the fbi. citing substantial public interest. the doj is keeping the affidavit under wraps, and that is a key document. it would give more details on the justification for the unprecedented and very controversial search. >> sandra: some are wondering if all of this trouble was even necessary because donald trump was issued a subpoena for documents back in june. the cover of "the new york post" this morning blaring "you could have just asked!" and denying a report that the feds were searching for a classified nuclear document. shannon bream and andy mccarthy are on deck with analysis, but we begin life at the justice department for the latest. hi, david. >> the question is what happened between when subpoena was issued. essentially calling the former presence plus, turning the tables, saying fine, we have no

problem with releasing the content of the search warrant to the public. how do you feel about it? well, the former president said let's go ahead and do it. i want to redo you something that he posted on his social media platform, truth social. he said "not only will i not opposed the release of documents related to the un-american unwarranted unnecessary raid and break-in of my home in mar-a-lago, i'm going a step further by encouraging the immediate release of those documents." sandra, dana, an unusual move to seat an attorney general talk about an ongoing case, but this is an unusual circumstance involving the former president. >> first, i personally approved seeking a search warrant in this matter. second, the department does not take such a decision lightly. where possible, standard practice to seek less intrusive means as an alternative to a search and to narrowly scope any

search that is undertaken. >> garland said he decided to come out publicly and speak about the case in front of millions because of the public interest. he was under intense pressure to say something, and to his credit, he did. >> all americans are entitled to the evenhanded application of the law, the due process of the law, and to the presumption of innocence. much of our work is by necessity conducted out of the public eye. >> fox news has learned that trump's office was served a subpoena in early june when the fbi team visited mar-a-lago. they tour the area where some of them were stored and then briefly took custody of a small amount of potentially sensitive material. sources also say that all investigators have spoken with at least one person who relayed the possibility of more sensitive national security material in that storage room

and other areas of the property. 3:00 p.m. is the big deadline today. eastern time. that is when the trump team needs to respond. ultimately it is up to judge bruce reinhardt. this is a blank search warrant. this is what we are going to see it. of course it will be filled in a little bit later today. it says inventory of the property taken. name of any person seized. of course, nobody was seized, but a lot of property was taken, so we will see what exactly was taken from mar-a-lago when the judge decides to unseal that. >> sandra: thank you. let's bring in our new fox news sunday anchor. congratulations to you, shannon. and former assistant u.s. attorney. shannon, let's start with you. the search warrant, it is still going to be pretty unsatisfying for people who want details. is that correct? >> you're exactly right, dana. it is going to be very basic

allocation of what they could search, look for, what statutes would be involved, and even the itemization list could be something rather generic or detailed. we will have to see if we get our hands on it, but as a former president said last night, he actually encourages it. we got that just before he went on the air. and my first question was why hasn't the president released what they have? it is the underlying stuff, like outs of the operation, the really juicy stuff, that neither the president nor the doj is asking to release at this point, but they are private entities, including groups like "the new york times" you say they want to see all of it. >> dana: there is more about the former president could be putting out there for the public to see right now, right? >> of course there is. to hear him say that he is demanding, you know, and encouraging the release of the documents when he has had the document since monday. he could put them out now.

he does not have to wait until 3:00, so for the reasons that shannon alludes to, i think this is going to be unsatisfying for people. and this is part of the downside i think for attorney general's before speaking yesterday. if he does not say anything, you assume that he is just refuting by silence whatever trump is saying publicly, but once he speaks, he should address the thing that people are curious about, which is why was this necessary at this point? and he really did not do that, so president trump is basically out there saying we were cooperating. we met with them in june. i don't know what happened between june and now that i'm in this necessary, and he's the only one putting a story out there. garland did not do anything yesterday to address was president trump uncooperative? did he flout the subpoena? did something happen that made them believe there was some kind of emerging situation that did not exist in january or june,

