it is classified material. >> it was an unprecedented action that needs to be supported by unprecedented justification. >> the justice department needs to release the information about the steps they did take to try to cooperate with the former president. >> harris: we're also learning from our sources the d.o.j. does not want a review of the raid. that's almost laughable. the former commander-in-chief calls them corrupt and says the raid is all part of their played out attempts to undermine him. the white house is, of course, denying any political motivations. >> this is about the american people and doing what is right for the american people. the department of justice, when it comes to law enforcement, is independent and this is what we believe and what the president has said. this is not about politicizing anything. >> harris: the former president himself was talking with fox this morning and said he is willing to do whatever possible to help the nation after the

raid saying the temperature has to be brought down. in "focus" now matt whitaker acting attorney general under president trump. great to see you today. let's talk about the temperature and speak directly to the former president's words and where we are and what the nation needs to know. >> well it's good to be with you today, harris. the president is absolutely right. we are need to lower the temperature across our country. political violence is never appropriate. i want to remind everyone that really the f.b.i.'s extraordinary unprecedented action never happened before in american history is really what raised the temperature in the first place. i think many people, including myself, need to talk about how we need to lower the temperature but i think transparency is what will lower the temperature. we need to understand how is the f.b.i. going to process and how is the department of justice legally going to analyze things that could be attorney/client privilege? things that could have maybe

been declassified, and ultimately what were the mitigating steps so that when they executed a search warrant, it was the least intrusive means they had available to them? more questions today probably than the last week. >> harris: we have more information. the information didn't do anything but open up more questions. we didn't get all of really what we needed to know. so my question then is was it explosive action that they took? was it over the line action that they took? in concert with what you have read so far. what more do we really need? >> yeah. well, harris, here is the way i analyze this. if you look at the precedent for these types of investigations, obviously we can talk hillary clinton, no search warrant was executed, sandy berger, general pataeus. search warrants were not executed.

the department of justice policy is the least intrusive means. i want to understand the negotiations leading up to this. 18 months since the president had left office. two months since in june when they allegedly last met on this topic. why a search warrant now? all the facts that i have that are publicly available suggest actually that the department of justice should have negotiated and should have done another subpoena and had other options. if i was attorney general i think the decision to raid a former president's home is the most grave decision that could be made. i just don't see the circumstances that require this step from a law enforcement perspective. >> harris: i will hit this quickly and move on. if nobody took into account that there might be things that had attorney/client privilege, it just seems sloppy. your quick reaction and we'll move on. >> the team wasn't equipped. f.b.i. agents can't tell the

difference between attorney/client privilege and anything else they are looking for. they need somebody to look at this before the investigation gets in. if you think about what could be in those documents. legal strategies relating to the january 6 defense. defenses related to this and quite frankly all the other litigation and investigations going on. donald trump for six years has had to fight all this. there could be a lot of attorney/client material in those boxes. >> harris: here is a quote from the "new york post." the raid has made even the highest political figures -- the media's new standard is the department can't be questioned as it goes around insuring no one is above the law. let's see how that holds when a future republican d.o.j. starts raiding the homes of joe biden, hillary clinton, barack obama, eric holder, james comey and

john brennan. what goes around always comes around. what went around this week will come around hard. and this op-ed in the "new york post" with the title merrick garland's raid of trump's mar-a-lago is a farce of law. what your reaction to all of it? >> well, harris, this is something i take very seriously and the department of justice can never be used as a political instrument to punish your opponents. a lot of americans. we can't live in a country where americans feel this is what is being done. we can't get into an escalation as the "wall street journal" and they point out in the op-ed. at the same time i know someone who has been at the department of justice for seven years in twho add min -- administrations we took seriously these criticisms. the attorney general has a platform where he can explain more so than he did last week. i thought his press conference

was very disappointing. he can explain in cases like this the decisions that are made, how things are mitigated like attorney/client privilege and how the defense of declassification and the standing order that the president had and has been reported is going to be handled. i just again say there are a lot more questions that could have been answered by merrick garland without talking about the specifics of the case. >> harris: he didn't have to give away everything. just the stuff that says it won't happen to anybody indiscriminately. 85 days out from a mid-term election. they'll have to talk about whether or not they can prove it is not political. who knows? we'll see what they say. always great to have you in "focus." >> great to see you, harris. >> such a tragic situation and so preventable. the fact is, afghanistan is a sanctuary for terrorism. the very reason we went there,

inflation and you can't tax yourself out of a recession. but this is the democrats' recipe. >> harris: the house budget committee's top republican one voice among those giving massive backlash right now. he and his colleagues are furious over legislation which democrats and the white house are calling the inflation reduction act which we know it doesn't reduce inflation. g.o.p. says the name is all wrong and the congressional budget office agrees. it found the bill that the president is set to sign will have a negligible effect on inflation. even the liberal media have serious questions. >> isn't it almost orwellian? how can you call it inflation reduction act what the nonpartisan experts say. >> it was the top line number. there is more in there that shows it will have the money from -- remember how we're doing this, too. it is making sure that billionaires and corporate america are paying their fair share and making sure that the

