of the bureau questioning his own bureau appointed by the donald trump or not.

>> ainsley: two agencies that he said could possibly are being accused of possibly covering up. steve: and regarding hunter biden, there is so much we don't know because it is an ongoing investigation and that's just the way they operate it can drive us crazy but that's the way they operate. >> ainsley: we don't know what secret documents they were looking for in mar-a-lago. >> steve: we haven't seen the warrant. >> ultimately all people want is a transparency. i know you can't comment on ongoing investigation. just give us the general broad strokes. why did this have to be done last night in the manner that it was? i think it's a fair question. it doesn't give away what the ultimate investigation may or may not be. >> steve: to that pointed that's why jonathan turley half an hour on this program said there must have been when they had the probable cause hearing where they presented the case to a judge, there must have been some particularity he said with this particular case that they had to go yesterday. and jonathan said maybe it was the worry of destruction of property. we don't know, we will have to

good morning. >> ainsley: good morning. i know her cancer came back. she was diagnosed in her early 40's. cancer came back, metastasized in her back and bones say it was very painful for her. she continued to have that bubbly personality when she came on "fox & friends" and when we all met her. what in the end did she go through and how can we prevent -- what do we need to do as women in america? >> well, first of all, you hit the most important point already it was her personal courage over 30 years from the time of diagnosis and then a late recurrence. women out there should know it can come back it usually doesn't come back that many years later but it can come back later. it's an issue of vigilance and keeping on it. she also by the way started her own cancer research and wellness foundation in mel gowrn, melbou, australia, worldwide. important that she looked at it that way. i'm not only going to fight my own cancer but fight it for others. the key is early detection.

this morning. you know there is breaking news. we start with a fox news alert. republican lawmakers are demanding investigation into the fbi's raid on at mar-a-lago. >> steve: that's right. the guy who owns mar-a-lago, former president donald trump released a campaign style video on truth social calling the united states a nation in decline largely because of the raid. >> ainsley: jacqui heinrich joins us live from the white house with the latest. jacqui, we might learn new information. whatever they found at mar-a-lago, if they found anything at all, right? >> well, we don't have any indication, ainsley right now that that information is forthcoming, but there are certainly many, many questions being posed to the justice department and the fbi about this case. claims that the agency has been weaponized coming a lot of the former president's supporters are being met with the current white house saying they had no idea this probe was coming. a white house official told fox in a statement we did not have notice of the reported action and would refer you to the justice department for any additional information. former president trump calling

much differently. you know, they could have sent a subpoena for these documents that they believe exist at mar-a-lago. i just think that sending 30 fbi agents seems to be a really a misallocation of resources when you have, you know, our nation's cities experiencing violent crime and when you have, you know, a crunch just generally across federal law enforcement to try to handle all of the issues that we have. i think, you know, the other thing that a lot of people are concerned about, including myself, is that continued two tiered system of justice where people like hunter biden, hillary clinton, and others, you know, get away, it appears with, you know, with nothing for consequences for their activities. but donald trump seems to be continually investigated whether it's russian collusion hoax, the two impeachments, january 6th committee, the investigation that's coming out of that from

the fbi. and now this investigation. >> ainsley: now the a.g. and the fbi director. they had to have signed off on this. and i know that you are the former acting attorney general under donald trump. what do you know about that? would they have had to say yes, you can go and do this? go and search his house rather than do the subpoena? >> well, there is two different things that could have happened. they could have, you know, had this working part of the investigation and gone to them late and said this is going to happen tomorrow, that, you know, what happened in the case when i was acting attorney general roger stone given late notice, wasn't told about the specifics of the tactics or techniques that were going to be used. but, you know, in this case, i'm guessing that both chris wray and merrick garland were intimately involved and not only approving this case being, you know, progressing as it did, but also approving the execution of a search warrant instead of other means to obtain this same information. and i just think it looks, to

me, like a very much an intentional shot across the bough to try to, you know, sort of make donald trump look like he is under investigation for something more serious than this actually is. because, steve was mentioning earlier, ainsley. that the presidential records act is not as clear cut as maybe some people on the left would like to suggest. you know, the records that they were looking at or things like, you know, a fox news alert kim jong un i read or, you know, other types of artifacts from his presidency, and this do have easily been negotiated or otherwise requested by a subpoena. >> lawrence: matt, this goes to the question of why. and the political aspects of the fbi. we know, you had early on michael sussmann going over to the fbi just to help them out. we know the inner workings of mccabe and lisa strzok and

