between people who are willing to use the power of the state to silence their opponent, and those who are unwilling. what's the hill this country together since the civil war? it's not that of a federal code, it's not even the bill of rights come as important is. remember, the soviet union had a bill of rights for guaranteed freedom of speech and equal rights. but in practice the bolsheviks sent their dissidents to the gulags. as he boasted, show me the man, i will show you the crime. now what's kept us functioning through the centuries where the bolsheviks failed is that our constitution separated powers and prevented a unit party. we also had an understanding that state power shall not be used for improper political purposes. the law must be enforced equally, without political considerations. and once you lose that common understanding, it's mutually assured destruction.

nobody had any reason to uphold the system, so the system will collapse. the late anthony scalia made this point back in october of 2011, speaking before the senate judiciary committee. it's one of the most important videos you can watch, and here it is. speak of the response i will get, and you will get this from almost any american, including the woman he was talking to at the supermarket, the answer woud be, freedom of speech, freedom of the press, no unreasonable searches and seizures. the marvelous provisions of the bill of rights. what did i tell them? if you think that a bill of rights is what sets us apart, you're crazy. every banana republic in the world has a bill of rights. just words on paper. what our framers would have called a parchment guarantee. and the reason is that the real constitution of the

soviet union, you think of the word "constitution" it doesn't mean a bill, it means structure. say a person has a sound constitution, they have a sound structure. the real constitution of the soviet union, which is what our framers debated that whole summer in philadelphia in 1787, they didn't talk about the bill of rights. that was an afterthought, wasn't it? that constitution of the soviet union did not prevent the centralization of power, in one person or in one party. and when that happens, the game is over, the bill of rights is just what our framers would call a parchment guarantee. >> will: the game is over. a parchment guarantee. most americans now, by the way, in both parties believe we are living in a banana republic that was just described by anthony scalia. 79% of americans believe the justice system defends political

insiders. two-thirds of democrats believe that. the president's son can commit multiple felonies,, corruption and the federal authorities will just ignore it. in fact, they will call them russian this information. a sitting member of congress can share bodily fluids and potentially classified materials, presumably not one in the same, with a chinese spy and no one in the fbi or the m the a will say a word. millions of migrants can illegally cross the border and you are not supposed to notice beer but when the president's home rated for the first time in american history, the very same cable news propagandists will celebrate it as a win for the rule of law. what's in that warrant that authorized to this rate? exactly. and why was a low-level magistrate judge, and obama donor who defended jeffrey epstein's associates, the one who approved of the warrant? they don't care about any of this. they are just happy that donald trump was targeted.

counterintelligence, he authored a handwritten note about his plan to entrap flynn. "what is our goal," he wrote. "truth, submission or get him to lie so we can prosecute him or get him fired. we all know then what happened next. according to a partisan fbi agent name peter strzok, he's not the most impartial of sources, flynn told agent he wasn't sure if he talked about sanctions with the russian ambassador. that's it. now keep in mind talking about sanctions with a foreign country is legal and expected when you are the national security advisor. but for that, the fbi ruined michael flynn. he had to sell his home and where is bill priestap? collecting a government pension. no raid, no jail. the same is true for kevin kleinsmith. remember him? he's the fbi lawyer who falsified a fisa warrant application to secure the wiretap on flynn. he admitted it.

he didn't spend any days in jail, not one day in jail. he wasn't even disbarred from being an attorney. as for jim comey, the fbi director at the time, well, he bragged about the fbi. >> you look at this white house now and it's hard to imagine two fbi agents standing up in the state room. how does that happen? >> i sent them. [laughter] something i probably wouldn't have done or gotten away with in a more organized investigation, more organized administration. i thought as early enough, let's just send a couple guys over. [laughter] and so we placed a call to flynn and said we are sending a couple guys over, hope you will talk to them. he said sure. nobody else was there, they interviewed them in a conference room in the white house situation room and that is what he has now pled guilty to. >> what did he think they were going over there for?

