against political opponents? >> the president believe in the rules of law and the independence of the department of justice. >> yes or no. >> it is a no for you. i'm answering the question. you may not like it but i'm answering the question. >> bill: or you could just say no. here is what we think we know at the hour. the search was related to a dispute with the national archives over the handling of presidential records is what has been reported. president trump left the white house with thoeps documents in january of 2021. later that year, the national archives contacted the president's team about potential classified information that was missing. >> dana: fast forward to january. the president voluntary gave more than a dozen boxes. in june d.o.j. visited mar-a-lago to get the transfer of more materials. >> bill: that's where things start to get murky. the talks broke down over the

summer, sometime in june or july. the president disputes that however. federal officials viewed the president's team as uncooperative. sometime this month, prosecutors submitted an affidavit and a judge signed a search warrant. the rest as we know at the moment is history for now. >> dana: team fox coverage and reaction from senator tim scott. the justice department, david spunt is there to catch us up on everything going on. >> i'm at the epicenter of this investigation. things are quiet here for day two since the search of the former president's home. attorney general merrick garland remains silent. he will not be talking about this. it the standard that the attorney general or other d.o.j. officials don't talk about an open investigation. however, as we know. things are different in this case. extraordinary circumstances. speaking of attorney general merrick garland and f.b.i. director christopher wray, we can confirm there are growing concerns about garland's safety

and wray's safety. authorities are monitoring social media posts and spotting a significant increase in death threats aimed toward agents, wray and garland. they continue at a steady pace online. security procedures aren't made public. they traveled with armed security. fox is told there are discussions to increase their security. the f.b.i. gave a heads-up to the secret service and a few local law enforcement officials to let them know monday morning they would be entering mar-a-lago to enter and had a search warrant. there is growing public and political pressure to release that. one of the former president's attorneys said after a back and forth negotiation. she was there on the ground, the trump legal team was able to get ahold of a copy of the search warrant. they could release it to the public. what is said on the document. doesn't include all the details but give us an idea of some of the contents of the copy of

that search warrant. we're told from the trump team to fox news as of now they do not plan to release anything to the public and they believe the burden is on d.o.j. to do so. >> dana: we're hearing the f.b.i. seized a cell phone of a republican congressman. walked up to him and took it? >> this is scott perry, republican from pennsylvania. he is an ally of the former president. perry believes this is involving the january 6 investigation and the former president's attempts to overturn the 2020 election. we know according to the representative from pennsylvania, the republican from pennsylvania, the three f.b.i. agents came up and seized his cell phone. they didn't even reach out to his attorneys in this case. right now we know his cell phone is in f.b.i. custody, dana. >> dana: david spunt at the justice department. >> bill: joining us now is the the author of a book america redemption story, the author is south carolina senator tim scott. sir, thank you for your time and good morning to you.

>> good morning. >> bill: i was struck by your comment you said i think anyone who suggests they have a clue what is actually happening is heading in the wrong direction. so what is your clue as to what is happening in florida? >> i think this is a shocking and unprecedented development as relates to mar-a-lago and the raid the other day, two days ago. i can't imagine this is just over presidential records act. when you read through it all, it seems to me that perhaps there is politics embedded in every layer of it. very concerning. one of the things that we hope for from f.b.i., one of the premier law enforcement agencies in the country, is an apolitical approach and what we've seen over the last several years is a political nature within the f.b.i. and the weaponizing of justice. if they can do that to the former president of the united states, what hope is there for the average person? you just talked about scott

perry's cell phone. for the average person, republican or democrat, we should be very concerned about the developments that we're seeing today. >> dana: this is on a slightly different topic but also about americans feeling like wow, okay, the administration has decided we are the ones that will be the targets of new i.r.s. audits. listen to an exchange between peter doocy and careen jean pierre, one of the ways they would get there and i want to talk about you on the other side of the quote because you are a small businessman and you know what it's like. watch here. >> do you think it is popular when the 87,000 new employees hired by the i.r.s. go around and start auditing people to pay for the inflation reduction act? >> inth is focused on those who are, you know, corporate, wealthy tax cheats that republicans, congressional republicans wanted to defend.