and suddenly now they had to do this? so i think if he speaks, he should address the thing that people actually curious about. >> dana: shannon, could you speak to "the washington post" saying that apparently the fbi was looking for documents that are classified that have to do with nuclear materials. it did not say weapons necessarily. did not say what that would be, what those documents would be, if they exist, if they were actually found. president trump this morning's saying that this is not accurate. what do you make of all of that? >> well, listen to your good reporting team who put this together over at "the washington post." they are well sourced, so we would imagine they have done some kind of information from inside which is interesting because we really did not get anything from the attorney general yesterday. brief statement. but the more that the attorney general does not speak to details like that, it leaves us guessing with plenty of room

for speculation about exactly what the documents were that they were looking for or that they allegedly obtained. again, filling in the story for the former president who is not afraid to come out and speak and talk about these things, issue statements, so he's going to be the one controlling the narrative until we get more. i mentioned that there are private entities trying to get you this. the real information. the judge has given the government until 5:00 on monday to respond to those requests for really what we would call "the whole enchilada." we will see whether the judge takes the interesting stuff of saying that i will give you more of what you want to see. >> dana: your thoughts on "the washington post" reported that among the classified documents they were searching for relating to nuclear weapons, what did you make of it when you sign? >> well, i'm curious about who their sources are because i thought the article they

resorted as carefully couched who they were talking to. it did not even indicate that these were people actually involved in the investigation. there's a lot of speculation about not only is it nuclear? or somebody else's nuclear stuff. and it just seems to me that the word "classified" is being thrown around very cavalierly. you are dealing with the one official in government who, when he was president, have the power to declassify anything. now i think it would be embarrassing for president trump if he declassified subs that he should not have so that he could keep it in my to have a mar-a-lago if that is what happened, but there is a difference between embarrassing and illegal. and all the stuff about the presidential records act, it is not a criminal statute. so the crime has to be classified information here. there is no indication about whether trump actually

declassify the stuff that he has been holding down there. >> dana: a lot of developments. shannon bream and andy mccarthy, thank you. good to have you with us today. also this in "the wall street journal," sandra. the headline is "merrick garland, mar-a-lago." "attorney general's before has broken a political norm that has stood for 232 years. he had better have enough evidence to justify it in the end, or he will have unleashed political forces, and illegal president the democrats as much as donald trump may come to regret." that is why we have the seriousness of the situation and people really paying attention to it. >> sandra: all eyes are on this in the country right now. the world is watching as well. the rate of a former u.s. presidents home, and people want answers. we will see where the day takes us. yesterday afternoon, police in ohio where in a standoff with an

armed suspect accused of trying to breach the fbi cincinnati office. that suspect fled 60 miles north to a field in wilmington, ohio, we are told, and after more than six hours, police moved in and killed them. >> the suspect -- as those negotiations went on, officers try to move in. took him into custody. shots were fired. >> sandra: police have the suspect was likely motivated by the radon former president trump florida home. shortly after the surge became public, his account on trumps truth social media platform reportedly posted calls to respond. all right, well, americans are fed up, and according to a new format, that is according to a new fox news poll mic that finds

they say the economy is excellent or good. very slightly up from last month, but it is way under water compared to 81% who say it is only fair or poor. 10% say their personal financial situation is excellent beer that is a number that has been steadily declining since last year. what does it all mean? does it mean that this is a really toxic environment for democrats ahead of the midterms? maybe, maybe not. now tied 41-41. republicans had a seven-point advantage in this poll in may, but it has slipped away. sandra. >> sandra: what did you say through the jackhammer and? on the crisis showing agents in san diego seizing more of the deadly drug than at any other port of entry. that makes a busy san diego crossing the epicenter for fentanyl trafficking. live on the border in texas for us. >> sandra, good morning to you. i will get into those new fentanyl numbers in just a moment because they are startling. we want to show you a group of about 200 migrants who just crossed illegally here into eagle pass where we are moments ago. we see this like clockwork every single morning out here. these large single groups will cross, and they are predominantly single adults, now waiting for border patrol transport out of the area, but back to the fentanyl. remember, just 2 milligrams, a few grains of salt with, considered a lethal dose by the dea. san diego is now the epicenter. reporting just this october they