>> i don't think he knew. we didn't tell him. >> will: to them it's comedy. two americans, a banana republic. the classified documents prove the fbi knew the clinton campaign invented many of the russian collusion allegations. they were the pretext for the entire probe. james comey went ahead with that comedy, without banana republic action anyway. that is what we've had for years, and fbi that is interested in really one mission, and that is eliminating levels of the uni party and permanent washington. as with the bolsheviks they used pretext to get what they want. last night's rate of the former president's home had nothing to do with the retention of classified materials. you can handle missing records with a subpoena. you don't come kicking the doors an end blowing open safes. that is why the fed never raided the home of sandy berger who literally shoved classified documents in his socks. or hillary clinton's home, or --

who shared military intel with his lover. no raid bear "the wall street journal" by the way is now claiming the fed had this raid had something to do with cocktail napkins. an notes from kim jong un. right. everyone knows what this was about. finding something, anything they can use to keep donald trump from running for president. now here's the interesting question. why? well, he's a threat to the entrenched, unelected power in washington. the biggest threat ever faced. from the beginning, donald trump is an outsider but not just an outsider, and outside of the declared war on the military-industrial complex. he stopped buying their weapons and sending them to ukraine, so they impeach trap. as axios reported two weeks ago, donald trump planned to get the federal bureaucracy if he is reelected in 2024, taking a butcher knife to the administrative state. that means eliminating career government employees installed

by barack obama. and nothing terrifies a career bureaucrat more than losing their grip on power. look, on the one hand, some politicians in both parties do appear to recognize this threat. florida governor ron desantis for example is calling this raid a sign we are now living in a banana republic. and andrew cuomo, a democrat who is no stranger to open-ended investigations, just called the raid a major threat to the credibility of the fbi appeared on the other hand the republican leader in the senate mitch mcconnell waited 24 hours before he demanded anss from the fbi peer tim scott of south carolina says we need to wait and let the process player. john cornyn sent out a few retweets. kevin mccarthy calling for reforms. really? how do you perform this? this is the fbi director on august 4th. >> do you agree that the allegation of secret collusion between president trump and

russia was a hoax? yes or no? >> i don't think that's the terminology i would use. i think there's a lot written on the subject both in special counsel's report and inspector general's report, so that is not a term i would use. >> okay. do you agree the hunter biden laptop was not russia disinformation? >> now you are asking about an ongoing investigation that i expect our folks to pursue aggressively, and i just can't comment on that. >> and you possess the laptop, right? >> again, i can't discuss an ongoing investigation. >> will: many people like to point out that christopher wray was appointed by trump. christopher wray is a member of permanent washington who doesn't like to discuss anything, including why his agents concocted a plan to kidnap the governor of michigan or how many fbi agents were there on januar. they are permanent fixtures in

washington, as is your national media. andy mccabe is always on cnn these days, peter strzok, john brennan, clapper, regular fixtures on msnbc. so is fbi former counterintelligence officials. watch this revealing moment from last night. lizzie informs msnbc producers that the term "raid" is a little strong. so msnbc change to the chyron in real time to obey his command. >> agents, by the way, don't like the word raid. they don't like it, they feel like it is some kind of extrajudicial nonlegal thing. it's the execution of a search warrant, it's a court authorized search warrant. >> will: the take away here is not that the media is biased, you know that. or that the fbi should prosecute hunter biden or is in the famous words of stephen a. smith, smoking crack! you know that as well. not calling on the fbi to raid eric swalwell even though he has

been sleeping with the chinese spy. what we are saying is if the biden administration doesn't immediately take steps to dismantle this uni party, to stop fbi corruption, to take down permanent washington, to terminate christopher wray and merrick garland for starters, then these kinds of raids will not end. republicans will eventually take power and then they will do the same thing ten times over. they will raid swalwell and garland and hunter biden and that will be just the beginning. and will that be good for the country? probably not. but it will be inevitable. victor davis hanson is senior fellow at the hoover institution and he joins us now. victor, always great to have you at moments like this. why, why has what we watched over the last 24 hours taken place? why have they targeted donald trump? >> they are afraid in the short term but in the long term they believe they are morally superior to america and therefore any means necessary or justifiable for their morally superior ends.