>> no new audits on anybody making under $400,000 a year? >> dana: no, very clear. >> that's ridiculous. >> dana: i don't know if you've been audited. you are a small business person and represent a lot of them. what do you think about this? >> one of the things that is important in this case, the cbo says 90% of the revenue generated from the new i.r.s. agents will come from people making less than $200,000. that is absolutely the exact opposite of what you just heard. under $200,000 represents 90% of the revenue generated. the revenue generated is around $300 plus billion dollars. as a former small business owner the one thing i can't do is be the human resource department, my own legal department and sell whatever it is i'm trying to sell. this is a burden that is head winds for job growth and reinvesting in your small business. i can't think of something less

popular than the three letters i.r.s. showing up in your mailbox. ridiculous. >> bill: she talked about corporate wealthy tax cheats. there have been questions about who will be audited and who will not be. they can't answer the question if you make less than $400,000 a year are you safe from this audit? how long will it take to hire 87,000 agents? >> well, it makes the i.r.s. bigger than the pentagon, the state department, the cbp, all combined together plus the f.b.i. so there is no good news coming to any american family as you fear the i.r.s. already. >> dana: senator, i read your book america a redemption story. i loved it. today you can hear more about that on the radio as well. you talk a lot about polarization. you are concerned. we're 36 hours since the

justice department made the call saying yes, you can go ahead and raid a former president's house. how does that square with what you are trying to communicate in this new book, because half the people voted for president trump and they are feeling like the justice department is against them as well. >> it is not creating unity. my book says is the importance of a fair justice system applied to every single personal equally. growing up in the deep south in the 80s my experience is interesting around race and justice. how things have changed and evolved. we aren't perfect. we still have work to do but we're getting closer. this is actually a step back when you look at the raid. you ask yourself if i was the president of the united states, would i expect 30 f.b.i. agents

to show up for a dispute over a presidential records that we've been negotiating since june? actually since february. the answer is of course not. if you ask yourself is this the treatment we've seen for hillary clinton as relates to classified emails, of course not. if you read by book you will be more hopeful about what can happen when good people of good conscience have the backbone and the tenacity to enforce the laws on everyone the same. no exceptions. >> bill: congratulations on the book. it's a good read. a lot of good anecdotes from you as a younger man and i was struck by the relationship you had with your father and how you were able to just patch everything up over time. congratulations, senator. >> dana: for more with senator tim scott check out my interview on the fox news rundown podcast. we talk more about the new book and cover a lot more including his ambitions in the future.

pens's endorsement. michels beat her by five points. he will face off against tony evers. further west we've got a final in this race in the third district in washington jamie beutler has conceded to joe kent. why is this important? kent endorsed by donald trump came back to beat her narrowly but able to pull off a victory in the state of washington which means right now if you look at the 10 republicans who voted for impeachment on the screen here, do we have it? okay, two are still alive, dana. at least four retired, a couple have been defeated now in the primary battles. but there are two that are still alive, liz cheney will have her primary on august 16th.

polling indicates in wyoming she could go down to defeat. we're watching that. that is a run down. >> dana: big decisions going on. i want to point this out to the main story of the day. the "wall street journal" editorial board talks about the raid and says the f.b.i.'s dangerous trump search merrick garland is taking the u.s. down a perilous path and went on to say didn't someone at justice point out that a search in this case would draw comparisons to hillary clinton's mishandling of information before her 2016 campaign? she was never prosecuted. unless mr. trump's offense involved a serious risk to national security half of america may see the trump search as an example of unequal justice. >> bill: when this news broke, andrew cuomo, who resigned his governor spot here in new york,

southern california police arresting a dermatologist after her husband accused her of trying to poison him. he says he caught her on a nanny kam in the kitchen spiking his lemonade with drano. what's up, william la jeunesse? >> one thing to consider, this is a divorce case. but what you say is accurate. husband, who is also a doctor, alleges his wife, emily, tried to poison him. she denies it and says it is about getting custody of their children in this divorce. having said that what you are about to see looks damning. there are images filed with the court taken on three separate occasions where his wife appears to grab a bottle of drano from under the sink and pour it into his cup. he claims he noticed a chemical taste and had stomach pain. a doctor diagnosed him with

stomach ulcers. drano is a mix of bleach and soda that will burn through hair, skin and muscle. he thought his wife was trying to kill him. in the video taken three times he claims she pours the drano in his cup. in a statement to fox news, the wife denies ever attempting to poison her husband or anyone else. so according to records, chan is 53, radiologist. emily a dermatologist. married 10 years, two kids. $3 million house in orange county. he said he feared being in the same home. he obtained a restraining order and filed for divorce. after her arrest for poisoning, who did she call to bail her out? her husband and he refused. she did post a $30,000 bail and the court date is set for later this year. >> bill: on it rolls.

