merrick garland deserves the american public some answers to -- americans are -- they care deeply about fairness. they have a strong moral character. and they find repub nant thuggish authoritarianism and this smacks of it. >> ainsley: they hate uneven justice. >> yes. >> ainsley: what do you make about this magistrate judge not a federal judge appointed by a president or congress. >> right. you know, it does trouble me. we don't have all of the facts. and, you know, the warrant and affidavits are sealed but if you look at the document, there's no identification of a regular federal district court judge, just a magistrate who signed on to this. that troubles me. magistrates are, as you point out not presidential appointments approved by congress. they are simply hired by the district court who do the menial grunt work. >> ainsley: like what? >> minor dispute, bail hearings.

misdemeanors, i mean, they do everything except unclog the toilets and empty the trash cans. i don't think they are qualified really and can be easily fooled by a bunch of guys from the fbi in suits flashing badges please sign here. that worries me. that may not be the case, but it kind of looks like it. >> ainsley: why would the cia go to someone low level? >> because it's easy. because they can be snookered. you know, magistrates do sign off on it but normally a federal judge, district court judge is involved with oversight, especially in something this important. now, i do believe that this dispute with the national archives simply a pretext to go in there, grab everything, and an investigation in search of a crime, which is wrong. >> steve: right. we should know soon because apparently that magistrate gave the department of justice until monday to start revealing stuff. so, we will stay tuned.

actual number is inflation was 8.5% year-over-year. so, in other words, you are spending 8.5% more in this july than you did last july. so for the white house to say, you know, it was zero. that's just a statistic, folks. the truth is it's up. >> ainsley: rent went up 6.3% year over year. food costs surging 10.9% increase year over year. look at the price for a lot of this food that we all love eggs look how much they are up 38%. margarine, flower flour mixes. fresh and frozen chicken parts. lunch meat, cereal products. >> paying 100 bucks more than a year ago. the president would be wise to say inflation dropped slightly i like the way it's trending because it's too high just under

even many of the democrats down here don't like the situation and they are fed up with what's going on. >> steve: yeah, sure. you know, i was past the port authority yesterday when some of these buses were coming in. and there was a lot of news presence because people were taking the pictures of the migrants arriving in new york city. with the exception of fox, there are not many cameras on our southern border watching the thousands of migrants stream in. you know, so far, texas has bused in a couple of dozen different migrants. but each and every day in texas and also in new mexico and arizona, you know, 5,000 people come across. so for this fiscal year, steve, in a state of texas alone, border patrol has encountered 1 million, 155,000 illegal aliens. that's the numbers they gave me yesterday. that's over 115,000 a month in

the state of texas. so, if new york wants to complain about a few thousand, well, it's going to fall on deaf ears because no one is going to care. if he wants to see what a problem is, come down. he wants to go door-to-door whether brownsville or mcallen he is going to find those folks are going to tell him to pack up and head back to, no. we are under invasion here in texas. we are being overwhelmed. the people in washington, d.c. and new york, they have no clue what's going on. people need to wake up and see what's hang. the cartels are taken over large areas down here and a lot of people that have ranches have had to move to town because it's no longer safe for them to be on their own property. >> steve: rather, sheriff, than talk about migration into the united states, what these democrats in new york city and washington, d.c. are doing, rather than talking -- addressing migration into the u.s., they are talking about oh, that bad republican guy down in texas, he is screwing everything