right now we don't have the rule of law in washington. whether you are targeted or exempt depends on your ideology. in the past when there was a dispute over the archives, the presidential papers, barack obama just said i'm not going to turn them over, freedom of information. he spent $30 million resisting efforts to do that. george bush had an executive board and said you know what, i'm not going to do this. and that was adjudicated. and now we go after a president go to his house with 30 agents. in the past when a high official was called for congressional subpoena, eric holder just said, i'm not going and i'm not turning over this fast and furious. the idea that you would put him in shackles or confront him with his family and grabbed his phone is just ridiculous. but this is what we're doing on an ideological basis. when you start to do that, you don't have a democracy anymore. and i don't think we do. the second thing is this januarf

like a french robespierre committee on public safety appeared to be on that committee a unit of one criteria, you have to vote to impeach donald trump. if you were a republican there was one of the qualification, you had to be politically inert, with no future. it was deductive. it started with the premise that we are going to destroy donald trump and then we are going to bring in witnesses and allow narratives to that end. there is no cross-examination, there's no disinterested counsel. we know that when dick cheney himself made a commercial and he bragged about his daughter, that she was the one power that could stop donald trump, but that is not what her job is in that committee. it's to be disinterested, it's to be inductive, it's to find out what happened on january 6th, not start with a boast that you're going to destroy donald trump and make the witnesses and the testimony for that. and finally, i never thought i would say this. the fbi is beyond redemption. all of its bureaus and its

institutions have to be farmed out and broken up. if you have an fbi warranted there is no guarantee that that has not been altered. if you subpoena and you want fbi records on the phone, they will be wiped clean. if you want disinterested legal counsel, look at lisa page and peter strzok. if you are the fbi and you want to find out why hillary clinton hired a foreign national to find dirt on a political opponent then you will hire the same for national. and you look at the last four directors. we just saw christopher wray and he just stonewalled every question and then he flew in an fbi plan, our plan, a luxury jet because he had to go to his own vacation spot. he took over from andrew mccabe, what did he do? lied four times to federal investigators and his wife was running for office with clinton related tax money while he was investigating hillary clinton's email scandal.

he took over about james comey, controversial devices on the media, and then when he was called on 245 occasions he said he didn't know and didn't remember. anyone -- irs and they are going to go to jail. and he took over from robert mueller whose entire special counsel case was based on two premises. the information that was false in the steele dossier and the shenanigans of the clinton hired gps disinformation firm and when he was asked specifically, he said under oath he knew nothing about either entity. this is very ironic because all of this is destroying this country and it comes from the people who warned us democracy dies in darkness and they have descended upon us the greatest cloud of autocracy and liberality in the history of this republic. and we are going to have to do

abilities to target the president personally again, asking for is confidential tax information. taxes from before he was president, texas from one he was president, and tax returns from after he was president. and unfortunately the courts in the district of columbia ratified that abuse, pretended there's no politics here worth worrying about comments of the president's civil rights, practically speaking, get thrown out the window. and again, the courts also need to step up and act to protect the structure of our government that is under attack. the presidency is under attack from within. you have congress trying to blow up our systems of government and the courts have almost been bystanders in large measure, or just rubber-stamping them in the case of the five the warrants in this case, the unprecedented effort to gain our confidential tax information and as we see, the irs getting 80,000 new

employees, obviously trump is the number one target in the rest of us will all have to worry as well. >> will: that is certainly terrifying. i don't know if you are familiar with the comedian schultz but he says he now judges president on their ability to move merchandise. the maga hat being bring an all-time best seller. hillary clinton has decided to enter the fray. she kept emails on a private server at home but was never rated for that. she is now gloating on that and she's going to sell march that reads "but her emails" to mark the occasion. what do you make of this? >> it's consistent with her mockery of the rule of law. remember when she joked about wiping with a cloth when they talked about deleting emails paid this person on the other hand isn't president because of her emails. and she's also out there in many

supervisor and special agent and he joins us now. thank you for being with us. in that montage, you heard a lot about the rule of law over partisan politics. therefore, i should assume there is a raid coming. for eric swalwell and hunter biden. right? >> the rule of law is not a bumper sticker. i know that seems to be applied on everything today because people are gleeful that a person or political figure that they dislike is getting what they believe he has coming to them. the problem is, which you laid out at the top of the show, disparate treatment. start with general flynn, the fact that the logan act was employed. enacted in 1799, never been prosecuted. yet the fbi and doj considered it. they get to play to 1,001. that is lying to an fbi agent. 25 years and the fbi and i tell you this, i pleaded with u.s. attorneys to allow us to charge people for lying to the fbi.