william la jeunesse with that. >> dana: let's bring in attorney brian claypool. this is extremely serious. important to point out it is a domestic case, a divorce. but when you have something like this that's an accusation, you have photographic evidence in a divorce case, what happens? >> great to see you this morning. there is something bizarre about this case. what i mean by that, i this i the orange county district attorney is still trying to clean out that drain within their own office before they actually bring charges. that's what i mean here. she is arrested, right? but she has not yet been formally charged and her bail, dana, is set at $30,000? if this is an attempted murder, her bail would be a half million or a million dollars. so i think authorities are

still trying to figure out what happened here. i am not defending her but it seems a little strange that she would just repeatedly pour drano into his lemonade. he is not more sick than he is. did he have a blood test done? wouldn't a blood test really get to the bottom of what was in his system? and again like williams said these two are fighting so there is motive on the husband's part to bring this issue up. >> dana: the foxnews.com piece he claimed his wife and mother-in-law verbally and emotionally abused him for years and be littleed the children and isolated them from their cousins and friends. a lot to figure out there. hopefully it will turn out well. another case we're following the father in texas accused of murdering his two daughters because they went outside the muslim religion dating non-muslims. the mother and the daughters

had fled the state. they had returned. he said everything would be okay. let's go out to dinner and he shot them. he was sentenced yesterday. a little bit from that yesterday. >> mr. said, you are a devil. you murdered your girls. i am going to say this, i hope somebody gets their hands on you. nine bullets you put in sarah and she called 911, your other daughter two bullets in the heart. >> the ex-wife after he was con viktd. he will serve life in prison. >> two things about the case that resonate with me. this guy was on the run for years, right, six years? he was found, what, 35 miles from where this happened? the f.b.i. was involved? they just sent 50 agents down

to mar-a-lago to raid president trump's camp yet they can't find this guy? i think we have again a bigger problem with the f.b.i. and where their focus and resources should be. we have a child murderers and predators on the street and we can't find them yet you will attack a former president? the other issue that hits me here, dana, i actually work on quite a few department of children and family services cases and there were red flags in this case. one girl told a teacher saying she thought her father would kill her and she and her sister feared for their life. a systemic failure. why didn't the school as mandated reporters contact authorities and have this father investigated? so i really think at the end of the day he goes to jail for life, but i think this can be a teachable moment. we have to take a look at why

the opening bell on wall street now. the dow jones is way up, 448 points. consumers are reacting. prices are up 8.5% from last year, down a bit from june's record surge. but still high enough to wipe out any wage gains. with the economy in recession, president biden is getting ready to head out of town on vacation. griff jenkins at the white house for us. >> good morning. you know this all too well. they might be getting together right now to consider delaying that vacation to let the president advocate for his agenda after a string of positive developments. this latest one, a slight decrease, inflation at 8.5%, down from 9.1%. but put that in perspective. a far car from the 1.4% when he took office. the latest numbers show wage gains that stand at 5.2% year-over-year are being wiped out by inflation.

this comes on the heels of a string of major legislative victories, first the chips bill. now in just about half an hour president biden will sign the pac act expanding access and benefits for veterans exposed to toxic burn pits. it is not translating to momentum. bernie sanders becoming a latest democrat unwilling to commit. >> do you want to see him run for reelection? >> look, right now my concern is electing more democrats in this mid-term election. >> sanders joining a list of at least a half dozen other democrats including joe manchin and aoc who won't back biden yet. two names previously in the no column with backtracking. they are offering words of support after being non-committal in the debate. we're waiting for a statement from the president on the latest inflation numbers and bring them to you as soon as we

get them. as you mentioned, the president planning to head out to south carolina. maybe some r & r will give him time to get over the lingering cough. >> bill: let's dig deeper. larry kudlow is with us now. check him out on fox business at 4:00 every afternoon. here is overall in july down to 8.5% with 9.1 in the month of june. it would appear to be good news, right? core stayed the same at 5.9. core excludes food and energy. that is a lot. so we'll bring in the white house next hour and probably argue that inflation has peaked perhaps. if they make that argument what would you say, larry? >> well, actually, inflation may have peaked. i underscore the word may. we just legislated a barrel

full of government spending between the chips plus bill, which is close to $300 billion and this manchin/schumer bill that is $750 billion. so maybe that federal spending will take affect in three or four months and raise the inflation rate but right now you can say the numbers have peaked but we have a long ways to go. look at, if you look at three-month changes, which is an important trend line, you are still seeing some pretty rough numbers. core inflation is 9 -- core inflation is close to 7% and the overall inflation rate the top line is 9 1/2%. you had rents and shelter going way up, food going way up. new cars up. used cars down and energy, gasoline at the pump is down. that was a very important swing factor. i want to also note, bill hemmer, one more thing.

yesterday we got a very difficult number on overall wages and productivity which is essential to the economy. so wages up nearly 7%. business prices up nearly 8%. and productivity down 2 1/2%. so i don't have any problem with the workforce making more money even though the wage rate is below the inflation rate. so they are working harder but getting less. i do have a problem with the productivity collapse. that is central to the economy. so all these numbers, i think, are still recessionary. we have a long ways to go honestly. a long ways to go. >> bill: put it on screen. the spike is trending lower.4.01 a gallon but the demand for gas is dropping which explains a lot of why we're down 50 days in a row now. i heard you the other day call

this recent bill pathetic. >> yeah. it's pathetic absolutely. >> bill: more power to the e.p.a. and the i.r.s.. will that help growth? is that going to help inflation, larry? >> no. absolutely not. i mean, this bill was a central planner's regulators' paradise. this is all about big government and big government socialism. there is nothing in here to cut inflation. there is nothing in here to grow the economy out of recession. there is nothing in here to incentivize entrepreneurs. this is not a bill that will help working folks. it will not help small businesses. it will not help large businesses. it will not help young entrepreneurs. it helps government bureaucrats, okay?