have seized 5,000 pounds of fentanyl. that is 60% of all of the fentanyl they have seized in the entire country during the same time span. case in point, take a look at this photo of last week. they just had a major fentanyl seizure and that to macula area. seizing 49 pounds of fentanyl pills as well as pure fentanyl powder hidden in a truck at a border patrol checkpoint. there was a canine hit. and they were able to confiscate the spirit of street value of over $700,000. then take a look at this photo. this photo in july. making ahead on a truck. they opened that truck. 250 pounds hidden inside of that truck. that was a street value of $3.6 million. believe it or not, this last photo here, and even bigger bust over a five day stretch.

seizing more than 600 pounds of fentanyl that were fitted in vehicles. that is a street value of more than $8 million. take a look at the startling graphic, courtesy of the medical examiner. san diego county in 2016, there were only 33 fentanyl related deaths. in 2021, that skyrocketed up to 817 fentanyl related deaths. that is a staggering increase of 2375%. we are back out here live view just goes to show the amount of efforts these traffickers are putting in day in and day out to get this deadly poison into our country. back to you. >> sandra: sitting here shocked, stunned. you are reporting numbers like this almost every day. thank you for your continued reporting from there. >> dana: the mayor of washington, d.c., calling for the national guard to help with the influx of migrants being

bused in from texas pure new york city says it is struggling to accommodate the surge sent its way from governor greg abbott. another busload of migrants arrived in the big apple. live in new york city to discuss the story fourth. hi. >> hey, dana, good morning. actually two buses arrive just over an hour ago carrying 89 migrants, and they were met by new york city officials feared one of them is now accusing texas governor greg abbott of anti-immigrant hatred. we will show you that moment in the second, but first take a look at this video as they arrived in new york city this morning. commissioner castor of the mayor's office of emigrant fares was there greeting them and shaking their hands as they were getting off the buses this morning. he says the city is working to increase its shelter capacity and improve health and legal services, but he also took a lot of shots at the texas governor.

>> is laughable. they should be naming them "the green new deal build." more than $400 billion with all the spending in this bill goes towards green new deal policies. seven and a half billion dollars for electric tax credits for the wealthy. $7 billion to the epa. you are looking at even paying the wealthy who have electric cars billions of dollars to resell those electric cars. there is billions for tree equity, planting trees. this is not about lowering inflation. it spends $745 billion and will increase debt by 146 billion. just the first five years, under even the democrats guidelines, it adds $54 billion to debt and does not even have their fake budget deficit decrease until the year 2030. that is not doing anything for inflation. >> dana: one of the ways that they showed they could pay was that they were going to hire

more agents. and i am wondering what kind of because you are getting in your district office about that. >> i can tell you, people are fearful of the irs w. this will add $80 billion, like you said, hiring 87,000 irs auditors. people who make less than $75,000 a year, we will see an increase of 700,000 more audits. people are not wanting that. the irs is projecting that we spend $80 million, that they can collect $200 billion to pay for this package. let me tell you, the folks for his phone call would be having an irs auditor showing up at their house. >> dana: one of the questions was do you see any signs of the economy turning the corner or that the worst is over? no, at 71%. the administration has said that this is going to reduce inflation, that this bill will

reduce inflation. do you think that anyone will see a direct result before let's say the end of the year? >> the american people are not buying this. it will actually prolong inflation. inflation is up 13.7% since joe biden has taken the oath of office. real wages have gone down 4.5% since he has taken the oath of office. people are only going to see the price of goods increase. they are not having had. the american people are going to speak loud and clear in november. >> dana: they are seeing gas prices go down, but the cost of everything is still high. >> dana, this bill -- >> dana: we heard from charles watson reporting on the cdc, changing guidelines on the vid. i it's unbelievable. i was a hill staffer in the late '90s. 189 members of congress cannot show up to work today in person. they are going to vote by proxy because of nancy pelosi