murderers, gang bakers, drug dealers. you've known me sell how many times in 25 years customer at zero. clinton, what a way to handle things. bleached emails that were under subpoena, 35,000 of them disappear. i know they were only related to yoga pants and working on details for her daughter's wedding. but they were under subpoena. and we took her at her word and didn't kick her out of new york. go to call me, the number one law enforcement agent in the land that time. he leaked through surrogate, not even on his own, to "the new york times" memorandums that were fbi property. federal records act, yeah. some were restricted, confidential, secret, could've been top-secret but he took it on his own to do that. that is the problem, the rule of law has to be applied equally, not disparately. >> will: so therefore, you have those three letters next to your name, the fbi is not the

only corrupted federal institution. from the cdc, the nih, the cia, we can look at every american institution and wonder what has gone wrong. but your former institution is the one in the spotlight tonight. what is wrong, james, with the fbi? >> it's a fair statement. pushback on corrupt. with the problems are just the upper echelons. we know the fbi director and the attorney general are political appointees. the vast majority of fbi agents, 12,000, 36,000 employees in total are good, decent people. they are working to follow evidence. it's the people at the top, they've got to go. >> will: i will say this and all optimism, i hope you are right. i do worry about a class of employees perhaps at the higher levels of every federal institution but a class of employees who remain amount of the party in power and whose primary purpose is for

good evening, thank you for being with us. what have you learned? >> pleasure, will. eyewitnesses and people close to the former president from legal sources. we've pieced together what happened in this raid and it's quite shocking. over 30 fbi agents from the washington field office who arrived unannounced at 9:00 a.m. terms lawyers, who were local lawyers, were not there. they didn't arrive for another hour, so these fbi agents, about three doj attorneys managed to get inside by showing their search warrant, we believe to the secret service agents outside. once inside this property, they had access to everything. to the trump's private quarters,

which includes the side bedroom and living rooms and dining rooms and so on, and they also had access to a separate part of the building in which donald trump's office was. plus they went down, we are told, to some basement storage room which had been locked, where these 15 boxes of presidential documents had been held since the general services administration had packed them up after trump's presidency in january, mid-january pretty much of 2020, and ship them to mar-a-lago where they've been kept under lock and key. in fact, in june, trump's attorneys, two of trump's attorneys actually helped the fbi, give them full access to their room, those documents, those boxes and they spent several hours than looking through them. donald trump was there at mar-a-lago at the time, in june, and he stopped by the basement and said hello to the agents.

but now of course the trumps, administered in new jersey, so mar-a-lago is closed up for the summer. it was only a skeleton staff including groundskeepers. it was a boiling hot day yesterday in palm beach, 91 degrees. and yet the fbi agents and the doj attorneys would not let donald trump's lawyers shelter inside come out of the sun, in the air-conditioned lobby. there were not allowed to observe any parts of this search that went on for nine -- sorry, yeah, about nine hours. over nine hours. from about 9:00 a.m. until about 6:30 p.m. and the demeanor of these doj attorneys was, i'm told, arrogant. and they continually repeated that we have access to everything and everywhere. we are told they went into every

single room and eric trump has said that they ransacked closets. we are told melania trump's closet, also donald trump's closet office. they spend hours in there. they brought a safe cracker to open his safe, and just rifled through material. someone who has seen the warrant that they brought said it confined itself to presidential records and classified information. so they were told that those boxes were in that storage room, they'd already seen it. only makes it more specific that there was not a fishing expedition. >> will: except obviously you can hide classified documents in the winter coast of the first lady buried deep in the

large out-of-state corporations have set their sights on california. they've written prop 27, to allow online sports betting. they tell us it will fund programs for the homeless. but read prop 27's fine print. 90% of profits go to out-of-state corporations, leaving almost nothing for the homeless. no real jobs are created here. but the promise between our state and our sovereign tribes would be broken forever. these out-of-state corporations don't care about california. but we do. stand with us.