millions of veterans who are exposed to toxic substances during their military services. you know, secretary mcdonagh can tell you i was going to get this done come hell or high water. it was one of the first things when i -- staff knows that is true. as part of my agenda i announced in the state of the union address, i announced four things that all americans can agree on. one was beating the opioid epidemic, two was tackling the mental health crisis we face as a nation as a consequence of the pandemic, three was ending cancer as we know it which we are going to do come hell or high water again. and three, supporting our veterans. big issues that unite us. we are always being told democrats and republicans can't work together. when i ran i said one of the reasons i was running was to unite the country and i was roundly criticized for being naive. that was the old days. used to be able to do that.

cancer. my son, beau was one of them. his son is son. and others, the commander of the national guard when beau was there. i want to thank them for being here as well. to us and to many of you in the room, if not all of you, it's personal, personal for so many people like danielle and others. a 39-year-old, and they held his hand for the last time at age 39. this is the least we can do for the countless men and women. many of whom may be in this room who suffered toxic exposure while serving their country. it expands access to health care and disability benefits for veterans harmed by toxic ex closure and move quickly to determine the illness and relate i had military service

to see if they qualify and families of veterans who died of veterans from toxic exposure $2,000 a month with surviving spouse for two children and access to life insurance, home loan insurance, tuition benefits and help with healthcare. it means new facilities, improved care, more research and increased hiring and retention of healthcare workers treating veterans. this new law matters a lot. it matters a great deal because these conditions have already taken such a toll on so many veterans and their families. i have directed the department of veterans affairs to treat all 23 presumptive conditions as this law as applicable the moment i sign this bill. i'm urging veterans of those decades of war to promptly file for your claims. the v.a. will move as quickly as possible to resolve your claim and get you the benefits and care you've earned. now i want every member, every

this is the first month in over a year that inflation did not go up, held down by an 8% decline in the price of a retail gas. by the way it wasn't the only component that fell. airfares, hotels, motels, apparel. cpi components had a negative handle. shelter ticked up but less than the previous month. in fact, about a month ago we were talking about a 1.3% incoos in inflation. compare that to zero today. if you attach that to the growth of pay in july from that great jobs report we were talking about a few days ago, we see the first real increase in monthly wages that we've seen in well over a year. half a percent up in real terms over the month of july. so a great report following a great jobs report and a bit of much-needed breathing room. no victory lap as you pointed

out. there are still a lot of areas. >> bill: they reflect demand in the economy and consumer. >> dana: what do you attribute this to? do you think your work is done and just say what happened going forward because people as they get ready for back to school, all those prices are still way up over what they were. >> great question. our work here is far from done. i cannot underscore that enough. the president will continue to talk about unacceptably high inflation. however, we have to look at the fingerprints of some of his initiatives as you requested on what is going on here. one of the most important declines in this report is the fall in the price of ga.s it is now about $1 off its peak in mid june. down 20%. many factors going. the release of oil from the strategic reserves is one of them.

i.r.s. to facilitate tax evasion by wealthy evaders. here is what the commissioner said. these i.r.s. resources are not about increasing audit scrutiny on small businesses or middle income americans as we have been planning. he is the commissioner and he knows what they are planning. our investment is designed around treasury's directive that audit rates won't rise for households making under $400,000. in other words, i.r.a. resources won't add to audits for households under $400,000 and those same households won't see one penny increase in their taxes based on proposals in the inflation reduction act. let's just make sure the record is clear on that point. >> dana: there are many other institutions that have said otherwise including the congressional budget office considered nonpartisan. let me ask you this. what people are feeling as a personal reaction to the possibility of the doubling of your chances of being audited.

in a typical scenario having followed him all these years he would be out there talking and doing interviews. there is a little bit of a quiet moment going on here and there are a lot of things not filled in yet. i think this goes one way or the other. either they have something very specific that they went in there for, which is in the affidavit, which has not been revealed. it is not necessarily in the warrant. the warrant can be more general and the warrant has been given to conduct this search. the affidavit has the much more detailed information what they are seeng in here and why they were given this right to go in based on the judge's decision that it was -- there is some sort of criminal connection. if they don't have that, this is the biggest political d.o.j. blunder potentially in the history of politics. it will be so empowering. i read a quote this morning from a reader who sent in to a