page. we just had the fbi director testify before congress and say that he is concerned with some of the revelations with the hunter biden probe. as well as having one of his agents maybe being convoluted within that. now you have mccarthy, the minority leader saying this. he said i have seen enough. the department of justice has reached intolerable state of weaponized politicization when republicans take back the house we will conduct immediate oversight of this department follow the facts, and leave no stone unturned. attorney general garland preserve your documents and clear your calendar. so, are the big question is this. what can the republicans do when they get power back? you have been in office before, they are scheduled to win the house. we know the presidency will still be joe biden's. what can they do there? >> well, it's a good point. don't forget, lawrence, that there is at least a dozen whistleblowers that have come to

chuck grassley and jim jordan and pointed out the politicization of the fbi and how they were putting their thumb on the scale. for example, of the hunter biden investigation. suggesting that it was russian disinformation that was the laptop and not, you know, hunter biden's records recording his illegal activities. with that being said, you know, i was the first person in the trump administration after the democrats retook the house to go up to an oversight hearing, if you remember, lawrence, what that was like, it was an salutee zoo. i would expect jim jordan who will be the judiciary chair to run a thorough oversight hearing of all of these people. whether it's director wray, merrick garland the deputy attorney general. whoever needs to come up there and answer these questions as to how does this happen? why did it happen and to demand answers and to not be satisfied until they get. >> lawrence: matt, the big question is republicans had control for two years. they knew what was happening at

the fbi. we knew about the fisa court yet pretty much all the republicans voted to give the fisa court back their authority again after they know that they lied to a federal judge, thiessen judge asked questions about that. why should republicans be trusted now to do something about it when they had control they did nothing about the fisa court. they did nothing about the fbi. they did nothing about the department of justice. >> yeah. well there was -- that two years went by very quickly in '17 and about 18 and oversight was distracted to say the least. and i'm sure that those that were there would suggest that they didn't have the appropriate people that could do this type of work. although i think john ratcliffe and others were fairly effective. but, you are right. i think there are some improvements, now on the fisa court, i think that is an important tool necessary but, you know, the fbi's abuses did call into question whether, you

know, they could appropriately run it because there is, remember in the fisa court there is no opposing side. kind of like the january 6th committee and we see what a disaster that is right now. >> steve: so the republicans are going to run on this. >> talk about the raid. trump's political team sent out fundraising solicitations about the search late last night. meanwhile, matthew, as you know, it's not the fbi just saying hey, let's all get a bunch of squad cars and go over to mar-a-lago and see what we can find in the safe. they -- the doj, in concert with the fbi, had to present evidence at a probable cause hearing with a judge. and the judge had to look at the stuff. so for it to be at this historic level, i mean, there has never been a raid at the honestly of a former president ever. so the fbi and the doj must have known exactly what they were looking for and you wonder whether or not somebody from,

perhaps trump's inner circle or somebody else flipped and now is cooperating with federal law enforcement and said okay, you need to go here and look for this because i saw it with my own two eyes or something like that. >> >> yeah, steve. while we don't know exactly what the fbi was looking for. all indications and stories coming out of this presidential records that were covered under the presidential records act or a mishandling of confidential information. you know, it just seems to me as i know how these cases work that this was a very grave situation and a very heavy handed tactic that could have otherwise been handled less publicly and more discreetly to get these documents that allegedly work. and you are right. an affidavit would have been sworn out, would have alleged, you know, that crimes had been committed and that there is evidence at mar-a-lago that would support, you know, proving those crimes. i just, you know, i think this

a well-work life balance for our teachers. it gives our teaches an opportunity to plan on those fridays. we will be bringing in teachers one friday a month to do lesson planning together and collaborating together. right now teachers work about 60 hours a week. this is giving them extra time with their families but also they will be better prepared in the classroom. >> ainsley: all right. and, john, how about you? what are you all doing? what about last year? didn't you have to go into some of your classes and substitute teach? >> yes. i worked in several classrooms and several different positions. i did some teaching. i worked as a substitute paraprofessional in special education setting. i think it's really important that all of us roll up our sleeves as much as we need to to make sure that we have the supports for our students. we aren't changing our schedule. we realize we have some significant unfinished learning and social emotional needs for our students so we are going with a full school week but we are really working hard behind the scenes to make sure that we have enough high quality staff