tax code is a little bit more fair. when you do that, when you put it in its totality you will see that it will bring down, lower the deficit, which will help fight inflation. >> harris: art laffer former reagan economic advisor in "focus" now. great to see you. orwellian, gas lighting, however you want to put it. calling it the inflation reduction act is what, fill in the blanks. >> it is not correct. let me go through the facts if i can with you for a second, harris. the president is correct when he says the july monthly number was zero percent. that is true. what he doesn't say is last month's monthly number was 17.1%. now, this month's year-over-year percent is 8 1/2%. last month year-over-year was 9.1%. this month the fall in energy prices just exactly offset the

rise in all of these other prices in the system to give us zero percent. that's the truth and the whole truth. there is none of this -- these people cherry pick the numbers they want to use and that's what happens. the gdp numbers. >> harris: when you say one month goes up 17% there is a reason why the next month can hit zero based on everything you talked about. >> exactly. >> harris: we both know when people hear the zer oef they think we're back to where we need to be and the white house knows that and why you don't get the primer on what the number means. critics are taking -- >> that's why you need the whole truth. >> harris: critics taking aim at energy secretary jennifer granholm for defending the inflation bill by explaining just go out and spend more money. >> 30% tax credit that you can

claim in 2022 for installing energy efficient windows, heat pumps, energy efficient appliances. if citizens want to install solar panels on their roofs so they can generate their own power. that's another 30% tax credit. and, of course, there is the tax credits that are at the dealership for the automotive sector for electric vehicles. >> harris: art. >> it's crazy. what's going on here is you have this government coming down and trying to manipulate every move you make from roof generation of electricity, the type of cars you buy. that's all janet granholm is doing. you must do this and that. what they ought to do is do a policy and get their hands out and let people make their own decisions. the idea you can tax the rich and collect more money is silly. i finished my book called the

taxes have consequences and it shows every time you raise tax rates on the rich you collect less money from them and the economy has gone -- has tanked and hurts the poor and minorities and disenfranchised. the rich now how to hire lawyers and lobbyists and don't respond well to higher tax rates and pull out of the economy and why a downturn in the economy. adding 87,000 i.r.s. agents is just plain wrong. >> harris: i don't often see it. you will hear me say they can hire whoever they want. the wealthiest among us we embrace capitalism. it is america. it is not like they are breaking the law to be able to do that. the 87,000 of these agents are going to be after the people they know they can catch. those are not the highest

earners. >> they aren't. also they will harass the living heck out of these people and make it far more expensive for them to keep their income. i did a paper a long time ago that 32 cents out of every dollar collected is expensed out-of-pocket expense just for filing and complying with tax codes. it is incredibly expensive to collect a dollar in taxes because the i.r.s. and government spends a lot and the people spend a lot defending. 32 cents out of every dollar they collect is a very inefficient way. you want a broad base tax so everyone pays the same rate and get your hands off the economy and let people make their own decisions, not let janet granholm tell us how we should brush our teeth or whatever else. >> harris: or whatever else, right? that information that you just gave is not new to you or any analyst but it might be new to -- it is to me and maybe other

people if you spend a certain amount of income just trying to make sure you are compliant. you are trying to keep the i.r.s. satisfied so they don't audit you. >> bill: -- >> when you get the letter you need to call your accountant even if you did it perfectly. >> harris: the "wall street journal" opinion page put it quote, it took only a few days for the congressional budget office to put the narrative to rest. a quick analysis from the budget scorer confirms the audit expansion will ensnare the middle class and what was the narrative? that high earners would be so impacted. what is your reaction to that? >> well, the high earners already are very well versed in how to defend their decisions and their filings. they get audited every year. you have to go lower and lower to find people a little bit less cautious and careful and have the i.r.s. go in.

believe me when i tell you, when the i.r.s. decides they want to audit your return they have a really good sense that they are going to get money from it. they don't audit returns that they don't expect to get money from. they audit and these people have to spend a lot of money trying to defend themselves and whatever. the i.r.s. probably will collect money from them. but the ones they didn't audit, if they had, they probably would find these people overpaid their taxes and they should return that money to them. they only go after people they think they can get money from, not go after people they think they can return money to. it is just a biased, horrible system of confrontation between government and the people. >> harris: wow. if we thought they were working to give us a bunch of refunds wouldn't that be rich and fantastic? >> it would be wonderful. we want to make sure you file your tax returns correctly. either way that would be wonderful. no, that's not what they are doing. they are here to rip you off and why they are doing it and

power panel now, david avila, jason nichols. gentlemen, great to have you in "focus." power panel. let's go. jason, your first response to that question that i just asked. will all of this be enough to move voters? >> well, first of all thank you for having me, harris. i think -- i hope democrats actually learn a lesson that you don't wait until the 11th hour to tout your accomplishments. there is someone on the other side who is always screaming about your shortcomings hour after hour. we know president biden has passed legislation on gun reform that respected people's second amendment rights, infrastructure bill that the other administration couldn't pass, lowering the cost of prescription drugs, fulfilling his promises on climate. i think that they needed to yell this a little bit earlier and needed to talk about this a little bit earlier. whether it will make a difference in november remains to be seen.

but i think it certainly will make things a lot closer because he is actually fulfilling his promises and could actually excite his base. >> 7 in 10 americans think we're going in the wrong direction. they won't give the president credit for what he has ultimately done, ultimately make things worse. never have we taxed our way out of an inflationary time which is exactly what this legislation does. when you increase taxes on petroleum, consumers feel it with higher gas prices. when you increase taxes on small and medium businesses, consumers ultimately feel that. and so if we believe this inflation reduction act is somehow going to do that, if democrats believe that, they are in for some big losses this election. >> harris: part of what you said is why even some democrats

after texas governor greg abbott. another bus load of illegal immigrants arriving to the big apple today. 52 people mostly men. the mayor repeatedly saying the city shelters are overwhelmed and he needs federal assistance and d.c.'s mayor, we've heard from her time and time again asking the national guard twice to help deal with the migrant influx there and wants federal help. nate foye live on the fox square plaza for us in new york city. nate. >> good afternoon. shortly after that bus arrived in new york city this morning just after 7:00 a.m. with 52 migrants on it, an official in the mayor's office accused texas of holding migrants against their will and not providing enough food and water on these buses. brand-new in focus i spoke with the man in charge of these buses saying it's a lie. listen to this. >> absolutely not true. the migrants that have been released by the federal

authorities to the non-governmental agencies here voluntarily get on these buses bound for new york and washington, d.c. food and water is placed on the buses for all these people. >> bill: most of the trip takes three days. manuel crass troe of the mayor aefs office was on hand to welcome the migrants and blasting the texas governor calling him morally corrupt and saying this. >> governor abbott is using this as a political ploy for his reelection campaign. we believe people should be treated with humanity and compassion and that is not what is happening here. >> again, texas officials say that's a lie, harris. they say each bus is inspected before every journey. governor abbott's office said they have sent over 400 migrants to new york city and 6800 to washington, d.c.

reelection in my estimation but send a message and give a taste of what the southern border is experiencing. it is simply beyond irony to see them now complain. >> harris: democrats have to be frustrated and embarrassed. what the governor has done is taken the pulpit he has at the moment and decided to say exactly what the truth is from the pulpit. they don't want that. they want him to have to fight this fight, to win to be governor again. what they aren't considering is maybe he cares a lot more than they do about this situation, which is why he is willing to spend some capital. >> seemingly lack of self-awareness in this complaint but they also don't seem to understand we all have our own eyes. these illegal immigrants are arriving in new york city to a reception line. we played video of that on "fox & friends" this weekend. people high fiving the immigrants getting off the bus and smiling. this is not a humanitarian that

they are arriving sick but arriving in three-day trips and being met with a celebratory line. this is a sanctuary city, new york. guess what? you are now a sanctuary. >> harris: cameras out by the way documenting their journey for the world to see and perhaps for some of those municipalities to help out the sanctuary cities. new op-ed says president biden should be up for lie of the year after making these comments on inflation last week. >> president biden: actually i just want to say a number. zero. today we received news our economy had zero percent inflation in the month of july. zero percent. here is what that means. while the price of some things go up -- went up last month the price of other things went down by the same amount. the result zero inflation last month. >> harris: and he did explain it there. art laffer said we need the

whole truth. what maybe was missing there is that really didn't help the overall inflationary number which was still 8.5 in july. still near a four-decade high. we are in trouble. on breakfast food like eggs and baby food is among there, too. milk has gone up. coffee has gone up 28%. an those items you see on your screen right now that's where we are still feeling the 8.5% year to year. it matters. he might have just added that line. the whole truth or nothing but. the op-ed points out the media are turning a blind eye. crickets from the usual fact checkers. >> i don't want to steal any lines. let me give credit to dan bongino and joe concha. that is a bit like a football team who gave up 43 points but

then manages to hold. it is a joke. you point out the lack of a fact check on this. i have opinions about the way you conduct yourself in media. i believe that our job to achieve objectivity is an aspiration. it is not a stauts. you don't arrive at objectively you target truth and honesty. you be honest with the audience about your own opinions. we all hold biases and try to give the audience information so they have full information what is going on about the storyteller and the story. what i'm getting at is this. there is no more insidious lie than the concept of a fact checker. they are a not objector. poll -- they are not objective. they pretend to be a god on the high mount telling you the

truth but they are simply biased like everyone else. they just lie about their bias. >> harris: wow. all of that is true. everybody comes to the plate with their lived experiences and the goal is to be able to tell the truth period and to help people find the truth. you put that so beautifully. what do we do when the president stands there and he explains what the zero is and he doesn't talk about the context for the american people who you know most people are busy in our lives and walk away and say inflation is down to zero. give them a gold star? >> the sad thing is, it is this week. next week it will be some other spin and lie. all of those perceived fact checkers would have had their fingers on the typewriter and pencils sharpened were a different president in office or one with a few years ago. >> harris: wow. that is very transparent. will cain, thank you for being in "focus."
